Abstract

Penelitian ini membedah anatomi kejahatan kekerasan seksual anak di Kabupaten Pohuwato melalui perspektif kriminologi dan yuridis hukum pidana Indonesia. Menggunakan metode yuridis empiris bersifat deskriptif-analitis kualitatif, data primer diperoleh melalui wawancara mendalam kepada 10 informan kunci (penyidik Unit PPA, korban/advokat, tokoh masyarakat, pakar hukum) dan observasi partisipatif, ditambah data sekunder dari UU No. 35/2014 tentang Perlindungan Anak, statistik SIMFONI-PPPA, serta laporan Polres Pohuwato (59 kasus 2022-2024). Temuan mengungkap dua faktor kriminogen utama: faktor internal pelaku meliputi dorongan seksual tak terkendali, gangguan pedofilia, paparan pornografi berulang, lemahnya moral agama, dan siklus trauma psikologis; serta faktor eksternal lingkungan mencakup pola asuh keluarga disfungsional, lingkungan pedesaan sepi yang memfasilitasi peluang, kedekatan relasi pelaku-korban (68% pelaku dikenal, 34% keluarga), grooming media sosial, stigma sosial menghambat pelaporan, dan eksploitasi kemiskinan. Faktor interaktif ini mendorong eskalasi kasus signifikan, menekankan urgensi pencegahan holistik yang mengintegrasikan rehabilitasi psikologis, edukasi keluarga, program kesehatan reproduksi, pengawasan teknologi, dan reformasi norma. Rekomendasi menyoroti mekanisme perlindungan korban humanis dan peran krusial Polri dalam penegakan hukum serta pengayoman guna mewujudkan perlindungan anak komprehensif sesuai regulasi nasional.

Abstract

The Post-Decision Intersection Between the Supreme Court and the Constitutional Court in Indonesia. The Constitutional Court Decision No. 70/PUU-XXII/2024 and the Supreme Court Decision No. 23/P/HUM/2024, both addressing the age eligibility requirements for candidacy in the 2024 simultaneous regional elections, have reignited tensions between two branches of judicial power. This tension is further exacerbated by the decision of the House of Representatives (DPR), through a Working Committee meeting, to favor the Supreme Court’s ruling. This study aims to analyze the extent of the intersection between the Supreme Court (MA) and the Constitutional Court (MK) by examining their respective decisions. The analysis adopts a normative approach, relying on secondary data as the primary source, supported by statutory, case law, and conceptual approaches to address the core issues. The findings reveal that the overlap between the Supreme Court and the Constitutional Court in conducting judicial reviews of regulations has led to delegitimization between Supreme Court Decision No. 23/P/HUM/2024 and Constitutional Court Decision No. 70/PUU-XXII/2024. To address this issue, both courts must exercise judicial restraint, particularly regarding substantive matters with potential overlap between their jurisdictions. Such restraint is essential to prevent external parties or institutions from exploiting court decisions to advance their institutional agendas, thereby avoiding unnecessary institutional conflicts.

Abstract

Community empowerment through bubara fish cultivation is one of the efforts to empower the village community through the maintenance and development of bubara fish, so that it can give results in improving the economic condition of the community. Therefore, this effort should be carried out with the principles of community-based empowerment and development in improving the economy of the local community. The role of the community is urgently needed as the main actor in all stages of planning, implementation, monitoring and evaluation of activities. However, there is also a need for support and cooperation from other stakeholders such as related agencies of local governments, village governments and the private sector which have greater resources in terms of finance, partnerships, information, knowledge, and technology.

Abstract

The rapid advancement of information technology has triggered an escalation in Electronic-Based Sexual Violence (KSBE), threatening the safety of young people in cyberspace. The community service activity serving as the focus of this study was conducted in Molowahu Village, Tibawa District, Gorontalo Regency, where such vulnerability was exacerbated by low legal awareness and the limitations of pre-existing regulations—prior to the enactment of Law No. 12 of 2022 on Sexual Violence Crimes (UU TPKS)—which often led to the secondary victimization (or "double criminalization") of victims. This study aims to analyze the legal reconstruction of KSBE handling under Law No. 12 of 2022 (UU TPKS) and to formulate a doctrinal strategy—implemented in Molowahu Village—to strengthen legal awareness among young people. A normative legal research method was employed, utilizing both statutory and conceptual approaches. The findings indicate that Article 14 of the UU TPKS introduces a juridical re-conceptualization, positioning KSBE as a distinct criminal offense based on the absence of consent, while simultaneously dismantling the moralistic stigma inherent in previous regulations. Implementation in Molowahu Village demonstrates that strengthening legal awareness among young people requires a transformation from mere legal knowledge to the institutionalization of an empathetic legal culture, an understanding of victims' rights to recovery, and proficiency in digital privacy protection literacy—all achieved through active collaboration among academics, university students, village officials, and local customary leaders.
