Abstract

The purpose of this study was to investigate and analyze: 1) the position of the deed under hand on legalization by notary and 2) Due to legal documents under the hand that has been in Legalization by Notary. Based on the wording of Article 15 paragraph (2) a and b of Law No. 2 of 2014 on the Amendment of Act No. 30 of 2004 concerning Notary, the Notary in carrying out his authority to conduct the legalization of the deed under the hand. The method used in this study is a socio-juridical. The data in this study are primary data obtained from the field by means of interviews and secondary data consists of primary legal materials, secondary legal materials as well as materials law tertiary literature. Data were then analyzed qualitatively.Based on the analysis, it can be seen that: 1). Position deed under the hand that was authorized by the Notary: when both parties recognize and explain correctly what is in deed under the hand, then the deed under the hand of a criminal offense and be perfect evidence as authentic deed. 2). The legal consequences deed under the hand which has been legalized by Notary: deed under hand on legalization by notary is not a legal effect of evidence which was perfect because they can be disputed later in court, and if the parties deny the strength of evidence in the hands of the judge's decision.Keywords: Deed Under Hand; Notary; Legalization.

Abstract

In running position, besides bound by the Law Notary, the Notary is also bound by the Notary Code, created by the organization Indonesian Notary Association (INI). Notary supervision carried out by the Minister of Law and Human Rights by establishing a Notary Supervisory Council, and the Organization of Indonesian Notary Association established the Honorary Board of the Notary. The purpose of this study is to analyze the type of Code violations that occurred in Cirebon, analyze the types of sanctions that are applied, and analyze the effectiveness of administrative sanctions were applied in establishing the Notary Code. The results showed of some types of provisions Notary Code, violations that occurred in the district of Cirebon include price competition, and the use of intermediaries in getting clients. Based on the results of this study concluded that several factors causing these violations such as contradictory rules with conditions on the ground, a notary referred to as public official, but are forbidden to promote themselves, as officials, but not paid by the State as public officials more, while the number of Notaries every year increases, there is competition between them, caused intentionally or not unethical Notary. Abstract

ABSTRAKNegara Indonesia adalah Negara Hukum yang dalam setiap interaksi masyarakat dan negara senantiasa didasarkan kepada hukum. Terciptanya kepastian hukum adalah merupakan salah satu tujuan dari negara hukum. Pengesahan atau legalisasi atas pengikatan-pengkatan hukum oleh masyarakat yang dilakukan oleh notaris juga merupakan bentuk pengukuhan untuk adanya kepastian hukum. UU No. 30 Tahun 2004 tentang Jabatan Notaris yang diubah dengan UU No. 2 Tahun 2014 tentang Perubahan UU No. 30 Tahun 2004 tentang Jabatan Notaris, telah memberikan kewenangan kepada notaris untuk melakukan pembuatan akta-akta otentik tentang pengikatan hukum di luar pertanahan. Untuk menjawab masalah yang dikaji tersebut, penulis menggunakan Penelitian ini adalah penelitian hukum normatif. Penelitian hukum adalah suatu proses untuk menemukan aturan hukum, prinsip-prinsip hukum, maupun doktrin doktrin hukum guna menjawab isu hukum yang dihadapi. Pendekatan yang digunakan di dalam penelitian ini adalah pendekatan perundang-undangan (Statute Approach), pendekatan teori (teoritical approach). Dalam penelitian ini disimpulkan bahwa notaris adalah seorang pejabat umum/pejabat negara yang diangkat dan disumpah oleh pemerintah, dengan tugas utama memberikan pelayanan dalam pengesahan/legalisasi atas pengikatan-pengiatan hukum oleh masyarakat di bidang-bidang umum dan bidang pertanahan. Tujuan akhirnya dalam rangka memberikan kepastian hukum.Kata Kunci: Kepastian Hukum, Notaris, Akta otentik, Kewenangan.ABSTRACTIndonesia is a rechtsstaat in which every interaction between people and state is always based on the laws. One of the aims of a rechtsstaat is legal certainty. Thus, the contract created by the people, which is then legalised by notary public, is in line with the effort to provide legal certainty. Laws number 30 of 2004 on Notary Public Profession, as amended by Laws number 2 of 2014 on the Amendment of Laws number 30 of 2004 on Notary Public Profession, has given a notary public to make authentic acts, except the deeds relating to land. To answer the problem under study, the authors use the method of normative legal approach, Statute Approach, and Teoritical Approach. It can be concluded that notary is a public officer who is appointed by the government to provide legal services, in example: legalisation of deeds committed by the citizens, in order to ensure the legal certainty among the people.Keywords: Legal Certainty, Notary Public, authentic deed, authority

Abstract

This study aims to find out to know the form of violations and witnesses to the notary position based on Law No. 2 of 2014 concerning the Position of Notary and the perspective of Islamic justice in viewing a notary who is indicated to have committed a crime in connection with an authentic deed he made.            This research uses normative law research or dogmatic law research using the doctrinal method. Normative legal research includes research on legal principles, research on legal systematics, research on vertical and horizontal synchronization stages, comparison of law and legal history.            This research concludes that the notary public is a public official who makes an authentic deed and has the authority as regulated in Article 15,16, 17 of Law No. 2 of 2014 concerning the Position of Notary Public. The notary is obliged to act on trust; honest; independent; objective and safeguard the interests of parties involved in legal actions. Notaries in carrying out their duties and positions if convicted of violations, may be subject to sanctions or sanctions in the form of civil, administrative, and notary code of ethics in accordance with Law of the Republic of Indonesia Number 2 of 2014 concerning Notary Positions. Even so, the Notary Position Law does not regulate criminal sanctions against Notaries. Whereas in practice there is an opportunity for a legal action or violation by a notary related to an authentic deed he made that can be qualified as a criminal offense. A notary who is indicated to have committed a crime in carrying out his authority as a Public Official, of course, must be a concern of the government and law enforcement because the law must be upheld against anyone who commits indiscriminate violations. This rule is a manifestation of the principle of "equality before the law" (equality before the law) which is a fundamental element in the concept of the rule of law. Honesty values; keep the mandate; fair; and this objective is synergistic with the values of justice in an Islamic perspective that promotes justice and problems. Described in the Qur'an An-Nisa verses 58 and 135 and QS. Al Ma'idah verse 8. Islamic law also regulates justice in recording a deed, for example just in recording accounts receivable debts (Q.S. Abstract

The purpose of writing  article is to know and the Honorary Board of Indonesian Notary Association Center for the Determination of Regulation No. 1 of 2017 on the Fairness Limit Per day Total Creation Agreement. This research methods to achieve the objectives of  law is the law of sociological or empirical research. Results of the research which set the contents of  regulation on the restriction of the notary in the agreement a day in which a number of 20 (twenty) in a day. Destinations create those rules for protecting Notary and society who use the services of a Notary, in  case the Honorary Board of Indonesian Notary Association has authority in making these regulations mandate based on the Notary Act. Abstract

The purpose of this research is to know and understand the procedures for collection of the Tax on Acquisition of Land and Building in Subang district, and to know and understand the barriers and solutions in the collection of the Tax on Acquisition of Land and Building in Subang district.Based on the analysis concluded that the taxation sector is one of the important factors for increasing state revenues. The Government has conducted several reforms in taxation or tax reform one product is Act No. 20 of 2000 regarding Amendment to Act No. 21 of 1997 on Tax on Acquisition of Land and Building (BPHTB is). One of the new provisions set out in the Act is the object of a legacy set forth in Article 2 paragraph (2) letter a number 5. Object inheritance tax is no definitive explanation in the Act so that the official who is authorized to perform counting BPHTB have different interpretations in terms of treatment fully shared with collective rights or by way of a deed to each heir. AbstrakDalam pasal 1 ayat (1) UU No 30 Tahun 2004 tentang Jabatan Notaris, Notaris  adalah pejabat umum yang berwenang untuk membuat akta otentik dan kewenangan lainnya sebagaimana dimaksud dalam undang-undang ini. Salah satu kewenangan notaris adalah membuat akta otentik, dimana hal tersebut sesuai dengan ketentuan dalam pasal 15 UU No 30 Tahun 2004 tentang Jabatan Notaris.Hal ini penulis mencoba menelaah kewenangan notaris dalam pembuatan akta otentik berkaitan dengan kontrak kerjasama.Peneitian ini menggunakan metode penelitian hukum normative, dimana pendekatan penelitian yang digunakan adalah pendekatan perundang-undangan dan pendekatan konseptual.Akta-akta yang dibuat oleh Notaris misalnya pedirian Perseroan Terbatas (PT), perubahan dan risalah umum pemegang saham, pendirian yayasan, pendirian bahan usaha-badan usaha lainnya, kuasa untuk menjual, perjanjian sewa menyewa, perjanjian jual beli, keterangan hak waris, wasiat, pendirian CV termasuk perubahannya, pengakuan utang, perjanjian kredit dan dan pemberian hak tanggungan, perjanjian kerjasama, kontrak kerja, segala bentuk perjanjian yang tidak dikecualikan kepada pejabat lain, oleh sebab itu akta yang berkaitan dengan kontrak kerjasama mutlak merupakan wewenang oleh sorang Notaris untuk membuat akta otentik tersebutKata Kunci : kewenangan notaris, akta otentik, kontrak kerjasama AbstractIn article 1 paragraph (1) of Law No 30 Year 2004 concerning Notary Public, Notary is a public official authorized to make authentic deed and other authority as referred to in this law. One of the authority of a notary is to make an authentic deed, which is in accordance with the provisions of Article 15 of Law No 30 Year 2004 regarding Notary Position.This author tries to examine the authority of notary in making authentic deed related to cooperation contract. Abstract

Basically inheritance is a movement of all the rights and obligations of a deceased person to his heirs. The notion of inheritance law is the law governing the transition of wealth which the person who died and the consequences for the heirsHeir rights arise before the opening of the inheritance in the sense that the beneficiary dies before the right to express their will in a testament / will. Heir ispeople for reasons (heredity, marriage/ Slavery) are entitled to part of the estate of the person who die.The second group includes beneficiariesThis group consists of the .People parents (father and / or mother) of the heir and brother and his descendants until the degree to 6. Abstract

ABSTRACTSocial life in everyday life often occurs between individual agreements with other individuals. The agreement between two or more individuals to perform an act to achieve a common goal is called an agreement. The covenant that is often used in everyday life is an agreement in oral form in the absence of a bond, so that if one party denies there is no legal sanction. People who want to make a written agreement can be made before a Notary. In making the agreement the parties freely express the intent and contents of the agreement before the Notary, but the problem is not all Notaries have the legal knowledge and ability enough to make the agreement in accordance with the wishes of the client. For that in the making of notarial agreement deed, there are things to note Notary, so that in making notariil deed can according to client wish without violating the rules that have been determined. The purpose of writing this journal is to know and analyze things that need to be noticed by Notary in making notarial agreement deed. The theory used is the theory of legal certainty associated with the notarization agreement deed made Notary can certainly not violate the rules that have been determined. The method used in the writing of this journal is literature method review books against books related to the theme of the journal that I created and also sourced from several journals from the internet. In making a notarial agreement deed, a notary must pay attention to matters in making the agreement, for which the Notary must use the precautionary principle in the making of Notariil agreement deed.Keywords: Agreement, Notarial Agreement, NotaryABSTRAKKehidupan bermasyarakat dalam sehari-hari sering kali terjadi kesepakatan antara individu satu dengan individu lain. Kesepakatan yang terjadi antara dua individu atau lebih untuk melakukan suatu perbuatan demi mencapai tujuan bersama disebut perjanjian. Perjanjian yang seringkali digunakan dalam kehidupan sehari-hari adalah perjanjian dalam bentuk lisan tanpa adanya suatu ikatan, sehingga jika salah satu pihak mengingkari maka tidak ada sanksi hukum. Masyarakat yang ingin membuat perjanjian secara tertulis dapat dilakukan dihadapan Notaris. Dalam pembuatan perjanjian para pihak bebas mengutarakan maksud dan isi perjanjiannya dihadapan Notaris, namun permasalahannya tidak semua Notaris memiliki pengetahuan hukum dan kemampuan yang cukup untuk membuat perjanjian yang sesuai dengan keinginan klien. Untuk itu dalam pembuatan akta perjanjian notariil, ada hal-hal yang perlu diperhatikan Notaris, agar dalam pembuatan akta notariil dapat sesuai dengan keinginan klien tanpa melanggar aturan-aturan yang telah ditetapkan. Tujuan penulisan jurnal ini adalah untuk mengetahui dan menganalisa hal-hal yang perlu diperhatikan oleh Notaris dalam membuat akta perjanjian notrariil. Teori yang digunakan adalah teori kepastian hukum yang berkaitan dengan akta perjanjian notariil yang dibuat Notaris dapat dipastikan tidak melanggar aturan-aturan yang telah ditetapkan. Metode yang digunakan dalam penulisan jurnal ini adalah metode literatur kaji pustaka terhadap buku-buku yang berhubungan dengan tema jurnal yang saya buat dan juga bersumber dari beberapa jurnal dari internet. Dalam membuat akta perjanjian notariil, notaris perlu memperhatikan hal-hal dalam membuat perjanjian, untuk itu Notaris harus menggunakan prinsip kehati-hatian dalam pembuatan akta perjanjian Notariil.Kata kunci: Perjanjian, Akta Perjanjian Notariil, Notaris
