Abstract

The research is concerning the implementation of verdict stating conditionally constitutional, conditionally unconstitutional and and the verdicts that contain new norm decided by Constitutional Court in the case of judicial review of laws againts the 1945 Constitutions of The Republic of Indonesia. This is a juridical-normative research using secondary data in the form of primary law materials, namely the court decisions which are issued throughout the year 2003 up to the year 2012 that have been collected in previous research. This research aims to know the choice of form of law taken by the addressee of the Constitutional Court verdict in following up the three variant of verdicts mentioned above. The research found that the choice of the form of law in implementing the three variants of Constitutional Court verdict is very diverse. Referring to the form and substance of the implementing rules and regulations of the three variants of verdict, there are still some incoherence with  the Constitutional Court verdict which is characterized by the presence of rejudicial review of norms that had been interpreted by the court. To address this problem,  the Constitutional Court must be provided with legal instruments, among other, judicial order that enable the Constitutional Court to order by force the addressee  to implement the Constitutional Court verdict. In addition, in order that to ensure the harmonization of legislation either vertically or horizontally as a result of the Constitutional Court verdict, then it is worth putting into consideration to expand the authority of the Constitutional Court to review all rules and legislation.

Abstract

This study attempts to elaborate the definition of the “open legal policy” concept which has stated by the Constitutional Court as the autonomy of the Law- making body whenever UUD 1945 as the constitution did not regulate particular substances of a Law that is being made. In order to prevent this autonomy leans toward arbitrariness, it is necessary to establish a model of review towards open legal policies. One feasable option that the Constitutional Court could adapt is the "maximin" strategy (selecting the best option in numbers of bad possibilities) which is developed from the rational choice approach.

Abstract

The reconsideration is an extraordinary legal remedy to the decision of Court that have legally binding (inkracht van gewisjde). The Decision of the Constitutional Court No. 34/PUU-XI/2013 stated that extraordinary legal remedy aims to obtain justice and truth material, so the provisions of Article 268 paragraph (3) Criminal Procedure Code states that, “request reconsideration of a decision can only be done once only” contrary to the 1945 Constitution and does not have binding force. The decision of Constitutional Court raises the pros and cons, on one side there are statements that reconsideration more than once is an effort to protect the rights of the public in obtaining justice, but on the other side there are statements that reconsideration is more than once is a violation of the principle of legal certainty. After analyzing the decision of the Constitutional Court No. 34/PUU-XI/2013  it could be concluded that, first, the reconsideration is more than once in accordance with the public interest to obtain justice in law enforcement, because in obtaining justice and truth material can not be limited by time. Second, the decision of the Constitutional Court are final and binding, despite raises the pros and cons, then all are required to implement the decision of the Constitutional Court. Therefore, the Supreme Court is expected to soon complete the Regulation of the Supreme Court about filing reconsideration in criminal cases by adjusting the decision of the Constitutional Court.

Abstract

This article aims to provide knowledge and understanding on the functions of the state law enforcement agencies in Indonesia. Differences of powers and functions of law enforcement agencies such as the Supreme Court, Attorney General’s Office and the Constitutional Court needs to be understood in depth. Furthermore, given the problems in all courts all over the world which is, among others, the slow settlement of cases, this article describes and analyses the role of Supreme Court Justices in resolving cassation and review cases before and after the issuance of the decree of the Chief Justice Number 119/KMA/SK/VII/2013 regarding the determination of the Day of Deliberation and Pronouncement and Number 214/KMA/SK/XII/2104 concerning Time Period for the Handling of Cases at the Supreme Court. However, when Constitutional Court pronounced Ruling Number 34/PUU-XI/2013 a problem arises in which the products of the two state judicial bodies seem to be inconsistent, especially in the framework for the resolution of criminal cases. On the one hand, the Supreme Court wants the creation of a judicial process that is simple, speedy, and low cost through the strengthening of the two products above, but on the    other hand the Constitutional Court through its award extend the time span of litigation process for the settlement of review cases which can be done repeatedly. Thus, in order to provide legal certainty, the Supreme Court issued Supreme Court Circular Number 7 Year 2014 which essentially affirms that the petition for review in criminal cases is limited only one time based on other legal basis namely Judicial Authority Act and Supreme Court Act.

Abstract

Discourse concerning state control concept on natural resources in Article 33 clause (3) of the 1945 Constitution is very dynamic. Such dynamic can be seen on      a variety of conceptions of state control rights on natural resources formulated in various acts in natural resources area. Lack of single concept on ‘state control right’ will impact to unfavorable situation where natural resources shall escape from conception of state control right and into control not by the state. The Constitutional Court as the Guardian and Interpreter of the Constitution has a significant role to ascertain that an act in natural resources area really adopt the principle of state control on natural resources in Indonesia. This article analyzes on dynamics of conception of state control on natural resources in various acts and the role of the Constitutional Court in guarding and interpreting acts in natural resources in order to be in accordance with Article 33 clause (3) of the 1945 Constitution. From the result of analysis a conclusion is achieved that there are many different concepts    of state control on natural resources in various acts in natural resources area. The Constitutional Court indeed has made interpretation on state control right. In order to make the conception stronger it is necessary to have an act in natural resources area as instruction of Article 33 clause (5) of the 1945 Constitution that further provisions of Article 33 shall be regulated by an act. Moreover, DPR (The House of Representatives) and the Government have to make certain or definite the concept of state control right in every draft bill of natural resources area so that liberalism and capitalism stream will not erode the principle of state control right.

Abstract

Judicial interpretation of the right to be free from discrimination is a central issue in the practice of judicial review of the constitutionality of legislation by the MKRI. This article tries to describe and systematize this practice and then to restate the legal principles as it is stated by the MKRI into its case law. This article finds that, as a matter of principle, the MKRI adopts two main tests i.e. strict scrutiny and rational basis test to determine whether a legislation is contrary to the principle    of non-discrimination

Abstract

This study examines the execution of the judgment against the spoils of crime  in forestry. Research using normative juridical approach and empirical jurisdiction. Execution of judgments against the state spoils of criminal offenses in the field of forestry, the injunction decision declared goods confiscated for the state not to do execution the form of an auction, because of legislation prohibiting the sale of forest products obtained from crime in protected forests. Perspective execution of court decisions to loot the proceeds of crime in the field of forestry is to judge using breakthrough progressive law, the court ruled that the injunction which reads "Evidence confiscated to the state and used for social purposes".

Abstract

Constitutional Court Decision No. 46/PUU-VIII/2010 granted the petition Machica Mochtar, who is married with Moerdiono the Islamic religion in accordance, but not recorded. If the marriage was born a boy named Mohammed Iqbal Ramadan. After the decision of the Court, the status of illegitimate children has a civil relationship with his father and his father’s family. Child outside  marriage  include  children born of the marriage legitimate religion, but not recorded, and the children born from adultery. According to Islamic law, the Constitutional Court’s decision is appropriate when applied to the child of a valid marriage according to religious but not registered. Meanwhile, when applied to children outside marriage, adultery result, the Court’s decision is contrary to Islamic law.

Abstract

Penetapan ukuran kerugian konstitusional memiliki kedudukan strategis sebagai pintu gerbang atas pengujian norma yang hendak diuji. Mahkamah Konstitusi merumuskan syarat kerugian konstitusional berdasarkan penafsiran Pasal 51 ayat (1) Undang-Undang Mahkamah Konstitusi. Doktrin kerugian konstitusional terdiri dari lima syarat yang dapat diklasifikasikan dalam dua kelompok. Kelompok pertama berisikan unsur-unsur yang harus dipenuhi pemohon terdiri dari (i) adanya hak dan/atau kewenangan konstitusional dan (ii) ada kerugian. Kelompok kedua merupakan prosedur pengujian mengenai ukuran kerugian yang diderita pemohon yang didalamnya yang terdiri dari (i) bentuk kerugian, (ii) hubungan kausalitas dan (iii) pemulihan kerugian. Kelima syarat ini bersifat kumulatif. Dalam penerapannya, doktrin kerugian konstitusional ini sangatlah dinamis. Ada kecenderungan bahwa doktrin ini menyimpan permasalahan. Tulisan ini berupaya mengidentifikasi masalah yang ada dalam penerapan doktrin kerugian konstitusional. Salah satunya adalah tumpang tindihnya antara pembuktian hak konstitusional pemohon dalam bagian kedudukan hukum dengan pengujian norma dalam pokok perkara. Sedangkan konkretisasi pembuktian unsur kerugian berkelindan dengan pengujiannya dalam kelompok doktrin kedua. Oleh karenanya, tulisan ini berkesimpulan bahwa telah ada kebutuhan untuk melakukan penyempurnaan doktrin kerugian konstitusional dengan melakukan penafsiran ulang atas Pasal 51 ayat (1) Undang-Undang Mahkamah Konstitusi dan tidak lagi mencantumkan kelompok pertama dalam doktrin kerugian konstitusional untuk pemeriksaan pengujian Undang-Undang di masa yang akan datang.The concept of constitutional injury is a substantial pre-requisite in the examination of judicial review case. The Constitutional Court drafted the concept as an interpretation of Article 51(1) of the Law on the Constitutional Court. It consists of five conditions that can be classified into two groups. The first group contains elements that must be met by the applicant which are (i) constitutional rights and/or authorities and (ii) injuries. The second group is the test in regard to the size of the injury suffered by the applicant therein consisting of (i) forms of injury, (ii) causality and (iii) redressability. The requirement is accumulative. Yet in practice the doctrine is variedly applied. There is tendency the doctrine itself causes problems. This paper seeks to identify the problems and aimed to give solution to the problem. Two problems are identified, one is an overlap examination of constitutional rights in standing and also in ratio decidendi. Another one is that the injury element in the doctrine intertwined with its own testing in the second group of the doctrine. Therefore, this paper concludes that there is a need to revise the doctrine with reinterpretation of Article 51 (1) of the Law and recommend not to exclude the first group of the doctrine.

Abstract

Dalam catatan sejarah perkembangan peradaban manusia diketahui bahwa keadilan merupakan salah satu value (nilai) yang diagung-agungkan, dicari, dan diimpikan semua orang, bukan hanya karena merupakan konsensus moralitas semua manusia yang lahir dari hati nuraninya masing-masing, melainkan keadilan memang merupakan konsep yang diturunkan dari langit. Selain itu, keadilan memang merupakan instrumen penting bagi upaya mewujudkan kedamaian dan kesejahteraan bagi semua manusia, bahkan bagi semua makhluk ciptaan-Nya. Demikianlah karakter hukum progresif yang dibangun (dikonstruk) oleh pendirinya yaitu Satjipto Rahardjo yang mengkonsepsikan bahwa “Hukum harus mengabdi kepada kepentingan manusia, bukan sebaliknya manusia yang harus menghambakan diri kepada hukum”. Namun kenyataannya, hukum telah kehilangan rohnya (value-nya) yaitu keadilan, sehingga dalam penegakannya, hukum tampil bagai raksasa yang setiap saat menerkam rasa keadilan masyarakat melalui anarkismenya yang berkedok kepastian hukum dalam bingkai positivisme yang mengkultuskan undang-undang.
