Abstract

Various cases of violence, gender discrimination, difficulty in accessing health care and exploitation of migrant workers still occur frequently, especially against women working in the non-formal sector. BP2MI noted that Taiwan is the number 2 highest destination country for PMI after Hong Kong. Indonesia as a member state of the United Nations has ratified CEDAW while Taiwan, which is not a member of the United Nations, has not ratified the convention. This is a challenge in the protection of female migrant workers in Taiwan. Thisstudy comparing the regulation of migrant workers within the legal framework of Taiwan and Indonesia in relation to CEDAW as well as the Indonesian government's efforts to protect migrant workers in the non-formal sector in Taiwan. This type of research is juridical-normative research, the nature of this research is descriptive analytical with a method of approaching laws and regulations and conceptual related to the research topic. The results of the study found that Indonesia tends to emphasize more on comprehensive protection starting from the preplacement process to repatriation and strengthened by the role of BP2MI, emphasizing on aspects of reproduction, gender-based violence, and protection of women from exploitation. Meanwhile, Taiwan emphasizes technical protection during the working period and still faces challenges in providing protection to female migrant workers in the non-formal sector because they have not been accommodated in labor.

Abstract

Dalam era globalisasi, kontrak perdata internasional semakin sering terjadi seiring dengan meningkatnya transaksi lintas batas, investasi, dan layanan digital. Namun, hubungan kontraktual antara individu dan perusahaan asing kerap menimbulkan persoalan serius, terutama terkait perlindungan hak-hak individu yang sering berada pada posisi lebih lemah dibandingkan perusahaan multinasional. Penelitian ini membahas kedudukan kontrak perdata internasional dalam sistem hukum Indonesia dan hukum internasional, potensi masalah kontraktual yang muncul, serta peran hukum nasional, perjanjian internasional, dan instrumen seperti soft law dalam memberikan perlindungan hukum bagi individu. Metode yang digunakan adalah kajian normatif melalui studi kepustakaan terhadap peraturan perundang-undangan, doktrin hukum, serta instrumen internasional terkait. Hasil pembahasan menunjukkan bahwa meskipun asas kebebasan berkontrak tetap menjadi landasan, perlindungan individu perlu diperkuat melalui regulasi nasional yang lebih responsif, ratifikasi perjanjian internasional, serta penerapan prinsip-prinsip hukum kontrak internasional yang adil. Dengan demikian, sistem hukum nasional dan internasional perlu bersinergi untuk mewujudkan kepastian hukum sekaligus menjamin keadilan kontraktual bagi individu dalam menghadapi perusahaan asing.

Abstract

Perlindungan royalti musik di Indonesia menghadapi tantangan serius akibat dominasi paradigma teritorial di tengah realitas distribusi musik yang lintas negara melalui platform streaming global. Kondisi ini memunculkan kesenjangan antara norma dan praktik yang berdampak pada kebocoran royalti, ketidakpastian yurisdiksi, serta melemahnya efektivitas perlindungan hak ekonomi pencipta. Kajian ini menelaah persoalan tersebut melalui penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan untuk mengurai dinamika regulasi nasional dan praktik di yurisdiksi lain yang lebih adaptif. Temuan menunjukkan bahwa prinsip lex loci protectionis yang masih dominan tidak selaras dengan karakter ekonomi digital yang tanpa batas. Diperlukan pergeseran menuju kerangka perizinan berorientasi transnasional melalui Transnational Hybrid Licensing Framework, dengan penataan ulang peran LMKN, penguatan kerja sama internasional, interoperabilitas data, serta pengakuan lisensi lintas yurisdiksi. Transformasi ini krusial untuk meningkatkan kepastian hukum, efektivitas struktural, dan keadilan substantif di era streaming global.

Abstract

The development of Artificial Intelligence (AI) has generated new challenges in civil law, particularly regarding breach of contract in cross-border transactions. The autonomous decision-making capacity of AI systems raises questions concerning their legal status and the allocation of contractual liability. This study aims to analyze liability for breaches of contract caused by AI under Indonesian civil law and to examine the determination of the applicable law (lex causae) in cross-border contracts from the perspective of private international law. Using a normative juridical method with conceptual, case-based, and comparative approaches, this research draws upon the Indonesian Civil Code, the Electronic Information and Transactions Law, the Copyright Law, and relevant legal literature. The findings show that autonomous AI cannot be recognized as a legal subject in the Indonesian legal system due to the absence of free will and moral consciousness, so liability remains attributed to the human or legal entity operating the system under the doctrine of vicarious liability. The case of Quoine v B2C2 confirms that contracts executed through algorithms remain legally binding on human or corporate parties rather than AI systems. From a private international law perspective, the study affirms that the use of AI does not alter the fundamental principles for determining lex causae, which continue to rely on connecting factors such as lex loci contractus, lex loci solutionis, and party autonomy.
