Abstract

To be able to anticipate unwanted things and remain orderly, a legal umbrella was issued in the form of Financial Services Authority Regulation Number 77/POJK.01/2016 concerning Information Technology-Based Money-Lending Services (hereinafter abbreviated as POJK NO.77). The Financial Services Authority (hereinafter abbreviated as OJK) in this regulation has authority in terms of regulating all matters that must be complied with by companies engaged in online lending. Fintech is a technology that can facilitate technological needs that can facilitate today's financial needs1. Offering financial solutions through technology brings changes to people's lives in various forms that are tailored to their needs. This type of fintech P2P lending is widely used because the online loan process offered can be done quickly and easily. On the other hand, a number of illegal online loans have sprung up and are easily accessible to the public. Many violations of the law have been committed by illegal online loans to the detriment of society. This paper aims to find out legal protection efforts for consumers in online lending services. The research method used is normative method.

Abstract

Society or social life is actually a collection of various kinds of relationships between its members. This relationship ultimately forms social life. Thus it can be said, that social life is the fabric of the various relationships that are carried out between members of society with one another. Everyone in association in society must pay attention to and implement (obey) legal regulations, in order to create an orderly and peaceful life. If there is a violation of the law against the applicable legal regulations, the violated regulations must be upheld, implementing the rule of law in a country is very difficult to separate from the political aspects of the country. It is the political situation that gives the style and form of implementing law enforcement. The formulation of the problem in this research is the function of law as social control from the perspective of legal sociology. The method used in this research is normative law. Based on the research results, it is known that the function of law as social control from the perspective of legal sociology is that in order for the function of law to work properly, there needs to be socialization of the law and it must be enforced fairly because this causes people to often take the law into their own hands in resolving the cases they face.

Abstract

Where the meaning of equal opportunity in government is inseparable from political rights which implies political rights or political rights is a right which is to take part and play a role in a form of government that exists in a country. So that in terms of civil and political rights for every Indonesian citizen, the implementation is very clearly regulated in the 1945 Constitution of the Republic of Indonesia, Chapter XA of Human Rights Articles 28A to Article 28J, while the explanation of political rights for citizens is regulated in Article 26D paragraph (3) states that every citizen has the right to obtain equal opportunities in government. The formulation of the problem in this study is how to revoke the political rights of convicts of corruption cases based on laws and regulations, how to grant additional criminal rights to the revocation of political rights of convicts of corruption cases based on laws and regulations. The method used is normative legal research. Based on the results of the study it is known that the Revocation of the Political Rights of Convicted Corruption Cases Based on Legislation that Based on these provisions the additional criminal imposition of revocation of political rights against convicts is not contrary to the Criminal Code as long as the revocation of rights is accompanied by a period of application. The right to vote and be elected to public office can be classified as the right to freedom of thought and conscience. Human rights are rooted in the human person because of their humanity, if they are revoked then their humanity will also be lost.

Abstract

Dalam perkembangan penerapan hukum pidana di Indonesia keberadaan anak yang melakukan kejahatan atau tindak pidana yang biasa dikenal dengan sebutan “anak” ini tetap diproses secara hukum. Di sisi lain penegakan hukum terhadap kejahatan anak menimbulkan masalah karena pelaku kejahatan itu adalah anak yang secara hukum belum cakap hukum. Rumusan masalah dalam penelitian ini adalah Bagaimana Pengertian Anak Di Bawah Umur Secara Hukum, Bagaimana Kejahatan Anak Dibawah Umur Dari Aspek Sosiologi Hukum. Metode yang dipergunakan adalah penelitian hukum normatif. Berdasarkan hasil penelitian diketahui bahwa Pengertian Anak Di Bawah Umur Secara Hukum bahwa dalam Pasal UU No. 23 tahun 2002 tentang Perlindungan Anak Pasal 1 angka 1 memberikan batasan usia anak yakni seorang yang belum berusia 18 (delapan belas) tahun. Isi Pasal itu menyatakan; “Anak adalah seseorang yang belum berusia 18 (delapan belas) tahun, termasuk anak yang masih dalam kandungan. Kejahatan Anak Dibawah Umur Dari Aspek Sosiologi Hukum bahwa berkaitan dengan kejahatan anak dibawah umur ini biasanya terjadi tindak pidana pemerkosaan, pencurian, pembegalan, dan lain sebagainya. Namun, apabila dilihat dari aspek sosiologi hukum, hal ini tentu menjadi moril dan tanggungjawab orang tua untuk mengawasi anaknya. Konteks anak yang berkonflik dengan hukum sangat penting mengkualifikasikan antara pertanggungjawaban pidana terhadap anak yang dibedakan dengan orang dewasa, hal ini dikarenakan semua perbuatan yang dari orang dewasa merupakan suatu kejahatan, namun bagi anak-anak merupakan delinquency. Delinquency merupakan perbuatan yang tidak sesuai dengan aturan dan norma yang dilakukan oleh anak apabila dilakukan orang dewasa dikualifikasikan sebagai tindak kejahatan.

Abstract

Sosiologi hukum menekankan objek pembahasan tentang efektivitas hukum/undang-undang. Dari paparan tersebut, nampak jelas bahwa antara kebudayaan, budaya hukum, antropologi hukum dan sosiologi hukum mempunyai kaitan yang erat, yaitu ingin melihat hukum dari segi manusia atau masyarakat. Adapun maksud dan tujuan pembahasan budaya hukum, adalah untuk dapat mengenal ciri-ciri (atribut) yang asasi, guna mengkaji proses yang berlanjut maupun yang berubah atau yang seirama dengan perkembangan karena sifat kontrososial itu tidak selamanya tetap. Perubahan budaya hukum itu tidak saja berlaku dikalangan masyarakat yang modern tetapi juga dikalangan masyarakat sederhana atau masya-rakat pedesaan, walaupun terjadinya perubahan itu tidak sama cepat, tergantung pada keadaan, waktu dan tempat Rumusan masalah dalam penelitian ini adalah Bagaimana Peranan Budaya Dan Kebudayaan di Indonesia Dari Aspek Sosiologi Hukum. Metode yang dipergunakan adalah penelitian hukum normatif. Berdasarkan hasil penelitian diketahui bahwa peranan budaya dan kebudayaan di indonesia dari aspek sosiologi hukum bahwa dalam dunia pragmatis sedikit-dikitnya ada dua sistem norma atau dua sistem aturan terwujud didalam interaksi sosial, sedangkan pada lain pihak, pandangan itu bertolak dari: “pluralisme budaya”, dan mengkaji bagaimana hukum itu berperan dan menyesuaikan diri di dalam kondisi seperti itu. Ada kalanya tingkat penegakan hukum pada suatu masyarakat sangat tinggi karena didukung oleh kultur masyarakat, misalnya melalui partisipasi masyarakat (public participation) yang sangat tinggi pula dalam usaha melakukan pencegahan kejahatan, melaporkan dan membuat pengaduan atas terjadinya kejahatan di lingkungannya dan bekerja sama dengan aparat penegak hukum dalam usaha penanggulangan kejahatan, meskipun komponen struktur dan substansinya tidak begitu baik dan bahkan masyarakat tidak menginginkan prosedur formal itu diterapkan sebagaimana mestinya.

Abstract

Various fake news appears in the mainstream media and become a phenomenon that must be handled with a smart and wise attitude by its users, especially among junior high school students. The spread of fake news can occur massively due to the inaccuracy of students in receiving the information that is circulating. Something considered "viral" will easily affect existing rules, norms, and culture. Open spaces are easier to access as targets for the spread of fake news which can trigger disintegrative actions for the nation if they are not based on adequate references.

Abstract

Legal politics, namely as an effort to realize good regulations in accordance with the circumstances and situations at a time. As well as a policy from the state through the authorized bodies to establish the desired regulations, which are expected to be used to express, what is contained in society, and to achieve what is aspired. Diplomas are included in the part of educational instruments; therefore, the national education law also regulates the crime so that it can be charged with two articles (articles listed in the Criminal Code and articles listed in the National Education System Law). So, if the forged is a school diploma, it is more appropriate that what is imposed is an article in the National Education System Law. Indeed, in general it has been regulated in the Criminal Code, but for example the use of fake diplomas is not regulated in the National Education System Law by the Criminal Code with the term authentic letters/deeds being accommodated. The formulation of the problem in this study is how the politics of criminal law against the failure to register candidates for DPR/DPRD in the General Election. The method used is normative legal research. Based on the research results, it is known that the Politics of Criminal Law Against the Failure to Register Candidates for DPR/DPRD in the General Election that law is a political product that views law as a formalization or crystallization of interacting political wills.

Abstract

In the elucidation of the Constitution of the Republic of Indonesia, it is emphasized that Indonesia is not based on power (machstaat) but based on rechtsstaat or law. The definition of machstaat includes, "Ligitimizing State Actions Based on Power". That authority is translated, the government can give the ability to carry out certain legal actions intended to cause legal consequences, including the emergence and disappearance of certain legal consequences. Thus, rechstaat should not be translated, someone can act on behalf of the government or the state to carry out or take legal action, arguing that the state wants to create justice, as if everything must be acceptable to the public. This study will analyze legal issues, facts, and other legal phenomena related to the legal approach. Research in the form of juridical, descriptive with its analysis limits the issue of appointing regional heads ahead of the 2024 presidential election which ignores the considerations of the Constitutional Court Decision. This method will not conclude that regional elections are generally accepted regarding the appointment of regional heads outside of their standard. In conclusion, the Judicial Review of Article 201, Law Number 10 of 2016 concerning Pilkada which the Constitutional Court Judges consisting of the Chairman, Anwar Usman, and its members in their Amar Decision rejected the petition of the Petitioners in its entirety. The discussion occurred because the rejection of the lawsuit was inconsistent with considerations that seemed to open up space for the public or civil society to demand an open and democratic government in appointing regional heads ahead of the 2024 presidential election.

Processing and analysis of legal materials are carried out by analyzing legal materials from deductive to inductive. The research results are: First. Appointment of Independent Commissioners within the company is mandatory, this has been regulated as in one of the OJK regulations namely Financial Services Authority Regulation Number 33/POJK.04/2014 concerning Directors and the Board of Commissioners of Issuers or Public Companies, Independent Commissioners must exist in Limited Liability Companies classified as Open/Public, especially in PTs that collect or manage public funds. Second. The Independent Commissioner guarantees the implementation of the principles of Good Corporate Governance in the company if the selected Independent Commissioner has competence and experience, in the selection process the Independent Commissioner has applied the principles of Good Corporate Governance and has fulfilled the Fit and Proper Test requirements by company regulations.

Abstract

Import activities are strongly related to international trade that one of the objectives is to meet the needs of a country. Indonesia carries out import activities on processed food products and agricultural products in order to fulfill food needs. To protect Indonesian consumers who are predominantly Muslim, Indonesia has passed legislation regarding halal certification and labeling through Law Number 33 the year 2014 concerning Halal Product Assurance. The ratification of the Law Number 33 of 2014 became an issue when looking at the fact that Indonesia is a member of the WTO country. The problems studied in this study include: (1) How is the implementation of Law Number 33 of 2014 concerning Halal Product Assurance in Halal certification and labeling of imported processed food products and imported agricultural products in Indonesia and (2) How is harmonized Law Number 33 the year 2014 concerning Halal Product Assurance, especially on halal certification and labeling of imported processed food products and imported agricultural products in Indonesia related to the Technical Barriers to Trade agreement? The implementation of Law Number 33 of 2014 has changed the provisions regarding halal certification and labeling of products circulating and traded in Indonesia, including imported processed food products and imported agricultural products, to become mandatory. The conformity of the Law Number 33 of 2014 which is included in technical regulations with the TBT Agreement is an urgency to ensure that national regulations and/or policies do not become obstacles in international trade. The research method used is juridical-normative with the data sources obtained in the form of primary legal materials in the form of laws and regulations, GATT 1994, and the TBT Agreement, secondary legal materials including legal books and journals, and tertiary legal materials, such as legal dictionaries.
