Abstract

The existence of Dayak customary law in Central Kalimantan plays an important role in resolving customary land disputes. Recognition of customary institutions and the authority of the Damang (Customary Chief) is affirmed in Central Kalimantan Provincial Regulation Number 16 of 2008. In practice, customary land disputes in Kurun District are often resolved through customary legal mechanisms without proceeding to formal courts. This study aims to analyze the position and authority of the Damang in enforcing Dayak customary law and the process of resolving customary land disputes based on the regulation, with a case study of Damang Decree Number 02/DKA/KK/I/2026. This research employs a legal research method with an empirical juridical approach using statutory and case approaches. Data were collected through literature review and interviews with the Damang Customary Chief, Mantir Adat (customary officials), and the disputing parties, and were analyzed qualitatively. The results indicate that the Damang holds a recognized customary authority with normative legitimacy to enforce customary law and resolve customary land disputes. The dispute resolution process involves complaint submission, examination, customary deliberation, site inspection of the disputed land, and the issuance of a Damang Decree accepted by the disputing parties without further litigation in formal courts.

Abstract

The rapid development of financial technology has contributed to the emergence of various digital investment platforms, some of which are misused to conduct illegal activities such as Ponzi schemes. A Ponzi scheme is a fraudulent investment model that promises unusually high returns within a short period by using funds from new participants to pay earlier investors rather than generating legitimate profits. This study aims to analyze law enforcement against perpetrators of Ponzi schemes, particularly the legal implications for upline actors and the legal protection available for victims. The research employs a normative juridical method using statutory and case study approaches, with legal materials derived from legislation, legal literature, and related references. The findings indicate that Indonesia does not yet have specific regulations governing Ponzi scheme practices. Nevertheless, perpetrators may be prosecuted under Article 378 of the Criminal Code concerning fraud, Article 103 of Law Number 8 of 1995 on Capital Markets, and Article 28 paragraph (1) of Law Number 11 of 2008 on Electronic Information and Transactions as amended by Law Number 19 of 2016. Therefore, stronger and more specific regulations are needed to provide legal certainty and better protection for victims.

Abstract

This study examines unfair business competition between modern retail stores and traditional markets in Palangka Raya City due to non-compliance with minimum distance regulations under Regional Regulation No. 17 of 2014. Using an empirical, and regulatory analysis. The results show that the rapid expansion of modern retail outlets often violates zoning requirements, causing financial losses and business closures among traditional traders, alongside weak local government supervision. Consistent regulatory enforcement is required to ensure fairness and sustainable local economic development.
