Abstract

The Criminal Procedure Code regulates Police Investigators as the main investigators and investigators of civil servants in coordination umbrella with Police Investigators. The development of laws outside the Criminal Code and Criminal Procedure Code regulates several Investigative Institutions (Police Investigators, Civil Service Investigators, Prosecutor Investigators, Corruption Eradication Commission Investigators, National Narcotics Agency Investigators, and Investigators of Financial Services Authorities). Differences in top management, as well as differences in authority and work in investigations, have led to conflicts between the Investigating Institutions, which have an effect on the achievement of the objectives of the integrated criminal justice system. In reality, the Investigative Institution consists of Police Investigators, Civil Service Investigators, Prosecutor Investigators, Corruption Eradication Commission Investigators, National Narcotics Agency Investigators, and Investigators of Financial Services Authorities. Each investigator has different top officials (Chief of Police, Attorney General, Minister of Law and Human Rights, Commander of the Indonesian National Army, Chairman of the Corruption Eradication Commission and Chairman of the National Narcotics Agency) and has different authority and conduct in conducting Investigations. Reconstruction of authority among the Investigating Institutions, conducted with Interpretation and Dialogue together which gave rise to new construction Pancasila Investigation Legal System.

Abstract

Abstract Indigenous leaders play a role in fostering and controlling the attitudes and behavior of the society to conform with the provisions of customs, as well as during conflicts or disputes caused by the separation of the village. Village formation is formed on the initiative of the society by taking into account the origin of the village and the socio-cultural conditions of the local society. This study aims to find out how the role of customary figure in formation in Ukui, Pelalawan District. Discusses the boundaries of the territory in charge of organizing and managing the interests of the local society based on local origins and customs that are recognized and respected in the governance system and the non-involvement of the Batin within in the expansion area,whether in asking for views or in asking for opinions as persons know about ulayat lands and village boundaries.Abstrak Tokoh adat berperan dalam membina dan mengendalikan sikap dan tingkah laku warga masyarakat agar sesuai dengan ketentuan adat termasuk juga disaat terjadi konflik atau perselisihan yang disebabkan pemekaran desa. Pembentukan Desa dibentuk atas prakarsa masyarakat dengan memperhatikan asal-usul desa dan kondisi sosial budaya masyarakat setempat. Penelitian ini bertujuan untuk mengetahui bagaimana Peran Tokoh Adat dalam Pembentukan Di Kecamatan Ukui Kabupaten Pelalawan. Membahas batas wilayah yang berwenang untuk mengatur dan mengurus kepentingan masyarakat setempat berdasarkan asal usul dan adat istiadat setempat yang diakui dan dihormati dalam sistem pemerintahan dan tidak dilibatkannya para Batin yang ada didalam Wilayah Pemekaran tersebut, baik dalam meminta pandangan ataupun dalam meminta pendapat sebagai orang yang tahu tentang tanah ulayat dan batas wilayah desa.

Abstract

Abstract This study aimed to analyze the Protection of Consumer Law Against Execution of Fiduciary Who Have Bad Debt at the Institute for financing, to find agreement financing between consumers and institutions already reflect the legal protection of the consumer, to know how the execution of fiduciary who has bad credit on the institution financing the consumer. The research method that I use is Observational Researc by means of surveys, plumb This research is descriptive analytic data source in this study are primary data, secondary data and data tertiary. The results of the study are described to provide protection and legal certainty financing company that does the consumer financing for motor vehicles with the imposition of fiduciary security, mandatory for financing companies to register a fiduciary, in practice many financing companies registering fiduciary under hand. Process execution must be taken by filing a Civil Lawsuit and the determination of the execution or application to the District Court through the process of civil procedure until a court decision is legally binding. There are also consumers who can not pay it off so that the object of fiduciary withdrawal by the financing institution. Abstrak Penelitian ini bertujuan untuk menganalisis Perlindungan Hukum Konsumen Terhadap Eksekusi Jaminan Fidusia yang Mengalami Kredit Macet pada Lembaga Pembiyaan, untuk mengetahui perjanjian pembiyaan antara konsumen dengan lembaga pembiyaaan sudah mencerminkan perlindungan hukum terhadap konsumen, untuk mengetahui bagaimana eksekusi jaminan fidusia yang mengalami kredit macet pada lembaga pembiyaan konsumen. Metode penelitian yang penulis gunakan adalah Observational Research dengan cara survey, sifat penelitian ini merupakan penelitian deskriftif analistis di dalam penelitian ini sumber datanya adalah data primer, data sekunder dan data tertier. Hasil penelitian adalah dijelaskan untuk memberikan perlindungan dan kepastian hukum perusahaan pembiyaan yang melakukan pembiyaan konsumen untuk kendaraan bermotor dengan pembebanan jaminan secara fidusia, wajib bagi perusaahan pembiyaan untuk mendaftarkan jaminan fidusia, pada prakteknya banyak sekali perusahaan pembiyaan melakukan pendaftaran fidusia dibawah tangan. Proses eksekusi harus dilakukan dengan cara mengajukan Gugatan Perdata dan ataupun Permohonan penetapan eksekusi ke Pengadilan Negeri melalui proses hukum acara perdata hingga putusan pengadilan berkekuatan hukum tetap. Dan hal itu memerlukan waktu yang lama, faktanya ada dari beberapa di antara konsumen memang benar-benar melakukan pembayaran sampai dengan lunas, namun ada juga konsumen yang tidak bisa melunasinya sehingga dilakukan penarikan objek jaminan fidusia oleh lembaga pembiayaan.

Abstract

Homelessness and Domestic Violence perpetrated by society are also seen as unlawful acts therefore for the perpetrators will be subject to strict sanctions. The police are trying to overcome by mediating the settlement of the case with a peaceful path but although peace is done on the normal offense the process is still carried out until it is terminated in court only that peace can be recommended as a matter of judicial consideration in deciding the case. Penal Mediation began to flourish especially after the issuance of Chief of Police Chief of Police Chief No Pol: Vol.I/No.5/Oktober-December/2013 B/3022/XII/2009/SDEOPS dated December 14, 2009, on Case Handling Through Alternative Dispute Resolution (ADR). The partial nature and the principles of penal mediation referred to in this Chief of Police emphasize that the settlement of criminal cases using the ADR, must be agreed by the litigants, but if no new agreement is settled in accordance with the applicable legal procedures professionally and proportionately.

Abstract

Abstract In the implementation of the tender offer to be achieved the main goal is to provide equal opportunities for all bidders, resulting in the most affordable price with output/output optimal and effective manner. Through the mechanism of the tender offer as far as possible avoided the opportunity to perform a conspiracy between competitors, or between bidders with the auction organizers. In Article 3 of Presidential Decree No. 80 of 2003 regulating the Guidelines for Procurement of Government Goods/Services that in order to procure good/services shall be applied on various principles, among others Efficient, Effective, open and competitive, Transparent, Fair/non-discriminatory, and Accountable. Atmosphere of healthy competition should be created, and this atmosphere should begin to appear in the tendering process, a competitive tender procedure, open and not limited to providing opportunities for possible for participants who desire/interest in following the activities of procurement/tender.AbstrakDalam pelaksanaan penawaran tender tujuan utama yang ingin dicapai adalah memberikan kesempatan yang seimbang bagi semua penawar, sehingga menghasilkan harga yang paling murah dengan output/keluaran yang optimal dan berhasil guna. Melalui mekanisme penawaran tender sedapat mungkin dihindarkan kesempatan untuk melakukan konspirasi di antara para pesaing, atau antara penawar dengan panitia penyelenggara lelang. Dalam Pasal 3 Keppres No. 80 Tahun 2003 yang mengatur tentang Pedoman Pelaksanaan Pengadaan Barang/Jasa Pemerintah bahwa dalam rangka pengadaan barang/jasa wajib diterapkan berbagai prinsip, antara lain Efisiensi, Efektif, Terbuka dan bersaing, Transparan, Adil/tidak diskriminatif, serta Akuntabel. Suasana bersaing secara sehat harus diciptakan, dan suasana seperti ini harus mulai nampak dalam proses tender, prosedur tender yang kompetitif, terbuka dan tidak terbatas untuk memberikan peluang sebesar mungkin bagi para peserta yang berkeinginan/berminat mengikuti kegiatan pengadaan/tender.

Abstract

The system of social stratification in marriage customs provisions in latently Muna society can generate conflicts between social layers that require completion. This study aims at how the role of traditional leaders as mediators to resolve conflicts in the process of marriage in Muna society in Sulawesi southeast. This research was conducted in Muna Regency, which is in Lawa and Wadaga sub-districts. This type of research, namely the juridical sociological research. Sampling was done by purposive sampling. Data were obtained through interviews and documentation study. The data were analyzed ie qualitatively and presented descriptively. The results showed that the Indigenous Leaders to function as a mediator, facilitator, negotiator, and arbitrator. Practice Indigenous Leaders generally use this together approach, especially in the private and public conflict resolution. Settlement reached by the parties in conflict is the settlement amicably by mediation in order to seek the best solution, it is necessary for the role of Indigenous Leaders acting as mediators with the consideration that they are people who know in depth about the philosophy of Muna customary law, has the authority, charisma, honored, respected, and obeyed his words.

Abstract

The concept of law is the idea of the law which is used as the basis of a legal state to mobilize its laws. The concept of law is important because almost all countries use the law as a basis for mobilizing, bring order and prosperity of the country. There are two legal concepts, namely the concept of legal positivism and materialism. Both the concept of this law provides a very significant effect in most countries in the world. The concept of legal positivism emphasizes that the law should be freed from all the elements so that the law is an autonomous authority. The concept of law of materialism agitates that the law must be present in the upper structure and the basic structure. The law is present in the upper structure because the law emerges from ideology. The law is present in the basic structure because the law functions to regulate and simplify the production processes.

Abstract

One of the regions in Riau province that still applies customary law in resolving criminal cases is Tanjung Alai Kecamatan XIII Koto Kampar village which involves the role of ninik mamak as a mediator. The purpose of this research is to find out what crimes are resolved through customary law ( reasoning mediation) and how the process of resolving criminal acts trough the mechanism of customary law in the people of Tanjung Alai Kecamatan XIII Koto Kampar village. The results of this study  are expected to provide a solution for law enforcement officers in overcoming the large number of cases that cannot be resolved by the criminal justice subsystem and the problem of over capacity of existing prisons throughout Indonesia

Abstract

Penelitian ini bertujuan untuk mengetahui dan memahami tentang kewenangan Badan Pengawas Pemilihan Umum yang dapat bertindak sebagai lembaga Adjudikator terhadap terjadinya pelanggaran administrasi pemilu serta kewenangan dikeluarkanya putusan  Badan Pengawas Pemilihan Umum dalam sistem hukum administrasi di Indonesia serta untuk mengetahui dan menganalisa peraturan Perundang-Undangan baik Undang-Undang Pemilu maupun Undang-Undang tentang Peradilan Tata Usaha Negara. Hasil penelitian menujukkan bahwa : Pertama, Badan Pengawas Pemilihan Umum dalam kedudukanya dalam peradilan administrasi pemilu diberikan kewenangan sebagai lembaga yang dapat memberikan putusan terhadap terjadinya pelanggaran administrasi pemilu. Dalam hal ini Badan Pengawas Pemilihan Umum dalam memberikan putusan dapat dilakukan melalui proses Adjudikasi. Kedua,  putusan Adjudikasi Badan Pengawas Pemilihan Umum dianggap masih memiliki kelemahan kekuatan hukum dalam sistem peradilan administrasi karena putusan tersebut sekalipun memiliki kewenangan untuk diajukan banding akan tetapi banding yang diajukan olek lembaga Komisi Pemilihan Umum diajukan ke Peradilan tingkat pertama yakni, Peradilan Tata Usaha Negara. Semestinya banding banding yang diajukan oleh Komisi Pemilihan Umum secara normatif berdasarkan Undang-Undang Nomor 48 Tahun 2009 tentang Kekuasaan Kehakiman diajukan ke Peradilan Tinggi Tata Usaha Negara. Kata Kunci : Badan Pengawas Pemilihan Umum, Peradilan Administrasi,                      Pemilihan Umum

RAMLI SURYONO, NIM: 1410245821, Law Enforcement and Legal Proof of Crime of Forest and Land Burning in Bukit Kerikil Village Bengkalis Riau, supervised by Firdaus and Erdianto.There are findings that become problems in the law enforcement of forest and land fires in Bukit Kerikil Village, Bukit Batu Sub-district, Bengkalis Regency, among others are people's awareness of lack of land clearance, arrears of Police Report mostly is about forest and land fire not exist witnesses who saw the burning so that the case was difficult to advance, the people caught were only those who were at the wrong place and time, as well as proof of forest and land fires cost a lot to ask for expert information. Before the proof is implemented, it takes a lot of money to do water bombing.The type of this research is sociological law research. Judging from its nature, this research is descriptive, that is describe clearly and detail about law enforcement and legal proof of crime of forest and land burning in Bukit Kerikil Village of Bengkalis Riau.Law enforcement on the crime of forest and land burning in Bukit Kerikil Village Bengkalis Riau has not been implemented properly although the legal proof of the crime is not essentially difficult. This is influenced by the difficulty of determining the status of land ownership on fire, the difficulties in the absence of witnesses, enormous enforcement costs, the distance to the location of land burned very far and the difficulty of access by land. There are no obstacles in law enforcement on the crime of forest and land burning in Bukit Kerikil Village Bengkalis Riau in terms of legislation and law enforcement apparatus. Factors that affect or become obstacles in law enforcement are facilities or facilities that support law enforcement, community factors and cultural factors. While the main obstacle in legal proof of the crime of burning forest and land in Bukit Kerikil Village Bengkalis Riau is the minimal cost to conduct investigation and investigation, especially in requesting expert information. The solution to overcome obstacles in law enforcement and legal proof of forest and land burning crimes in Bukit Kerikil Village Bengkalis Riau is the enhancement of facilities or facilities that support law enforcement, increase public awareness of law and eliminate cultures that harm the environment. The main solution in legal proof of the crime of forest and land burning in Bukit Kerikil Village Bengkalis Riau is the increase of investigation and investigation costs, especially in the case of requesting expert information.
