Abstract

Permasalahan keagrariaan merupakan persoalan sosial yang memiliki tingkat kompleksitas tinggi, sejalan dengan laju pertumbuhan penduduk serta meningkatnya kebutuhan terhadap sumber daya alam, khususnya tanah. Berbagai konflik dan sengketa agraria yang telah berlangsung dalam jangka waktu lama belum sepenuhnya memperoleh penyelesaian yang mampu memberikan kepastian hukum secara berkelanjutan. Upaya penyelesaian yang dilakukan cenderung bersifat sementara dan responsif terhadap perubahan sosial, tanpa didasarkan pada fondasi hukum dan konseptual yang kuat untuk menjawab tantangan di masa depan. Akibatnya, regulasi di bidang keagrariaan sering kali tidak mampu mengimbangi dinamika dan realitas yang berkembang dalam masyarakat. Di sisi lain, pendekatan dalam penyelesaian persoalan keagrariaan masih kurang memperhatikan dimensi perlindungan lingkungan hidup, sehingga berpotensi mengesampingkan keberlanjutan ekosistem. Kondisi ini menunjukkan pentingnya penataan ulang kebijakan keagrariaan yang komprehensif dengan menempatkan perspektif lingkungan hidup sebagai bagian yang tidak terpisahkan. Penelitian ini bertujuan untuk menelaah urgensi sinergi antara kebijakan keagrariaan dan prinsip perlindungan lingkungan hidup guna mewujudkan kepastian hukum, keadilan sosial, serta pengelolaan sumber daya alam yang berkelanjutan. Metode yang digunakan adalah penelitian hukum normatif melalui pendekatan peraturan perundang-undangan dan konseptual. Hasil kajian menunjukkan bahwa integrasi kebijakan keagrariaan dan orientasi perlindungan lingkungan hidup merupakan prasyarat penting dalam menciptakan tata kelola agraria yang berkeadilan dan berkelanjutan bagi generasi kini dan mendatang.

Abstract

Waqf land in East Java amounts to 78,825 plots covering 5,006.23 hectares, yet its registration level remains relatively low. Of this number, only 37,940 plots (2,270.25 ha) have been certified, while 4,885 plots (2,735.98 ha) have not obtained formal legal status. This study aims to analyze the registration system for waqf land under the Complete Systematic Land Registration Program (PTSL) and the implementation of E-Registration, as well as to examine the supervision mechanisms and their legal implications. Using an empirical juridical method with a socio-legal approach, the study explores registration practices and institutional dynamics of waqf management in the field. The primary contribution of this research lies in establishing a conceptual link between digital transformation in land administration—specifically through E-Registration—and Islamic legal institutions governing waqf. The findings show that digitalizing PTSL significantly increases the number of registered waqf lands and enhances efficiency, transparency, accountability, and legal protection for both nazhir and wakif. This demonstrates that digitalization is not merely an administrative innovation but also a tool that strengthens waqf governance as part of contemporary Islamic legal reform. This study fills a gap in the literature, which has largely focused on normative aspects of waqf without examining the integration of technology into its implementation. From a policy perspective, the success of digital PTSL depends on effective E-AIW training, accurate data validation, digital outreach, and continuous monitoring.

Abstract

Advocates occupy a strategic position as law enforcers and play a crucial role in ensuring access to justice, protecting legal rights, and maintaining the integrity of judicial processes. However, the increasing involvement of advocates in legal misconduct, including bribery, corruption, document forgery, breaches of confidentiality, conflicts of interest, and obstruction of justice, has raised serious concerns regarding professional integrity and ethical accountability. This study aims to analyze the enforcement of the Advocate Code of Ethics against advocates who commit legal misconduct and to evaluate such enforcement through the principles of amanah (trustworthiness) and al-‘adl (justice) in Islamic law. This study employed normative legal research using statutory, conceptual, and Islamic law approaches. The research relied on primary, secondary, and tertiary legal materials collected through an extensive literature review and analyzed using qualitative legal analysis. The findings reveal that although ethical enforcement in Indonesia is supported by a relatively comprehensive legal framework through Law Number 18 of 2003 and the Indonesian Advocate Code of Ethics, its implementation remains constrained by weak disciplinary supervision, inconsistent sanctions, limited transparency, institutional fragmentation among advocate organizations, and the separation between ethical accountability and criminal liability. From the perspective of Islamic law, legal misconduct committed by advocates reflects a failure to uphold the principles of amanah and justice, which constitute the moral foundation of professional integrity. This study offers an integrative analytical framework that combines positive law and Islamic legal ethics to evaluate ethical enforcement and argues that strengthening advocate professionalism requires not only regulatory compliance but also the internalization of trustworthiness, fairness, accountability, and justice.
