Abstract

ABSTRACTThis research is based on the problem of excessive extraction of river stones which in the process of taking or can also be called the exploitation of river stones does not pay attention to maintenance and environmental sustainability. The Environmental Service is a regional organization that has the task of supervising and managing the environment in Simalungun Regency. This research was conducted to determine the role of the Environmental Agency in supervising river rock exploitation activities in Timbaan Village, Bandar District, Simalungun Regency. The theory used by the researcher in this study is the concept of Supervision. This study uses the Empirical Normative method. The analysis technique used in this study is using qualitative techniques. The results of this study show that the role of the Environment Agency in supervising river rock exploitation activities that occur in Timbaan Village has not run optimally, because it is seen from the obstacles passed by the Environment Agency in carrying out its role to supervise river rock exploitation activities. Therefore, it is necessary to improve everything that affects the supervision process to maintain and manage the environment.Keywords: Exploitation, Environment, Supervision. ABSTRAKPenelitian ini dilatar belakangi oleh permasalahan tentang pengambilan batu sungai secara berlebihan yang mana dalam proses pengambilannya atau dapat disebut juga dengan tindakan eksploitasi batu sungai tidak memperhatikan pemeliharaan dan juga kelestarian lingkungan. Dinas Lingkungan Hidup adalah Organisasi daerah yang memiliki tugas untuk mengawasi dan mengelola lingkungan hidup di Kabupaten Simalungun. Penelitian ini dilakukan untuk mengetahui Peran dari Dinas Lingkungan Hidup dalam melakukan Pengawasan terhadap kegiatan eksploitasi batu sungai di Desa Timbaan, Kecamatan Bandar, Kabupaten Simalungun. Teori yang peneliti gunakan dalam penelitian ini adalah konsep Pengawasan. Penelitian ini menggunakan metode Normatif Empiris. Teknik analisis yang digunakan dalam  penelitian ini adalah menggunakan teknik kualitatif. Hasil dari penelitian ini menunjukkan bahwa peran Dinas Lingkungan Hidup dalam melakukan pengawasan terhadap kegiatan eksploitasi batu sungai yang terjadi di Desa Timbaan belum berjalan dengan optimal, karena dilihat dari hambatan-hambatan yang dilalui oleh Dinas Lingkungan Hidup dalam melakukan perannya untuk mengawasi kegiatan eksploitasi batu sungai. Maka dari itu perlu dilakukan peningkatan terhadap segala hal yang berpengaruh terhadap proses pengawasan untuk memelihara dan mengelola lingkungan hidup. Kata kunci: Eksploitasi, Lingkungan Hidup, Pengawasan.

Abstract

AbstractSocial workers play a highly strategic role in the implementation of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (SPPA), which aims to ensure the protection of the rights of Children in Conflict with the Law (ABH). This research aims to conduct a comprehensive study of the role of social workers in the implementation of the SPPA Law in Batu Bara Regency, with a particular focus on efforts to prevent and address ABH. This research is an empirical study using a qualitative method with a descriptive qualitative approach to provide handling for Children in Conflict with the Law. The results of the study show that social workers act as facilitators in building an effective referral system between families, schools, and judicial institutions, social workers act as companions for ABH, and social workers are also actively involved in the diversion process. This study also identifies a number of challenges faced by social workers in carrying out their duties, such as improving the capacity of social workers through training and certification, increasing cross-sectoral collaboration, and improving rehabilitation service facilities. This study concludes that the role of social workers in SPPA is crucial. Therefore, there is a need for policies and programs that better support the role of social workers in efforts to prevent and handle ABH. Keywords : Social Worker, SPPA, ABHAbstrakPekerja sosial memainkan peran yang sangat strategis dalam implementasi Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (SPPA), yang bertujuan untuk memastikan perlindungan terhadap hak-hak Anak yang Berhadapan dengan Hukum (ABH). Penelitian ini bertujuan untuk melakukan kajian komprehensif mengenai peran pekerja sosial dalam pelaksanaan Undang-Undang SPPA di Kabupaten Batu Bara, dengan fokus khusus pada upaya pencegahan dan penanganan ABH. Penelitian ini merupakan penelitian Empiris dengan menggunakan metode Kualitatif dengan pendekatan deskriptif kualitatif untuk memberikan penanganan Anak yang berhadapan dengan Hukum. Hasil penelitian menunjukkan bahwa pekerja sosial bertindak sebagai fasilitator dalam membangun sistem rujukan yang efektif antara keluarga, sekolah, dan lembaga peradilan, pekerja sosial berperan sebagai pendamping bagi ABH dan pekerja sosial juga aktif terlibat dalam proses diversi. Penelitian ini juga mengidentifikasi sejumlah tantangan yang dihadapi pekerja sosial dalam menjalankan tugasnya, seperti peningkatan kapasitas pekerja sosial melalui pelatihan dan sertifikasi, peningkatan kolaborasi lintas sektor dan peningkatan fasilitas layanan rehabilitasi. Penelitian ini menyimpulkan bahwa peran pekerja sosial dalam SPPA sangat krusial. Oleh karena itu, perlu adanya kebijakan dan program yang lebih mendukung peran pekerja sosial dalam upaya mencegah dan menangani ABH.Kata Kunci : : Pekerja Sosial, SPPA, ABH

Abstract

ABSTRACTThis research is a field research conducted in Lae Nuaha Village, Siempat Nempu Hulu District, Dairi Regency. The formulation of the problem in this study is how the role of village assistants in village development in implementing Permendes Number 3 of 2015 concerning villages in Lae Nuaha village, Siempat Nempu District, upstream of Dairi Regency, how the function of village assistants in supporting village development based on Law Number 3 of 2015 concerning village assistants from the perspective of fiqh siyasah and how to review fiqh siyasah to Law Number 3 of 2015 related to roles and functions Village assistant in Lae Nuaha Village, Siempat Nempu District, upstream of Dairi Regency. In this study, the author emphasizes the role and function of village assistants in supporting village development as a research sample. In collecting data, the author uses the following methods: Observation , Interview and Documentation. One of the ways to realize village welfare, the regulation of the village minister, the development of disadvantaged areas and transmigration, in this case, forms a village companion to assist the village both in planning, implementation and monitoring of village development. The existence of village assistants is very important in assisting villages to realize village welfare. The compiler aims to find out the roles, functions, and obstacles experienced by village assistants in supporting development in Lae Nuaha village, Siempat Nempu Hulu District, Dairi Regency. Of course, it is very interesting for the author to research, especially in village assistance, the government collaborates with village assistants and village assistants in collaboration with the community in Lae Nuaha Village, Siempat Nempu Hulu District, Dairi Regency. Based on the Regulation of the Minister of Villages, Development of Disadvantaged Regions and Transmigration Number 3 of 2015 concerning village assistants, the existence of village assistants can be known whether something is running according to the plan or in accordance with the instructions that have been determined. It can be known the advantages and disadvantages of working and it can also be known whether it works effectively or not. However, based on the facts in the field that the existence of the implementation of village assistance has not been maximized in carrying out its role and function as a village assistant, namely the lack of speed of the budget provided by the provincial government to the district government and the district government to the village government, then the lack of facilities so that village assistants are constrained in carrying out their roles and functions, and communication between village assistants and the community so that development is not as fast as possible. in Lae Nuaha Village, Siempat Nempu Hulu District, Dairi Regency Not fulfilled. Rumusan masalah dalam penelitian ini adalah Bagaimana peran pendamping desa terhadap pembangunan desa dalam mengimplementasikan Permendes Nomor 3 Tahun 2015 tentang desa di desa Lae Nuaha Kecamatan Siempat Nempu hulu kabupaten dairi, bagaimana fungsi pendamping desa dalam menunjang pembangunan desa berdasarkan Undang-undang Nomor 3 Tahun 2015 tentang pendamping desa Perspektif fiqih siyasah dan bagaimana tinjauan fiqih siyasah terhadap Undang-undang Nomor 3 Tahun 2015 terkait peran dan fungsi pendamping desa di desa lae nuaha kecamatan siempat nempu hulu kabupaten dairi. Dalam penelitian ini penulis mentepkan peran dan fungsi pendamping desa dalam menunjang pembangunan desa sebagai sample penelitian. Dalam mengumpulkan data penulis menggunakan cara: Observasi (Pengamatan), Interview (Wawancara) dan Dokumentasi. Salah satu dalam mewujudkan kesejahteraan desa, peraturan menteri desa, pembangunan daerah tertinggal dan transmigrasi dalam hal ini membentuk pendamping desa untuk mendampingi desa baik dalam perencanaan, pelaksanaan dan pemantauan terhadap pembangunan desa. Keberadaan pendamping desa sangatlah penting dalam mendampingi desa untuk mewujudkan kesejahteraan desa. Penyusun bertujuan untuk mengetahui Peran, Fungsi, dan kendala-kendala yg dialami pendamping desa dalam menunjang pembangunan yang ada di desa Lae Nuaha Kec. Siempat Nempu Hulu Kab. Dairi. Tentunya sangat menarik bagi penulis untuk meneliti khususnya dalam pendampingan desa, pemerintah bekerja sama dengan pendamping desa serta pendamping desa bekerja sama dengan Masyarakat yang ada di Desa Lae Nuaha Kec. Siempat Nempu Hulu Kab. Dairi. Berdasarkan Peraturan Menteri Desa, Pembangunan Daerah Tertinggal dan Transmigrasi Nomor 3 Tahun 2015 tentang pendamping desa, adanya pendamping desa dapat diketahui apakah sesuatu berjalan dengan rencana atau sesuai dengan intruksi yang di telah ditentukan. Dapat diketahui kelebihan dan kelemahan dalam bekerja serta dapat diketahui juga apakah bekerja secara efektif atau tidak. Namun berdasarkan fakta yang ada dilapangan bahwa keberadaan pelaksanaan pendampingan desa belum maksimal dalam melaksanakan peran dan fungsinya sebagai pendamping desa, yaitu kurang cepatnya anggaran yg di berikan pemerintah provinsi kepada pemerintah kabupaten serta pemerintah kabupaten kepada pemerintah desa, kemudian kurangnya Fasilitas sehingga pendamping desa terkendala dalam melaksanakan peran dan fungsinya, dan komunikasi antara pendamping desa dengan masyarakat sehingga pembangunan yg ada di Desa Lae Nuaha Kec. Siempat Nempu Hulu Kab. Dairi Tidak terpenuhi.Kata Kunci: Peran, Fungsi, Pendamping Desa.

Abstract

ABSTRACTThe Research "Effectiveness Of Zakat Distribution On Mustahik (Case Study In Baznas Medan City In 2019 And 2020 In The Review Of Siyasah Maliyah)" This Research Is A Type Of Qualitative Research, Namely Research That Explains The Facts That Occur In The Field Systematically Which Aims To Answer Questions About The Effectiveness Of Zakat Distribution To Mustahik In 2019 And 2020 At Baznas Medan City In The Review Siyasah Maliyah. The Research Approach Used Is  The Statue Approach (Law Approach), In This Case The Law Used By The Author Is Law No. 23 Of 2011 Concerning The Management Of Zakat, Especially In Article 26. The Research Data Collection Used Documentation Techniques And Interviews With Related Parties, Namely The Chairman Of The Medan City Baznas, The Management Of The Distribution Of Zakat Of The Medan City Baznas, And The Zakat Recipients In 2019 And 2020 At The Medan City Baznas. The Data Analysis Technique In This Study Uses A Qualitative Descriptive Method With An Inductive Mindset, Namely Explaining The Results Of Research On Facts That Occur In The Field Which Is Then Analyzed Based On Article 26 Of The Zakat Management Law Which Then The Results Of The Analysis Are Associated With The Views Of Siyasah Maliyah To Its Application In The Field. The Results Of The Research Obtained Are That The Distribution Of Zakat In 2019 And 2020 At Baznas Medan City Has Been Carried Out Effectively. It Is Said To Be Effective Because The Distribution Of Zakat In 2019 And 2020 Both From The Priority Scale, The Principle Of Equity, The Principle Of Justice, And The Principle Of Territoriality Contained In Article 26 Of The Zakat Management Law Has Been Well Implemented In The Zakat Distribution System By The Medan City Baznas. With This Effective Implementation, This Is In Accordance With The Purpose Of The Zakat Management Law, Namely To Realize The Welfare Of Mustahik As Zakat Recipients. If The Welfare Of Mustahik As A Recipient Of Zakat Has Been Realized, Then This Is In Accordance With The Principle Of Siyasah Maliyah Where The Arrangement Is Focused On The Benefit Of The Ummah With The Aim Of Ensuring The Fulfillment Of The Needs Of The Community. Because In Fact, If The Distribution Of Zakat Is Carried Out Effectively, The Function Of Zakat To Ensure The Fulfillment Of Mustahik Needs  As A Community Receiving Zakat Can Be Realized.Keywords: Effectiveness, Zakat Distribution, Siyasah Maliyah. ABSTRAKPenelitian  “Efektivitas Pendistribusian Zakat Terhadap Mustahik (Study Kasus Di Baznas Kota Medan Tahun 2019 Dan 2020 Dalam Tinjauan Siyasah Maliyah)” penelitian ini merupakan jenis penelitian yang bersifat kualitatif, yakni penelitian yang menjelaskan fakta yang terjadi di lapangan secara sistematis yang bertujuan menjawab pertanyaan mengenai bagaimana efektivitas pendistribusian zakat terhadap mustahik pada tahun 2019 dan 2020 di Baznas Kota Medan dalam tinjauan siyasah maliyah. Pendekatan penelitian yang digunakan adalah pendekatan statue approach (pendekatan Undang-Undang) dalam hal ini UU yang penulis gunakan ialah UU No. 23 tahun 2011 tentang pengelolaan zakat khususnya dalam pasal 26. Adapun pengumpulan data penelitian menggunakan teknik dokumentasi dan wawancara dengan pihak terkait yaitu ketua Baznas Kota Medan, bidang kepengurusan pendistribusian zakat Baznas Kota Medan, dan masyrakat penerima zakat pada tahun 2019 dan 2020 di Baznas Kota Medan. Teknik analisis data dalam penelitian ini menggunakan metode deskriptif kualitatif dengan pola pikir induktif yaitu menjelaskan hasil penelitian mengenai fakta yang terjadi di lapangan yang selanjutnya dianalisis berdasarkan pasal 26 UU Pengelolaan Zakat yang kemudian hasil analisisn tersebut dikaitkan dengan pandangan siyasah maliyah terhadap pengaplikasiannya dilapangan. Adapun hasil penelitian yang diperoleh ialah bahwa pendistribusian zakat pada tahun 2019 dan 2020 di Baznas Kota Medan sudah dilakukan dengan efektif. Dikatakan efektif karena pendistribusian zakat pada tahun 2019 dan 2020 baik dari skala prioritas, prinsip pemerataan, prinsip keadilan, dan prinsip kewilayahan yang tertuang dalam pasal 26 UU pengelolaan zakat sudah diterapkan dengan baik dalam sistem pendistribusian zakatnya oleh pihak Baznas Kota Medan. Dengan penerapan yang efektif tersebut maka hal ini sesuai dengan tujuan dari UU pengelolaan zakat yakni untuk mewujudkan kesejahteraan mustahik sebagai penerima zakat. Jika kesejahteraan mustahik sebagai penerima zakat  telah terwujud maka hal ini sesuai dengan prinsip siyasah maliyah yang mana pengaturannya di fokuskan untuk kemaslahatan umat dengan tujuan untuk menjamin terpenuhinya kebutuhan masyarakat. Sebab sejatinya jika pendistribusian zakat dilakukan secara efektif maka fungsi dari zakat untuk menjamin terpenuhinya kebutuhan mustahik sebagai masyarakat penerima zakat dapat terwujud.Kata Kunci : Efektivitas, Pendsitribusian Zakat, Siyasah Maliyah.

Abstract

AbstractHuman life requires regulations that are in accordance with the times, one of the tasks of the government in a country is to formulate regulations whose main purpose is to realize justice, certainty, and legal benefits. In the community of Hutaraja Lama Village, two population systems are regulated, namely: first, law number 24 of 2013 concerning Population Initiation. Second, the pasahat pamatang customary law system. That these two systems apply in Hutaraja Lama Village, this is what drives this research. The formulation of the problem in this thesis is Who is referred to as a resident according to Law No. 24 of 2013 concerning Population Administration, Who is referred to as a Resident according to the Pasahat Pamatang Customary Law, How Law No. 24 of 2013 concerning Population Administration can coexist with the Pasahat Pamatang Customary Law, How is the Review of Fiqh Siyasah on the enactment of the Population Administration Law which is adjacent to the Customary Law Pasahat Pamatang. The method used in this study is qualitative with an empirical approach, using two data sources, namely primary and secondary data sources. Primary data was obtained from direct interviews with traditional leaders in Hutaraja Lama Village and also the Pasahat Pamatang Traditional process. According to the Pasahat Pamatang customary law, the population status of a person who has met the requirements for residents according to the Population Administration Law is not valid, before meeting the requirements as a resident according to the Pasahat Pamatang customary law. These two rules are equally applicable and live in the community in regulating and ordering the social order in the community of Hutaraja Lama Village. According to the Siyasah fiqh review to form a law that is enforced in society in accordance with  the Siyasah Dusturiyah Principle. Therefore, wherever we settle and reside, we must report as residents, so that our rights as citizens are fulfilled. Keywords: Population, Pasahat Pamatang, Siyasah Dusturiyyah AbstrakKehidupan manusia memerlukan peraturan yang sesuai perkembangan zaman, salah satu tugas pemerintah dalam suatu Negara adalah merumuskan peraturan-peraturan yang tujuan utamanya adalah mewujudkan keadilan, kepastian, dan kemanfaatan hukum. Pada masyarakat Desa Hutaraja Lama mengatur dua sistem penduduk yakni: pertama, undang-undang nomor 24 tahun 2013 tentang Adaministrasi Kependudukan. Kedua, sistem Hukum adat pasahat pamatang. Bahwa kedua sistem ini berlaku di Desa Hutaraja Lama, hal tersebutlah yang mendorong penelitian ini. Rumusan masalah dalam skripsi ini adalah Siapakah yang disebut sebagai penduduk menurut Undang-Undang No 24 Tahun 2013 Tentang Administrasi Kependudukan, Siapakah yang disebut sebagai Penduduk menurut Hukum Adat Pasahat Pamatang, Bagaimana Undang-Undang No 24 tahun 2013 tentang Administrasi Kependudukan dapat hidup berdampingan dengan Hukum Adat Pasahat Pamatang, Bagaimana Tinjauan Fiqh Siyasah terhadap berlakunya Undang-undang Administrasi Kependudukan yang berdampingan dengan Hukum Adat Pasahat Pamatang. Metode yang digunakan dalam penelitian ini adalah Kualitatif dengan pendekatan empiris, menggunakan dua sumber data, yaitu sumber data primer dan sekunder. Data Primer di dapatkan dari wawancara langsung kepada Tokoh-tokoh adat yang ada di Desa Hutaraja Lama dan juga proses Adat Pasahat Pamatang. Menurut hukum adat pasahat pamatang belum sah status kependudukan seseorang yang telah memenuhi persyaratan penduduk menurut uu administrasi kependudukan, sebelum memenuhi persyaratan sebagai penduduk menurut hukum adat pasahat pamatang. Kedua aturan ini sama-sama berlaku dan hidup di masyarakat dalam mengatur dan menertibkan tatanan sosial di masyarakat Desa Hutaraja Lama. Menurut Tinjaun fiqh Siyasah untuk membentuk suatu hukum yang di berlakukan di masyarakat sesuai dengan Prinsip Siyasah Dusturiyah. Oleh sebab itu, Dimanapun kita menetap dan bertempat tinggal harus melaporkan sebagai penduduk, supaya terpenuhi hak-hak sebagai Warga Negara. Kata Kunci: Penduduk, Pasahat Pamatang, Siyasah Dusturiyyah

Abstract

ABSTRACTThe Constitutional Court (MK) in Indonesia cannot be separated from the historical exploration of the concept and facts regarding judicial review, which is the most important authority of the Constitutional Court. Judicial review or the right to material review is the process of testing lower laws and regulations against higher laws and regulations carried out by judicial institutions. The formulation of the problem in this study is about how the Constitutional Court judges consider making decisions on decision No. 23/PUU-XVIII/2020 (Judicial Review of Perppu No. 1 of 2020 concerning State Financial Policy and Financial System Stability for the Handling of the Corona Virus Disease 19 (Covid-19) Pandemic and/or in the Context of Facing Threats that Endanger the National Economy and/or Financial System Stability) as well as a study of fiqh siyasah on the decision.  This research method uses a normative and descriptive method. The conclusion of this study is that the Judicial Review submitted by, Amien Rais, Din Syamsuddin, Sri Edi Swasono on April 14, 2020 and on the official website of the Constitutional Court, the material test of Perppu No. 1 of 2020 has been accepted by the Constitutional Court with receipt number 1962/PAN.MK/IV/2020 but the Constitutional Court led by Judge Anwar Usman decided not to accept the submission of Judicial Review with the consideration that Perppu No. 1 of 2020 has officially become Law No. 2 of 2020 so that the application has lost its legal object. The study of fiqh siyasah in this study is included in the discussion of Siyasah Dusturiyyah.Keywords: Judicial Review, Constitutional Court. ABSTRAKMahkamah Konstitusi (MK) di Indonesia tidak dapat lepas dari  jelajah historis konsep dan fakta mengenai judicial review, yang merupakan kewenangan paling utama lembaga MK. Judicial review atau hak uji materi merupakan proses pengujian peraturan perundang-undangan yang lebih rendah terhadap peraturan perundang-undangan lebih tinggi yang dilakukan oleh lembaga peradilan. Adapun rumusan masalah dalam penelitian in tentang Bagaimana pertimbangan hakim MK dalam  mengambil keputusan terhadap putusan Nomor 23/PUU-XVIII/2020 (Judicial Review Perppu Nomor 1 Tahun 2020 Tentang Kebijakan Keuangan Negara Dan Stabilitas Sistem Keuangan Untuk Penanganan Pandemi Corona Virus Disease 19 (Covid-19) Dan/Atau Dalam Rangka Menghadapi Ancaman Yang Membahayakan Perekonomian Nasional Dan/Atau Stabilitas Sistem Keuangan) serta kajian kajian fiqh siyasah terhadap putusan tersebut. Metode penelitian ini menggunakan metode normative serta bersifat deskriptif. Kesimpulan dari penelitian ini adalah bahwa Judicial Review yang diajukan oleh , Amien Rais, Din Syamsuddin, Sri Edi Swasono pada tanggal 14 April 2020 dan dalam laman resmi MK, uji materi Perppu No. 1 Tahun 2020 telah diterima MK dengan nomor tanda terima 1962/PAN.MK/IV/2020 namun MK yang dipimpin oleh Hakim Anwar Usman memutuskan untuk tidak menerima pengajuan Judicial Review dengan pertimbangan bahwa Perppu No. 1 Tahun 2020 telah resmi menjadi Undang-undang No. 2 Tahun 2020 sehingga permohonan tersebut telah kehilangan objek hukumnya. Kajian fiqh siyasah dalam penelitian ini masuk dalam pembahasan Siyasah Dusturiyyah.Kata Kunci: Judicial Review, Mahkamah Konstitusi.

Abstract

ABSTRACT:This research is a field research conducted in Lae Nuaha Village, Siempat Nempu Hulu District, Dairi Regency. The formulation of the problem in this study is how the role of the government in prospering the community through the Family Hope program in Lae Nuaha Village, Siempat Nempu Hulu District, Dairi Regency, how effective is the implementation of the Family Hope Program in Lae Nuaha Village, Sie Mpat Nempu Hulu District, Dairi Regency based on the Regulation of the Minister of Social Affairs No. 1 of 2018 concerning the Family Hope Program and how Fiqh Siyasah views the role of the village government in prospering community about the Family Hope Program in Prospering the Underprivileged in Lae Nuaha Village, Siempat Nempu District, Hulu Dairi Regency. In this study, the author determined the recipients of the family hope program as a research sample. In collecting data, the author uses the following methods: Observation , Interview and Documentation. The results of this study show that the reality of the government's role in implementing the family hope program to prosper the community in Lae Nuaha Village, Siempat Nempu Hulu District, Dairi Regency is still not appropriate. The village government) in Lae Nuaha Village stated that the distribution of PKH social assistance was on target to the beneficiary families. However, in the facts in the field, there are still people who are declared eligible to receive PKH assistance, but until now they have not been touched by the assistance. Meanwhile, from the perspective of fiqh, siyasah syar'iyyah and siyasah maliyah, the Family Hope program has the goal of prospering the community as regulated in Permensos No. 1 of 2018 concerning the Family Hope Program. In this case, it is the same as the purpose of siyasah shariah, which is to bring benefits to the people so that they avoid going to mudharatan. Siyasah syar'iyah is the determination of policies for the management of state issues based on sharia. And the analysis of the siyasah maliyah government program known as the Family Hope Program (PKH) which is distributed to the community is highly recommended because it is a manifestation and concern of the government in terms of prospering people's lives. So, the government's role in prospering the community through the family hope program has not fully run well. Where, the distribution of this assistance has not been really realized properly, because there are still people who have not received assistance. Keywords: Government. Rumusan masalah dalam penelitian ini adalah bagaimana peran pemerintah dalam mensejahterakan masyarakat melalui program keluarga harapan di desa lae nuaha kecamatan siempat nempu hulu kabupaten dairi, bagaimana efektivitas pelaksanaan program keluarga harapan di desa lae nuaha kecamatan sie mpat nempu hulu kabupaten dairi berdasarkan peraturan menteri sosial no 1 tahun 2018 tentang program keluarga harapan dan bagaimana pandangan fiqh siyasah terhadap peran pemerintah desa  dalam mensejahterakan masyarakat mengenai program keluarga harapan dalam mensejahterakan masyarakat kurang mampu di desa lae nuaha kecamatan siempat nempu hulu kabupaten dairi. Dalam penelitian ini penulis menetapkan masyarakat penerima program keluarga harapan sebagai sample penelitiaan. Dalam mengumpulkan data penulis menggunakan cara: Obervasi (pengamatan), Interview (Wawancara) dan Dokumentasi. Hasil penelitian ini menunjukkan bahwa realita peran pemerintah dalam melaksanakan program keluarga harapan guna mensejahterakan masyarakat di Desa Lae Nuaha Kecamatan Siempat Nempu Hulu Kabupaten Dairi masih kurang sesuai. Pemerintah desa) di Desa Lae Nuaha menyatakan bahwa penyaluran bantuan sosial PKH sudah tepat sasaran kepada keluarga penerima manfaat. Namun, pada fakta dilapangan masih ditemukan masyarakat yang dinyatakan layak untuk mendapatkan bantuan PKH, namun sampai saat ini belum tersentuh oleh bantuan tersebut. Sedangkan dalam perspektif fiqh siyasah syar’iyyah dan siyasah maliyah program Keluarga Harapan memiliki tujuan untuk mensejahterakan masyarakat sebagaimana yang di atur dalam Permensos No 1 Tahun 2018 Tentang Tentang Program Keluarga Harapan. Dalam hal tersebut sama dengan tujuan siyasah syar’iyah yaitu membawa kemaslahatan bagi rakyat agar terhindar dari ke mudharatan. Siyasah syar’iyah merupakan penentuan kebijakan pengurusan masalah kenegaraan yang berdasarkan syariat. Dan analisis dari siyasah maliyah Program pemerintah yang dikenal dengan Program Keluarga Harapan (PKH) yang di salurkan kepada masyarakat dianjurkan sekali karena merupakan wujud dan kepedulian pemerintah dalam hal mensejahterakan kehidupan rakyat. Jadi, peran pemerintah dalam mensejahterakan masyarakat melalui program keluarga harapan belum sepenuhnya berjalan dengan baik. Dimana, penyaluran daripada bantuan ini belum benar-benar terealisasi dengan baik, disebabkan masih ada masyarakat yang belum mendapatkan bantuan.Kata Kunci : Pemerintah. Kesejahteraan, PKH

Abstract

ABSTRACT:This study aims to find out the challenges of applying civil servant discipline to the effectiveness of public services in Indonesia. The research was carried out with a qualitative approach through policy analysis, in several government agencies. The background of this research is rooted in the importance of civil servant discipline in ensuring efficient, transparent, and accountable government performance. The results of the study show that the implementation of effective disciplinary policies, such as awarding, regular feedback, and professional development training, contributes to increased productivity, efficiency, and job satisfaction of employees. The research also highlights the importance of clear communication and a culture of accountability in creating a positive work environment and supporting the sustainability of public organizations.Keywords: Civil Servant Discipline, Effectiveness, ChallengesABSTRAKPenelitian ini bertujuan untuk mengetahui tantangan  penerapan disiplin pegawai negeri terhadap efektivitas layanan publik di Indonesia. Penelitian dilakukan dengan pendekatan kualitatif melalui analisis kebijakan, pada beberapa instansi pemerintah. Latar belakang penelitian ini berakar pada pentingnya disiplin pegawai negeri dalam memastikan kinerja pemerintahan yang efisien, transparan, dan akuntabel. Hasil penelitian menunjukkan bahwa penerapan kebijakan disiplin yang efektif, seperti pemberian penghargaan, umpan balik teratur, dan pelatihan pengembangan profesional, berkontribusi pada peningkatan produktivitas, efisiensi, serta kepuasan kerja pegawai. Abstract

 This article aims to discuss the influence of globalization in the eradication of corruption through whistleblowers and is reviewed from the economic analysis of law. The type of research used is normative law, with an approach to laws and regulations and legal concepts. Data sources were obtained from primary, secondary and thesis legal materials which were then analyzed qualitatively. The results of the study concluded that the eradication of corruption in Indonesia was influenced by the globalization of law. This can be seen from Indonesia's participation in the international agreement United Nations Convention Against Corruption (UNCAC) which was later ratified into Law Number 7 of 2006. The substance of UNCAC includes requiring States parties to include in their national legal systems the protection of whistleblowers. The transplantation of UNCAC law into the national legal system is contained in the provisions of Article 10 of Law Number 31 of 2014 concerning the Protection of Witnesses and Victims. From the perspective of economic analysis, the role of whistleblowers in providing information is quite effective and efficient in dismantling corruption. In general, law enforcement has difficulty in uncovering corruption cases, even spending considerable resources and costs in handling them. This is due to the characteristics of corruption crimes that are carried out in a hidden, organized manner and difficult to uncover. Whistleblower  information is very helpful for law enforcement, saving resources and costs in the disclosure process. On the other hand, the state also gains profits because corrupt actors are caught and return state losses. Therefore, cost and benefit, whistleblowers need to be rewarded and protected.Keywords: Globalization, Corruption, Whistleblower, Economic Analysis, Law

Abstract

ABSTRACTIndonesia as a democratic country has experienced various leadership dynamics that affect political, economic, and social development. As a country based on a presidential system. In accordance with the provisions of the 1945 Constitution of the Republic of Indonesia, the President of the Republic of Indonesia holds the highest government power and is assisted in carrying out his duties by the Vice President and state ministers. As time goes by, the President's support system continues to develop. In addition to the Vice President and ministries that have been regulated in the 1945 Constitution of the Republic of Indonesia, non-structural institutions such as the Special Advisor to the President, Special Envoy to the President, Special Staff to the President, and Special Staff to the Vice President have emerged which were formed based on Presidential Regulation Number 137 of 2024 concerning Special Advisers to the President, Special Envoys to the President, Special Staff to the President, and Special Staff to the Vice President. This study is a normative juridical research with a legal and regulatory approach and aims to deeply examine the roles and positions of the Special Advisor to the President, Special Envoy to the President, Special Staff to the President, and Special Staff to the Vice President in running the government.Keywords : President, Minister, Special Envoy of the President
