Abstract

In recent years, developments in information and communication technologies have increased the use of digital media, which has simultaneously expanded the risk of online gender-based violence (GBV). This phenomenon includes sexual harassment, non-consensual dissemination of intimate content, and gender-based threats, which commonly affect women and vulnerable groups. In Indonesia, Law No. 12 of 2022 on the Criminalization of Sexual Violence (UU TPKS) comes as a first step to provide protection to victims, including in cases of online GBV. However, the implementation of the TPKS Law still faces obstacles, such as the lack of understanding of law enforcement officials, difficulties in digital proof, and social stigma against victims. A normative juridical research method was used to evaluate the adequacy of regulations, harmonization of laws, and international best practices. The analysis shows that existing regulations, including the GCV Law, ITE Law, and Criminal Code, still have gaps in effectively addressing online GBV. Legal harmonization, strengthening digital forensic capacity, and increasing gender sensitivity are urgent needs. A holistic approach, including cross-sector collaboration, public education, and policies adaptive to technological developments, is expected to strengthen victim protection. This strategy is needed to realize law enforcement that is responsive, equitable, and supports efforts to eradicate gender-based violence in the digital space.

Abstract

The Post-Decision Intersection Between the Supreme Court and the Constitutional Court in Indonesia. The Constitutional Court Decision No. 70/PUU-XXII/2024 and the Supreme Court Decision No. 23/P/HUM/2024, both addressing the age eligibility requirements for candidacy in the 2024 simultaneous regional elections, have reignited tensions between two branches of judicial power. This tension is further exacerbated by the decision of the House of Representatives (DPR), through a Working Committee meeting, to favor the Supreme Court’s ruling. This study aims to analyze the extent of the intersection between the Supreme Court (MA) and the Constitutional Court (MK) by examining their respective decisions. The analysis adopts a normative approach, relying on secondary data as the primary source, supported by statutory, case law, and conceptual approaches to address the core issues. The findings reveal that the overlap between the Supreme Court and the Constitutional Court in conducting judicial reviews of regulations has led to delegitimization between Supreme Court Decision No. 23/P/HUM/2024 and Constitutional Court Decision No. 70/PUU-XXII/2024. To address this issue, both courts must exercise judicial restraint, particularly regarding substantive matters with potential overlap between their jurisdictions. Such restraint is essential to prevent external parties or institutions from exploiting court decisions to advance their institutional agendas, thereby avoiding unnecessary institutional conflicts.

Abstract

Penelitian ini bertujuan untuk mengkaji sistem penegakan hukum pada Pemilihan Kepala Daerah (Pilkada) yang dijalankan oleh Bawaslu maupun Gakkumdu sebagai insitusi yang memiliki kewenangan untuk menegakan hukum. Selain itu reformasi sistem penegakan hukum pada Pilkada dalam pendekatan hukum progresif merupakan sebuah langkah guna Bawaslu menjalankan peran sentral dalam menegakan hukum pada pemilihan kepala daerah. Metode penelitian yang digunakan dalam kajian ini adalah metode penelitian normatif dengan berfokus pada analisis terhadap data sekunder, khususnya yang bersumber dari peraturan perundang-undangan, prinsip-prinsip hukum, doktrin, serta dokumen hukum lainnya yang relevan. Pendekatan penelitian yang digunakan adalah pendekatan Undang-Undang, Analitis, dan konseptual untuk menggambarkan secara prespektif reformasi sistem penegakan hukum. Penelitian ini menemukan bahwa terdapat kekurangan pada sistem penegakan hukum pada pemilihan kepala daerah yang selama ini menjadi sentralnya berada di Bawaslu. Penanganan Pelanggaran yang masih dibatasi oleh waktu yang membuat kurang optimalnya penyelesaian laporan pelanggaran. Kemudian penelitian ini menjelaskan pendekatan hukum progresif dalam sistem penegakan hukum pada pemilihan kepala daerah dengan memperhatikan tiga asepk yaitu, reformasi regulasi yang progresif, perubahan sistem triparti gakkumdu, dan penegasan dalam perekrutan SDM pengawas pemilu yang memiliki kewenangan menangani dugaan pelanggaran.

Abstract

Pemilu yang demokratis membutuhkan pengawasan partisipatif yang kuat dari masyarakat untuk menjamin keadilan dan integritas proses politik. Penelitian ini bertujuan untuk menganalisis peran Badan Pengawas Pemilu (Bawaslu) dalam mendorong demokrasi partisipatif melalui program Desa Tangguh Anti Politik Uang. Penelitian ini menggunakan pendekatan hukum normatif dengan metode konseptual dan analitis yang menekankan pada kajian doktrinal dan regulatif terhadap pengawasan pemilu berbasis komunitas. Hasil penelitian menunjukkan bahwa program-program partisipatif yang telah dijalankan oleh Bawaslu, seperti SKPP, GSRPP, dan Saka Adhyasta Pemilu, masih menghadapi tantangan dalam jangkauan dan keberlanjutan. Pembentukan Desa Tangguh Anti Politik Uang dipandang sebagai strategi potensial untuk memperkuat pengawasan di tingkat desa serta membangun budaya politik yang bersih dan deliberatif. Implikasi dari penelitian ini menegaskan pentingnya sinergi antara Bawaslu dan pemerintah desa dalam memperluas pendidikan politik dan membangun ketahanan warga terhadap praktik politik transaksional

Abstract

Di Indonesia, sertifikat tanah merupakan dokumen sah yang menyatakan kepemilikan atas hak atas tanah. Namun, dalam praktiknya, sertipikat sering kali menjadi objek penyiaran di pengadilan akibat adanya cacat administratif atau yuridis dalam proses penerbitannya. Mengetahui dampak putusan Hakim Pengadilan Tata Usaha Negara Gorontalo terhadap pencabutan sertifikat hak milik atas tanah menjadi tujuan penelitian ini. Adapun rumasan masalah yang digunakan, Pertama bagaimana penerapan hukum terhadap pembatalan sertipikat hak milik atas tanah dan mekanisme pembatalan sertipikat hak milik atas tanah. Kedua, dampak pembatalan sertipikat hak milik atas tanah bagi pihak yang bersengketa. Metode penelitian yang digunakan yakni empiris di mana mengetahui secara langsung di lapangan akibat yang ditimbulkan terhadap pembatalan hak milik atas tanah di Gorontalo. Hasil penelitian ditemukan dalam pembatalan sertipikat hak milik atas tanah hakim menggunakan peraturan – peraturan terbaru yang berhubungan langsung dengan pertanahan. Dampak yang dirasakan dari pembatalan secara langsung dan tidak langsung juga dirasakan oleh subjek hukum yang terlibat langsung di dalamnya.

Abstract

Community service (PkM) in the form of educational assistance and legal consultation in Bulili Village, Duhiadaa Subdistrict, was carried out with the aim of improving legal understanding and assisting the community in resolving legal issues they face. This educational support and legal consultation activity was based on two crucial issues: the community's lack of understanding of marriage and inheritance laws, and their low participation in the village regulation formation process. These two issues were chosen because they significantly affect the realization of a safe, orderly, and prosperous village. The methods used in this community service program include interactive outreach and participatory-based direct consultation, combining educational and legal empowerment approaches for village residents. The results of the program indicate an increase in community legal awareness regarding rights and obligations within the family context, as well as the importance of active community involvement in the formulation of village regulations. It is hoped that this activity can strengthen the legal culture at the local level and serve as a foundation for the development of a just, inclusive, and sustainable village.

Abstract

The development of digital technology has encouraged the increasing use of electronic transactions in various walks of life, including in rural areas. However, the rapid utilization of digital transactions has not been balanced with an adequate level of public understanding of the law, causing various legal risks such as online fraud, misuse of personal data, and legal uncertainty in electronic agreements. This community service activity aims to improve the legal literacy of the community through educational assistance and legal consultation related to legal protection in digital transactions. The method used is in the form of legal counseling and direct consultation held in Mekar Jaya village, Duhiadaa District, Pohuwato Regency, involving village officials and the general public. The results of the activities show that the public has been actively using digital transaction services, but still has a limited understanding of the legal rights and obligations as digital consumers. Through practical and contextual education, people are beginning to understand the importance of personal data protection, the validity of electronic agreements, and dispute resolution mechanisms in digital transactions. This legal assistance and consultation proved to be effective in increasing the legal awareness of the public and strengthening their position in facing the risks of digital transactions. This activity is expected to contribute to creating a secure, fair, and equitable digital transaction ecosystem, as well as being a model for sustainable legal service in the era of digital transformation.
