Abstract

Islamic law instructs the guardians of orphans not to arbitrarily affect the orphans and their property. Because children are part of the younger generation as one of the human resources who have a strategic role in forming a better family. Guardians should not behave unjustly towards orphans. he law recommends the guardian to make a list of assets so that the guardian's property is not mixed with the orphan's property and in Law No. 1 of 1974 concerning Marriage, it is regulated about the prohibition of using and consuming excessively, moving and selling the 1 Nurkhafifah Tamsyur property of orphans. However, the reality of society, in the care of orphans has not been carried out as specified in Islamic teachings. In maintaining the property of an orphan by a guardian, the guardian must have a concept in managing finances on a monthly or yearly basis, it is better if he develops his property so that it is "alive" and not "frozen" in order to get benefits to cover his daily life. And if the child has reached puberty, is an adult or can manage his own property, his property must be handed over honestly according to the assets he has and when submitting he must present witnesses so that there is a guarantee for his responsibility so as not to cause disputes or quarrels that can lead to disputes and conflicts. prejudice, By understanding the maintenance of the orphan's property, the guardian or the one who is entrusted with the care of the orphan's property can be more careful and pay attention to the property as best as possible starting from the time it is guarded until the time it is handed over when the child is an adult. In QS. An - Nisa verse 2 explains about the care of orphans by guardians when the orphans are mature (adults) they can manage their own assets

Abstract

Sharia law found in the Qur'an still requires interpretation and has the potential to evolve. Abdullahi Ahmed An-Na'im answers the gap between sharia and issues of modernity. The deconstruction of sharia is used in the problem of Islamic law with current issues using an analytical knife in the form of Mahmud Thaha's theory of legal evolution, the theory of nasikh mansukh, Makiyyah and Madaniyyah, the meaning of gender texts and the concept of sharia on human rights. All Muslims in the world have the right to apply Islamic law as long as it does not violate the rights of other people, other groups or other religions

Abstract

The interpretation of the Qur’an has undergone dynamic development in line with the growing awareness among Muslims of the importance of the principle of justice, particularly in the relationship between men and women. Within the development of contemporary Qur’anic thought, feminist exegesis has emerged as an approach that seeks to reconstruct perspectives on the sacred text by positioning women as active subjects in the interpretive process. This approach responds to the patriarchal bias that has shaped classical exegetical traditions, in which women are often portrayed in subordinate and marginalized roles. Amina Wadud is one of the central figures in feminist exegesis, offering a critical and contextual reading of the Qur’an. Through a hermeneutical approach that emphasizes the interrelation between text, context, and reader, Wadud highlights the importance of the Qur’an’s universal values such as tawḥīd (divine unity), justice, equality, and respect for human dignity as a foundation for building more just and equitable social relations. This study aims to examine Amina Wadud’s intellectual contributions to the development of feminist exegesis through a literature review of her major works, including Qur’an and Woman and Inside the Gender Jihad. Using a qualitative-descriptive method based on library research, this paper explores her methodology, thematic concerns, and the social and theological implications of her feminist readings. The findings indicate that the feminist approach developed by Wadud not only broadens the horizons of Qur’anic interpretation but also opens space for a more inclusive, just, and contextually grounded understanding. Her thought significantly contributes to shaping a more humanistic, socially responsive, and gender-equitable understanding of Islam
