Abstract

This study examines the concept of munakahat (Islamic family law), focusing on the legal requirements (syarat), pillars (rukun), and underlying wisdom (hikmah) of marriage in Islam. Using a normative library research approach based on the Qur’an, Hadith, and scholarly opinions, the study finds that marriage in Islam is not merely a social contract but an act of worship with legal and moral implications. The validity of marriage requires the fulfillment of key elements, including eligible spouses, a guardian (wali), two witnesses, ijab kabul, and mahr. These components ensure both the legal legitimacy of the marriage and the protection of the spouses’ rights. Furthermore, marriage aims to establish a harmonious family characterized by sakinah, mawaddah, and rahmah, contributing to social and moral stability. This study highlights the importance of integrating legal norms and philosophical values in understanding Islamic marriage, particularly in contemporary contexts. It contributes to strengthening Islamic legal literacy in the field of munakahat.

Abstract

This study aims to examine the meaning of hadith as one of the primary sources of Islamic law. The research employs a literature study design, with data collection conducted through the review of scholarly journals, reference books, and publications relevant to the theme of Islamic legal sources, particularly hadith. The main findings indicate that hadith (or sunnah) encompasses all sayings, actions, and approvals attributed to Prophet Muhammad (peace be upon him), serving as essential guidance for human well-being alongside the Qur’an. However, the development and transmission of hadith have not been as straightforward as that of the Qur’an. Various doubts and even rejections have emerged alongside the evolution of hadith studies. Skepticism toward hadith reached a peak with the emergence of groups that deny the authority of the sunnah (Inkar al-Sunnah), including certain interpretations within Shia Islam that are often viewed as deviating from the perceived authenticity of Prophetic traditions. The implications of this study highlight the importance of enhancing public understanding of hadith in everyday life, enabling Muslims to apply Islamic teachings more effectively. The originality of this research lies in its comprehensive analysis of the dynamics of acceptance and rejection of hadith, particularly through the lens of Inkar al-Sunnah and Shia Islam perspectives, which are often underexplored in mainstream discussions on the authenticity of Islamic legal sources.

Abstract

This study aims to analyze the fundamental framework of Islamic teachings, with a particular focus on the concept of Shariah and its integral role in the lives of Muslims. The research employs a qualitative library review method, drawing upon various Islamic texts and scholarly interpretations. The main findings indicate that Shariah constitutes a comprehensive set of divine laws ordained by Allah to guide human beings in their relationships with God, fellow humans, and the natural environment. A proper understanding and implementation of Shariah are essential for Muslims to live in accordance with Islamic principles. The study further highlights that inadequate understanding of Shariah may lead to moral and spiritual decline, as individuals may misinterpret or neglect its teachings. This study concludes by emphasizing the importance of integrating Shariah into daily life to ensure spiritual and moral well-being in line with Islamic values. The implications suggest that disseminating accurate knowledge of Shariah is crucial to prevent disorientation in religious and social practices among Muslims. It also underscores the need for improved educational programs on Shariah principles. The originality of this research lies in its comprehensive emphasis on Shariah as a fundamental pillar that not only governs acts of worship but also shapes all dimensions of Muslim life, including social interactions and environmental ethics, while identifying the potential negative impacts arising from its misinterpretation or lack of understanding.

Abstract

This study aims to analyze the Islamic perspective on Islamic Law, Human Rights, and Democracy. Specifically, it explores the fundamental principles within Islamic teachings that address justice, equality, and human dignity. The research employs a qualitative library study design, involving the analysis of primary religious texts such as the Qur’an and Sunnah, as well as relevant secondary literature. The main findings indicate that Islam contains principles that can be interpreted as compatible with modern human rights concepts and democratic governance. The concept of shura (consultation) and maqasid al-shariah emphasize the importance of public participation and human welfare. Fundamental rights such as the right to life, freedom of religion, and the right to justice are also explicitly recognized within Islamic tradition. However, this study also identifies areas of tension and diverse interpretations within Islamic thought regarding these concepts, particularly in their practical implementation in many Muslim-majority countries. A comparison with the Universal Declaration of Human Rights reveals significant points of convergence, despite differences in philosophical foundations. The implications of this study lie in providing a nuanced understanding of the complex relationship between Islamic Law, human rights, and democracy from an Islamic perspective, highlighting both their potential compatibility and the challenges of implementation. Such understanding is crucial for intercultural dialogue and for developing appropriate governance models in Muslim-majority societies. The originality of this research lies in its systematic effort to bridge the discourse on Islamic Law, human rights, and democracy within a unified analytical framework, offering a comprehensive perspective that not only identifies areas of alignment but also critically addresses tensions and interpretative diversity within Islamic tradition.

Abstract

This research is motivated by the rise of political violence fueled by the convergence of inflammatory political rhetoric and firearm accessibility. In the digital era, political communication has shifted from policy persuasion to an instrument of dehumanization that threatens the stability of deliberative democracy. This study aims to analyze how socio-psychological mechanisms and media ecosystems contribute to the phenomenon of contemporary political violence. The research method employed is a qualitative approach with library research. Secondary data were gathered from reputable scientific literature, policy reports, and relevant textbooks. Qualitative content analysis was conducted by integrating cognitive-neoassociation theory, totalism theory, and deliberative democracy theory to map the causality between mass communication patterns and the probability of violence. The results indicate that extreme political rhetoric creates a "siege mentality" that dehumanizes political opponents as existential threats. This phenomenon is validated as stochastic terrorism, where social media algorithms act as incubators for radicalization that trigger lone-wolf violent actions. The availability of firearms further exacerbates the situation by providing physical capability to ideologically radicalized individuals. In conclusion, the threat to democracy today is systemic, originating from the erosion of communication norms at the elite level to the manipulation of information in the digital sphere. Effective mitigation requires the construction of political "cooling structures," media algorithm regulation, and the restoration of discursive ethics to return human dignity to the political arena.
