Abstract

The regulation concerning severance pay was previously governed by Article 158 paragraph (4), Article 164 paragraph (2), and Article 168 paragraph (3) of the Manpower Law. These three articles were removed following the enactment of Law Number 11 of 2020 on Job Creation and Law Number 6 of 2023 on the Ratification of Government Regulation in Lieu of Law Number 2 of 2022 on Job Creation into Law. However, provisions on severance pay are still found in Government Regulation Number 35 of 2021 on Fixed-Term Employment Agreements, Outsourcing, Working Hours and Rest Periods, and Termination of Employment, which serves as the implementing regulation of Law Number 11 of 2020 on Job Creation. This situation creates confusion in its implementation and may potentially lead to a gap in the protection of workers' normative rights by employers. The problem addressed in this paper is how the legal certainty of workers' normative rights in the form of severance pay is post the enactment of Law Number 6 of 2023. This research is a juridical-normative study with a descriptive-analytical approach. The result of this study shows that Government Regulation Number 35 of 2021 is still in effect as one of the positive labor laws, even though the provisions of Article 158 paragraph (4), Article 164 paragraph (2), and Article 168 paragraph (3) were abolished with the enactment of Law Number 6 of 2023, because the basis for the enactment of Government Regulation Number 35 of 2021 is the provisions of Article 81 and Article 185 letter b of the Job Creation Law, which were not abolished by the enactment of Law Number 6 of 2023. This means that the right to severance pay, as one of the workers' normative rights, must still be fulfilled by employers as part of their obligations when a termination of employment occurs, according to the criteria set out in these articles that result in the entitlement to severance pay.

Abstract

Contract-based Government Employees (PPPK) fall under the scope of employment law, as do private sector workers. Both PPPK and private workers are entitled to rights regulated by law, one of which is the right to social security protection. However, there exists a significant disparity between the social security benefits received by PPPK and those received by private sector workers. The benefits available to private workers are considered more comprehensive, even though both PPPK and workers are employed under fixed-term agreements and are exposed to similar risks, including the potential loss of employment. This paper examines the current state of social security protection for PPPK and private sector workers, as well as the ideal formulation of a social security system specifically for PPPK. Using a juridical-normative approach and descriptive research method, the study reveals that social security coverage for private workers generally includes health insurance, old age security, pension security, work accident security, death security, and job loss security. Meanwhile, PPPK are currently only entitled to health insurance, work accident security, and death security. Based on these findings, the study proposes that the ideal social security framework for PPPK should also encompass old age security, pension security, and job loss security to ensure more equitable and comprehensive protection in line with the nature and risks of their employment status.

Abstract

The misuse of lodging business permits in Lubuklinggau City has raised legal, administrative, and ethical concerns, highlighting weaknesses in local regulatory enforcement. This study aims to analyze the legal framework and the urgency of imposing administrative sanctions on business owners who violate licensing regulations, as well as to evaluate the effectiveness of these sanctions in supporting law enforcement and public order. The research employs a normative juridical method with a statutory and conceptual approach, relying on primary legal sources such as legislation and secondary materials including scholarly articles, books, and legal documents. The findings reveal that the regulation of sanctions for the misuse of lodging business permits remains fragmented across multiple regional regulations, resulting in legal uncertainty and inconsistent enforcement. The absence of a comprehensive regulatory mechanism weakens administrative control and reduces compliance among lodging business owners. Consequently, the implementation of clear, firm, and proportional sanctions is essential to strengthen administrative law enforcement, ensure legal certainty, promote fair competition, and realize the principles of good governance within the local tourism sector. Abstract

Pemerintah mengeluarkan Keputusan Presiden Nomor 17 Tahun 2023 tentang Penetapan Berakhirnya Status Pandemi Corona Virus Disease 2019 (COVID-19) di Indonesia pada 21 Juni 2023. Kendati status pandemi Covid-19 sudah dinyatakan menjadi endemi melalui Keputusan Presiden Nomor 17 Tahun 2023, saat ini masih ditemukan pelaku usaha yang merumahkan pekerjanya guna menekan labour cost dengan tidak membayarkan upah pekerja dengan dalih asas no work no pay karena perusahaan berhenti produksi sementara. Tulisan ini berfokus membahas analisis yuridis penerapan asas no work no pay dalam pemenuhan hak upah pekerja saat perusahaan berhenti produksi sementara. Jenis penelitian ini adalah penelitian yuridis-normatif, sifat penelitian ini adalah deskriptif analitis. Hasil penelitian yaitu penerapan asas no work no pay ketika perusahaan berhenti produksi sementara didasari hubungan kerja pada yang tetap berjalan karena tidak terjadi PHK, sehingga pekerja tetap berhak menerima upah. Pemberi kerja yang tidak membayar upah dalam situasi ini melanggar ketentuan Pasal 186 UU Nomor 6 Tahun 2003. Pelanggaran terhadap hak upah dapat dikualifikasikan sebagai tindak pidana pelanggaran dan berpotensi menimbulkan perselisihan hubungan industrial berupa perselisihan hak. Sebagai rekomendasi, pemerintah perlu melakukan reformulasi norma pengupahan dalam hukum ketenagakerjaan khususnya batasan asas no work no pay, membuat guidelines pada tataran yudisial dan administratif untuk menyeragamkan intepretasi penerapan asas tersebut dalam pemenuhan hak upah pekerja. Penguatan pengawasan di bidang ketenagakerjaan oleh pengawas ketenagakerjaan sangat diperlukan guna menjamin dipatuhinya norma ketenagakerjaan oleh pemberi kerja melalui rutinitas kegiatan pembinaan, pemeriksaan, pengujian dan atau penyidikan tindak pidana ketenagakerjaan terhadap kegiatan usaha dengan tahapan preventif edukatif, tahap represif non yustisial, dan tahap represif yustisial.

Abstract

Various cases of violence, gender discrimination, difficulty in accessing health care and exploitation of migrant workers still occur frequently, especially against women working in the non-formal sector. BP2MI noted that Taiwan is the number 2 highest destination country for PMI after Hong Kong. Indonesia as a member state of the United Nations has ratified CEDAW while Taiwan, which is not a member of the United Nations, has not ratified the convention. This is a challenge in the protection of female migrant workers in Taiwan. Thisstudy comparing the regulation of migrant workers within the legal framework of Taiwan and Indonesia in relation to CEDAW as well as the Indonesian government's efforts to protect migrant workers in the non-formal sector in Taiwan. This type of research is juridical-normative research, the nature of this research is descriptive analytical with a method of approaching laws and regulations and conceptual related to the research topic. The results of the study found that Indonesia tends to emphasize more on comprehensive protection starting from the preplacement process to repatriation and strengthened by the role of BP2MI, emphasizing on aspects of reproduction, gender-based violence, and protection of women from exploitation. Meanwhile, Taiwan emphasizes technical protection during the working period and still faces challenges in providing protection to female migrant workers in the non-formal sector because they have not been accommodated in labor.

Abstract

The high national prevalence of early marriage in Indonesia, affecting 5.90% of women aged 20-24 who were married before 18, and particularly 8.45% in South Sumatra, poses a significant risk to adolescent physical and mental well-being. Early marriage often leads to severe health consequences like high maternal and infant mortality rates, preeclampsia, and anemia due to an immature reproductive system. The current minimum marriage age is 19 years for both genders as regulated by Law Number 16/2019. This community service aimed to address the lack of knowledge among adolescents on this critical issue. The activity at Junior High School 23 Palembang utilized the Participatory Action Research (PAR) approach, focusing on legal counseling and interactive discussions for ninth-grade students. The core material covered legal provisions, social, mental, and reproductive health impacts, and the roles of parents and schools. A key finding was the significant improvement in student understanding, as evidenced by the evaluation: the average score increased from 56.25 on the pre-test to 90.82 on the post-test, an increase of 34.58 points. This result confirms the effectiveness of the legal counseling in enhancing students' legal knowledge and fostering a positive attitude to reject early marriage and act as agents of change.
