Abstract

This study aims to analyze the transformation of vocational education through the Link-and-Match 2.0 policy and the effectiveness of curriculum synchronization in Vocational High Schools (SMK) with the needs of the national economic industry in the digital era. This research employs a descriptive qualitative approach using literature review and document analysis of government regulations, previous studies, and labor market statistics. The analysis is conducted from philosophical, sociological, and pedagogical perspectives to identify structural problems in Indonesia’s vocational education system. The findings indicate that although regulations such as Presidential Instruction No. 9 of 2016 and Presidential Regulation No. 68 of 2022 provide a strong legal framework, the unemployment rate of SMK graduates remains the highest, reaching 8.63% in 2025. This condition is mainly caused by skills mismatch, limited educator capacity, and slow curriculum adaptation to digital technological developments. The implementation of the 8+i concept has proven to be a key strategy in strengthening substantive collaboration between schools and industry. Adaptive curriculum synchronization, enhancement of teachers’ competencies in artificial intelligence and programming, and the strengthening of ICT infrastructure are essential factors in developing relevant and competitive vocational education toward Indonesia Emas 2045. ABSTRAK Penelitian ini bertujuan untuk menganalisis transformasi pendidikan vokasi melalui kebijakan Link-and-Match 2.0 serta efektivitas sinkronisasi kurikulum Sekolah Menengah Kejuruan (SMK) dengan kebutuhan industri ekonomi nasional di era digital. Penelitian menggunakan pendekatan kualitatif deskriptif dengan metode studi literatur dan analisis dokumen terhadap regulasi pemerintah, hasil penelitian terdahulu, serta data statistik ketenagakerjaan. Analisis dilakukan dari perspektif filosofis, sosiologis, dan pedagogis untuk mengidentifikasi problem struktural pendidikan vokasi di Indonesia. Hasil penelitian menunjukkan bahwa meskipun regulasi seperti Inpres No. 9 Tahun 2016 dan Perpres No. 68 Tahun 2022 telah memberikan landasan hukum yang kuat, tingkat pengangguran lulusan SMK masih menjadi yang tertinggi, yaitu 8,63% pada tahun 2025. Kondisi ini disebabkan oleh skill mismatch, keterbatasan kapasitas pendidik, serta lambatnya adaptasi kurikulum terhadap perkembangan teknologi digital. Implementasi konsep 8+i terbukti menjadi strategi kunci dalam memperkuat kolaborasi substantif antara sekolah dan industri. Sinkronisasi kurikulum yang bersifat adaptif, peningkatan kompetensi guru dalam bidang kecerdasan artifisial dan pemrograman, serta penguatan infrastruktur TIK menjadi faktor utama dalam mewujudkan pendidikan vokasi yang relevan dan berdaya saing menuju Indonesia Emas 2045.

Abstract

Permendikdasmen No. 9 of 2025 introduces the Academic Ability Test (TKA) as a new standardization and selection instrument in Indonesia's education landscape. This policy aims to provide standardized academic achievement data for selection purposes (Ministry of Education and Education, 2025). This paper presents a critical pedagogical analysis that argues that, in the context of Vocational High Schools (SMK), TKA policies show significant pedagogical dissonance. Using the theoretical lens of constructivism, differential pedagogy, and authentic evaluation, this analysis shows that TKA is philosophically contrary to the basic principles of vocational education. Instead of answering chronic competency gaps, especially soft skills deficits which is consistently identified by the industrial world, foreign workers are at risk of exacerbating the phenomenon of academic drift (shift of focus to academics). Furthermore, TKA creates assessment redundancy (overlapping with ANBK) and paradoxically devalues the significance of performance-based assessments of the Expertise Competency Test/UKK which should be the heart of vocational education. This paper recommends radical differentiation or exclusion of foreign workers for vocational schools, as well as the strengthening of UKK as a 'golden standard' for national vocational assessments that are in line with international best practices.

Abstract

The implementation of the informed consent doctrine in Indonesia is frequently trapped in rigid administrative texts and juridical formalism, which consequently overlooks the essence of patient autonomy. The enactment of Law Number 17 of 2023 concerning Health necessitates a conceptual repositioning of medical treatment consent. This study aims to reconstruct the concept of informed consent through the lens of Progressive Law and Bioethics to establish a balance between patient autonomy and legal certainty for medical practitioners. Utilizing a normative juridical research method with statute and conceptual approaches, this study examines the shift from a paternalistic paradigm to an educational-contractual relationship. The findings indicate that legal reconstruction must position informed consent as a continuous ethical communication process rather than a mere signing of a form. While Law No. 17 of 2023 strengthens transparency, it requires the integration of humanitarian values to minimize medical disputes and malpractice cases, which have increasingly appeared in mass media.

Abstract

This study aims to analyze the conflict of authority in the management of secondary education in Indonesia following the enactment of Law Number 23 of 2014 on Regional Government. This research employs a socio-legal approach with a qualitative method based on normative-empirical analysis through literature review and policy document analysis. The focus of the study lies in the dynamics of the transfer of authority from district/city governments to provincial governments and its implications for educational governance and service quality. The findings indicate that juridically, this policy is intended to enhance efficiency and standardization of education quality; however, in practice, it generates various sociological issues such as administrative distance, regional ego, and the unpreparedness of local bureaucracies. From a pedagogical perspective, the centralization of authority risks limiting local innovation if not accompanied by strong school-level autonomy. Furthermore, strategic issues such as the abolition of honorary teachers and the discourse on re-centralizing teacher management further complicate governance dynamics. Therefore, this study recommends regulatory harmonization and strengthened intergovernmental collaboration to establish an effective, adaptive, and equitable education system. ABSTRAK Penelitian ini bertujuan untuk menganalisis konflik kewenangan dalam pengelolaan pendidikan menengah di Indonesia pasca pemberlakuan Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Kajian ini menggunakan pendekatan yuridis-sosiologis dengan metode kualitatif berbasis normatif-empiris melalui studi literatur dan analisis dokumen kebijakan. Fokus penelitian terletak pada dinamika peralihan kewenangan dari pemerintah kabupaten/kota ke pemerintah provinsi serta implikasinya terhadap tata kelola pendidikan dan kualitas layanan. Hasil penelitian menunjukkan bahwa secara yuridis kebijakan ini bertujuan untuk meningkatkan efisiensi dan standardisasi mutu pendidikan, namun dalam praktiknya menimbulkan berbagai persoalan sosiologis seperti kejauhan pelayanan, ego kedaerahan, serta ketidaksiapan birokrasi daerah. Selain itu, secara pedagogis, sentralisasi kewenangan berpotensi menghambat inovasi berbasis kearifan lokal apabila tidak diimbangi dengan penguatan otonomi satuan pendidikan. Isu strategis terkait penghapusan guru honorer dan wacana sentralisasi pengelolaan tenaga pendidik semakin memperumit dinamika tata kelola pendidikan. Oleh karena itu, penelitian ini merekomendasikan perlunya harmonisasi regulasi serta penguatan kolaborasi antar level pemerintahan guna menciptakan sistem pendidikan yang efektif, adaptif, dan berkeadilan.

Abstract

This study analyzes the tension between accelerated investment through National Strategic Projects (PSN) in Law Number 6 of 2023 (the Job Creation Law) and the constitutional rights of indigenous peoples (MHA). Following Constitutional Court Decision No. 35/PUU-X/2012, customary forests have been normatively separated from state forests. However, the Job Creation Law introduces a centralized risk-based licensing and land acquisition mechanism that has the potential to marginalize local living space sovereignty. Using a juridical-normative research method through legislative and conceptual approaches, this study finds normative inconsistencies between the spirit of constitutional recognition and administrative formalism in the derivative regulations of the Omnibus Law. The study recommends legal reconstruction through the adoption of substantive Free, Prior, and Informed Consent (FPIC) principles and the zoning of indigenous territories (Red, Yellow, and Green Zones) to balance national development interests with the protection of traditional rights. A paradigm shift from state-centric to community-based protection is essential to avoid the escalation of structural agrarian conflicts. ABSTRAK Penelitian ini menganalisis ketegangan antara percepatan investasi melalui Proyek Strategis Nasional (PSN) dalam Undang-Undang Nomor 6 Tahun 2023 (UU Cipta Kerja) dengan hak konstitusional masyarakat hukum adat (MHA). Pasca Putusan Mahkamah Konstitusi No. 35/PUU-X/2012, status hutan adat secara normatif telah dipisahkan dari hutan negara. Namun, UU Cipta Kerja memperkenalkan mekanisme sentralisasi perizinan berbasis risiko dan pengadaan tanah yang berpotensi memarginalkan kedaulatan ruang hidup lokal. Dengan menggunakan metode penelitian yuridis-normatif melalui pendekatan perundang-undangan dan konseptual, penelitian ini menemukan adanya inkonsistensi normatif, antara semangat pengakuan konstitusional dengan formalisme administratif dalam regulasi turunan Omnibus Law. Hasil penelitian merekomendasikan rekonstruksi hukum melalui pengadopsian prinsip Free, Prior and Informed Consent (FPIC) yang substantif dan pembagian zonasi wilayah adat (Zona Merah, Kuning, Hijau) untuk menyeimbangkan kepentingan pembangunan nasional dengan perlindungan hak tradisional. Transformasi paradigma dari state-centric menuju community-based protection menjadi prasyarat mutlak guna menghindari eskalasi konflik agraria struktural.
