Abstract

The regulation of the legal position of Deputy Regional Heads in the implementation of Regional Government has undergone dynamics. Law Number 32 of 2004 has further clarified the position of Deputy Regional Heads in a more concrete manner. Especially with the election of a single pair with the Regional Head, it shows that the role of the Deputy Regional Head is becoming stronger in the implementation of Regional Government. This research uses a descriptive juridical method. The results of this study show that the regulation of the position and duties of deputy regional heads in the structure of regional government has undergone different regulatory dynamics in several laws. Their position as a local government official elected directly by the people as a running mate with the regional head strengthens their position in the structure of regional government. Although their duties are primarily to assist the regional head in the implementation of regional government, in certain situations, the deputy regional head can replace the regional head when the regional head is unable to perform their duties.

The results of this study indicate that efforts that can be made to optimize the implementation of the lawyer's function in criminal cases are as follows: Lawyers must be aware of and fulfill their primary duties and functions in providing legal assistance to the public without discrimination. Law Enforcement Officials (Police, Prosecutors, Judges) as legal enforcement partners should provide positive support to lawyers so that they can fulfill their primary duties and functions in providing legal assistance to the public without discrimination.

Abstract

This study aims to analyze the neutrality of civil servants (ASN) within the framework of bureaucratic meritocracy in regional head elections (pilkada), with a particular focus on identifying structural and institutional factors that influence violations of neutrality. This research employs a normative legal method using statutory and conceptual approaches. Legal materials are classified into primary sources, including laws and regulations governing ASN neutrality, secondary sources such as books and scholarly articles, and tertiary sources including legal dictionaries. The analysis is conducted through qualitative and interpretative techniques to examine the consistency between legal norms and their implementation in practice. The findings reveal that the persistence of neutrality violations among civil servants is not primarily caused by the absence of legal regulation, but rather by weak implementation of the merit system, ineffective bureaucratic oversight, and inconsistent law enforcement. Supervision mechanisms tend to be reactive rather than preventive, while enforcement institutions face fragmentation of authority and lack of coordination. Furthermore, the legal culture within bureaucracy still tolerates political intervention, which undermines the principle of professionalism. In conclusion, the study demonstrates that ensuring ASN neutrality requires not only adequate regulatory frameworks but also institutional strengthening, integrated supervision systems, and consistent enforcement mechanisms. These findings contribute theoretically to the development of administrative law by emphasizing the importance of institutional capacity and legal culture and practically provide policy implications for improving bureaucratic governance and safeguarding democratic integrity in Indonesia.

Abstract

Ensuring the sustainability of child protection initiatives at the village level remains a significant challenge due to weak institutionalisation and limited support from local governance structures. Although the Community-Based Integrated Child Protection programme (Perlindungan Anak Terpadu Berbasis Masyarakat or PATBM) was designed as a community-driven mechanism emphasizing prevention, public education, and early referral systems for cases of violence and exploitation against children, its implementation frequently depends on external assistance and project-based support. This article examines the institutionalisation of PATBM through Village Regulations as a legal strategy for strengthening sustainable child protection governance in villages in Bone Regency. This research conducted with socio-legal approach with a case study design, combining normative analysis of village governance and child protection regulations with empirical analysis of local institutional practices. The findings demonstrate that the adoption of four Village Regulations formally incorporating PATBM into the Village Community Institution structure has strengthened legal legitimacy, clarified institutional responsibilities, and integrated child protection into village governance mechanisms. While concerns regarding fiscal capacity emerged during the regulatory process, these challenges were addressed through activity-based budgeting arrangements that provide greater flexibility and financial accountability. The study concludes that Village Regulations constitute an effective legal governance instrument for ensuring the sustainability of community-based child protection initiatives.

Abstract

This study examines the practice of community raids against unmarried couples residing in boarding houses and rented housing, which are often justified in the name of enforcing moral norms. Although such practices are framed as efforts to maintain social order, they raise serious legal concerns when conducted without lawful authority and due process. This study aims to analyze the practice of community raids from the perspectives of criminal law and human rights and to assess whether such actions constitute taking or enforcing the law into one’s own hands, which in modern terms is commonly referred to as vigilantism. This study employs normative legal research using statutory and conceptual approaches through the examination of relevant legislation, legal doctrines, and scholarly opinions related to criminal law and human rights. The findings indicate that community raids lack legal authority, may give rise to criminal liability, and violate fundamental human rights, particularly the right to privacy and protection from arbitrary actions. The study emphasizes the necessity of clear normative boundaries on community participation in enforcing morality to ensure consistency with the rule of law and human rights protection.

Abstract

This study examines the strengthening of female legislators in the Regional People's Representative Council of South Sulawesi through a mixed empirical–normative socio-legal approach. It integrates doctrinal analysis of statutory frameworks with qualitative field data derived from interviews, document analysis, and legislative records to construct a context-sensitive empowerment model. The findings reveal that despite formal guarantees of gender equality within Indonesian legal frameworks, female legislators continue to face structural, cultural, and institutional constraints that limit their substantive participation in legislative functions. Empirical evidence highlights gaps in institutional support, unequal access to strategic political positions, and the persistence of patriarchal norms influencing legislative dynamics. The study develops a multidimensional empowerment model consisting of legal reinforcement, institutional restructuring, and capacity enhancement, which is validated through triangulation and expert evaluation. This model demonstrates the importance of aligning legal mandates with institutional practices and individual competencies to achieve gender-responsive governance. The research contributes to socio-legal scholarship by offering an empirically grounded and normatively informed framework for strengthening women’s legislative roles in decentralized political systems.

Abstract

This community service program aimed to strengthen legal awareness through the empowerment of Keluarga Sadar Hukum (KADARKUM) as a preventive strategy against free association, alcohol consumption, and drug abuse in Cumpiga Village, Awangpone District, Bone Regency. The program applied participatory, educational, and collaborative approaches through observation, coordination, legal counseling, interactive discussion, question-and-answer sessions, group formation, and evaluation. The results showed a substantial increase in participants’ legal understanding, with the average score rising from 42% in the pre-test to 88% in the post-test, representing a 46% improvement. The program also strengthened family roles in supervision, communication, early detection, and legal education related to risky adolescent behavior. The formation of KADARKUM provided a community-based forum to sustain legal education and encourage collective participation in prevention efforts. These findings indicate that integrating legal literacy, family resilience, and community participation can effectively strengthen preventive mechanisms at the grassroots level. Continued mentoring, periodic legal education, and collaboration with village authorities and relevant institutions are needed to maintain program sustainability and expand its preventive impact on adolescents and families within the wider Cumpiga community over time.
