Abstract

The promulgation of the Regional Regulation of Special Region of Yogyakarta Number 4 of 2012 on the Protection and Fulfillment of the Rights of Persons with Disabilities where one of the mandate of the Regional Regulation is with the establishment of the Fulfillment Committee and the protection of the rights of Disability of Special Region of Yogyakarta. The existence of the committee is a breakthrough and positive response from the local government to the problems of people with disabilities that occurred in Yogyakarta Special Region, one of them related to cases of violence that often occur against women with disability. So this paper would like to see the real role of the Special District Disability Committee of Yogyakarta especially in the case of legal protection for women disability victims of violence which hope not only the concrete role of the committee, as it is a newly born regional institution but also as success story on the partisanship of Regional Government Yogyakarta Specialties to Persons with Disabilities.

Abstract

Economic development is the main pillar in supporting the growth and development of a nation. The dynamics of economic development sometimes cause disputes due to business conflicts and feuds. Conventional dispute resolution is done in one place, court. Non-court settlement disputes generally use different ways of dispute resolution through courts, ie, the use of several means among others is mediation in economic disputes. This paper discusses how the role of mediation as an alternative institution of dispute resolution to support national economic development and the role of the approach mufakat. This research uses nominal juridical method with analytical descriptive approach. The results of this study indicate that the role of mediation as an alternative institution of dispute resolution is important and some are not, especially in commercial court disputes; dispute that industrial relations courts; business competition; consumer disputes, and other disputes whose hearings in the hearing are determined by the deadline for settlement in the provisions of laws and regulations, such as disputes in banking and insurance. The approach of mufakat is very important in carrying out mediation of economic dispute resolution, because consensus is a symbol of the Indonesian nation.

Abstract

This study intends to analyze the relationship between Law Number 13 of 2012 concerning the Privileges of Jogyakarta to the conditions of social and economic welfare of the Jogyakartan communities. The problem that will be analyzed is why does Act Number 13 of 2012 not yet function effectively in improving the welfare of the Jogyakartan communities. This study uses the socio-legal method. The results of this study indicate that even though the existence of Law Number 13 of 2012 received a positive response from the Jogkartan communities, it has also been implemented in a number of Jogjakarta Special Regional Regulations such as the appointment of public offices, civil service and cultural civilization, but in its failed to improve the Jogyakartan communities welfare because of the availability of factors in the local representative people considering the conflict of interest between members of the Palace families.

Abstract

Pelaku dalam pengembangan hukum pidana, tidak hanya oleh manusia sebagai subyek hukum, tapi juga dilakukan oleh korporasi. Salah satu kriteria dari tindak pidana korporasi adalah apakah korporasi mampu memutuskan suatu tindakan harus dilakukan atau tidak. Pemidanaan terhadap pelaku tindak pidana korporasi harus mempertimbangkan upaya effective deterrent. Solusi mengatasi permasalahan dalam lingkup tindak pidana korporasi antara lain, yaitu: Pertama, diadakan penelitian dan seminar lebih lanjut terkait dengan perkembangan konsep mengenai pertanggungjawaban pidana bagi korporasi yang berorientasi pada kepentingan korban. Kedua, dilakukan penelitian-penelitian tentang kejahatan korporasi guna mengenalkan masyarakat terhadap kejahatan korporasi atau meningkatkan kesadaran masyarakat dari ketidaktahuannya atas kejahatan korporasi yang disebabkan oleh kompleksnya, kecanggihan perencanaannya, pelaksanaannya, dan tidak ada atau lemahnya penegakan dan pelaksanaan hukum, dan oleh lenturnya sanksi hukum dan sanksi sosial.

Abstract

Kecelakaan akibat tubrukan kapal pompong tujuan Pelantar-Kampung Bugis dengan kapal barang KM Trisakti tujuan Tanjung Batu-Tanjung Unggat yang pernah terjadi pada Agustus 2014, telah berakibat kapal pompong tenggelam. Serta terjadinya angin puting beliung yang berakibat terhadap tenggelamnya kapal pompong tujuan Tanjungpinang-Pulau Penyengat pada Agustus 2016, telah menewaskan hampir seluruh penumpang juga menyebabkan kapal tenggelam dan hancur. Peristiwa terjadinya tubrukan kapal serta cuaca buruk tersebut merupakan risiko yang sangat mungkin dihadapi setiap saat oleh pemilik kapal pompong. Untuk mengatasi risiko tersebut, harus ada bentuk perlindungan terhadap segala risiko yang mungkin terjadi terhadap kapal Pompong sebagai aset dan sumber penghasilan bagi pemiliknya. Salah satu bentuk pengalihan risiko kerugian yang mungkin terjadi adalah dengan menggunakan mekanisme asuransi. Hasil penelitian ini bertujuan untuk menelaah tentang kapal pompong sebagai objek asuransi dan skema perlindungan asuransi yang tepat bagi kapal pompong.  Penelitian ini tergolong penelitian hukum normatif-empiris/terapan (applied normative law) dengan menggunakan data primer dan sekunder. Pendekatan masalah yang digunakan adalah pendekatan normatif analitis substansi hukum (approach of legal content analisys). Langkah-langkah yang ditempuh adalah dengan mengidentifikasi dan menginventarisasi ketentuan-ketentuan hukum normatif yang berupa bahan hukum primer dan bahan hukum sekunder berdasarkan perumusan masalah, kemudian hasil analisis diuraikan secara lengkap, rinci, jelas dan sistematis sebagai jawaban dari rumusan masaah dalam penelitian ini.

Abstract

The purpose of this paper is to express the urgency of determining the amount of time deposits by foreign mining companies in Indonesia. The application of time deposits is a manifestation of enforcement of environmental protection carried out by foreign mining companies in Indonesia. Disbursement of funds placed in partner banks that have been determined before the issuance of a Mining Business License (IUP) is based on the projected value of mining production profits as a form of environmental protection if real errors are made by foreign mining companies in relation to environmental management. This research is normative through library studies using secondary data sources, namely using primary legal materials, secondary legal materials, and tertiary legal materials. Data analysis and data validation used source criticism related to the theme of time deposits guaranteed for reclamation and post-mining by foreign mining companies in Indonesia. The results of the study indicate that the old method of determining time deposits based solely on the projected value of mining production profits, is something that is not right. This is because the amount of time deposits placed is sometimes not proportional to the level of environmental damage caused as a result of mining production. A new method is needed to determine time deposits that should be based on the level of environmental damage, both during the mining production process until the end of the company's responsibility for the former mining production area as a form of environmental protection and management. Therefore, the determination of the amount of reclamation and post-mining time deposits based on the level of environmental damage caused by the production of foreign mining companies in Indonesia is deemed necessary as a real effort to improve environmental protection and management in the mining sector in Indonesia.

Abstract

The standing of the Judiciary Commitee, thus structurally it wascreated on the same level with the Supreme Court and the Constitutional Court.Even so, the nature of the Judiciary Committee is an auxiliary to the judiciary bodies.Even if the function of the Judiciary Committee is related with Judiciary power, yet it is not the actor of the Judiciary power, but an institution to uphold the code of ethics. Aside from that, the Judiciary Committee is not involved in the organization, human resources, administration, and financial matters of the judges. This is different with the similar committees in the Europe, i.e. France. The France Council for Judiciary has the authority in the technical field as well as the policy making in the judiciary bodies. The judciary committees of the France and Europe in general has the authority in the management of the organization, budgeting, and administration of the courts, including on promotion, rotation, recruitment, and the giving of a sanction to the judges. The Supreme Court itself focuses on the trial conduct, and does not handles the administration and the organization of the court.

Abstract

The loss suffered by the insured can be processed by submitting a claim to the insurance company, so that compensation can be paid. The compensation referred to in insurance must apply the principle of Indemnity. This principle applies the principle of equilibrium, where compensation imposed by the insured may not exceed the price or the sum insured submitted prior to the loss. This principle only applies to loss insurance, not to insurance amount of money (Life insurance). The problem discussed is how to regulate the principle of Indemnity on Motor Vehicle Insurance and how to apply the principle of Indemnity to Motor Vehicle Insurance. The purpose of this paper is to determine the regulation and application of the principle of Indemnity on Motor Vehicle Insurance. The Legal Research Method used is an Empirical Jurisdiction by observing Insurance companies then analyzing the results according to existing insurance law regulations. Results and Discussion The regulation of the Indemnity Principle on Motorized Vehicle Insurance is only discussed in the Commercial Law Act, namely article 246 KUHD, Article 353 KUHD, while Law No. 40 of 2014 concerning Insurance Business Has not discussed in detail the Indemnity arrangement, so new provisions specifically discussing the Principle of Indemnity. The application of the Indemnity Principle to Motor Vehicle Insurance is set forth in the Indonesian Motor Vehicle Standard Policy. In practice the principle of indemnity has not been carried out according to the policy, so that it can cause obstacles in compensation.

Abstract

Dalam UU No. 27 Tahun 2009 Tentang MPR, DPR, DPD & DPRD (MD3) banyak kewenangan DPD yang tereduksi, sehingga DPD melakukan pengujian UU tersebut ke Mahkamah Konstitusi. Mahkamah Konstitusi melalui putusan No. 92/PUU-X/2012 mengembalikan kewenangan DPD sebagaimana yang diatur oleh UUD 1945. Namun demikian walaupun sudah ada putusan Mahkamah Konstitusi No. 92/PUU-X/2012 akan tetapi dalam UU No. 17 Tahun 2014 Tentang MD3 yang merupakan pengganti dari UU No. 27 Tahun 2009, DPR kembali melanggarnya dengan mengabaikan putusan Mahkamah Konstitusi tersebut sehingga DPD akhirnya kembali mengajukan judicial review. Kemudian Mahkamah Konstitusi mengeluarkan putusan No. 79/PUU-XII/2014 yang mengembalikan lagi kewenanangan DPD, tetapi DPR tetap mengabaikannya dengan tidak mengakomodirnya dalam Tata Tertib (Tatib). Oleh karena itu kedepan DPR dan Presiden sebagai institusi negara yang mempunyai kewenangan untuk membentuk UU agar mematuhi dan menjalankan keputusan Mahkamah Konstitusi, karena bagaimanapun putusan Mahkamah Konstitusi itu adalah sama derajatnya dengan Undang-Undang. Abstract

Kegiatan perusahaan pada hakekatnya merupakan upaya bersama antara pihak pengusaha dan pekerja yang bertujuan untuk pertumbuhan perusahaan dan juga untuk kesejahteraan para pekerja. Oleh karena itu pihak perusahaan perlu memberikan suatu imbalan yang layak kepada pekerjanya sesuai dengan peraturan perudang-undangan yang berlaku. Dan selain itu, perusahaan wajib memperhatikan segala upaya untuk peningkatan kesejahteraan para pekerja sesuai dengan kemampuan dan kemajuan perusahaan. Hubungan kerja yang baik hanya bisa dicapai apabila setiap karyawan dan perusahaan dapat memahami serta menghayati hak dan kewajiban masing-masing pihak. Dimana pada akhirnya akan menimbulkan dan menumbuhkan saling menghargai dan saling mempercayai dalam menjaga iklim kerja sama yang baik dan harmonis. Keywords: Pengupahan, Hubungan Kerja. The company's activity is essentially a joint effort between employers and workers aimed at the growth of the company and also for the welfare of the workers. Therefore, the company needs to provide a reasonable compensation to the workers in accordance with the rules and regulations that apply perudang. And besides, the company must pay attention to all efforts to improve the welfare of workers in accordance with the capabilities and progress of the company. A good working relationship can only be achieved if each employee and the company can understand and appreciate the rights and obligations of each party. Where will eventually rise to and fosters mutual respect and trust in maintaining a good working climate and harmony. Keywords: Wages, Employment.
