Abstract

The contents of the contract are primarily determined by what the real mutually agreed upon by the parties. By interpreting some certain statements, in this case to determine its meaning, to be clear based on what the parties committed themselves. Why is the interpretation required? In facts, on the many cases provided a valuable lesson, how many commercial disputes arise when the performance of the contract. The dispute begins when the parties have a different understanding of the statement that they use in the contract. Indeed, businesses are very familiar with the business processes that they do, but at the time of the business process are set forth in the contract language and designed by those who do not understand the legal aspects of the contract, the contract can be ascertained open possibility for disputes. The power of contract binding (the contents of the agreement) toward to the characteristic and the wide spectrum of the rights and obligations contractually, basically a contract represents the power of performance among others in order implementing the rights and obligations of the parties. As an instrument to understand the contract, the method of determining the content of the contract (e.g., through interpretation, autonomous and heteronomous factors), further can be used to assess the reciprocation of rights and obligations in a meaningful and proportional contractual relationship.

Abstract

In the year 2000, most of the States in Northern Nigeria re-introduced Sharia as part of their legal system in disposing of both civil and criminal cases. Bauchi State was among the States that re-introduced Sharia as part of its legal system. Based on that, Sharia Courts were created to replace Area Courts, and Sharia Courts Civil Procedure Rules was enacted to regulate the proceedings before the said Sharia Courts on Civil Matters. The Bauchi State Sharia Courts Civil Procedure Rules, 2001 did not contain a provision on Khul’i. Prior to the amendment of Bauchi State Sharia Courts Civil Procedure Rules, Judges of Sharia Courts were in a serious dilemma as to the amount of money to be paid by a woman in order to relieve herself from the bond of marriage. This is because Khul’i is a right accorded to a wife to remove herself from the union of marriage (to get a divorce) by compensating her husband. In order to address the above problem and others, Sharia Courts Civil Procedure Rules of Bauchi State, 2001 was amended in 2013 and right of Khul’i (Redemption) was incorporated under Order 21 of the Bauchi State Civil Procedure Rules, 2013. With the amendment of the said Sharia Courts Civil Procedure Rules of Bauchi State, instead of addressing the problem of a quantum formula for Khul’i, rather brought a controversy to the said issue. Therefore, this study critically examines the Qur’anic Verses, Hadith and the opinion of the Islamic Scholars on Khul’i and compare them with Order 21 Right of Redemption (Khul’i) of Sharia Courts Civil Procedure (Amendment) Rules of Bauchi State, 2013 so as to ascertain its consistency or otherwise.

Abstract

Indonesia sejak awal telah menegaskan dirinya sebagai sebuah negara hukum. Hal itu tampak pada adanya pengaturan yang jelas terkait kekuasaan dan fungsi masingmasing lembaga negara dalam bentuk sistem checks and balances antar cabang kekuasaan, jaminan perlindungan HAM yang cukup lengkap, kejelasan prinsip-prinsip mekanisme demokrasi, serta jaminan peradilan yang independen. Meskipun konstitusi telah mengatur sedemikian rupa, upaya mewujudkan negara hukum bukanlah hal yang mudah. Sekarang ini nampak perjalanan negara hukum Indonesia terasa masih tertatih-tatih. Berbagai persoalan hukum yang mengusik rasa keadilan terus muncul silih berganti. Hasil penelitian menunjukkan bahwa lebih dari dasawarsa terakhir, Indonesia telah banyak melakukan perubahan untuk mewujudkan cita negara hukum. Namun pada praktiknya, pembangunan hukum terasa masih tetap jauh dari harapan. Keberhasilan membangun negara hukum tidak dapat diukur dari kemampuan memproduksi legislasi dan menciptakan atau merevitalisasi institusi hukum. Lebih dari itu, keberhasilan bernegara hukum harus pula diukur dari implementasi dan penegakan hukum yang mampu menciptakan keadilan bagi seluruh rakyat. Oleh karena itu, fokus utama berbagai kajian hukum dan kebijakan hukum, harus diorientasikan pada institusi peradilan dan penegakkan hukum.

Abstract

Pela-Gandong could be seen as an alliance among two or more villages in Central Maluku territory. Pela-Gandong, besides as brotherhood and friendship among them,this alliance also shared common purpose of cooperation and collective security. Conflict in the beginning of 1999 draws up public attention to the effectiveness of the principles which contains in pela-gandong alliance. Important question come forward because of the plurality condition among current Indonesian society. Should pela-gandong principles nowadays, still playing role to develope social, economy and cultural life of Maluku traditional society? The purpose of this writings is to find out the weaknesses of pela-gandong alliance(s). Based on this, it should offers some suggestion how to strengthening the principles of pela-gandong alliance into the state and the social life in Indonesia.

Abstract

The paper seeks to discuss an overview on the advanced fee fraud offences as well as cybercrime in Nigerian. The aims of the paper focus on discussing the advanced fee fraud under the related provisions of Advanced Fee Fraud Act 2006 on the success of the law in addressing the practices of crimes in relation to information technology. The paper also discusses the cybercrimes in Nigeria with a brief look out on the Cybercrime (Prohibition and Prevention) Act 2015. Further, it also aims at examining the application of the law in the fraud offences which raises an issue of the regulatory framework of the cybercrime. The methodology adopted by the paper is doctrinal approach method wherein both primary and secondary sources of data were analysed, particularly the local laws and other relevant documents. The finding of the paper reveals that the relevant section of the in the Advanced Fee Fraud Act that deals with electronic communication has not been invoked. This is because the discussed relevant law under the advanced fee fraud did not in any away deal with cases concerning electronic communication under section 13. The paper recommends that there is a need to strengthen the adequacy of the legal framework on the Cybercrimes so as to checkmate such practices in Nigeria.

Abstract

This article reviews the preparation for composing and formulating the international business contracts in facing the ASEAN Economic Community era. The study used the normative approach by collecting the materials related to the international business contracts. The outcomes of the research indicate that constitutionally, the Indonesian government must provide protection and equitable legal certainty for Indonesian citizens who intend to conduct business transactions within the framework of AEC. Format and writing techniques of international business contracts is compulsory known by the business people and their legal consultants that they do not suffer losses due to errors in the preparing of contract that violates the rules and provisions of international business contract.

Abstract

Orderly international community and international law are determined by a national court. Essentially, the national court must be competent to maintain the balance between the national interest which based on the national sovereignty as well as the provisions of international law within the framework of peaceful coexistence. This article reviews the role of national courts in creating and developing the customary international law. As it turns out in practice, however, it has certain weaknesses, particularly in view of the accountability and legitimacy aspects of its establishment. This purpose could be achieved if national courts were able to maintain a balance between the national interest based on the sovereignty of State on the one hand and the provisions of international law on the other. The function of the national court was to maintain a balance between international law and national law.

Abstract

The New Order government led by President Soeharto was supposed to be a regime that would ameliorate the abuse of power conducted by the previous government. One of the important agendas for the New Order government was overcoming the issues regarding the abuse of authority and corruption in the government sector. Several legislations, Presidential legal policies and institutions were formed to carry out such mission. However, the New Order government eventually failed and became a corrupt regime. This study concludes that notwithstanding Indonesia theoretically had an institutional framework to combat corruption under the New Order government, it failed to eradicate corruption. The failure of anti-corruption policies under the New Order era was caused by 3 forms of failure. Firstly, the failure to build a democratic and anti-corruption presidential power. Secondly, the failure to build a comprehensive anti-corruption policy. Thirdly, the failure to build an effective anti-corruption agency. The method employed in this study is a combination of several approaches between the statutory approach, historical approach and conceptual approach. The main data used in this study is the literature which are consists of previous research, legislation and Presidential policies.

Abstract

Gagasan hukum progresif merupakan konsep berhukum dengan cara menempatkan hukum sebagai instrumen dalam pencapaian tujuan-tujuan sosialnya. Gagasan ini pula menekankan adanya penemuan hukum di setiap putusan hakim sebagai upaya untuk menggali nilai-nilai yang hidup dalam masyarakat. Pemikiran hukum progresif ini telah teraplikasi pada beberapa putusan hakim di Indonesia. Salah satunya adalah pada perkara keperdataan yang dikenal dengan sebutan kasus “Pohon Mangga” yang terjadi di wilayah hukum Pengadilan Negeri Jayapura. Tujuan pada penelitian ini dimaksudkan untuk mengkaji secara yuridis normatif salah satu putusan pengadilan dalam perkara perdata yang berbasis hukum progresif. Metode penelitian yang digunakan ialah metode pendekatan normatif dengan putusan pengadilan sebagai bahan hukum primer. Hasil penelitian menunjukkan bahwa terdapat pertimbangan yuridis hakim yang berbasis hukum progresif pada putusan perkara tersebut, dimana hakim telah berhasil menyelesaikan permasalahan hukum yang termasuk kategori rumit dan abstrak. Kesimpulan pada kajian kasus ini menunjukkan bahwa setiap permasalahan hukum dapat diselesaikan tanpa harus mengenyampingkan peraturan dengan tetap berpegang teguh pada kaidah untuk mencapai rasa keadilan, kemanfaatan dan kepastian hukum sebagai ciri dari hukum yang progresif.

Abstract

This article is intended to analyze the existence of local values that have become part of local wisdom prevailing in Bajo community. Type of research is legal anthropology, using interviews and focus group discussion. The results showed that the Bajo Gorontalo society, there are the local values associated with the management of fish resources in the sea. Local values mean that has been implemented since long time ago, and until this day the local values still remains valid. For the people of Bajo the values meant being a model society, thus forming a community adherence behavior in managing and treating fisheries resources in the sea, so that it becomes part of the public legal awareness. Therefore, it is important to identify the values that are still applicable and to make it as a basis for the development of laws related to fisheries, which is expected to be developed, as the expectations set forth in the legislation.
