Abstract

The rapid growth of e-commerce has significantly reshaped the global marketplace, enabling consumers to engage in digital transactions easily. However, alongside its benefits, e-commerce has introduced challenges, particularly regarding consumer protection in cases of unlawful acts committed by business actors. The aim of this study is to analyze the legal concept of compensation for consumers in e-commerce transactions, focusing on unlawful acts. This research investigates the responsibilities of business actors in ensuring consumer protection and the applicability of various laws, such as the Civil Code, the Consumer Protection Law, and the Electronic Information and Transaction Law (ITE Law), to e-commerce contexts. Using a descriptive-analytical approach with normative juridical methods, the research explores case law, legal frameworks, and secondary data related to consumer complaints, including issues of fraud, product misrepresentation, and privacy violations. The findings highlight the complexities surrounding compensation claims for both material and immaterial damages resulting from e-commerce violations. The study concludes that there is a need for stronger legal provisions to ensure fair compensation and accountability for e-commerce business actors. This research also recommends enhancing digital literacy among consumers and reinforcing the regulatory mechanisms to promote a safer e-commerce environment. The study contributes to a deeper understanding of consumer rights in the digital economy and suggests improvements in the legal framework for e-commerce transactions.

Abstract

The diversity of customary law in Indonesia reflects the reality of legal pluralism that exists within society. However, the existence of customary mediation mechanisms as a means of dispute resolution is often overlooked in the national legal system, which is oriented towards formal legality. This shows the imbalance between living law and positive law. This study uses a normative juridical method with a conceptual, legislative, and case-based approach to examine the position of customary mediation law in the national legal system and to formulate an ideal model of customary mediation that can be accommodated legally and harmoniously. The results of the study show that philosophically and constitutionally, customary law has strong legitimacy as recognized in Article 18B paragraph (2) of the 1945 Constitution and Article 2 of the 2023 Criminal Code concerning living law in society. Empirically, customary mediation models in various regions such as Aceh and Kalimantan are capable of delivering restorative, participatory, and humanistic justice, despite facing the challenges of modernization and the principle of legality. Therefore, the integration of customary mediation into the national legal system needs to be realized through the strengthening of customary institutions and normative regulations that guarantee equal rights and legal certainty. Customary mediation should ideally become a model of restorative justice unique to Indonesia, rooted in cultural values and the principle of deliberation to reach consensus.

Abstract

Tujuan dari pengabdian ini agar pelajar bisa melindungi dirinya dari hal yang merugikan dalam memenuhi kebutuhannya. Lemahnya posisi konsumen dalam hubungan dengan pelaku usaha, maka perlu ditingkatkan martabat dan harkat konsumen dengan ditingkatkan pengetahuan, pemahaman dan kesadaran serta meningkatkan kemampuan konsumen untuk melindungi dirinya terutama dalam hal terjadinya kualitas dan kualitas barang yang tidak sesuai. Pelajar SMA merupakan bagian dari masyarakat yang sering melakukan transaksi secara langsung maupun secara online. Pelajar SMA termasuk komunitas yang paling aktif dalam penggunaannya dengann meningkatnya kebutuhan pelajar SMA dalam melakukan trasaksi. Hal ini juga tidak menutup kemungkinan terjadi pada pelajar SMA Negeri 1 Kabupaten Muaro Jambi, maka sebaiknya kepada pelajar SMA Negeri 1 dibekali dengan pengetahuan, pemahaman dan kesadaran akan perlindungan hukum terhapap konsumen. Melalui kegiatan Pengabdian ini diharapkan dapat memberikan dampak yang positif kepada pelajar SMA Negeri 1 Kabupaten Muaro Jambi. Target yang ingin dicapai Pelajar SMA Negeri 1 Kabupaten Muaro Jambi memahami dan menyadari apa saja hak dan kewajiban sebagai komsumen, sehingga menjadi konsumen yang cerdas dalam melakukan transaksi dengan pelaku usaha. Pelajar memahami dan menyadari untuk menjadi konsumen yang mandiri dalam melindungi dirinya. Peningkatan pemahaman dan kesadaran pelajar SMA Negeri 1 untuk menjadi konsumen yangmemahami haknya dan mampu melakukan upaya untuk menuntut ganti rugi jika haknya dilanggar.
