Abstract

Seluruh Satuan Kerja di bidang kesehatan baik pusat maupun daerah dan FKTP atau FKRTL dalam pengadaan obat baik untuk program JKN maupun program kesehatan lainnya tidak perlu melakukan proses pelelangan, namun dapat langsung memanfaatkan Katalog Elektronik (e-Catalogue) obat dengan prosedur Pengadaan Secara Elektronik (e-Purchasing).  Pengadaan Obat BPJS Secara Elektronik (e-Purchasing) merupakan merupakan tata cara pembelian obat BPJS sesudah sistem Katalog Elektronik (e-Catalogue) Obat tersedia. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan (statue approach) dan pendekatan komparatif (comparative approach). Puskesmas sebagai UPT-SKPD termasuk pengguna barang/jasa yang menggunakan APBD dan/atau APBN sebagai bagian dari unsur penyelenggara Pemerintah Daerah (D), sehingga keberadaan Puskesmas tidak berbeda dengan Rumah Sakit Pemerintah Daerah maka model Pengadaan Obat BPJS secara Elektronik (e-Purchasing) di Rumah Sakit dapat diaplikasikan juga di Puskesmas dengan membentuk perangkat organisasi Pengadaan Barang/Jasa untuk menyederhanakan alur sistem Pengadaan Obat BPJS secara Elektronik (e-Purchasing) di Puskesmas.Kata kunci : analisis hukum, pengadaan obat BPJS, e-purchasing

Abstract

Perjanjian kredit dengan dalam pengikatan obyek jaminan berupa surat kuasa jual dapat menimbulkan masalah hukum di kemudian hari bagi kreditor. Namun di sisi lain hal tersebut masih terjadi di masyarakat dengan anggapan sebagai wujud salah satu bentuk kebebasan berkontrak. Penulis dalam penelitian ini ingin menelaah dan menganalisa lebih lanjut tentang kedudukan hukum kuasa jual yang ditanda tangani oleh debitor kepada kreditor bersamaan dengan perjanjian kredit dan bentuk perlindungan hukum bagi kreditor dalam pengikatan obyek jaminan berupa surat kuasa jual saat debitor Wanprestasi Metode penelitian yang digunakan adalah penelitian hukum normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau bahan hukum sekunder sedangkan pendekatan masalah dilaku kan dengan menggunakan pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian menunjukkan kuasa jual yang ditandatangani oleh debitor kepada kreditor bersamaan dengan perjanjian kredit berakibat batal demi hukum. Perlindungan hukum kepada kreditor tetap ada meskipun surat kuasa menjual menjadi tidak sah atau batal demi hukum karena pada prinsipnya segala harta kekayaan debitor akan menjadi jaminan umum bagi perutangannya dengan semua kreditor.

Abstract

Health is need of every human being in living his/her life. Health is also crucial because without good health, it will be difficult for every human being to carry out his/her daily activities. Entering an era of rapid development, the world is faced with the emergence of new technologies in the medical field that allow doctors to practice in a virtual space. To analyze the legal basis of online medical services as well as to analyze the legal liability of doctors in providing online medical services if a patient experiences loss. Until now, there have been no detailed regulations regarding online-based medical services, both in statutory provisions and in the provisions of the medical code of ethics. Law Number 36 of 2009 concerning Health and Law Number 29 of 2004 concerning Medical Practice so far have not been used as a reference for the administration of medical practice using online-based medical services. Furthermore, Law Number 11 of 2008 concerning Electronic Information and Transactions also cannot be used as a reference.

Abstract

Abstract

This study aims to provide insights on the Constitutional Court Decision Number 97 / PUU / XIV / 2016 on filling-in the space for religion or belief in the Identity Card (KTP) has maslahah value for the community. This can be declared true after an analysis of the objectives and their enforcement in Indonesia has been carried out. Maslahah values are manifested by the certainty of the beliefs contained in the KTP. So that in socializing, the people may know for sure one’s religion or belief to guarantee or minimize the occurrence of interfaith and belief marriages. This study uses a normative method with a statutory and conceptual approach. The results of the study conclude that the Constitutional Court's decision has maslahah principles in Islamic thought as it provides recognition of rights, recognition of access to rights to public services, public services on marriage registration as a form of certainty, is an order in the Marriage Law, legal certainty creates rights and obligations for spouses, marriage registration creates protection, the state is obliged to provide protection for its citizens

Abstract

The significance of contract is to secure a fair transaction of rights and obligations of the party to the contract, by which it creates a safely properly and beneficially contractual relation. Under no circumstances is the contract made to harm one or both of the parties. Despite fair formation, due to breach of contract or force majeure the contract is not performed as supposed to be. The stipulation of force majeur clause, in some cases, are not accomodative to the business activity because the dispute settlement is usually put in the court. Therefore, there is a new way to apply hardship doctrine which in the perspective of business is seen more flexible and accomodative to solve the dispute. The hardship characteristic, as mention above, is appropriate to the business character which needs both dynamic activity and the business continuity among parties. The implementation of hardship doctrine is a "win-win solution" model which benefits both parties.

Abstract

Penelitian mengenai akibat hukum pembatalan akta kelahiran terhadap anak bertujuan untuk mengetahui akibat hukum yang berpengaruh terhadap anak, serta meninjau dari penetapan dan putusan hakim di pengadilan yang berperan dalam tindakan hukum pembatalan akta kelahiran. Penelitian ini menggunakan metode penelitian hukum, karena dalam menghadapi isu hukum maka perlu proses untuk menemukan aturan-aturan hukum, prinsip-prinsip hukum, serta doktrin hukum yang berkaitan dengan isu hukum tersebut. Dalam penelitian tipe yuridis normatif, digunakan metode deduktif yang berawal dari hal yang bersifat umum lalu diterapkan pada rumusan masalah dan dapat menghasilkan jawaban yang bersifat khusus dan sah. Berdasarkan hasil penelitian, dari berbagai aturan hukum, doktrin serta putusan dan penetapan pengadilan, bahwa pembatalan akta kelahiran membawa akibat hukum yang cukup besar bagi anak. Hal ini berakibat pada status dan kedudukan anak, di mana dalam beberapa contoh penetapan dan putusan pengadilan yang menghasilkan akibat hukum dari anak sah menjadi anak luar kawin maupun anak luar kawin menjadi anak sah. Selain itu, hubungan antara anak dan orangtua yang terhubung dengan hak alimentasi tidak akan terputus selama terdapat bukti-bukti hubungan darah antara orangtua dan anak.Research on the legal consequences of the annulment of birth certificates against children aims to know the effect of law affecting the child, as well as review of the determination and judgment in court that acts in legal action cancellation of birth certificate. This research uses legal research methods, because in dealing with legal issues then it is necessary to find the legal rules, legal principles, and legal doctrines relating to these legal issues. In normative juridical type research, a deductive method is used which begins with a general nature and then applies to the problem formulation and can produce a specific and legitimate answer. Based on the results of research, from the various rules of law, doctrine and judgment and the determination of the court, that the cancellation of the birth certificate carries considerable legal consequences for the child. This has resulted in the status and position of the child, in which in some instances the determination and judgment of the court resulting in legal consequences of a lawful child being a child outside of marriage and an outsider becomes a legal child. In addition, the relationship between children and parents connected with alimentation rights will not be interrupted as long as there is evidence of a blood relationship between parent and child.

Abstract

The development of information technology might control the pattern of people’s behavior in digital era. The presence of internet as the main platform for online activities, including electronic transactions, was now increasingly attracting the interest of Indonesian people although it was vulnerable to be hacked by irresponsible parties as a cyber-attack. One cyber-attack targets individual’s personal data. This study, therefore, took some issues related to that matter. First, it discussed the regulation of personal data protection in Indonesia applied in recent days, and second, it proposed an appropriate law to regulate such issue in the future.This study was a normative research with statute and case approaches. The result showed that, first, the existing regulation for personal data protection was less effective as it was still scattered in some sectorial setting, and thus, the system of appropriate regulation under a comprehensive law was considerably important. Second, the disharmony of regulatory legislation in regulating people personal data protection needed to be solved through a specific regulation which particularly regulated on personal data protection.

Abstract

The objective of this article is to argue that the issue of equal and unequal position of the parties is irrelevant to commercial contract. The essence of commercial contract that ponders business relationship without interruption does not deal with the issue of mathematical equality; rather it emphasizes on proportional exchange of interests of the parties irrespective of result obtained by the parties. There are three important things in this paper found. First, the principle of proportionality is applied in the entire phases of contract, i.e. in negotiation, formation, and enforcement phases. Second, the principle of proportionality is not perceived from mathematical equality perspective but it is viewed from fair exchange process and proportionate result, which is acceptable by both parties. Third, the principle of proportionality is a doctrine of "fair contract", which improves the doctrine of freedom of contract that may lead to unfairness. It is recommended in this dissertation that jurists, currently be not regard the doctrine of freedom of contract sacred; rather they shall find other philosophical basis to develop "fair contract" procedurally as well as substantively.
