Abstract

This  study  employs  normative  legal  research  methods,  which  focus  on  analyzing  legal norms and regulations relevant to the research topic. Normative legal research is a scientific procedure  aimed  at  discovering the truth  through logical  reasoning  based on the  established principles  of  law. This method  relies  on  the  systematic  examination  of  legal  materials, including legislation, case law, and legal doctrines, to provide a comprehensive understanding of  the  issue  under  study.  The  data  used  in  this  study  are primarily  secondary  in  nature, consisting  of  laws,  regulations,  legal  precedents,  and  scholarly  legal  commentaries  that  are pertinent  to  the  topic  of  Commercial Law dan Political Law. Once the relevant legal materials were collected, the data analysis process began with the systematic  interpretation  of  legal  texts,  focusing  on  their  application  to  sexual  violence  and commercial law. This included evaluating the purpose, scope, and application of laws, as well as identifying any inconsistencies or gaps. A comparative legal analysis was also employed, where necessary, to contrast Indonesian laws with international conventions and legal practices from  other  countries,  highlighting  differences  and  suggesting  improvements.  Finally,  the findings were synthesized to propose recommendations for enhancing legal protections against sexual violence and human trafficking. This detailed methodological approach ensures that the research is grounded in thorough legal analysis, enabling readers to understand the steps taken to collect and interpret the data without needing to refer to external sources.

Abstract

Juvenile recidivism represents a significant criminological issue, reflecting the limited effectiveness of rehabilitation within the juvenile justice system. The return of child offenders to correctional institutions indicates the presence of underlying factors that contribute to reoffending, as well as gaps in the current rehabilitation approach. This study aims to analyze the criminological factors influencing juvenile recidivism and to evaluate the rehabilitation programs implemented at the Class II Juvenile Correctional Institution (LPKA) in Tenggarong. The research employs a socio-legal approach, combining empirical data obtained through interviews with secondary data derived from statutory regulations, academic literature, and relevant studies. The findings reveal that juvenile recidivism is influenced by multiple factors, including social environment, prisonization effects, social media exposure, economic conditions, low educational attainment, and inadequate supervision. Although the institution has implemented various rehabilitation programs—such as personality development, religious guidance, legal awareness, intellectual training, and vocational skills—these efforts have not been fully effective in preventing reoffending. This study highlights the need for a more integrative and sustainable rehabilitation model that involves family support, community participation, and post-release supervision to reduce juvenile recidivism. From a criminological perspective, this research contributes to understanding the interplay between institutional rehabilitation and social factors in shaping recidivist behavior among juveniles. Keywords: Juvenile Recidivism, Criminology, Juvenile Correctional Institution, Rehabilitation

Abstract

Criminal liability for perpetrators of verbal sexual harassment (catcalling) in public places, which is a form of non-physical sexual violence that is often normalized in Indonesian society. Catcalling has serious psychological impacts on victims, such as shame, fear, and loss of security. This study aims to analyze the basis for criminal liability of catcalling perpetrators in the perspective of Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence (UU TPKS), as well as to examine the form of legal protection provided to victims. This study uses a normative legal method with a legislative approach and literature study. The results of the study indicate that catcalling has been recognized as a form of non-physical sexual violence in Article 5 and Article 14 of the TPKS Law, with a maximum prison sentence of 9 months and/or a maximum fine of IDR 10 million. However, obstacles to proof in catcalling cases are still the main obstacle, especially due to the lack of physical evidence, lack of witnesses, and social stigma against victims. This study also highlights the importance of the role of the state and institutions such as LPSK in ensuring protection, recovery, and legal assistance for victims. Strategic and collaborative efforts are needed between the government, law enforce

Abstract

Law enforcement against fish electrocution offenses is crucial due to its direct impact on aquatic ecosystem degradation and the sustainability of fishery resources. This study aims to assess the feasibility and limitations of applying restorative justice in handling such cases in Pulau Harapan Village, Muara Muntai District, Kutai Kartanegara Regency. The research employs a socio-legal approach, combining normative legal analysis with empirical data obtained through interviews with law enforcement officers. The findings indicate that the application of restorative justice through mediation and social agreements is effective in resolving conflicts quickly; however, it does not fully comply with the procedural requirements of criminal procedural law. This condition reveals a gap between practice and the existing normative framework, which may lead to legal uncertainty and weaken the protection of public and environmental interests. This study concludes that restorative justice in fish electrocution cases is only conditionally appropriate and should be applied in a limited manner, provided that legal procedures are fulfilled and environmental impacts are not significant. The contribution of this research lies in clarifying the juridical boundaries and identifying potential legal risks in the application of restorative justice, thereby providing a basis for strengthening more accountable and sustainable law enforcement policies. Keywords: fish electrofishing; law enforcement; restorative justice; fishery resources
