Abstract

Lahirnya UU No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (Lembaran Negara RI Tahun 2012 No 153 Tambahan Lembaran Negara RI No. 5332, selanjutnya disingkat UU-SPPA) merupakan “harapan” bagi anak-anak yang berhadapan dengan hukum baik sebagai pelaku maupun sebagai korban untuk tetap mendapatkan hak-haknya. Hal penting yang diatur dalam UU-SPPA adalah pelaksanaan diversi yaitu pengalihan penyelesaian pidana anak dari proses peradilan pidana di luar peradilan pidana. Langkah diversi tersebut dimaksudkan untuk memperoleh keadilan restorasi (restoratif justice) yaitu penyelesaian perkara tindak pidana dengan melibatkan pelaku, korban, keluarga pelaku/korban, dan pihak lain yang terkait untuk bersama-sama mencari penyelesaian yang adil dengan menekankan pemulihan kembali pada keadaan semula dan bukan untuk pembalasan. UU-SPPA merupakan penyempurna atas pelaksanaan UU No. 3 Tahun 1997 tentang Pengadilan Anak yang berlaku selama ini. Hal-hal yang harus dipersiapkan dalam pemberlakuan UU-SPPA ada dua aspek, yaitu fisik dan non fisik. Persiapan secara fisik yang berupa sarana dan prasarana, yang selama ini masih belum ada karena semua persiapan itu membutuhkan ketersediaan dana yang tidak sedikit. Pemerintah daerah harus mempersiapkan lembagalembaga seperti Lembaga Pembinaan Khusus Anak (LPKA), Lembaga Penempatan Anak Sementara (LPAS), Lembaga Penyelenggaraan Kesejahteraan Sosial (LPKS). Sedangkan persiapan non fisik meliputi penegak hukum yang mempunyai sertifikat sebagai penyidik anak, jaksa anak dan hakim anak. Faktor pendukung berlakunya UU-SPPA adalah UU No. 23 Tahun 2002 tentang Perlindungan Anak, UU ini telah mengakomodir kepentingan dan perlindungan anak yang selama ini telah mewarnai penyelesaian kasus-kasus anak yang berhadapan dengan hukum. Sedangkan faktor penghambat atas pemberlakuan UU-SPPA yang paling dominan justeru ada pada UU-SPPA itu sendiri karena masih banyak aturan yang memerlukan petunjuk teknis untuk melaksanakannya, seperti aturan tentang prosedur diversi. Jika diversi merupakan amanat dalam UU-SPPA, maka selama lembaga-lembaga baru belum tersedia, maka pelaksanaan diversi akan mengalami hambatan, dimana anak harus ditampung? Demikian juga selama belum tersedia penegak hukum khusus anak, maka amanat UU-SPPA juga tidak akan terlaksana.

Abstract

The constitution 1945 has guaranteed the poor and neglected children as stated in Article 34. The homeless, beggars and street children can also be categorized as poor that are maintained by the state. In fact, the portraits of beggars, especially in Pamekasan regency have become a spectacle and terrible habits. The question is whether the beggars obviously meet the criteria of the poor? This is what we need to look deeply as begging become habit or living. In this study, the researcher wanted to know and map the characteristics of female beggars in the District of Tlanakan Pamekasan. Beggar’s view and understanding of the needs of life is merely about to eat and to drink. The desire to stop their habits and having a job may become solutions for them to fill their needs. Female beggars actually have a psychological concern when they are begging in the streets, shopping centers, government offices, and door to door. They feel ashamed to even if people’s responds and attitude towards them are normal. They desired to end the habits as they are old and no longer be able to walk; so that, they do an easy thing to support their own needs.

Abstract

Case Number 0779/Pdt.G/2019/PA.Pwt is interesting to discus because int his case, the applicant's first wife allowed her husband to practice polygamy despite the fact that she can carry out her obligations as a wife, give birth, and she is not disabled or suffering from an incurable disease ( as the conditions contained in the Compilation of Islamic Law). The purpose of this paper is to examine the maslaha of the first wife in allowing polygamy. This research is classified as normative legal research, with a case study approach and some literature reviews derived from laws and regulations, books, official documents, journals, and research findings. The data sources used in this research are primary, secondary, and tertiary data sources. This research shows that the judge's consideration is based on the main reason of the applicant, husband, for asking polygamy because his wife is deemed unable to fulfill his Biological needs regularly which only fulfill for once or twice per week. Because of this, the court argue that the applicant’s proposal for polygamy has satisfied the provisions of Article 4 paragraph (2) letter A of Law No. 1 year 1974 concerning Marriage which is in line with the provisions of Article 57 letter A Compilation of Islamic. From the gender analysis, the decision did not show justice for the respondent, it was normal for biological relations to be fulfilled twice in one week, but the judge did not see the side of the applicant who experienced hypersex, however, the respondent still stated that he did not mind polygamy.

Abstract

This study explores integrative legal protection strategies for wives and children, bridging normative and sociological perspectives, in the face of Isbat Nikah application rejections. This strategy is essential because it is motivated by the facts in the field, namely that many Isbat Nikah are not registered and have legal consequences. This study uses a qualitative approach; this empirical study is drawn from observation data and interviews with judges and clerks in three religious courts (PA) in East Java, namely in Pamekasan, Probolinggo, and Pasuruan Districts. The data was further enriched by comparing it with document and literature studies, then analyzed using descriptive techniques. This article finds that the legal protection of wives and children due to the rejection of Isbat Nikah applications is to apply an integrative normative-sociological strategy. Normatively, the way that can be taken is by integrating several aspects such as aspects of the law, law enforcement, and facilities or facilities that can support the application of law, such as human resources and sophisticated tools such as tools to find out a person's DNA. Meanwhile, sociologically, two aspects of social problems are crucial to carrying out an integrated improvement strategy, namely aspects such as aspects of a religious-type society and a negative patriarchal culture. Religious communities often exhibit a strong susceptibility to dependence on religious guidance.

Abstract

Tanah perdikan adalah suatu bidang tanah yang mempunyai kedudukan tanah istimewa karena tanah perdikan ini tidak dikenakan pajak sebagaimana hak atas tanah lainnya. Tanah perdikan diberikan kepada mereka yang bekerja atau memberikan jasa (sebagai kawulo) kepada raja yang memerintah saat itu. Seiring berjalannya waktu, hingga saat ini belum ada lagi raja atau kerajaan, sedangkan tanah perdikan secara fisik masih ada dan dikelola oleh keturunan masyarakat yang sebelumnya merupakan penerima tanah perdikan tersebut. UUPA tidak lagi menyebut tanah Perdikan. Perlu dikaji perlindungan dan jaminan kepastian hukum bagi pemegang tanah perdikan dan kedudukan hukum tanah perdikan dalam sistem Hukum Pertanahan Nasional. Penggunaan gabungan yuridis normatif dan empiris dalam pengumpulan data dengan pendekatan kualitatif dan pendekatan undang-undang, pendekatan kasus, pendekatan sejarah, dan pendekatan konseptual. Perlindungan dan kepastian hukum bagi pemegang tanah perdikan akan diperoleh apabila yang bersangkutan mengajukan permohonan hak atas tanah dan diterbitkan Sertifikat Hak Atas Tanah. Dalam sistem hukum pertanahan nasional tidak ada lagi penyebutan tanah Perdikan, dengan diundangkannya Undang-undang N0 13 Tahun 1946 tentang Penghapusan Desa Perdikan dan Peraturan Menteri Dalam Negeri dan Otonomi Daerah Nomor 11 Tahun 1959 tentang penghapusan seluruh Desa Perdikan dan Desa Pedukuhan/Perdikan di Karesidenan Madura Jawa Timur, maka tanah Perdikan menjadi tanah dikuasai langsung oleh Negara

Abstract

Artikel ini membahas peran Pusat Pelayanan Terpadu Pemberdayaan Perlindungan Perempuan dan Anak (P2TP3A) di Kabupaten Pamekasan dalam mencegah dan membantu korban narkoba. Fokus masalah yang diangkat adalah pertama, faktor-faktor apa yang mendasari kenakalan remaja dalam hal narkoba. Kedua, apa peran Pusat Pelayanan Terpadu Pemberdayaan Perlindungan Perempuan dan Anak (P2TP3A) Kabupaten Pamekasan dalam mencegah dan membantu korban narkoba. Penelitian ini menggunakan metode penelitian hukum empiris dengan teknik wawancara, observasi, dan dokumentasi. Hasilnya, Pertama, faktor-faktor yang mendasari adalah faktor internal (krisis identitas; lemahnya pengendalian diri) dan faktor eksternal (faktor keluarga; dan pengaruh lingkungan sekitar). Kedua, Pusat Pelayanan Terpadu Pemberdayaan Perlindungan Perempuan dan Anak (P2TP3A) memiliki peran penting dalam membimbing anak-anak korban narkoba, yaitu: Peran Perlindungan: Menjamin keselamatan dan hak-hak korban anak. Peran Pendampingan: Memberikan bimbingan dan dukungan untuk membantu pemulihan korban. Peran Pemberdayaan: Memfasilitasi program yang meningkatkan keterampilan dan harga diri korban narkoba

Abstract

The age of marriage enhancement as mandated by Law no. 16 of 2019 is increasing the minimum age for marriage from 16 years for women and 19 years for men to 19 years for both women and men. However, this rule has not been accepted wholeheartedly by the community, so there are pros and cons. This study focuses on answering three questions: 1) Why are there pros and cons in the provisions of Law no. 16 in 2019 within a society? 2) What steps are taken by the community in violating the provisions of Law no. 16 of 2019? 3) What steps have been taken by the KUA and the Religious Courts in implementing the provisions of Law Number 16 of 2019? This research uses qualitative research with discourse analysis method. The researcher uses Pierre Bourdieu's theory to see the dynamics of the pros and cons contestation in increasing the age of marriage. With the genetic structuralism approach, to unite the origins of the individual mental structure, which is the product of the unification of the social structure that surrounds it. There are groups of people who agree to increase the age of marriage, and there are groups against it. The importance of mature marriage is to reduce divorce rates, poverty rates, children dropping out of school, maternal and child mortality rates. On the other hand, some people still prioritize the legal requirements of marriage by fulfilling the provisions of Islamic law (alternative options) not cumulative as required in the conditions for a valid marriage in the UUP. The arguments of people against the increase of marriageable age are based on the background of community culture, economic conditions, and free lifestyle of teenager. Unregistered marriage (nikah siri), legalization of marriage procedure and marriage dispensation are alternative steps taken by people who are against the increase of marriage age. KUA (religious affairs office) and the Religious Courts as the frontline in maintaining the mandate of Law no. 16 of 2019 using legal norms, still tightening the provisions on the age limit for marriage, marriage dispensation and legalization of marriage.

Abstract

Madurese’s resistance to the development of tourism facilities is based on the socio-cultural conditions of the community, which is less open to modernization. This research describes the form of resistance and reflects on its relation to Madurese society’s social and historical conditions. This research uses qualitative data with interview methods, collecting news on the internet, and literature studies. Data collection in this research begins with reading news on the internet on Madurese's resistance related to modern facilities and modern tourism, then conducting interviews with informants to confirm data from the news. Data analysis was carried out through three stages, namely describing data, classifying, and interpreting data thematically to reveal the meaning of the resistance by the Madurese community against the development of tourism facilities. The findings of this study highlight at least three main things, namely the forced closure of non-Muslim entertainment venues due to dissatisfaction with the resulting value shifts. Second, the presence of powerful actors triggers resistance from the community. Third, Madurese people tend to make tourism based on Islamic Sharia as they believe in their daily lives.

Abstract

Problem statement: Marriage guardianship is a significant aspect of Islamic marriage, wherein the guardian assumes responsibility for the marriage of a female. The influence of culture and tradition in the practice of marriage guardianship in Madura frequently leads to challenges related to the selection of a male bride. Objective: This study aims to analyse the relationship between Madurese culture and traditions and gender equality in the practice of marriage guardianship. Methods: This research employs a qualitative approach, utilising data collection techniques such as participatory observation, in-depth interviews, and the analysis of documents pertinent to Madurese culture and traditions. The collected data is subsequently analysed using content analysis to ascertain the impact of Madurese culture and traditions on gender equality within the context of marriage guardianship. Results: This study reveals a shift and transformation in gender awareness in Madura, driven by efforts from community groups and non-governmental organisations to promote gender equality in marriage brokerage practices. Nevertheless, these initiatives continue to encounter formidable cultural and traditional obstacles. The relationship between Madura's culture and traditions and gender equality in marriage brokerage practices remains significant. Conclusion: Comprehensive and integrated efforts are essential from various stakeholders, including the community, government, and non-governmental organisations, to foster more inclusive gender awareness and facilitate positive changes in marriage brokerage practices in Madura.

Abstract

The importance of analyzing sexual violence, which frequently occurs both in the private sphere and in the public sphere where the law does not reach. This paper addresses three questions: (a) How is the low awareness of sexual violence victims manifested in taking legal action, (b) why do sexual violence victims exhibit low awareness in taking legal action, and (c) what is the impact of this low awareness on the law enforcement process. This study uses a normative juridical and empirical legal research approach, combining a statutory and conceptual approach, as well as qualitative methods aimed at identifying obstacles in law enforcement against sexual violence crimes. The findings indicate a lack of legal awareness among victims in making reports, which is influenced by factors such as power relations, the status/identity of children born from the abuse, closeness to the perpetrator, and societal stereotypes that view victims negatively. Aspects of law enforcement have not yet guaranteed justice, as they are affected by law enforcers' professional ethics and legislation that is insufficiently accommodating those issues. It is hoped that this article will contribute to a reduction in cases of sexual violence and the attainment of social justice.
