Abstract

Article 13 of the Financial Services Authority Regulation (POJK) Number 5/POJK/03/2015 concerning Minimum Core Capital Provisions for People's Credit Banks has required all People's Credit Banks to fulfill the minimum core capital of Rp. 6 billion until the deadline ending December 31, 2024. Based on the above provisions, Bank Perkreditan Rakyat which does not have a core capital of Rp. 6 billion must find funds, including by selling its personal assets, looking for new investors and also for shareholders to sell their Bank Perkreditan Rakyat to other parties. The approach of this research is normative juridical supported by empirical juridical juridical The data used in this study are secondary data and primary data in the form of interviews. Based on the results of the research, the discussion and analysis were concluded. First, the legal consequences of the issuance of financial services authority regulations regarding the obligation to fulfill the minimum core capital for the existence of the People's Economic Bank are subject to administrative sanctions in the form of: 1) it is stated that the health level of BPR has decreased; 2) it is forbidden to open an office network; 3) it is prohibited to carry out Foreign Exchange Business Activities and electronic banking device services; 4) subject to restrictions on the area of disbursement of funds to one district that is the same as the location of the BPR office; 5) subject to remuneration restrictions or other forms equivalent to it to members of the Board of Commissioners and/or the Board of Directors of BPR, or in return to related parties, 6) revocation of BPR's operational license. Second, the obstacles faced in the implementation of the Financial Services Authority Regulation on the obligation to fulfill the minimum core capital by the People's Economic Bank are divided into two, namely: legal and non-legal constraints. Legal obstacles are 1) limited BPR business activities, 2) merger efforts (consolidation) can eliminate the historical traces of BPR Lugas Dana Mandiri, 3) takeover efforts have the potential to cause the relocation of BPR business locations, and non-legal obstacles, namely; 1) the financial ability of BPR shareholders, 2) the existence of sectoral egos in BPR merger efforts.

Abstract

The ethical responsibility of forensic doctors for the confidentiality of the results of the autopsy of the crime of murder at Bhayangkara Padang Hospital is a form of multidimensional responsibility that includes legal, ethical, social, and humanitarian aspects. In carrying out their duties, forensic doctors must maintain a balance between the obligation to assist law enforcement objectively and the protection of the dignity and privacy of victims and their families. Violations of the confidentiality of autopsy results are not only a violation of professional ethics, but also have the potential to be a violation of criminal and administrative law, which can ultimately damage the integrity of forensic institutions and public trust in the judicial system. Therefore, this responsibility must be carried out with full professional awareness, high integrity, and compliance with legal norms and noble human values. Obstacles in the implementation of the ethical responsibility of forensic doctors at Bhayangkara Padang Hospital for the confidentiality of the results of the autopsy of the crime of murder include two main dimensions, namely legal constraints and non-legal constraints. Legal obstacles include the indecisiveness of norms in Law Number 17 of 2023 concerning Health, weak structural protection for medical data, overlap between health law and criminal procedure law, and the absence of sectoral regulations that specifically regulate forensic medicine. Meanwhile, non-legal constraints include weak information security systems, low ethical literacy, social pressure on forensic doctors, lack of cross-sector training, limited support facilities, and cultural influences that sometimes do not support efforts to maintain medical confidentiality.

Abstract

Kewenangan Kepolisian melaksanakan pemeriksaan khusus sebagai bagian dari tindakan kepolisian dalam rangka pencegahan diatur dalam Pasal 15 Ayat (1) huruf f Undang-undang Nomor 2 Tahun 2002 tentang Kepolisian Republik Indonesia. Salah satunya adalah strategi pencegahan yang dilakukan oleh Unit Reserse Kriminal Polresta Padang terhadap tindak pidana penganiayaan dalam aksi tawuran. Selain merupakan perbuatan yang mengganggu Kamtibmas juga menimbulkan tindak pidana penganiayaan. Mengingat dalam aksi tawuran melibatkan anak, sehingga pencegahan jauh lebih efektif dan murah dibandingkan penanganan secara hukum. Spesifikasi penelitian bersifat deskriptif yang memberikan gambaran strategi  pencegahan terhadap tindak pidana penganiayaan dalam aksi tawuran. Metode pendekatan menggunakan pendekatan yuridis normatif didukung pendekatan yuridis empiris. Sumber data terdiri dari data sekunder yang diperoleh dari studi dokumen dan data primer diperoleh dari wawancara. Strategi Unit Reserse Kriminal Polresta Padang dalam upaya tindak pidana penganiayaan pada aksi tawuran terdiri dari: (1) sosialisasi ke sekolah-sekolah satu kali dalam sebulan. (2) mengadakan Kegiatan Rutin Yang Ditingkatkan (KRYD) yaitu patroli dan memblokir jalan pada jam malam di titik rawan terjadinya aksi tawuran sesuai Pasal 3 Ayat (2) Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 1 Tahun 2019 tentang Sistem, Manajemen dan Standar Keberhasilan Operasi Kepolisian Negara Republik Indonesia. Hambatan yuridis yang ditemui adalah menekankan diversi dan pembinaan. Hambatan non yuridis (1) belum adanya kerja sama antara kepolisian, (2) dinas pendidikan dan pemerintah daerah sehingga upaya pencegahan belum berkesinambungan, karena strategi pencegahan harus bersifat integratif, melibatkan berbagai pemangku kepentingan dengan pendekatan preemptif, preventif, dan edukatif secara berkesinambungan.
