Abstract

National zakat movement has been implemented in the statehood but in fact it has not been able to overcome the poverty. This study aimed to recognize (1) what programs are carried out by the Province of Maluku in order to overcome the poverty in the Maluku? (2) whether and how the Amil Zakat institutions program (Baznas) Province of Maluku in order to reduce the poverty in Maluku? (3) How the contribution of Islamic Higher Education Institutions in order to succeed the National Zakat Movement as effort to reduce the poverty in Maluku? The results shows that already many national programs that be implemented in Province of Maluku, but the data shows the poverty indicators in Province of Maluku is still high. Amil Zakat Institution (BAZNAS) in Province of Maluku has been doing the program but still not significant in overcoming the poverty in Province of Maluku. This study also provides several scenarios for Islamic higher education institutions to reduce the poverty in Province of Maluku. Keywords: zakat, zakat institutions, poverty, Maluku

Abstract

Communities often assume that employment agreements signed without materei are illegal and therefore are not recognized. In law, the purpose of the covenant is to prove the existence of a legal event forming a legal relationship between the parties (the engagement). So here is the relationship between workers and employers. In certain time labor agreements made for the benefit of such proofs, stamp duty is not a legitimate requirement, so the absence of stamp duty does not result in a specified time period of employment being invalid. Because the legitimate requirements of the agreement contained in Article 1320 of the Civil Code and Article 52 of Act 13 of 2003 on Manpower does not require stamp duty. Thus the legal consequence of the absence of seal is that the agreement remains binding on the parties making it, but if the agreement or document is to be used before the court as a proof then it can be done later. Abstract

The data collection was done by using; documentation, observation, and interviews. Data were analyzed qualitatively through data reduction, display/presentation of data, and conclusion/verification. The results showed that; 1) governance institutions in the implementation of Ambon IAIN Tridarma not running optimally and satisfactorily. The fundamental issue is due to weak work culture, the lack of consolidation and utilization of academic resources, and lack of commitment, awareness and a sense of collective responsibility to understand, appreciate and execute the vision, mission, tasks, functions and programs are consistently under applicable laws; 2) Application of the principles of good university governance in institutional governance as a whole is still relatively weak. Indication of the weakness was seen; a) the lack of transparency, especially in terms of regulation, management and implementation of the budget; b) Accountability in terms of public accountability which demands an increase in PT's ability to maximize available resources effectively and efficiently to achieve the expected results, in this context IAIN not sufficiently accountable; c) Responsibility is still relatively weak, many neglected issues, the activities and performance of quality not still often done repeatedly so IAIN not yet reached the high quality; d) Independence, space for creating, innovating is open to all parties, the problem is the individual consciousness academicians who have maximum independence in utilizing space to develop professionalism, except to the work that are routine, structural and formalistic; e) Fairness or equality in relation to the consolidation and utilization of academic resources to participate in various academic agenda has not seen enough fairness. 3) Quality IAIN Ambon is currently in the category of good or moderate. The achievement of quality is closely related to the level of implementation of the principles of GUG that are not yet consistent and maximum. If the principles of GUG can be consistently and maximum, it is believed to be able to make IAIN Ambon superior, high-quality, competitively and have high competitiveness.

Abstract

The marketing strategy greatly affect the progress of the business, both in small and large scale. One type of business that developed the merchant in the city of Ambon is the smoked fish business, better known locally by the term asar fish. In carrying out its business, fish traders asar in Mardika Market and Small Hative Ambon has used a marketing strategy, but it is still traditional in nature. Its products are not designed to permanently, either packaging or labeling. The price set by the merchant using a strategy of price mark-up, differential, and the cost plus pricing strategy. Traders also use the direct distribution strategy, namely asar fish are sold directly to consumers. Whereas in promoting asar fish produced most traders use promotional strategies through personal selling, sales promotion and direct marketing. However, the strategy undertaken by fish asar in Ambon City traders have not been able to support the business expanded significantly. Keyword: marketing mix, merchants, smoked fish

Abstract

Leaders basically is carrying out the mandate and responsibility, either to those who are lead or to God. Therefore a leader must have character. An ideal leader character has been hinted in the Qur’an with few terms, i.e., the caliph, ulu al-amr, and imam. The Caliph, is meant substitute of Allah position as His representative to prosper the earth, as well as a test for the leader. Since the caliph as a representative of God on the earth, a leader must act wisely. Ulu al-amri, means a person who has authority to regulate and control the situation in accordance with the provisions of Allah. Imam means a people you follow and emulate. Therefore the leadership and the exemplary must be based on faith and piety, knowledge, and success in variety of the exams. Thus the leader character in al-Qur'an perspective is the trustworthy, responsible, wise, and prudent leader, and assess his position as the exam from Allah, so as not to abuse the position and office. Abstract

The inception of Act RI No. 3, 2006 on the Religious Courts have strengthened position of Religious Courts as one of the law enforcement institution for the expansion of absolute competence in the resolution of Islamic economics dispute. However, after being passed of the legislation, many rules were also passed that indirectly unripe the authority of religious courts as an authorized institution to resolve the Islamic economics disputes. The norm conflicts occurred between some rules and regulation could not remove the authority of religious courts in resolving the Islamic economics disputes because it based on the Islamic principles. The courts are able to apply the Islamic principles and make the Qur'an, Hadith of Prophet, ijtihad of Islamic jurists as a guide in the court is only the religious courts. So it is a necessity, if the Islamic economic disputes resolved in the religious court because the whole is something has been attached to the Muslim community and moreover the religious courts id for the needs of Muslim community. Abstract

In 1070 M Corpus Iuris Civilis, or "Book of Justinian", was rediscovered in northern Italy in the western region of Europe, most of the existing kingdom instituted a handful of remaining Roman institutions. The Crusade, which was first called for in 1095, is a military effort of Western European Christians to regain power over the Holy Land from Muslims. The development of Islam experienced a phase of progress in the year 650-1250 M which was marked by the very wide power of Islam, science and science experienced progress and unification between Islamic territories. In 1058, the great Islamic leader Imam al-Ghazali was born full name Abu Hamid Muhammad bin Muhammad al-Tusi al-Ghazali. He has contributed to the development of Islamic economic thought. Even his thoughts were utilized by thinkers afterwards in the world of Islam and non-Islam.

Abstract

Islamic Leadership, a leadership model that has transcendental values, which rests on the Quran and Sunnah. But in its development, the application of the current Islamic leadership looks increasingly short of expectations. According to Islam leadership is trust. Because the leaders of the company must have four characters, the honest (shidiq), trust (trustworthy), fathanah (smart) and Tabliq (transparent, open). In practice, the leadership must be based on the principle: monotheism, deliberation, fairness and freedom. The results of the application of Islamic leadership within the company, are the results in order to meet the necessities of life, for the benefit of families and businesses to work as good deeds. Abstract

The financial institutions as mediators of the parties who have excess of funds to the parties who lack of fund so that to be complement each other and serves as the financial intermediary of community. In reality, each institution or organization has several types, namely; first; pure-profit organization, second; quasi-profit organization, third; quasi-non-profit organization and fourth; pure-nonprofit organization. The purpose of first institution type is to make a profit as much as possible in the supply and sale of goods, secondly; aims to make a profit and get other purposes as needed by the owner, thirdly; aims to make profit (surplus) and serve the community, while the last institution aims to improve the community welfare and serve it. The type of organization will continue to face numerous polemics, inequality and disparities occurs today. Abstract

The development of wealth is not something that is prohibited but God has outlined the rules in the development of wealth to create harmony and human order. The development of assets with usury instruments is a prohibited method. Likewise with interest based on the 2003 MUI fatwa which states that even interest is usury that is unlawful. Usury is not only forbidden based on the syar'i argument, but the practice of usury has a negative impact on the economic order of a country. This study uses a descriptive qualitative research approach, namely by describing the phenomenon of usury as well as arguments that are pro and counter to interest as an innovation of capitalist ideology. The results of this study are that interest included in usury is prohibited even though it does not multiply and has a negative impact on the economy such as causing inflation in 1998. The solution to avoiding usury practices is the mudharabah contract. This contract is friendly to entrepreneurs and consumers because profits and losses are borne together.
