Abstract

In actuality, the Constitutional Court's decision confirms that the Job Creation Law's formation is conditionally illegal, which means that the methods, strategies, and procedures used to create the Job Creation Law are against the Constitution. Given that article 22A of the constitution states that "Further provisions regarding the procedures for forming laws are regulated by law," this demonstrates to the public that there is a problem with legislators (the DPR and the President) disobeying the Guidelines for Forming Laws and Regulations. Because its text is a direct order from Article 22A of the Republic of Indonesia's 1945 Constitution, the law in question, Law Number 12 of 2011, is substantively and materially the same as the Constitution. The issue is how the decision will be positioned and what its repercussions will be. utilizing legislative methodologies and normative research techniques. The findings demonstrate that court rulings actually produce legal clarity and represent justice, and demonstrate that some of the aforementioned provisions are the foundation for existence

Abstract

Art no. 11/2020 concerning Job Creation is still valid, according to the deadline for the Constitutional Court Decision. During the two years it was ignored as unconstitutional, the articles that had been revoked or amended were reinstated. The principle of lex posterior derogate legi priori, should this principle be passed in order to revive the old rules under the pretext of the principle of lex specialis derogate legi generali. The solution to the problem tries to use zombie science, as an evil consequence of the evaluation of knowledge based on self-interest which has an impact on the possibility of regional autonomy. The discussion posits another point of view, in finding thoughts drawn from the angle of possibility arising from the point of view of zombie science destroying definite theory. The results of other studies show that the results of the study show that there is a potential for injustice to the parties affected by a positive fictitious decision. Noting the similarities in content, form, and function between law and morality, there is a significant difference between these two systems of normative social order. Must consider the law by including morality, moral principles, and political and historical considerations.

Abstract

This research aims to provide an overview of the relationship between business and human rights and discuss how investment activities carried out by corporations must respect and fulfill the rights of local communities in their business areas and how the government should balance investment interests and the rights of local communities. By prioritizing secondary data, which was then analyzed qualitatively to draw conclusions and provide prescriptions, it was found that businesses have a responsibility to respect, protect, and fulfill human rights in all their activities. The government has a key role in maintaining a balance between investment interests and the rights of local communities. Abstract

Abstract

Children are the best hope for the future of any country, community group or family; they are a gift from God to those blessed by their presence. The emotional, mental, and social well-being of their children primarily falls within the purview of the child's parents. Children's journey towards adulthood and the development of their capacity to live independently is the responsibility of parents. This article was created with the aim of enlightening readers regarding the responsibilities of parents for petty theft committed by their children while they are under their supervision and while the children are in their care. Researchers will use normative legal research techniques to ensure that they have a comprehensive understanding of the criteria they will use to analyze results and find solutions to the problems they pose in their research. Legal case analysis, legal literature analysis, and regulatory analysis are some of the methodologies used. The authors of this study draw several conclusions regarding children's responsibility for their financial well-being as perpetrators of criminal acts. The author then outlines the need to dispel doubts regarding responsibility towards minors, while emphasizing the need to monitor children's psychological development. The uniformity of children's responsibilities in long-form fairy tales is a stumbling block for writers.

Abstract

The privacy movement was created by Warren and Brandhuis, who wrote an article in Harvard Law School Journal title "The Right to Privacy" is the right to a person's privacy not to be invaded by others or the government. Laws must recognize and protect an individual's right to privacy. Personal data protection at the global level is regulated by several regulations such as the UDHR and ICCPR.The writing method used in this paper is a normative juridical research method which uses literature references as research data in this paper. The results of this research, namely in ratifying the UDHR and ICCPR regardingThe Right to Privacy As part of the protection of human rights, the Indonesian government is seen as not yet serious about implementing it thoroughly. The PDP Bill, which should be the main focus of the government, is to protect the privacy and security of citizens' data, which has not yet become a top priority. The use of personal data in registration of various applications and regulations for private interests, especially NIK, is not in accordance with the required purposes and creates a potential risk of misuse by cybercriminals and corporations who use the personal data collected. Problems in law enforcement in Indonesia related to privacy violations still occur frequently because there is no national data protection authority that is specifically responsible for data privacy. Keywords: The Right to Privacy, Human Rights, Personal Data
