ABSTRAKKTUN sebagai objek sengketa di PTUN telah diatur dalam UU PTUN termasuk prosedurnya. Setelah diundangkannya UU AP, KTUN dan prosedurnya ini juga turut diatur dalam UU AP, namun terdapat perbedaan dalam pengaturan terhadap hakikat keputusan dan prosedurnya. Jenis penelitian yang digunakan adalah penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Penelitian ini menggunakan bahan hukum primer, sekunder dan tersier. Teknik pengumpulan bahan hukum yang digunakan adalah studi dokumen dengan teknik analisis kualitatif. Berdasarkan hasil penelitian dapat disimpulkan bahwa terdapat perbedaan pengaturan terhadap 3 aspek yang diatur dalam UU PTUN dan UU AP, yaitu pertama pengaturan terhadap hakikat KTUN, kedua pengaturan terhadap status permohonan yang didiamkan oleh Badan dan/atau Pejabat TUN, ketiga pengaturan terhadap pengajuan gugatan yang melalui upaya administratif berupa banding. Meskipun terdapat perbedaan, pengaturan untuk hukum materil berpedoman kepada UU Administrasi Pemerintahan dan hukum formil tetap berpedoman kepada UU PTUN. Implikasi dari Pengaturan terhadap hakikat KTUN dalam UU PTUN dan UU AP adalah terjadinya perluasan kriteria KTUN dan perluasan kewenangan PTUN.Kata kunci: administrasi pemerintahan; keputusan TUN; sengketa.ABSTRACTDecision of State Administration as the object of dispute in the state administrative court has been regulated in the statutory administrative law of the state including its procedures. After the promulgation of the law of the Government Administration, The state administrative decisions and procedures are also governed by the laws of the Government Administration. but there are differences in the arrangement of the nature of decisions and procedures. Type of research used is normative legal research with used is approach to legislation and conceptual approaches. The legal material used is primary, secondary and tertiary legal materials. The technique of collecting the legal material used is study documents with used qualitative analysis techniques. Based on the results of the study can be concluded that 1). there are different settings against the 3 aspects set forth in laws of state administrative courts and government administration laws that is, the first is the regulation of the nature of the state administrative decisions, the second is the regulation of the status of the government’s silenced petition, third is the arrangement of a lawsuit filed through an administrative appeal in the form of an appeal, Although there are differences, arrangements for material law are guided by the laws of the Government Administration and formal law remains guided by the state administrative court law. 2). Implications of Arrangements on the nature of state administrative decisions in state administrative justice laws and Government Administration laws are the occurrence of expansion of the criteria of state administrative decisions and expansion of the authority of the state administrative court.Keywords: goverment administration; decision of state administration; dispute.

Pengaturan pengajuan gugatan yang melalui upaya administratif berupa banding menurut undang-undang peradilan tata usaha negara dan undang-undang administrasi pemerintahan telah diatur dalam UU PTUN. Setelah diundangkannya UU Administrasi Pemerintahanan, hal ini juga turut diatur dalam UU Administrasi Pemerintahan, namun terdapat perbedaan dalam pengaturan tersebut. Rumusan masalah dalam penelitian ini adalah Bagaimana pengaturan pengajuan gugatan yang melalui upaya administratif berupa banding menurut undang-undang peradilan tata usaha negara dan undang-undang administrasi pemerintahan. Berdasarkan hasil penelitian dapat disimpulkan bahwa meskipun terdapat perbedaan, pengaturan untuk hukum materil berpedoman kepada UU Administrasi Pemerintahan dan hukum formil tetap berpedoman kepada UU PTUN.

Pemilihan umum adalah sarana pelaksanaan kedaulatan rakyat yang dilaksanakan secara langsung, umum, bebas, rahasia, jujur, dan adil dalam Negara Kesatuan Indonesia berdasarkan Pancasila dan Undang-undang Dasar Negara Republik Indonesia 1945. Hilangnya kepercayaan rakyat untuk tidak lagi menyalurkan hak pilihnya atau hak suaranya dalam pemilu sering terjadi akibat kebijakan pemerintah yang tidak sesuai dengan kehendak rakyat. Tetapi satu hal yang tidak disadari yaitu keadaan tersebut merupakan buah dari suara yang mereka salurkan pada momentum pemilihan umum. Adapun tujuan dari pengabdian masyarakat ini adalah untuk mengetahui bagaimana tingkat pemahaman masyarakat Kelurahan Alai Parak Kopi, Kecamatan Padang Utara, Kota Padang mengenai tentang pemilu. Metode pengabdian Masyarakat yang digunakan adalah metode ceramah dan metode diskusi. Hasil yang diperoleh dari pengabdian masyarakat ini adalah peserta pemilu menjadi paham mengenai arti penting suara mereka dalam pemilihan pemilu dan memahami prosedur dalam pelaksanaan pemilu

The decision of the administrative court implemented by unplugging and/or issue a decision on stateadministration. The activity in the law on public service known as administrative services. Nevertheless, there is still a lot going on maladministration inthe implementation of the decision of the administrativecourt. The problem in this research is What are the implications of the disharmonization of the State Administrative Courts Law and the Public Services Law.Legal data used primary legal data, legal data secondary and tertiary legal data. Legal data collection techniques used are the study documents. Legal data analysis technique used is the tecnique of qualitative analysis.based on the results of this study concluded that Based on the results of the research and discussion carried out by the author, the following conclusions can be drawn: Administrative services to implement decisions of the State Administrative Court do not meet the indicators of good public service and have implications in various aspects, including: first, administrative services to implement decisions of the State Administrative Court are difficult to implement quickly and easily.second, the low level of responsibility of state administrative agencies or officials to implement court decisions voluntarily.third, there is no certainty of time for the plaintiff to obtain administrative services in implementing the State Administrative Court's decision quickly and easily.

The Constitutional Court stated that there were 9 articles that were unconstitutional in the Oil and Gas Law. After the Constitutional Court's decision the government was deemed inconsistent in carrying out the Constitutional Court's decision. The formulation of the problem in this research is 1). How is the management of oil and gas before the Constitutional Court Decision Number 36 / PUU-X / 2012. Type of research used is normative legal research, The research approach used is approach to legislation and conceptual approaches. The legal material used is primary legal materials, secondary law materials and tertiary legal materials. The technique of collecting the legal material used is study documents. The technique of analysis of legal materials used is qualitative analysis techniques. Based on the results of the study can be concluded that Oil and gas management prior to the birth of the Constitutional Court Decision is carried out by the oil and gas implementing agency, where the oil and gas implementing agency represents the country in conducting civil relations with business entities or permanent business entities.

The Status of Applications Silenced by State Administrative Agencies and/or Officials has been regulated in the Administrative Court Law. After the promulgation of the Government Administration Law, the Status of Applications Silenced by State Administrative Agencies and/or Officials is also regulated in the Government Administration Law, but there are differences in the arrangements for the Status of Applications Silenced by State Administrative Agencies and/or Officials. The formulation of the problem in this study is how to regulate the Status of Silenced Applications by State Administrative Agencies and/or Officials according to the Law on State Administrative Court Law and the Government Administration Law. The type of research used is normative legal research. The research approach used is a statutory approach and a conceptual approach. The legal materials used are primary legal materials, secondary legal materials and tertiary legal materials. The legal material collection technique used is document study. The legal material analysis technique used is a qualitative analysis technique. Based on the results of the study, it can be concluded that the regulation regarding the status of applications that are silenced by the State Administrative Agency and/or Officials, which was previously negatively fictitious, but after the issuance of the Government Administration Law became positively fictitious. Even though there are differences, the arrangements for material law are guided by the Government Administration Law and formal law is still guided by the Administrative Court Law.

State administrative court decisions are carried out by revoking and/or issuing state administrative decisions. These activities in the Public Service Act are known as administrative services. Even so, there are still many maladministrations in implementing state administrative court decisions. in this study is how maladministration in the implementation of decisions of the State Administrative Court in the perspective of public service law. The type of research used is normative legal research. The legal data used are primary legal data, secondary legal data and tertiary legal data. The legal data collection technique used is document study. The legal data analysis technique used is a qualitative analysis technique. Based on the results of the study it can be concluded that 1) There is no synchronization and harmonization between Article 116 Paragraph (3), Paragraph (4) and Paragraph (6) of the State Administrative Court Act and Article 34 letter d of the Public Service Act.

Mahkamah Konstitusi dalam putusannya Nomor 36/PUU-X/2012 tanggal 13 November 2012 menyatakan bahwa terdapat 9 Pasal yang inkonstitusional dalam Undang-Undang Migas. Pasca putusan MK pemerintah dianggap tidak konsisten dalam melaksanakan putusan MK. Rumusan masalah dalam penelitian ini adalah bagaimanakah pengelolaan usaha hulu minyak dan gas bumi pasca putusan Mahkamah Konstitusi Nomor 36/PUU-X/2012 dalam rangka mencapai kemakmuran rakyat. Jenis penelitian yang digunakan adalah penelitian hukum normatif. Pendekatan penelitian yang digunakan adalah pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum yang digunakan adalah bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Teknik pengumpulan bahan hukum yang digunakan adalah studi dokumen. Teknik analisis bahan hukum yang digunakan adalah teknik analisis kualitatif. Berdasarkan hasil penelitian dapat disimpulkan bahwa pengelolaan usaha hulu migas tidak dapat dipisahkan dari konsep hak menguasai negara, tindakan pemerintah dan tujuan Pasal 33 UUD 1945 yakni untuk mencapai kemakmuran rakyat. Oleh karena itu pengelolaan usaha hulu migas dikembalikan pada pemerintah dengan membentuk SKK Migas, namun SKK migas memiliki kesamaan dengan BP Migas yang dinyatakan inkonstitusional oleh MK sebelumnya.

Article 116 of the State Administrative Court Law regulates the implementation of decisions of the State Administrative Court. In the event of a delay in the implementation (execution) of a court decision, in procedural law the State Administrative Court acting as the executor is the relevant state administrative agency or official. The implementation of decisions based on the legal awareness of state administrative officials results in many State Administrative Court decisions being disobeyed or not implemented by state administrative officials which can cause material and immaterial losses for the plaintiff. The formulation of the problem in this scientific work is how is the analysis of article 116 of law number 51 of 2009 concerning the second amendment to law number 5 of 1986 concerning state administrative justice from the perspective of statutory theory? The method used is normative research. The result of the discussion is that Article 116 Paragraph (3), Paragraph (4) and Paragraph (6) of the State Administrative Court Law does not expressly state a time limit for State Administrative Bodies or Officials to provide a decision (beschikking) in implementing the decision of the State Administrative Court.
