Abstract

Artikel ini mengkaji interaksi yang kompleks antara politik hukum dan penegakan hak asasi manusia di Indonesia. Artikel ini menyelidiki bagaimana kerangka hukum hak asasi manusia berinteraksi dengan realitas politik, yang sering kali mengakibatkan inkonsistensi dalam penegakan hukum. Dengan menggunakan pendekatan yuridis-empiris, penelitian ini menggunakan analisis legislatif dan observasi berbasis kasus untuk mengkaji mekanisme implementasi dan penegakan hukum hak asasi manusia. Temuan penelitian menunjukkan bahwa meskipun Indonesia telah meratifikasi berbagai instrumen internasional dan menetapkan hukum nasional tentang hak asasi manusia, implementasinya sering kali dipengaruhi oleh kemauan politik dan kepentingan elit. Akibatnya, lembaga hukum sering kali kesulitan menegakkan keadilan, terutama dalam kasus yang melibatkan aktor negara. Penelitian ini menyimpulkan bahwa sistem hukum yang lebih independen dan terintegrasi diperlukan untuk memastikan perwujudan penuh hak asasi manusia di Indonesia.

Abstract

Abstract

Children born from sirri marriages still have the right to receive state administrative services and be recognized as citizens without requiring verification of their parents' marital status, as stipulated in Article 4 paragraph (2) of the Ministry of Home Affairs Regulation Number 9 of 2016. Therefore, it is important to assess the validity of Article 4 paragraph (2) through the perspective of maslahah mursalah. This study aims to analyze the validity of this provision in light of the principles of maslahah mursalah in Islamic law, using a field study approach. The research was conducted in a specific region, involving key informants, including state administrative officials, couples in sirri marriages, and religious leaders. Data collection methods included in-depth interviews, observation, and documentation. The results show that the implementation of Article 4 paragraph (2) provides a real solution for couples unable to fulfill the requirements for isbat nikah. This policy not only facilitates administrative services for children born from sirri marriages but also aligns with Islamic law's goal of achieving maslahah, particularly in protecting the rights of children. This research contributes significantly by examining the legal validity of sirri marriages from the perspective of maslahah mursalah and offering recommendations for regulatory reform to accommodate the rights of children born from sirri marriages in a fair and just manner according to Islamic legal principles.

Abstract

This article investigates the evolving role of ulama as pivotal agents in the reform of inheritance norms within Minangkabau society, particularly amid tensions between Islamic legal principles and matrilineal customary law (adat). Situated within the broader dynamics of legal pluralism and global cultural transformation, this study employs a qualitative ethnographic methodology, incorporating field observations, semi-structured interviews with religious leaders and adat authorities, and textual analysis of sermons, deliberative forums, and locally issued fatwas. The findings indicate that ulama do not operate in antagonism to tradition but strategically embed Islamic inheritance principles (faraid) within the local moral universe through culturally resonant methods—such as cultural preaching, participatory musyawarah, and the reinterpretation of foundational axioms like adat basandi syarak, syarak basandi Kitabullah. These efforts have produced a hybrid inheritance model that distinguishes between pusaka tinggi (ancestral property), retained under matrilineal logic, and pusaka rendah (acquired assets), increasingly subject to faraid distribution. The study reveals that ulama, by leveraging their dual authority as religious scholars and cultural insiders, facilitate normative convergence between syariah and customary law, generating legal syncretism that is both context-sensitive and ethically grounded. This convergence is particularly visible in urban and diasporic communities, where exposure to global Islamic discourses and structural changes in kinship systems have intensified the demand for codified and equitable inheritance practices. Conclusively, the research underscores the capacity of local religious actors to drive legal transformation from within, offering an empirical contribution to scholarly debates on Islamic legal anthropology, indigenous legal change, and the adaptive resilience of customary systems in plural societies.

Abstract

This study aims to analyze the ambivalence toward legal compliance in the practice of unregistered marriage in Agam Regency, Indonesia. Although marriage registration is mandated by national law as a means of ensuring legal certainty and protecting the rights of spouses and children, unregistered marriages continue to occur and are socially accepted in certain communities. This research employs an empirical legal approach with a socio-legal perspective. Data were collected through interviews with religious leaders, marriage actors, community leaders, and relevant government officials, as well as through the examination of legal documents and related regulations. The findings reveal that legal ambivalence emerges from the coexistence of two competing normative systems: religious legitimacy and state legal requirements. Many individuals perceive marriage as valid once religious requirements are fulfilled, while marriage registration is regarded as an administrative rather than substantive obligation. Economic constraints, bureaucratic obstacles, cultural traditions, and limited legal awareness further contribute to the persistence of unregistered marriage practices. The study concludes that legal compliance regarding marriage registration is shaped not only by legal norms but also by social, religious, and cultural considerations that influence individual decision-making. This research contributes to the development of Islamic family law and socio-legal studies by demonstrating how legal pluralism creates ambivalent attitudes toward state law in matters of marriage and family regulation. The findings provide insights for policymakers in designing more effective strategies to promote marriage registration and strengthen legal protection for families.
