Abstract

The Presidential Threshold is a constitutional issue that continues to spark debate in Indonesia’s democratic system, as it is viewed as undermining electoral justice and limiting citizens’ choices in presidential elections. The Constitutional Court (MK) has repeatedly received petitions for judicial review of Article 222 of Law Number 7 of 2017 on General Elections. This study aims to analyze the Court’s shifting stance in reviewing the constitutionality of the Presidential Threshold and to identify the legal reasoning underlying its decisions. Employing a normative juridical approach combined with comparative analysis of Constitutional Court rulings from 2008 to 2024, the study finds that various arguments claim Article 222 contradicts citizens’ political rights, the principle of popular sovereignty, and substantive justice. The findings highlight evolving dynamics in the Court’s jurisprudence and the ongoing challenge of maintaining consistency in constitutional interpretation amid political pressures and broader social change.

Abstract

The practice of surrogacy in Uganda has several legal issues and implications. Therefore, this study aims to analyze the legal issues and implications related to surrogacy in Uganda and make comparisons with the United Kingdom. In this case, the study was conducted using a doctrinal research method, relying on primary and secondary research materials. This study found the following: legislation on surrogacy is still being developed by the Ugandan government, and existing laws do not directly regulate surrogacy, which essentially creates legal loopholes and legal vacuums. In addition, this study found that UK law appears to adequately address issues related to surrogacy. This study concludes and recommends that the Ugandan government needs to accelerate the enactment of legislation on surrogacy to address relevant issues in the future, such as the commodification of women's bodies, parental rights, the best interests of the child, and so on.

Abstract

This paper explores the relationship between natural justice and procedural justice, as well as its implications for the role of judges within the Pancasila-based rule of law. Procedural justice is often misconstrued as mere compliance with formal rules, even though it essentially represents an embodiment of natural justice principles that require judicial proceedings to be fair, impartial, and transparent. Employing normative legal research with a conceptual and statutory approach, this study examines core principles of natural justice, including audi alteram partem, nemo judex in causa sua, and the obligation to provide reasoned judicial decisions. These principles are integral to procedural justice and constitute a constitutional mandate as enshrined in Article 28D paragraph (1) of the 1945 Constitution. In relation to Pancasila, judges bear a professional and moral responsibility to ensure that procedural justice is upheld as the foundation of fair trials and the legal protection of every citizen.

Abstract

Regulatory inconsistencies pose a barrier to the implementation of restorative justice in Indonesia, particularly in the handling of sexual violence cases. This issue arises because Article 5 of Police Regulation No. 8/2021 does not exclude sexual violence crimes from the restorative justice mechanism, while Article 21 of Law No. 12/2022 explicitly prohibits the resolution of cases outside the judicial process. This study aims to analyze the normative limitations of applying restorative justice in sexual violence cases and to identify the implications of regulatory disharmony on legal certainty. This study employs a normative legal methodology, drawing on legislative, conceptual, and case-based approaches. The results of the study indicate that this regulatory disharmony leads to multiple interpretations, weakens legal certainty, and disrupts the coherence of restorative justice implementation within the criminal justice system; therefore, regulatory harmonization is necessary through the establishment of an integrated legal framework oriented toward victim protection.

Abstract

The legal vacuum regarding the mechanism for suspending the statute of limitations on prosecution in Law No. 7 of 2021 creates a legal loophole that threatens state revenue. This study aims to comprehensively analyze the application of the principle of legal preference to fill this vacuum and to elucidate the disparity in statutes of limitations between the tax regime and the general criminal justice system. The research method employed is a legal-normative approach utilizing legislative, conceptual, and case-based analyses. The findings successfully demonstrate that the legal gap in tax legislation must be addressed by applying Article 138 of the National Criminal Code through the bridge provision of Article 187 of the National Criminal Code, thereby ensuring that investigative actions legally suspend and renew the statute of limitations. This study recommends that lawmakers undertake a fundamental revision of the Tax Regulation Harmonization Act to explicitly include a statute-of-limitations suspension clause.

Abstract

The constitutional dysfunction of the Regional Representative Council of the Republic of Indonesia has resulted in weak regional representation in national policy. This study employs a normative legal methodology with a legislative. conceptual and comparative law approach based on Konrad Zweigert’s theory of legal style; it analyzes the transformation of the Regional Representative Council by drawing on the model of the Spanish Senate. The results of the study indicate that the Spanish Senate possesses authoritative procedural leverage, whereas in Indonesia, the absence of such leverage results in regional aspirations being consistently dominated by political party coalitions within the People’s Representative Council. Through this strengthening, the Regional Representative Council transforms into a functional counterbalance that ensures justice for all regions of the archipelago.

Abstract

Historical legal studies employing historical analysis, as well as historical research utilizing legal perspectives, have received relatively limited attention in Indonesia. Therefore, strengthening legal history studies, particularly those concerning rijksblad, is necessary. This research aims to examine the regulation of Village Heads in Rijksblad van Surakarta 1931 Number 9 from a legal-historical perspective. The study applies a normative legal method using statutory and historical approaches. The findings reveal two principal conclusions. First, the regulation positioned Village Heads primarily as state administrative officials rather than representatives of village communities. Their main functions included administering tax collection and allocating labor obligations for state purposes. Second, Village Heads were exempted from compulsory state labor, indicating their relatively privileged status within the colonial administrative structure. Based on the perspective of legal history, these provisions demonstrate a transformation in the position of Village Heads from local customary leaders into administrative agents supporting colonial administration functions.
