Abstract

Pancasila, as the nation's foundation and source of all legal sources in Indonesia, plays a fundamental role in shaping the national legal identity. However, in the era of globalization, marked by the penetration of foreign legal values and liberalization across various sectors, the existence of Pancasila faces serious challenges both ideologically and normatively. This study aims to analyze how Pancasila remains relevant as the national legal identity in the face of globalization dynamics. The study employs a normative research approach using legal and philosophical frameworks. Data analysis is conducted qualitatively through a literature review of primary and secondary legal documents. The novelty of this research lies in its emphasis on the importance of repositioning the role of Pancasila not only as an ideological symbol but also as an operational principle in the formation and implementation of national law. The results of the study show that although globalization has an impact on the adaptation of the national legal system, the values of Pancasila can still serve as a solid foundation for the formulation of legal policies as long as there is a revitalization of understanding and institutional strengthening. The re-actualization of Pancasila values in national legal products has proven capable of filtering out global influences that are not in line with the character of the nation. This study recommends the need to strengthen Pancasila-based legal education, harmonize regulations with the noble values of the nation, and establish an ideological supervisory body to ensure that all laws and regulations are in line with Pancasila values as the national legal identity.

Abstract

The community-based tourism sector in various regions of the Indonesian archipelago, such as Java, Sumatra, Kalimantan, and Sulawesi, holds enormous potential, but is often hampered by limited marketing reach and suboptimal use of digital technology. This community service (PkM) activity aims to increase the capacity of tourism destination managers to utilize social media and produce creative content as an effective tourism branding tool in these four strategic regions. The activity was implemented through technical guidance (bimtek) methods, including digital literacy training, visual and audiovisual content creation workshops, and direct assistance with strategies for optimizing Instagram and TikTok platforms. The target audience for this activity was tourism awareness groups (Pokdarwis) and micro-businesses around local tourist destinations. The activity results showed a significant increase in partners' understanding of social media aesthetics (feeds and reels), attractive photography techniques, and content calendar development. Furthermore, this activity succeeded in producing a number of creativecontent that was immediately uploaded, resulting in increased audience interaction (engagement rates) on tourism social media in each region.

Abstract

The rapid expansion of financial technology (fintech) has transformed digital financial services, particularly in the online lending sector. However, this growth has been accompanied by the proliferation of illegal online lending platforms operating outside formal regulatory frameworks. These platforms often engage in abusive practices, including excessive interest rates, coercive debt collection, misuse of personal data, intimidation, and other forms of cyber-enabled economic crime. This article examines the regulatory and criminal law frameworks governing fintech-related abuses in illegal online lending in Indonesia, focusing on their coherence and limitations. Using a normative juridical approach, the study analyzes statutory regulations, policy instruments, and legal doctrines related to fintech regulation, consumer protection, cybercrime, and criminal liability. The findings reveal that, despite the existence of multiple regulatory and penal mechanisms, the legal framework remains fragmented and institutionally dispersed. Key challenges include overlapping regulatory mandates, weak coordination among supervisory and law enforcement bodies such as the Financial Services Authority (OJK), the Ministry of Communication and Information Technology, and criminal justice institutions and the increasingly transnational nature of digital financial crimes. This article proposes normative recommendations to enhance regulatory coherence, particularly through integrated regulatory supervision. This approach emphasizes structured coordination among relevant authorities, clearer division of institutional responsibilities, shared enforcement mechanisms, and harmonized regulatory standards. By clarifying structural and doctrinal gaps, this study contributes to strengthening consumer protection and improving legal certainty within Indonesia’s fintech ecosystem.

Abstract

Usaha Mikro Kecil dan Menengah (UMKM) memiliki peran strategis dalam perekonomian nasional, namun seringkali menghadapi kendala kelembagaan dan legalitas usaha. UMKM Maggot Kampung Semar di Kelurahan Arjosari Kecamatan Blimbing Kota Malang merupakan usaha inovatif yang memanfaatkan limbah organik rumah tangga untuk budidaya maggot, namun belum memiliki perjanjian kerjasama formal dengan Dinas Lingkungan Hidup Kota Malang. Ketiadaan perjanjian kerjasama ini berimplikasi pada lemahnya kepastian hukum, perlindungan hukum, dan keberlanjutan usaha. Pengabdian ini bertujuan untuk memperkuat kelembagaan UMKM Maggot melalui pendampingan pembuatan perjanjian kerjasama dengan Dinas Lingkungan Hidup Kota Malang. Metode pelaksanaan terdiri dari tiga tahap: persiapan (survei awal, diskusi dengan mitra, dan pembentukan tim), pelaksanaan (pendampingan penyusunan substansi perjanjian, rancangan perjanjian, dan pendampingan ke Dinas Lingkungan Hidup), serta evaluasi dan pelaporan. Luaran kegiatan pengabdian ini berupa: draft perjanjian kerjasama yang komprehensif memuat klausul hak dan kewajiban para pihak, Implementation Arrangement (IA) dalam bentuk Memorandum of Understanding (MoU) yang telah ditandatangani oleh UMKM Maggot dan Dinas Lingkungan Hidup Kota Malang, serta modul pendampingan hukum bagi UMKM. Kegiatan ini menghasilkan peningkatan pemahaman hukum pelaku UMKM sebesar 80% dalam aspek perjanjian bisnis, penguatan kredibilitas usaha melalui legalitas formal, akses terhadap bantuan sarana dan prasarana produksi dari pemerintah daerah, serta terciptanya model kemitraan pemerintah-masyarakat yang berkelanjutan dalam pengelolaan lingkungan berbasis ekonomi sirkular. Implikasi jangka panjang mencakup peningkatan kapasitas kelembagaan UMKM berbasis lingkungan, penguatan literasi hukum pelaku usaha mikro, dan kontribusi nyata terhadap pemberdayaan ekonomi masyarakat sekaligus mendukung program pengelolaan lingkungan hidup yang berkelanjutan di Kota Malang.
