ANTROPOLOGI INDONESIA was published to develop and enrich scientific discussion for scholars who put interest on socio-cultural issues in Indonesia. These journals apply peer-reviewed process in selecting high quality article. Editors welcome theoretical or research based article submission. Author’s argument doesn’t need to be in line with editors. The criteria of the submitted article covers the following types of article: first, the article presents the results of an ethnographic/qualitative research in certain topic and is related with ethnic/social groups in Indonesia; second, the article is an elaborated discussion of applied and collaborative research with strong engagement between the author and the collaborator’s subject in implementing intervention program or any other development initiative that put emphasizes on social, political, and cultural issues; third, a theoretical writing that elaborates social and cultural theory linked with the theoretical discourse of anthropology, especially in Indonesia anthropology; last, the article is a critical review of anthropological reference and other ethnography books that must be published at least in the last 3 years.

Abstract

This paper is an ethnographic study to understand the prison’s culture in the correctional institutions “X”. The writer has examined carefully the way of living day by day directly and raised a variety of mutual agreements among the residents behind the prison walls. The results in the investigation field shows the limit and deprivation that appears as an interpretation actor, not the institution, that occur according certain contexts. Abstract

Among the Minangkabau people who practice a matrilineal kinship system, occurs a change in mens's social role, i.e. from a role as an "uncle" (mamak) to a "father" or "husband". This change is caused by various factors, such as religion, education, migration (merantau), and economics. Further, it leads to another change in the Minangkabau's common law, i.e. in the marriage and heredity properties. A problem, however, still exists in the kinship law. The author raises a question whether a change in men's role may influence the Minangkabau's perspective towards the matrilineal kinship system as a basis for their kinship law.

Abstract

This article generally describes the development of legal anthropological studies in Indonesia in the last 20-year period. First, this article proposes some notes concerning a number of papers written by scholars of this discipline as well as writers from other disciplines who are interested in legal anthropology. Second, this article describes teaching of legal anthropology in various universities in Indonesia, and the problems faced by lecturers of this field. Third, the writer provides information on all kinds of research in legal anthropology carried out the Indonesia researchers, and the problems that occurred in the studies and researches on legal anthropology in Indonesia. At the end, the writer specifically focus on important of researches, publication of writings on legal anthropology, and the trainings for legal anthropologist, e.g. through cooperation between Indonesia and foreign universities as a way to stimulate and encourage the development of legal anthropology in Indonesia.

Abstract

Subak di Bali merupakan suatu organisasi sosial masyarakat yang biasanya dikaitkan dengan norma-norma dan sistem pengetahuan orang Bali. Dalam melihat organisasi tersebut untuk dikaji dalam kajian Antropologi Hukum, hal yang harus dilakukan oleh peneliti adalah menentukan dalam konteks apa suatu institusi semacam itu dilihat. Pentingnya menentukan konteks permasalahan secara cepat bertujuan untuk menghindari penjelasan yang terlalu panjang lebar tentang keterkaitan antara sub-sub sistem dalam kebudayaan itu sendiri.

Abstract

Keamanan sosial merupakan satu bidang yang kini banyak menjadi perhatian ahli antropologi hukum. Dalam artikel ini, penulis menyajikan hasil penelitiannya tentang studi perbandingan pada sistem-sistem keamanan nasional dari penduduk Maluku Tengah yang memiliki latar belakang kebudayaan dan agama yang sama, tetapi yang bermukim di dua Negara yang berbeda: Indonesia dan Belanda. Keamanan sosial mengacu pada mekanisme yang menjamin diperolehnya kesempatan untuk hidup yang layak, baik bagi orang-orang dewasa yang sehat dalam satu komuniti maupun bagi mereka yang tidak dapat menyajikan hal itu untuk dirinya sendiri. Dalam artikel ini penulis menunjukkan bagaimana bentuk-bentuk keamanan sosial dalam komuniti yang berbeda terwujud karena pengaruh kondisi sosial dan ekonomi yang berbeda pula.

Abstract

In describing the development of legal anthropology as a new subdiscipline in anthropology, the author firstly clarifies the differences between legal anthropology and the common law science. Although the description of law had been found in ethnographic literatures since two centuries ago, a particular analysis on law emerged in 1920s as the result of debates between Malinowski and R. Brown on the mechanism of social control in stateless societies. Problems of whether law exists in the state or stateless societies stimulated the anthropologists to define the boundaries and scopes of "law", such as L. Pospisil's definition. The development of studies, analysis, and interpretation on law systems in various societies lead to the emergence of legal anthropology as a subdiscipline in anthropology.

Abstract

One of the characteristic of legal anthropology, according to the author, is the refusal law in its formal and absolute form. The Vollenhoven's thesis on the importance of studying law as it is rooted in the Indonesian society and culture can be regarded as the emergence of legal anthropology in Indonesia. Nevertheless, studies on law from anthropological viewpoint have just been intensified since 1970s. In describing the history of law and the position of legal anthropology in the legal history, the author reveals the main contribution of ideas from some law scientist. One among the ideas is the importance of analyzing the contents of law in recent context without precluding its historical dimension. The analysis on the history of law should constitute explanation on how events emerge and develop so as to provide better understanding on various rules, concept, and institutions of law at recent times. The legal anthropology provides us with such understanding on how certain laws emerge, develop, and change, since it analyzes law in its very "natural" context or as the manifestation of socio-cultural aspects of a society.

Abstract

Konsep mengenai tanah di kota juga mencakup tanah disekitar kota tersebut. Tanah di desa umumnya berkaitan erat dengan tanah pertanian dan tanah adat, tetapi tanah di kota biasanya menunjuk pada suatu keterpaduan dan yang terutama adalah tanah sebagai tempat untuk mendirikan bangunan baik bangunan untuk tempat tinggal maupun bangunan untuk kegunaan lainnya. Pemilikan tanah di desa berhubungan erat dengan suatu pewarisan dari nenek moyang dari suatu klen. Pemilikan tanah di kota terutama diperoleh karena pembelian. Pemilikan tanah di desa diatur dengan akte Lurah dan di kota dengan akte Notaris. Keduanya secara hokum diangkat sebagai Pejabat Pembuat Akte Tanah.

Abstract

Pela adalah salah satu hukum adat di Indonesia, tepatnya hukum adat yang ada di Kepulauan Maluku yang berlaku pada orang-orang Maluku. Ada dua peneliti yang telah mengadakan penyelidikan secara mendalam tentang pela ini, yaitu C. Cooley dan D. Bartels. Cooley mengemukakan bahwa pela adalah suatu ikatan yang dilembagakan mengenai persahabatan atau persaudaraan antara semua penduduk pribumi dari dua desa atau lebih, yang dibentuk oleh nenek moyang menurut keadaan tertentu dan membawa kewajiban-kewajiban tertentu untuk semua pihak yang terkait didalamnya. Kewajiban ini penting dalam definisi ini mengenai eksogami desa. Bartel meninjau pola ini dari sisi sosialnya.[...] Aplikasi dari hukum adat pela dalam masalah perkawinan (intermarriage taboo) menimbulkan persoalan di antara para generasi muda Maluku di Negeri Belanda. Hal ini selanjutnya mengakibatkan konflik antara generasi tua dengan generasi muda. Di Negeri Belanda sendiri terdapat pluralisme hukum, ialah hukum yang resmi dan hukum yang kurang resmi yang berlaku diantara berbagai subgolongan yang ada. Salah satu subgolongan yang menerapkan hukum demikian adalah golongan pendatang Maluku di Negeri Belanda yang menerapkan adat pela dalam kelompok masyarakat mereka sendiri.
