Abstract

Trade-Related Aspects of Intellectual Property Rights (TRIPs) Agree-ment interesting to be understood in the perspective of hard law and soft law. TRIPs Agreement justified as hard or soft law by identifying the norms in the TRIPs agreement. Parameter obligation of TRIPs agreement visible implementation and enforcement of agreement norm with full compliance to fourth of the IPR Convention for the State parties is an indicator of unconditional obligation. Parameters precision TRIPS agreement showed formulation of general obligation setting up the implementation of treaty obligations is regulated in detail and the use of ”shall” term in any norm, describe the imperative norm character and shown indicator as substantial limited of interpretation with the parties might not interpreted. Parameter delegation looked explicitly provision of implementation and enforcement agreement that put an obligation on national authorities of state parties through domestic law and its courts. Parameter obligation, precision as well as delegation showed as high indicator that the TRIPs agreement characterized as hard law.

Abstract

Penelitian ini bertujuan untuk mengetahui penerapan konsep ketaatan hukum dalam bingkai negara hukum (rechstaat) dan bagaimana implementasi dan implikasi prinsip kebebasan (individu) dalam negara hukum di Indonesia. Penelitian dilakukan dengan menggunakan metode penelitian normatif (doctrinal research) dengan mengggunakan pendekatan konseptual. Hasil penelitian menunjukkan bahwa pendekatan Rule of Law diperlukan untuk membuat konsep negara hukum (Rechtstaat) menjadi lebih dinamis dan mampu menghadapi dinamika perubahan yang terjadi di masyarakat, serta membuat hukum lebih otonom dari intervensi otoritas lainnya semisal politik. Implementasi kebebasan dalam konteks negara hukum masih dimaknai secara sempit dan hanya mengangap keadilan dapat terlaksana jika hukum prosedural dapat dipatuhi oleh semua warga negara. Tujuan utama dari penerapan Rule of Law adalah pembatasan kekuasaan otoritas dan pengurangan kewajiban-kewajiban warga negara, sehingga akan menghasilkan suatu ajaran ilmu hukum yang berpusat pada hak (right centered jurisprudence).

Abstract

Realita banyaknya undang-undang produksi DPR dan Presiden yang dibatalkan oleh Mahkamah Konstitusi, terjadi sebagai akibat materi muatan undang-undang tersebut yang jamak mencermikan ketidakadilan dan ketidakpastian hukum. Tingginya angka judicial review menjadi sinyal kurang terakomodasinya kepentingan dan hak-hak warga negara dalam sebuah produk perundang-undangan. Tidak adanya keharmonisan pengaturan yang dilakukan DPR itulah yang memberi dampak pada jamaknya undang-undang yang digugat. Tulisan ini mencoba mendeskripsikan beberapa perdebatan antinomi yang mewarnai eksistensi perundang-undangan di Indonesia. Hasil analisis menunjukkan, antinomi— pertentangan—norma dalam peraturan perundang-undangan adalah satu hal yang sulit terhindarkan, apalagi mengingat buruknya proses legislasi di DPR saat ini. Dalam setiap pembentukan peraturan perundang-undangan, sinkronisasi dan harmonisasi norma bukanlah satu titik tekan yang utama, melainkan terkalahkan oleh politik transaksional antarfraksi di DPR yang justru tampak lebih dominan. Namun bilamana pertentangan norma tersebut justru membentuk satu aturan hukum yang simultan, dinamis, dan memenuhi cita hukum, tentu tidak menjadi persoalan. Selama tidak menimbulkan kerugian bagi pemenuhan hakhak konstitusional (constitutional rights) warga negara.

Abstract

This article aims to determine the applicable of Islamic rules in Sharia Banking of Jayapura. The study was conducted in Jayapura City, Papua, Indonesia with purposive sampling techniques which involving over 90 respondents from two Islamic banks, Bank Muamalah Indonesia (BMI) and Bank Syariah Mandiri (BSM). The research also involved some knowledgeable informants to give rich related information. The data were analysed by using the frequency table with the descriptive analysis. Results of the research revealed that the actualization is still facing a wide range of issues. Firstly, most of the customers have not clear or deep understanding of profit-and-loss sharing system. Secondly, they also do not know what advantages they would get if they do transactions in the BMI and BMS Jayapura. Besides that, it also indicated that most of the BMI and BSM customers decided to be member of the banks because of their fanatics to their religion and they are afraid of breaking the Islamic rules.

Abstract

Numerous and consecutive aircraft accidents combined with a consistent failure to meet international safety standards in Indonesia, namely from the International Civil Aviation Organization and the European Aviation Safety Agency have proven a nightmare for the country’s aviation safety reputation. There is an urgent need for bureaucracy reform, harmonization of legislation, and especially ensuring legal enforcement, to bring Indonesian aviation safety back to world standards. The Indonesian Aviation Law of 2009 was enacted to reform the situation in Indonesia. The law has become the ground for drafting legal framework under decrees of the Minister of Transportation, which have allowed the government to perform follow-up actions such as establishing a single air navigation service provider and guaranteeing the independency of the Indonesian National Transportation Safety Committee. A comparison with Thailand is made to enrich the perspective. Finally, foreign aviation entities have a role to assist states, in this case Indonesia, in improving its aviation safety, considering the global nature of air travel.

Abstract

Nowadays, corruption is still the most and biggest problem facing by Indonesian, due to its impacts on the nation. It caused huge loss to the state finance and even to the democratic life in this country. Various efforts have been resorted to fight corruption, but the results are unfruitful. Until recently, Indonesia is still the third most corrupt country in Asia according to the survey of Transparency International Indonesia (TII) in 2015, with the Corruption Perceptions Index of 36 points. The fight in eradicating corruption cannot be separated from the effort to deter the criminals through severe punishment. However, ICW’s most recent data shows otherwise. During the first half of 2014, there were 261 accused of corruption, with 242 of them were convicted guilty by the Corruption Courts. Among them, 193 were sentenced lenient (between 1-4 years imprisonment), 44 moderate (4-10 years), and only 4 with over 10 years imprisonment. The average length of sentence is therefore 2,9 years. The lenient sentence can also be found in criminal restitution. Only in 87 of the total cases state compensation is imposed, amounting 87.04 billion rupiahs in total. The amount is only 0.022% of the total financial loss of 3.863 trillion rupiahs. The weak penalty triggered then the idea of impoverishing corruptors as a strategic step to accelerate the eradication of corruption while restoring the loss to the state. In contrast to the criminal restitution, which is restricted only to the state loss caused by the perpetrators, criminal confiscation of assets has no limit in amount.

Abstract

Recent findings have indicated that both in-country trafficking (trafficking of individuals from rural areas to relatively affluent towns and cities) and external trafficking (trafficking of individuals from a given country to foreign countries) are prevalent in Ethiopia. In 2012, the government acceded to the Protocol to Suppress and Punish Trafficking in Persons Especially Women and Children supplementing the United Nations Convention against Transnational Organized Crime (The UN Trafficking Protocol, here after). With a view to giving effect to the requirements of this instrument, the government passed in to law Proclamation No. 909/2015 (The Prevention and Suppression of Trafficking in Persons and Smuggling of Migrants Proclamation), which is the most comprehensive of all laws adopted in Ethiopia to deal with human trafficking. Taking in to account the fact that human trafficking is exacerbated by the absence of regulatory framework on the employment of Ethiopian nationals in foreign countries, the govern-ment has also brought in to practice Proclamation No. 923/2016 (Ethiopia’s Overseas Employment Proclamation). This article has examined whether the above-mentioned laws of Ethiopia comply with international standards in dealing with prevention strategies.

Abstract

The amendment of 1945 Constitution is deemed to have many weaknesses and shortcomings, especially related to the regulate institutional relationship between state institutions. There are some problem related to the obscurity of position of state institutions, the overlapping of duties, functions and authority which lead to the unrealized of checks and balances and the vulnerable for abuse of power. The direction of the arrangement of relationship between state institutions should be: First, to strengthen the implementation and purification of presidential system; Second, to clear up the position of the MPR as a joint session between DPD and DPR in an institutional relationship directed to create a strong bicameralism system; Third, the arrangement of judicial institutions should affirm the concept of MK as the court of law and MA as the court of justice. With the addition of constitutional complaint authority for MK and the authority of the previlegiatum forum for MA. While the arrangement of institutional relationship between MA and KY in supervising the judge should be developed based on the concept of share responsibility; Fourth, to make Attorney General as a constitutional organ that have the same constitutional authority and legal standing as other law enforcement agencies, namely National Police and the Courts (MA and MK). Fifth, the institutionalization of independent state commissions as constitutional organs based on the criteria of having the urgency and function of strengthening the constitutional democratic state and strengthening the mechanism of checks and balances.

Abstract

The right to freedom of religion/belief has been guaranteed by law in Indonesia, but there are still going on some violations of the right to freedom of religion/belief in the various regions. The purpose of this study was to determine the form of the legal guarantee of the right to freedom of religion/belief in Indonesia, shape inconsistencies state recognition of the right to religion/belief in Indonesia, and efforts to improve the rights of religion/belief in Indonesia. This paper uses a normative study. It was found that there are some rules that apply in Indonesia, which may hinder the implementation of the right of religion/belief, thus causing the occurrence of cases of rights violations religion/belief in some areas, should therefore rules should be immediately revoked. The conclusions of this paper are contained inconsistent state recognition of the right to religion/ belief in Indonesia.

Abstract

Berbagai cara seperti cession, prescription, discovery dalam memperoleh hak atas suatu wilayah dapat dilakukan oleh suatu negara, asal saja negara tersebut dapat menjalankan pengendalian efektif (effective occupation) atas wilayah itu. Pengendalian yang berlangsung lama, terus menerus dan damai yang disertai dengan pengakuan tidak memiliki karakter fisik semata-mata, tetapi terutama terkait dengan pelaksanaan fungsi-fungsi pemerintahan sebagai manifestasi kedaulatan teritorial, sebagaimana ditemukan melalui berbagai yurisprudensi, seperti kasus Sipadan - Ligitan. Hak Malaysia atas kedua pulau itu tidak semata-mata terkait prinsip ‘effective occupation’, tetapi juga terkait dengan sulitnya menghindari pengaruh eksternal di balik putusan Mahkamah Internasional. Argumentasi dan pertimbangan mahkamah sarat dengan alibi atau permainan kata dalam mematahkan pendirian pihak Indonesia sehingga dirasakan adanya ketidakadilan.
