Abstract

The existence of Dayak customary law in Central Kalimantan plays an important role in resolving customary land disputes. Recognition of customary institutions and the authority of the Damang (Customary Chief) is affirmed in Central Kalimantan Provincial Regulation Number 16 of 2008. In practice, customary land disputes in Kurun District are often resolved through customary legal mechanisms without proceeding to formal courts. This study aims to analyze the position and authority of the Damang in enforcing Dayak customary law and the process of resolving customary land disputes based on the regulation, with a case study of Damang Decree Number 02/DKA/KK/I/2026. This research employs a legal research method with an empirical juridical approach using statutory and case approaches. Data were collected through literature review and interviews with the Damang Customary Chief, Mantir Adat (customary officials), and the disputing parties, and were analyzed qualitatively. The results indicate that the Damang holds a recognized customary authority with normative legitimacy to enforce customary law and resolve customary land disputes. The dispute resolution process involves complaint submission, examination, customary deliberation, site inspection of the disputed land, and the issuance of a Damang Decree accepted by the disputing parties without further litigation in formal courts.

Abstract

The rapid development of financial technology has contributed to the emergence of various digital investment platforms, some of which are misused to conduct illegal activities such as Ponzi schemes. A Ponzi scheme is a fraudulent investment model that promises unusually high returns within a short period by using funds from new participants to pay earlier investors rather than generating legitimate profits. This study aims to analyze law enforcement against perpetrators of Ponzi schemes, particularly the legal implications for upline actors and the legal protection available for victims. The research employs a normative juridical method using statutory and case study approaches, with legal materials derived from legislation, legal literature, and related references. The findings indicate that Indonesia does not yet have specific regulations governing Ponzi scheme practices. Nevertheless, perpetrators may be prosecuted under Article 378 of the Criminal Code concerning fraud, Article 103 of Law Number 8 of 1995 on Capital Markets, and Article 28 paragraph (1) of Law Number 11 of 2008 on Electronic Information and Transactions as amended by Law Number 19 of 2016. Therefore, stronger and more specific regulations are needed to provide legal certainty and better protection for victims.

Abstract

This research examines the implementation of Article 378 of the Indonesian Criminal Code (KUHP) in handling cases of fraud in adulterated rice trading in Palangka Raya City using an empirical juridical research method. The study aims to analyze the application of criminal fraud provisions to adulterated rice trading practices and to identify the obstacles faced by law enforcement authorities in its implementation. The empirical juridical method is employed by combining a normative approach to Article 378 of the Criminal Code with field research through the collection of case data that occurred in Palangka Raya. The research findings indicate that, normatively, Article 378 of the Criminal Code is highly relevant to be applied in cases of adulterated rice, as it fulfills all elements of fraud, namely the intention to unlawfully benefit oneself, the use of deception through fake packaging and labels, and inducing consumers to hand over their money. However, empirically, implementation in Palangka Raya City faces significant obstacles, including difficulties in proving the element of intent on the part of the perpetrator, low public participation in reporting, weak inter‑agency coordination, limited resources, and an ever‑evolving modus operandi. Law enforcement authorities often prefer to use the Consumer Protection Law and the Food Law, which impose heavier sanctions. The research concludes that effective law enforcement requires the improvement of technology‑based supervision systems, strengthening coordination through special task forces, enhancing the capacity of law enforcement officers, building easily accessible reporting infrastructure, and harmonizing regulations between general criminal law and special laws in order to protect consumers from fraudulent practices in adulterated rice trading.
