Abstract

The rapid growth of Sharia-based e-commerce reflects the increasing demand among Muslim consumers for transactions that comply with Islamic principles. However, digital transaction practices still raise various concerns, particularly regarding the clarity of contracts (akad), payment security, and information transparency. This study aims to explain Muslim consumers’ perceptions of the application of the legal maxim al-yaqīn lā yazūlu bi al-shakk in Sharia e-commerce transactions, with a focus on students of the State Islamic University of North Sumatra. This research employs a descriptive qualitative approach, using in-depth interviews with 10 informants as the primary data source, supported by questionnaire data to identify general tendencies in respondents’ perceptions. The findings reveal that although most respondents understand the maxim theoretically, they have not been able to apply it effectively in digital transaction contexts. The uncertainties experienced by respondents are predominantly triggered by technical factors, such as delays in payment confirmation, rather than shakk in the fiqh sense. Moreover, limited understanding of digital contract mechanisms contributes to uncertainty regarding the moment when a contract is considered legally valid. Information transparency emerges as a key factor in fostering yaqīn, particularly in relation to the clarity of product descriptions and transaction procedures. This study concludes that the application of al-yaqīn lā yazūlu bi al-shakk in Sharia e-commerce remains suboptimal due to limited digital fiqh literacy and insufficient technological reliability, highlighting the need for enhanced digital muamalah education and improved information quality on Sharia e-commerce platform.

Abstract

The rapid shift toward digitalization has introduced new financial products and transactional models that require a more adaptive and integrated approach to Islamic legal reasoning. This study analyzes the role of al qawāid al fiqhiyyah al kulliyyah in addressing contemporary legal challenges within the digital economy and develops a methodological framework for assessing the Sharia compliance of emerging digital practices. Using a qualitative library based method, the research engages classical and modern legal sources by combining substantive contract analysis, application of core legal maxims, and maqāṣid al sharīʿah evaluation. Several case domains are examined, including e commerce arrangements, Islamic P2P financing structures, cryptocurrency usage, and blockchain based smart contracts, to identify potential issues related to gharar, ḍarar, and misalignment with Sharia objectives. The findings show that the five universal legal maxims offer a strong and adaptable foundation for managing uncertainty, promoting transactional fairness, and safeguarding consumer interests in digital environments. The study also proposes a five stage methodological model designed to guide Sharia supervisory boards, regulators, and industry practitioners in developing policies, operational standards, and compliance mechanisms suited to Islamic digital financial services.

Abstract

Penelitian ini bertujuan untuk menganalisis kesesuaian praktik pre-order di marketplace Shopee dan Tokopedia dengan prinsip hukum Islam. Sistem pre-order pada dasarnya dapat sesuai dengan konsep akad salam dan istishna dalam fiqh muamalah yang memperbolehkan pembayaran di muka dengan penyerahan barang di kemudian hari. Kesesuaian ini bergantung pada terpenuhinya syarat transparansi informasi meliputi kejelasan spesifikasi barang, harga pasti, dan waktu pengiriman yang jelas untuk menghindari unsur gharar atau ketidakpastian berlebihan yang dilarang dalam Islam. Potensi gharar dalam transaksi pre-order dapat diminimalisir melalui keterbukaan informasi dari penjual sejak awal transaksi. Kebijakan pembayaran di awal dan mekanisme refund yang diterapkan marketplace dinilai sudah mencerminkan prinsip keadilan Islam dalam melindungi hak konsumen ketika terjadi ketidaksesuaian atau kegagalan penyerahan barang. Praktik pre-order merupakan bentuk transaksi muamalah yang sah menurut hukum Islam selama dilaksanakan dengan kejujuran, amanah, dan sesuai regulasi yang berlaku termasuk fatwa DSN-MUI Nomor 05/DSN-MUI/IV/2000 tentang jual beli salam serta Undang-Undang Perlindungan Konsumen yang menjamin transparansi dan keadilan dalam transaksi elektronik.
