Abstract

Penelitian ini bertujuan untuk mengkaji fenomena vigilantisme sebagai respons sosial terhadap lemahnya legitimasi hukum dan ketidakmampuan sistem peradilan formal dalam memberikan rasa keadilan, dengan menganalisis pada kasus kekerasan terhadap lansia di Boyolali. Penelitian ini didasarkan pada metode pendekatan kualitatif berbasis sosiologi hukum. Analisis didasarkan pada teori living law Eugen Ehrlich, teori penandaan (labelling theory) Howard Becker, dan konsep keadilan sosial John Rawls. Hasil penelitian menunjukkan bahwa tindakan vigilantisme dipicu karena hukum formal belum menjangkau kebutuhan moral masyarakat, sementara struktur sosial yang hierarkis dan pelabelan negatif terhadap kelompok rentan memperkuat ketimpangan keadilan. Fenomena ini menunjukkan krisis legitimasi hukum dan tidak ada keadilan substansial bagi kelompok rentan. Penelitian ini menekankan peran pendidikan publik dan media dalam meningkatkan kesadaran hukum dan mendorong reformasi sosial yang humanis. Untuk memulihkan kepercayaan publik terhadap hukum dan mewujudkan keadilan yang substantif, negara, media, dan masyarakat harus bekerja sama.

Abstract

Penelitian ini membahas kesenjangan antara norma hukum dan realitas sosial dalam kasus pemutusan hubungan kerja (PHK) massal di PT Danbi Internasional Garut pada awal tahun 2025. Secara normatif, Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan dan Undang-Undang No. 37 Tahun 2004 tentang Kepailitan dan PKPU telah mengatur perlindungan terhadap hak-hak pekerja. Namun, implementasi di lapangan menunjukkan ketimpangan yang signifikan antara hukum tertulis (law in the books) dan praktik nyata (law in action). Menggunakan pendekatan kualitatif deskriptif dan perspektif sosiologi hukum, penelitian ini menelaah disfungsi hukum dalam melindungi hak pekerja serta faktor-faktor penyebab kesenjangan tersebut. Hasil penelitian menunjukkan bahwa lemahnya penegakan hukum, minimnya komunikasi antara perusahaan dan pekerja, serta ketimpangan modal sosial dan ekonomi antara aktor dalam arena industri menjadi penyebab utama terjadinya ketidakselarasan antara norma hukum dan realitas sosial. Kasus ini menggambarkan kegagalan hukum dalam menjalankan fungsinya sebagai alat rekayasa sosial (law as a tool of social engineering) sebagaimana dikemukakan oleh Roscoe Pound. Dengan demikian, diperlukan peran aktif pemerintah dalam memperkuat pengawasan, penegakan hukum, serta memastikan keadilan sosial bagi pekerja terdampak.

Abstract

Fenomena main hakim sendiri merupakan bentuk tindakan sosial yang muncul akibat rendahnya kepercayaan masyarakat terhadap sistem hukum formal yang dianggap tidak mampu memberikan rasa keadilan secara efektif. Penelitian ini bertujuan untuk menganalisis akar permasalahan perilaku main hakim sendiri dalam perspektif sosiologi hukum melalui studi kasus kematian seorang pencuri ayam di Desa Rancamanggung, Subang, Jawa Barat pada April 2025. Metode penelitian yang digunakan adalah studi literatur dengan menganalisis data sekunder dari berbagai sumber ilmiah. Hasil penelitian menunjukkan bahwa tindakan main hakim sendiri disebabkan oleh beberapa faktor utama antara lain: (1) lemahnya kepercayaan publik terhadap aparat penegak hukum, (2) ketidakadilan sosial yang berkelanjutan, dan (3) kesenjangan antara norma hukum formal dengan norma sosial lokal. Kasus Subang mencerminkan kondisi anomie, yaitu kehilangan relevansi nilai-nilai norma hukum dalam struktur masyarakat. Penelitian ini menyimpulkan bahwa untuk mengatasi fenomena ini diperlukan penegakan hukum yang adil, konsisten, dan responsif terhadap kebutuhan lokal, serta penerapan restorative justice yang mengintegrasikan nilai-nilai keadilan komunal tradisional dengan prinsip hak asasi manusia modern.

Abstract

The month of Ramadan, a religious and cultural event in Indonesia, is closely linked to the tradition of buying new clothes to celebrate Eid al-Fitr. This tradition has evolved into a socio-economic phenomenon that drives increased public consumption and trade activity each year. This condition makes Tanah Abang Market one of the centers of economic activity, experiencing a significant surge in demand. The urgency of this research lies in the importance of understanding how traders are able to survive and compete amidst the high intensity of competition during the Ramadan period. Without the right strategy, traders risk losing competitiveness despite increasing market opportunities. Therefore, this study aims to analyze the sales strategies used by traders to increase consumer purchasing power and sales volume. This study uses a descriptive qualitative approach with a literature study method. Data were collected from various literature sources, such as academic books, scientific journal articles, previous research, and official publications from relevant institutions such as the Central Bureau of Statistics. The data obtained were analyzed using qualitative analysis techniques through a process of classification, interpretation, and critical analysis to identify relevant patterns and strategies. The results show that traders implement strategies such as following fashion trends, creating innovative product designs, offering discounts, and utilizing reseller networks to expand distribution. This strategy has proven to be able to increase sales, expand market reach, and strengthen consumer loyalty as well as optimize existing capital to maintain competitiveness in traditional markets.

Abstract

The economic vulnerability of fishermen in South Garut is a critical issue, influenced by unpredictable weather changes and fluctuations in market prices for their catch. These conditions directly impact fishermen's income and welfare, leading to prolonged economic uncertainty. The urgency of this research lies in the need for a deeper understanding of the factors influencing this vulnerability in order to formulate appropriate strategies to improve fishermen's economic resilience. This study aims to analyze the forms of economic vulnerability of fishermen and their causal factors in the South Garut region. The research method used is a qualitative approach with a case study method. Data were collected through in-depth interviews with fishermen, field observations, and analysis of related documents. Data analysis techniques were carried out descriptively through data reduction, data presentation, and drawing conclusions. The results show that fishermen's economic vulnerability is influenced by high dependence on natural conditions, limited access to technology and weather information, and unstable market price fluctuations. Furthermore, minimal institutional support and access to capital also exacerbate these conditions. This study recommends increasing access to weather information, strengthening fishermen's institutions, and implementing price stabilization policies to improve fishermen's welfare.

Abstract

Economic interactions within local communities often face challenges such as uncertainty and high transaction costs when relying solely on rigid formal market rationality. This research is crucial as it examines how trust functions as an essential social infrastructure to maintain economic stability and efficiency at the grassroots level. The objective of this study is to analyze the transformation of trust as social capital that drives the economic wheel of local communities in Indonesia. The research method employed is a qualitative approach using the library research method. Data were collected through a comprehensive literature search of scientific journals, books, and research reports, which were then analyzed using content and thematic analysis techniques within the framework of embeddedness theory. The results indicate that trust significantly reduces transaction costs by replacing formal contracts with norms of reciprocity and reputation, while also serving as an effective social control mechanism through social sanctions. Honesty is proven to be a rational survival strategy for MSME actors to maintain access to community resources. This study recommends strengthening social capital in economic empowerment policies and suggests further field research to measure the impact of digital disruption on trust in rural areas.

Abstract

This study examines women's involvement in home industries as part of a strategy to meet family economic needs, particularly in indigenous communities that still maintain local cultural values. This study aims to analyze the role of women in the cassava processing home industry in the Cireundeu Traditional Village, including their involvement in the production process, their contribution to the family economy, and their role in maintaining local culture. The study used a qualitative approach with a descriptive design. Data were collected through in-depth semi-structured interviews, participant observation, and purposive selection of informants. The results show that women play a dominant role in processing cassava into various marketable products, such as opak (rice crackers), chips, and kecimpring (rice crackers). This involvement not only contributes to increasing family income through diversifying economic resources but also serves as a means of empowering women through the development of business skills and experience. In addition, women play a role in the cultural sustainability of the Cireundeu community through the preservation of traditional processing techniques and cassava-based products. Thus, women occupy a strategic position as economic actors and guardians of the cultural identity of indigenous communities.

Abstract

This study aims to analyze the socioeconomic conditions of people working in the informal sector in Cipadung Village. The informal sector plays a crucial role in absorbing labor, especially those without access to formal employment. However, this sector also faces various challenges related to income instability, limited access to capital, and minimal social protection. This study employed a qualitative approach with library research, where data was drawn from various secondary sources such as books, scientific journals, and reports from official institutions such as the Central Bureau of Statistics, the International Labour Organization, and the World Bank. Data analysis was conducted through content analysis to identify patterns and relationships between relevant concepts. The results indicate that the economic conditions of people in the informal sector tend to be vulnerable, characterized by low and unstable incomes and limited access to economic resources. Socially, people in the informal sector generally have low levels of education and limited access to health and education services, despite having strong social ties within their communities. Furthermore, people's socioeconomic conditions are influenced by various factors, such as education level, access to capital, social environment, and government policies. Thus, comprehensive efforts are needed through inclusive policies and empowerment of people to improve the welfare of informal sector workers in a sustainable manner.

Abstract

This study examines the dynamics of intimate relationships among Generation Z across three stages: partner selection through online ta’aruf platforms, family negotiation in wedding planning, and post-marital interactions that may lead to household disorganization. The aim of this study is to understand how individuals make relational decisions based on rational considerations. The method used is descriptive qualitative, with data collected through semi-structured interviews with purposively selected participants. Data analysis was conducted using a thematic approach grounded in Coleman’s Rational Choice Theory. The findings indicate that the use of online ta’aruf applications encourages more rational and structured partner selection while reducing physical commodification. In the wedding planning stage, there is a flexible negotiation process between individual autonomy and family expectations, resulting in mutually perceived fair compromises. Meanwhile, in the post-marital phase, low-quality interaction and lack of emotional presence, particularly in long-distance marriages, create vulnerability to infidelity, influenced by technological opportunities and weak social control. It is concluded that household disorganization emerges as an accumulative process rooted in interactional deficits. This study recommends strengthening relational communication and premarital preparation as preventive measures.
