Abstract

This article explains about the Islamic law of gift from Bank to customers related to saving and gyro accounts of Islamic Bank. The Islamic Banks give gift directly  and  indirectly  to  new  ettstomers  and  old  customers  through drawing  (qur'ah) or lottery and non-drawing. There are disputes (ikhtilaf) among Islamic Law  Experts (Fuqaha’) about the status of law when Islamic Banks give the gift. Hanafi and  Syafi'i  Schools  of thought  opined  that  the gift  can  be given  to  the customers as long as there is no agreement between bank and costomers meanwhile the banks still have a debt to consumers, this is permissible. Maliki and Hanbali schools opined that the gift is not permissible during the time of borrowing and lending. Majority Islamic Exsperts allow to give gift after banks have already paid­ back the debt to consumers as long as there is no agreement between bank and cusiomers, but Maliki School do not allow lo give gift at that condition. Also, for giving gift should free from gambling or elements of gambling (muqamarah).  The method of this article is using literature reviews from classical Islamic Law's books and contemporary Islamic law's books related to drawing or lottery and gambling, meanwhile the aims if this mticle are to investigate the law status if gift from bank to new customers and old customers with direct and indirect ways.   Keywords : gift, saving and gyro accounts, disputes, drawing and elements of gambling

Abstract

Theofogicaffy, Islam is one and absolutely correct. However, historicaffy, after being understood and translated into the real life, Islam is not single, but various or plural that manifests at feast in three schools of thoughts: Traditional Islam, Revivalist Islam (fundamentalism), and Liberal Islam (Progressive). The group of Jaringan Islam Liberal (JIL) represents the fast school of thoughts. Even though it is stiff young (ten years), JIL becomes populer because it frequentfy proposes the new thoughts that often evoke controversions in the community. The reformation of thoughts proposed by JIL covers four areas: first, reformation in politics. In this context, JIL gives a priority to the idea of secularism; Second, reformation in socio-religion. Dealing with this, JIL proposes the concept of pluralism; Third, reformation in individual freedom. In this case, JIL gives a priority to the idea of liberalism both in thoughts and actions;fourth, reformation in women. Regarding this, JIL proposes the idea of gender equaliry. This reformation thought of JIL receives pro and con in the community. On the one hand,some of them panne and fulminate it; on the other hand, the other ones support and give appreciation. In such situation, JIL grows as a thought and Islamic progressive movement in Indonesia. Key Words: Islamic Thought, JIL, Secularism, Pluralism, Liberalism, and Gender Equality.

Abstract

This pape tries to explain the difference and the similarty of the law system that regulates the war law stated both in the International humanitarian law and in the Islamic law. This article will answer two main problems. First, what are the difference and the similarity of the regulation of the war law between International humanitarian law and the Islamic law? Second, to what extent is the. implementation of both International humanitarian law and the Islamic law when the war occurs?Based on the research the writer conducted, it could be concluded that: first, the similarity of the war regulation between International humanitarian law and the Islamic law covers the regulation of the beginning and the ending of the war, the method and the means used in the war time, the regulation of the war prisoner protection, the regulation of the civil society protection. In addition, both of these laws aims at humanizing the war. Moreover, the difference between International humanitarian law and the Islamic law are that while Islamic law clearly regulates the prohibition of war, the qualifications as prerequisites of war and the principle of balance, International humanitarian law do not do it so clearly that it enables a conflict tends to be a potential for war. Hence, the principles of Islamic law are appropriate to apply in, modern war condition. Second, the use of nuclear, biological and chemical weapons, ill-treatment toward war prisoners, cruel treatment and ravishment toward civil society during wars show us that the implementation of International humanitarian law has not applied completely by the parties of lawsuit in wars. Different from the implementation of Islamic law both in the Prophet era and in caliph era, in every war, the Muslim soldiers much appreciated the human values such as a very human treatment to those who did not take part in wars, the war prisoners, even to animals.

Abstract

Pada dasarnya dakwah adalah kewajiban muslim yang tidak akan pernah terliburkan sepanjang masa. Sejauh hayat di kandung badan, sejauh itu pula kewajiban dakwah melekat pada diri setiap muslim. Sebagai sebuah kewajiban dari Ilahi, maka niscaya acuan-acuan nilai yang mendasarinya juga bersifat ilahiyah. Tulisan ini lebih jauh akan melihat hakikat dakwah dengan merujuk pada acuan­acuan normatif yang diturunkan oleh yang menurunkan kewjiban dakwah itu sendiri. Tentu dikemukakan pula tafsir-tafsir atas teks dimaksud. Lebih jauh tulisan ini juga akan melihat konteks-konteks dakwah -khususnya, konteks dakwah nafsiyah, dakwah fi'ah, dan dakwah fi'liyah dengan mengacu pada petunjuk-petunjuk al-Qur’an maupun khazanah ilmu secara umum, seperti psikologi.Key words: Dakwah, Tabligh, Irsyad, Da'i.

Abstract

In the field of mental health nowadays, rhe public find several alternatives to heal the psychiatric disorders. Some decades earlier however, efforts to heal their soul were perhaps more focused on models of healing typical of the region. Now public can find alternative healings that come from different regions and even countries. This phenomenon happens in Serang city, the capital of Banten province. Serang society have been encountered by various soul healing techniques (psychotherapy) based on culture, religion, and science. The healing techniques could  be  the  continuation  of the typical model developed by 1he older generation  and  it  also could be an alien healing model that fit into society. Using descriptive-qualitative approach, the researc her argues  that  there are three models of psychotherapy among Muslims in Serang city, namely: ruqyah therapy,  magic  healing  (hikmah),  and rehabilitation model. In the three models of psychotherapy, I discovered similarities and differences in  rhe  process  of  rh e therapy. In ruqyah models, rhe opproach is based on the major religious texts., the Koran and the  Hadith. The magic healing model is a combination of religious lexrs and loca l influence. The last  is the rehabilitation model which is based on the medical­ psychological approach.

Abstract

Sejak penyebaran agama Islam, perkembangan studi bahasa Arab dan linguistik Arab dimulai pada abad ke-7 Masehi dengan tumpuan pada kajian kitab suci Al Qur'an. Kitab suci Al Qur'an merupakan konsep dasar pengembangan bahasa Arab yang fasih dan murni tanpa dicampuri lahn, dialek­dialek non Arab, sehingga mendapat perhatian para linguis untuk mencoba melacaknya. Mengapa studi bahasa linguistik Arab berlangsung dalam terminologi bahasa Arab AI-Qur'an ? kemurnian bahasa Arab sebagai motif yang menjadi pendorong bagi ahli bahasa Arab untuk melahirkan suatu disiplin ilmu sharf yang menggeluti bidang leksikografi. Dipelopori oleh Mu'adz bin Muslim AI-Hira' sebagai pencetus pertama untuk melahirkan suatu disiplin ilmu sharf yang mempelajari bidang leksikografi bahasa Arab, melalui infleksi, deklinisi, derivasi leksikat atau kata. Infleksi dan verbum bahasa Arab berdasarkan sistem tiga bunyi konsonan sebagai akar. Umpamanya /ا, ر, ق/'membaca" menjadi /قرا/ ''ia telah membaca" dan /قراءة/ "bacaan" dan sebagainya. Puncak tata bahasa Arab terjadi pada akhir abad ke 8 atau awal abad 2 hijriyah yang terpusat di Basrah. Para linguis Arab di Basrah mendapat julukan kelompok aliran Basrah yang meletakan dasar yang kokoh akan kereguleran dan sistematisasi dari bahasa Arab sebagai alat tutur yang logis tentang fenomena dunia. Mereka sudah pasti mendapat pengaruh konsep analogi dari zaman Yunani. Disamping itu, ada pula satu kelompok linguistik Arab di Kuffah yang memberikan perhatian kepada keanekaragaman bahasa. Beberapa kelompok linguis Arab di Kuffah berkonsep anomah. Tulisan ini mencoba melirik tenang alasan-alasan timbulnya ilmu sharf sebagai disiplin ilmu tersendiri.

Abstract

After the death of Prophet, Muslims are faced with issues that divided and conflicted the ummah up for a long time. To defend its interests, each side try to build their own arguments. One of them is the Shi'a belief in twelve imams. They used the traditions which believed from the Apostle to legitimate their conviction. This study examine the validity of the traditions that are used by Shiites in conceptualize leadership of ummah. Abstract

This paper tries to study an edition of Ibn Abi Dunya's work, entitled Kitab al-Manam, edited by Leah Kinberg. This paper also aims to deal with the nature of Islamic classical texts and tries to examine the existing edited form of the text that can be scientifically accepted in recently scholarly circumstances. Kitab al-Manam is one of which has attracted many scholars due to its popular contents about dream. It is a collection of 350 narratives. Most of these narratives tell readers about information transmitted through dream. The nature of dream is very dominant in the whole of its content, nearly 327 narratives. Kinberg explains in the beginning of her edition that those dreams are mostly short and follow a set of basic patterns, which is common patterns in relating dreams: 'motifs and formulae·. Viewed from its main nature, Kitab al-Manam, as a whole, is a compilation of traditions drawn from early sources prior to Ibn Abi Dunya’. Somehow, this was an important work since that we hardly can find explanations about dreams prior to Ibn Abi Du'nya’. That's why, the populariry of Ibn Abi Du'nya’ was later acknowledged by many scholars especially those concerned with the nature of dreams in Islamic eschatology. Abstract

Manusia adalah makhluk sosial yang sejak awal kehidupannya sudah memerlukan pertolongan orang lain. Pada awal kehidupannya mansuia adalah makhluk yang lemah, sekiranya setelah lahir tidak ada yang merawat hampir dipastikan akan mati. Demikianlah selanjutnya dalam perkembangannya mauusia saling bergantung kepada yang lain. Dengan berkeluarga dan bermsyarakat, manusia dapat belajar mengembangkan kemampuan dirinya sehingga ia mampu menciptakan berbagai peralatan yang akan mempernudah kehidupannya. Tetapi manusia berbeda dengan hewan, kehidupan bermsyarakat perlu nilai-nilai dan nonna-nonna sesuai agama agar dalam berinteraksi tidak terjadi benturan -benturan. Nilai-nilai dan norna-norna sesuai agama itu akan lebih ditanam jika sejak dini diajarkan dalam keluarga dengan bimbingan orang tua. Sayangnya lidak sedikit orang tua yang kurang menyadari atau kurang mampu melakukan tugasnya ilu. Uraian ·berikut ini mencoba mengurai problema tersebut.
