Misykat Al Anwar Jurnal Kajian Islam dan Masyarakat is a nationally accredited peer-reviewed scientific journal published by the Faculty of Islamic Studies University of Muhammadiyah Jakarta. Abstract

The fiqh rule regarding intention is the basic rule that is agreed upon as the first order. The formula is al-umūr bi maqāsidihā (the law of each case depends on its purpose/purpose/intention). The contents explain the purpose or intention as the basis for the assessment. This well-established rule has sufficient strength to become an argument for a fatwa for the permissibility of Muslims wishing Christians a Merry Christmas. This qualitative research takes data from literatures. The first step in content analysis in this research is mapping the arguments including fiqh principles what are involved in reasoning the fatwas about saying 'Merry Christmas' as a Christian holiday. Furthermore, the research will analize the results of the mapping based on the intention rule.

Abstract

Bulughul Maram Min Adilatil Ahkam is a book compiled by Ibn Hajar Al-Asqalani (773 H - 852 H). This book is a thematic hadith book that contains traditions that are used as sources for taking fiqh law (istinbath) by fiqh experts, because almost all of the hadiths are related to fiqh law. However, the last part of the book Bulughul Maram is a collection of hadiths about adab and morals called Kitabul Jami '. The aims of this study are: (1) to determine the values of moral education contained in the book Bulughul Maram, (2) to determine the relevance of the values of moral education in the book Bulughul Maram with Character Education. The research method used by the author is a type of document analysis research through library research, by collecting data or materials related to the theme of the discussion and its problems, which are taken from library sources, then analyzed by content analysis methods. This analysis examines the values of moral education from the contents of the book Bulughul Maram. To support this research, the author uses the main data source, namely, the book of Hadith Bulughul Maram by Imam Ibn Hajar Al-Asqalani and a secondary source in the form of syarah from the book. Based on the results of this study, the author categorizes the hadiths of morality in the book Bulughul Maram into three parts, namely: morality to Allah Ta'ala, morality to oneself, and morality to family. Then the author concludes that in the book there are hadiths that contain the values of moral education whose relevance can improve character education which is only based on human norms. Because having character is thinking, having wills, and behaving according to their nature (conscience) to continue to serve Allah, they are not only human beings with good character but also have noble character.

Abstract

The World Halal Food Council (WHFC) harmonized halal standards and enacted the Job Creation Law with BPJPH, which is in charge of halal registration, certification, and verification, and there is still public understanding that there is no need for halal certification. Research objective: knowing halal perceptions and certification, research method: a descriptive-analytic study. Research results: The survey involved 48 WhatsApp groups with 3,240 members. There were 104 respondents. Four of the 48 WhatsApp groups were business WhatsApp groups, with 225 members. All respondents understood the halal concept, and those who did not understand doubted 21.2%. Of the respondents who understood the term halal certification, 88.5% and 98.1% stated the need for halal labeling. As many as 73.1% of respondents understand that BPJPH and MUI accommodate halal certification, 72.1% of respondents understand that BPJPH manages the administration of halal certification, and 99% of respondents know that halal fatwas are carried out by MUI. Only 30.8% of respondents know that the government facilitates free halal certification. Conclusion: some respondents still do not understand the term syubhat; most are familiar with halal certification, but only a few know about the government's free facilitation of halal certification.

Abstract

Substantially, religious proselytizing can be divided into two agents. They are agent of social service and agent of social change. As the agent of social service, religious proselytizing tries to fix the system of human live in Islamic through the process of amar ma’ruf and nahi munkar. Religious proselytizing as the agent of social change is changing situation and condition of moslems from underdevelopment, ignorance, destitution, atheism, tyranny, godlessness, and many more which is to be fixed or diverted toward the progress of wisdom, prosperity, faith, orderliness, and many more. Surakarta City is one of city where has glory and golden history of Islam before the freedom of RI and beginning of freedom. The desire of the future of Surakarta City is to go back at Solo City like the past time, so that the glory of Islam must be built with revitalization the role of religious proselytizing in building Surakarta City. The condition of Surakarta City is very diverse. It needs creativity of delivering the massage of religious proselytizing, so that it can create the value of Islam theory in the society. Some of method and phenomenological in building Surakarta City, namely : Integrative Functional, Dialogue, Cultural Approach, Physiology Approach, Political Approach, Cooperation between the Institutions, and Building Public Opinion.

Abstract

In the literature of Islamic scientific studies it is difficult to find differences and separation between religious knowledge and general science. Both must be studied because they need each other in building society. History records that Islam has experienced the glory of a high civilization of science with various competences in scientific disciplines and figures for centuries. This phenomenon occurred because at that time there was no dichotomy between religion and general science. Many of the works and findings of integrative education figures were transferred to other nations by way of scientific recognition. This phenomenon took place because the separation of the two sciences had taken place. There is an expression that what is obligatory to learn is only religious knowledge, while it is not obligatory for general knowledge. The reason for this is, among other things, the rapid development of knowledge, even in one scientific discipline giving rise to new knowledge. On the other hand, especially the Islamic leaders were so happy with the glittering life of the palace. Other facts emerge that many understand leaving the world, focusing on the afterlife. This opportunity is used by the western world which incidentally is not happy to see the glory of Islam. They took over the glory of Islamic knowledge in an unsatisfied way, they even admitted that the appropriation was their product. It is urgent for Muslim scientists to restore the glory of civilization to the glory of civilization of Islamic knowledge because it has been dormant for decades. All scientific movements that carry integrative education must start from Islamic Higher Education which is tasked with producing Muslim scholars who have strong faith and imtaq through the implementation of integrative education in the middle of Islamic campuses. The combination of curriculum based on the combination of general knowledge and religion. In fact, many have changed from institutes to universities, such as the State Islamic Religious Institute to become an Islamic University. This university policy is a concrete step in implementing integrative education at the higher education level as a form of participation by the academic community in the community.

Abstract

Rungal marriages or a marriage that step over the elder sibling has become a tradition in Kebarongan Village. The effects emerge not only for the brides but also for the elder siblings, and their families believed it may cause calamity. The people’s negative view for the rungal brides has also created another fear; therefore, “uang pelangkah” is needed to avoid this calamity. Although this tradition is no longer done by many people, people in Kebarongan Village still do this tradition. How is fiqh perspective? Previous studies on rungal marriage have not discussed this from fiqh perspective. Based on the study of fiqh, rungal marriage and “uang pelangkah” belongs to 'urf. The type of 'urf is based on the scope, material and the perspective of the rungal marriage practitioners, whether it is good or bad. In terms of the scope of its use, the rungal tradition and the step money are included in the 'urf khas category. In terms of material, including 'urf fi'li. And in terms of good and bad, it can include 'urf fasid or 'urf shahih depending on the goals and views of the perpetrator in giving step money in marriage.

Abstract

This paper aims to analyse the discourse of the rule of law in the perspective of Islamic law and constitutional law in Indonesia. The research is a literature study with the main source of books, journals and other references related to the concept of the state in the perspective of Islam and constitutional law in Indonesia. The research method is descriptive qualitative with a normative approach. In the Indonesian context, the concept of law and the rule of law must be realised that it is not an original result or does not grow from within Indonesian society itself. The rule of law is an imported product or a building imposed from outside. The rule of law is the fruit of adoption and transplantation through the Dutch colonial concordance politics and European countries, commonly known as the Rule of Law and Rechtstaat. The conception of the Rule of Law and Rechtstaat are two conceptions of the rule of law that are only normative-legalistic in nature with categorical elements such as the supremacy of law, equality before the law, due process of law, It appears that the Indonesian rule of law, both at the level of the Rule of Law and Machtstaat, is influenced by external legal thinking that emphasises the anthropocentric dimension that focuses on individual and liberal values. So that in practice the Rule of Law turns into the Rule of Man, or from Rechtstaat turns into Machtstaat. In contrast to nomocracy in Islamic law, the rule of law is built on divine values, where law is the highest supremacy in human life. To get to the true state of law, it is necessary to reconstruct the conception and paradigm of the state of law in the future.
