Abstract

ABSTRACTThe dualism of national land law appears before the formation of the agrarian law through the Basic Agrarian Law (BAL), has not been fully terminated. Various opportunities or legal vacuum still encountered, especially in relation to the provision of rights to land based on adat law. Pekulen land derived from adat law with communal characteristics/ joint ownership and land tenure in rotation, in fact is still exist in rural Java. Its posision became an important element in the village agrarian structure has the potential to make agrarian justice through policies at the local level.INTISARIDualisme hukum tanah nasional yang muncul sebelum terbentuknya hukum agraria melalui UUPA, belum sepenuhnya dapat diakhiri. Berbagai peluang atau kekosongan hukum masih ditemui terutama dalam kaitannya pengaturan hak atas tanah yang berdasar pada hukum adat. Tanah pekulen yang bersumber dari hukum adat dengan karakteristik komunal/ pemilikan bersama serta penguasaannya secara bergilir, pada kenyataannya masih ada di wilayah pedesaan di Jawa. Kedudukannya menjadi unsur penting dalam struktur agraria desa karena berpotensi menjadi sarana pencipta keadilan agraria melalui kebijakan di tingkat lokal.

Abstract

ABSTRACT Brahmin women marriage to men of different castes in Bali is called intermarriage in terms of customary law, commonly is called asupundung. Punishments for such marriages still exist among people, especially patiwangi ceremonies and other social punishments. This study is conducted based on that issue. The research problems are how do punishmentsof Brahmin women marriage to men of different castes apply? How are marriage punishments in the perspective of Hindu values? The method used is empirical legal research using primary and secondary data which then are analyzed using legal theory, principles and teachings of Hinduism in qualitative descriptive and finally arguments are provided. Punishments for this marriage include: killed by jumping into the fire, drowned in a sea with a stone tied around legs, isolated, downgrading, not allowed to go home, refined language. These punishments in Hindu perspective are contrary to the teachings of Tri Hita Karana, Tri Kaya Parisudha, Vasudaiva, Kutumbakam, Tat WamAsi, Manusapada, Ardhanareswari, Akhroda, Ahimsa.

Abstract

ABSTRACTIt’s way before the decree of prostitution and pornography enforced in Indonesia, the Dalihan na Tolu customs had their own regulation in preventing prostitution phenomenon. Dalihan na Tolu consist of 3 elements as it is understood as three poles in traditional burning-stove which cooperating to each other, this is also applied to prostitution prevention. In every prevention of these prostitution practices, they lean on the philosophy of :”Somba mar Mora, Elek mar Anak Boru, Manat-manat mar Kahanggi”. Dalihan na Tolu custom has a principles that one cannot speak careless words or act in imprudent behaviour in front of the public.INTISARIJauh sebelum lahirnya undang-undang tentang prostitusi dan pornografi di Indonesia, ternyata masyarakat adat Dalihan na Tolu telah memiliki aturan tersendiri dalam melakukan pencegahan tindak prostitusi. Masyarakat adat Dalihan na Tolu terdiri dari 3 unsur layaknya seperti tiga tungku yang saling bekerjasama dalam berbagai hal, termasuk dalam pencegahan tindak prostitusi. Dalam setiap pencegahan praktek prostitusi, mereka berpatokan pada filosofi:”Somba mar Mora, Elek mar Anak Boru, Manat-manat mar Kahanggi”. Masyarakat adat Dalihan na Tolu menganut prinsip bahwa seseorang tidak akan sembarangan bicara, apalagi bertindak sembrono di hadapan orang lain, karena masing-masing mengerti tentang hubungan kekerabatan satu dengan lainnya.

Abstract

AbstractRelationship problems Judicial Commission and the Supreme Court re-strained due to the addition of authority in the appointment of judges first instance courts. It is set in the third package of legislation, namely Law No. 49 of 2009, Law No. 50 of 2009 and Law No. 51 of 2009. The three laws are carried out judicial review to the Constitutional Court by Decision No. 43/ PUU-XIII/ 2015. The Constitutional Court stated that the expansion of the authority of the Judicial Commission against the constitution and interfere with the independence of judges as an independent institution. The purpose of this paper is to examine the decision is linked to the independence of judges and the impact of such decision to the authority of the Judicial Commission.IntisariDilematika hubungan Komisi Yudisial dan Mahkamah Agung kembali renggang akibat adanya penambahan wewenang dalam pengangkatan hakim peradilan tingkat pertama. Hal tersebut diatur dalam ketiga paket undang-undang yaitu Undang-Undang Nomor 49 Tahun 2009, Undang-Undang Nomor 50 Tahun 2009, dan Undang-Undang Nomor 51 Tahun 2009. Ketiga undang-undang tersebut dilakukan yudicial review ke Mahkamah Konstitusi dengan Putusan Nomor 43/PUU-XIII/2015. Mahkamah Konstitusi menyatakan bahwa perluasan wewenang Komisi Yudisial bertentangan dengan konstitusi dan mengganggu independensi hakim sebagai lembaga mandiri. Tujuan penulisan ini adalah untuk mengkaji putusan tersebut dikaitkan dengan independensi hakim serta dampak dari putusan tersebut terhadap wewenang Komisi Yudisial.

Abstract

AbstractMigrant workers are often discriminated against in almost every aspect of life. Discrimination against them is due to irrational dislike of them and also negative perception towards them. It is alleged that migrant workers contribute to the crimes hike in Malaysia. Using doctrinal research methodology, this article discusses direct and perceptive discrimination against them. This article concludes that physical discriminations are mostly happened because ineffective enforcement of the law, abuse of powers and human-trafficking problem. Besides, migrant workers have not being major contributor to crime hike. Malaysia should introduce comprehensive migration law and strengthen the monitoring of recruitment agencies.

Abstract

AbstractIndonesia is a country with a majority Muslim population is responsible for the comfort and certainty to consume halal products. Halal assurance of any product in Indonesia has been delegated by the State to LPOM MUI. In a further development based on Law No. 33 2014 On Halal Product Guarantee, that the authority for the implementation of halal certification in Indonesia is conducted by BPJPH. The purpose of this research is to determine and analyze the arrangement of the halal certification management organization in Indonesia associated with the Act No. 33 of 2014 On Halal Product Guarantee and to determine and analyze how should halal certification management organization modelsby BPJPH. The results of this study, the first in the halal certification management organization held by BPJPH, but the Act of JPH provide 3 years for the establishment of BPJPH in accordance with the Act of JPH, as a  result until now the halal certification management organization is still held by LPPOM MUI, which both models of BPJH in the management of halal certification under the Act of JPH still involve collaboration with other agencies and institutions.IntisariIndonesia merupakan negara yang mayoritas penduduknya beragama Islam bertanggung jawab terhadap kenyamanan dan kepastian untuk mengkonsumsi produk yang halal. Jaminan atas kehalalan setiap produk yang ada di Indonesia selama ini di delegasikan oleh Negara kepada LPOM MUI. Dalam perkembangan selanjutnya berdasarkan UU No. 33 Tahun 2014 Tentang Jaminan Produk Halal, bahwa kewenangan untuk penyelenggaraan sertifikasi halal di Indonesia dilaksanakan oleh BPJPH. Tujuan dilakukannya penelitian ini untuk mengetahui dan menganalisis pengaturan kelembagaan penyelenggaraan  sertifikasi halal di Indonesia  dikaitkan dengan UU No. 33 Tahun 2014 Tentang Jaminan Produk Halal dan untuk mengetahui dan menganalisis bagaimakah sebaiknya model kelembagaan penyelenggaran sertifikasi halal oleh BPJPH. Hasil dari penelitian ini, yang pertama dalam penyelenggaraan kelembagaan sertifikasi halal dipegang oleh BPJPH, namun UU JPH memberikan waktu 3 tahun untuk berdirinya BPJPH yang sesuai dengan UU JPH, sehingga sampai saat ini kelembagaan penyelenggaraan sertifikasi halal masih dipegang oleh LPPOM MUI, yang kedua model BPJH dalam penyelenggaraan sertifikasi halal berdasarkan UU JPH  tetap melibatkan kerjasama dengan instansi dan lembaga terkait.

Abstract

AbstractThis research aims to examine the positions of international law and the applicable principles regarding the issues of fulfillment of international obligations under ratified/acceded international agreements by Indonesia. Upon assessment, this research concludes that: Firstly, there are two main obligations that should be fulfilled by Indonesia in an international agreement and treaties, which is legal obligation and moral obligation. Secondly, practices shown that Indonesia’s commitments in fulfilling its international obligation are still not optimal, as a solution, it is recommended that future ratification of international agreement should include additional executorial / performance provision either in the form of Law or Presidential Regulation.IntisariPenelitian ini bertujuan untuk mengetahui bagaimana ketentuan hukum internasional mengatur persoalan kewajiban hukum negara terhadap pemenuhan perjanjian internasional yang telah diratifikasi/diaksesi dan untuk mengetahui bagaimana praktik yang Indonesia terkait pemenuhan kewajiban tersebut. Hasil pembahasan menunjukkan bahwa: Pertama, bahwa terdapat 2 kewajiban yang harus dilakukan oleh setiap negara pihak terkait dengan pemenuhan Perjanjian Internasional yakni kewajiban hukum dan kewajiban moral. Kedua, bahwa praktik pelaksanaan kewajiban pemenuhan Perjanjian Internasional di Indonesia masih kurang optimal dan sebagai solusinya dapat ditambahkan beberapa penegasan untuk pemenuhan berbagai kewajiban tersebut dalam bentuk penambahan klausula dalam produk pengesahan perjanjian internasional baik yang berupa Undang­Undang Ratifikasi maupun Peraturan Presiden.

Abstract

AbstractJohn Austin has been widely criticized and supported in equal measure for his bold assertion that international law is not ‘real law’ due to the lack of a ‘sovereign’. This article explores Austin’s position and analyzes it as against its veracity in relation to current legal systems; modern contemporary international law; and analysis of legal questions in the international arena. While indeed Austin’s position was true about the legal systems of his time, the same cannot be transposed into the international legal system. If on the other hand the transposition is necessary, it will be shown that international law is indeed ‘real law’ with a somewhat real ‘sovereign’ just like any municipal law

Abstract

Abstract In the mid of free trade era, both in domestic and international level, consumer protection issues has become more relevan to be examined. One of the important aspect in the field of consumer protection that should be strengthened is consumer’s acces to justice. The complexity of global trade marked by unfair commercial practices have often negative impacts for consumer; consumer rights often be ignored and violated by business people. Therefore government must be able to ensure the existence of consumer’s access to justice through the rule making, policy, and the new legal institutionalization in order to create fair business climate. IntisariDi era perdagangan bebas seperti sekarang ini, isu perlindungan konsumen makin penting dan relevan baik dalam konteks perdagangan di tingkat domestik maupun internasional. Salah satu aspek yang masih harus ditingkatkan di bidang perlindungan konsumen ialah akses keadilan konsumen, sebab pertumbuhan perniagaan yang makin kompleks jangan sampai hanya memposisikan konsumen sebagai obyek kepentingan bisnis semata. Oleh karena itu, Negara harus dapat menjamin terciptanya akses keadilan konsumen baik melalui regulasi, kebijakan, maupun kelembagaan hukum baru agar tercipta iklim perniagaan yang berkeadilan. Di samping itu melalui peningkatan akses keadilan konsumen diharapkan dapat menumbuhkan kesadaran konsumen akan hak-haknya.

Abstract

AbstractRegulation on CSR under laws and regulations of Company Act have not given clarity and legal certainty as it does not stipulate sanction and control mechanism. In the practical level, the implementation of CSR is often mistargeted because the company does not have a clear guidance to fulfill people’s demand. It is the purpose of this research to understand how far CSR is obligatory towards Limited Liability Companies who perform business in the field of and or related to natural resources as well as to understand the reason behind mandatory CSR in Indonesia. IntisariPeraturan mengenai Tanggung Jawab Sosial dan Lingkungan yang diatur dalam peraturan perundang-undangan mengenai Undang-undang Perseroan Terbatas belum memberikan kejelasan dan kepastian hukum karena tidak adanya sanksi dan mekanisme pengawasan. Dalam ranah praktis, penerapan TJSL seringkali kurang tepat sasaran karena Perseroan Terbatas tidak memiliki panduan yang jelas untuk memenuhi permintaan masyarakat. Penelitian ini ditujukan untuk memahami sejauh mana kewajiban TJSL terhadap Perseroan Terbatas yang melakukan usaha di bidang atau terkait dengan sumber daya alam, sekaligus untuk memahami alasan di balik kewajiban TJSL di Indonesia.
