Abstract

Natural resource management is an important thing that should be done by the community for survival. Consciously of many ways in the management of natural resources has resulted in environmental damage, coupled with government policies that give permission without good supervision to entrepreneurs or private individuals in natural resource management adds a long list of environmental damage. In the last three decades, governments tend to ignore the phenomenon of legal pluralism in the legal development policy, preparation of legal instruments, as well as the implementation of the law through political neglect of the fact legal pluralism. So the product of legislation, especially those that set natural resource management, normatively ignore and displace the rights of indigenous peoples and local over control, management, and utilization of natural resources. Moreover, with deprivation of the rights of indigenous peoples’ customary rights and the implementation of development without taking into consideration the pattern of spatial planning, more and enlarge the conflict between the government and society.

Abstract

The rapidly growing business traffic either nationally or internationally forces the business practices to establish a standard agreement to secure the products and to protect the buyer from any risks. The standard agreement successfully meets the demand of international trade which urgently need the high speed and the accuracy. The objective of this research is to find out how does the development of agreement affect to the commerce practices and what are the requirements of standard agreement in accordance with the right and obligation. A qualitative method is applied in searching data of business practices. This study uses a normative research which guides the rule of law or determines some business standards and norms. The finding of this study show that the development of agreement strongly affects to the commerce practices, and standar agreement is urgently needed by business practices as a guideline to perform business traffic as smooth as buyer and seller expect, then both seller and buyer should know the three alternative way used as the procedures of standard agreement, namely; contract signing, notification document agreement, and notification by bulletin board. At last, a standard agreement could be accepted as legal agreement corresponding to willingness and trustworthy.

Abstract

In the modern era, Bilateral Investment Treaties (BITs) are relatively effective to attract more foreign direct investment (FDI). Many countries then eagerly concluded BITs, including Indonesia. Considering the adverse impact of FDI on the environment, most countries then start putting the environmental concern in their BITs, assisting them to prevent and mitigate any adverse impact of FDI on the environment. Indonesia, however, did not follow this measure. This paper then shows the lack of the current Indonesia’s BITs in putting the environmental concern in their provisions. The fact that Indonesia has terminated some BITs becomes a right momentum to start putting the environmental concern in the updated and modified Indonesia BITs in the future. From other countries’ practices, there is evidence to suggest that BITs can and do contain provisions aimed at ameliorating environmental damage caused as a result of FDI within host countries’ territories.

Abstract

In relation to the positive law, the management of marine and coastal natural resources, there is also the rule of customary law. Customary law that still lives and develops in indigenous peoples also regulates the management system and utilization of natural resources in coastal and marine areas. Recognition of the rights of indigenous peoples is constitutionally contained in the 1945 Constitution of the State of the Republic of Indonesia where the state recognizes the existence of the Customary Law Community. In Maluku, marine potency management in general is still done traditionally known as marine customary rights that have been going on for generations but not yet fully recognized either by the government or entrepreneurs who are actually important partners in the development process.

Abstract

Hakim dalam mengambil putusan dibebankan kewajiban oleh undang-undang untuk memuat pasal tertentu dari peraturan perundang-undangan yang bersangkutan sebagai dasar untuk mengadili. Paradigma hukum yang berkembang menunjukkan adanya harapan agar pengadilan, khususnya hakim, tidak hanya mampu memberikan keadilan prosedural semata berdasarkan teks perundang-undangan, akan tetapi lebih utama adalah keadilan substantif. Keadilan substantif bukan berarti hakim harus selalu mengabaikan bunyi undang-undang, melainkan dengan keadilan substantif berarti hakim bisa mengabaikan undang-undang yang tidak memberi rasa keadilan, tetapi tetap berpedoman pada formal undang-undang yang sudah memberi rasa keadilan sekaligus menjamin kepastian hukum. Faktor-faktor yang berpengaruh terhadap penerapan paradigma hukum bagi hakim dalam memutus perkara adalah faktor pendidikan hakim, lingkungan peradilan (spirit of the corp), pengawasan eksternal, dan integritas hakim.

Abstract

Labelisasi halal tidak sekedar sarana pemenuhan kebutuhan lahiriah, tetapi sekaligus kebutuhan spiritual. Kehalalan dan keharaman makanan biasanya mudah diketahui bila dalam keadaan segar. Tetapi jika setelah mengalami proses pengolahan, maka akan sulit menentukan kehalalannya. Tujuan penulisan ini adalah untuk mengetahui aspek perlindungan hukum bagi konsumen untuk secara nyaman dapat melakukan transaksi terhadap produk makanan yang dikehendaki, untuk mengetahui Kewenangan MUI sebagai pihak yang berwenang dan memiliki otoritas mengeluarkan fatwa di Indonesia terkait kehalalan dan keharaman produk pangan; dan untuk mengetahui sejauhmana pengawasan yang dilakukan oleh Pemerintah, LPKSM, dan masyarakat sebagai pihak yang berperan penting dalam melakukan pengawasan terhadap produk atau barang yang beredar di pasaran. Hasil penelitian ini menunjukkan bahwa masih lemahnya perlindungan hukum bagi konsumen, tidak maksimalnya pengawasan yang dilakukan oleh pemerintah, LPKSM, dan masyarakat. Selain itu hadirnya UU JPH No. 33 Tahun 2014 masih menuai polemik salah satunya terkait monopoli kewenangan oleh MUI.

Abstract

Land acquisition for public interest development is stipulated in Act No. 2 of 2012 concerning Land Acquisition for Development of Public Interest. One arrangement of land acquisition in legal substances that have been formed are small-scale land acquisition (less than 5 hectares), but it is still governed by very vague and thus susceptible to the multi-interpretation and raises doubts in its implementation. This paper discusses the problematic that arise due to unclear regulations concerning small-scale land acquisition and to provide solutions to these problems. Based on the discussion the authors concluded first, the problematic of small-scale land acquisition is the arrangement of land acquisition that is so vague that there is no clarity regarding the procedures for determining of location, the phase of land acquisition, which excludes public consultation, there is no regulation regarding preventive measures against the impact for the community around location of land acquisition. Second, the solution could be found to this problem is a regulation of small-scale land acquisition should ideally be regulated more comprehensively considering that small-scale land acquisition allows the emergence of adverse effects for the community around location of land acquisition so that the stages of planning and preparation that is set for the large-scale land acquisition is similarly applied for small-scale.

Abstract

The provision of the Law Number 40 of 2007 concerning Limited Company on Corporate Social Responsibility has changed the nature of such responsibility from voluntary into mandatory. Similarly, it strengthened welfare state (verzorgings staat) concept as commanded by Article 33 (3) and (4) of the 1945 Constitution of the Republic of Indonesia. Denaturing of this Corporate Social Responsibility is progressively assured by the Decision of Indonesian Constitutional Court, so that responsibility must be performed as legal responsibility or mandatory.

Abstract

This research aims to form an effective supervision model of a standard clause to protect consumer’s rights and interests. This study answers the questions the effectiveness of a standard clause supervision carried out by Otoritas Jasa Keuangan [Financial Services Authority (OJK)] and Badan Penyelesaian Sengketa Konsumen [Consumer Dispute Settlement Agency (BPSK)]; effective supervision model of a standard clause which can protect the rights and interest of the consumer. The object of this study are OJK and BPSK as a supervision of a standard clause. The result of this research shows that the supervision of standard clause done by those institutions has not been effective yet, this caused by several factors to wit the weakness of implementing regulation in terms of supervision, unclear supervision mechanism, the weakness of socialization related to the rules of standard clause towards business actors, and other weakness and obstacles faced by both institutions. The effective supervision model of standard clause is being formed that based on five points, namely: (1) the needs of institution/agency reformation who authorize to do supervision of standard clause; (2) the needs to determine the scope of duty and authority of standard clause supervision institution; (3) the needs of determination of material range about standard clause subjected to supervision which comprises: the content, the form, the position and the expression; (4) the needs of precise mechanism of standard clause supervision conducted by supervision institution; (5) the needs of following up the supervision results, especially to the business actors who break the standard clause rules.

Abstract

In order to ensure the suffrage of citizens is implemented according to the principle of fair election, regulations on general and local elections may contain various kinds of restriction of suffrage. The rights to vote as well as be voted must be restricted in a way that the process of election may run seamlessly and generate a government capable of exercising the mandate of the people. However, such restriction must be performed in a fair and proportionate manner. The restriction must not cause uncertainty or even distinction of treatment towards the citizens. By means of normative legal research, this research comes to a conclusion that restriction of suffrage in general and local elections have yet been performed fairly. Legal uncertainty in the restriction of suffrage still occurs. Simultaneously, different treatment towards citizens who intend to nominate themselves is still contained in the norms related to the requirements to vote and be voted.
