Abstract

Insurance is a financial instrument that can help communities and companies reduce financial risk due to unexpected events such as natural disasters, accidents or property loss. The use of insurance as a form of financial protection is increasingly important in the face of ever- increasing risks today. In the world of insurance business, the aim is to transfer risk, compensate for losses, cover the welfare of members, transfer risks, raise funds and balance premiums, and provide protection in the event of an incident on company property. on the google scholar database. The legal basis for insurance in Indonesia is stated in Law Number 2 of 1992 concerning Insurance Business (UU UPA). The UPA Law was later amended by Law Number 40 of 2014 concerning Insurance Companies need insurance for various reasons. When conducting business, we are responsible for the well- being of many, from employees to customers. There are several types of insurance risk, including: pure risk, speculative risk, special risk, fundamental risk, individual risk, asset risk and liability risk. There are four things that can be done to manage risk, namely: avoidance. controlling, delaying and diverting. The importance of the company having insurance legality to provide protection when experiencing risks in the future.

Abstract

In an effort to encourage business actors to create fair and ethical business competition, the Business Competition Supervisory Commission (“KPPU”) recently issued a new regulation regarding the Competition Compliance Program. The core of this program is expected to be a tool to ensure companies comply with Competition Laws, and to detect any violations of Competition Laws in business. The need to influence behavior and motivate individuals or business entities to comply with regulations related to business competition is in line with one of the objectives of the theory Carrot and Sticks. This theory is based on the assumption that rewards and punishments can be effective instruments to encourage compliance and prevent fraud.

Abstract

Pasal 51 piagam PBB mengatur hak menggunakan kekuatan bersenjata untuk membela diri bagi suatu negara. Berdasarkan pasal ini, penggunaan kekuatan bersenjata untuk membela diri bagi negara adalah sah. Namun ketentuan ini dinilai kurang jelas dalam mengatur batasan penggunaan kekuatan bersenjata untuk pertahanan diri. Oleh karena itu, legalitas penggunaan senjata ini sebagai pertahanan diri juga perlu ditinjau kembali dari ketentuan yang tertuang dalam Space Treaty 1967. Penelitian ini bertujuan untuk mengetahui legalitas penggunaan kekuatan bersenjata untuk pertahanan diri dan upaya menjaga perdamaian dan keamanan internasional serta penggunaan senjata pencegat rudal berbasis ruang angkasa. ruang menurut Piagam PBB dan Perjanjian Luar Angkasa 1967. Metode yang digunakan adalah yuridis normatif yang merupakan penulisan hukum sastra. Hasil kajian menunjukkan bahwa penggunaan pencegat rudal berbasis antariksa sebagai upaya pertahanan diri adalah sah baik berdasarkan Pasal 51 Piagam PBB maupun Pasal III Perjanjian Antariksa 1967, namun berdasarkan ketentuan Pasal yang kurang jelas. 51 Piagam PBB, ada batasan hukum penggunaan senjata ini sebagai alat pertahanan diri. Legalitas penggunaan senjata tersebut terbatas pada penggunaannya untuk mencegat rudal yang sudah aktif atau sedang terbang di wilayah negara yang bertindak sebagai aktor pertahanan diri dan di wilayah yang tidak ada kedaulatannya. Selain itu, berdasarkan resiko atau akibat dari pencegatan rudal tersebut, khususnya rudal dengan hulu ledak nuklir untuk pertahanan diri negara dan negara lain, maka upaya pencegatan rudal tersebut melalui penggunaan pencegat rudal berbasis antariksa dapat dilegalkan sebagai upaya pertahanan diri.

Abstract

Abstract Currently, Indonesia has not provided adequate protection of intellectual property rights (IPR) in the implementation of the Material Transfer Agreement (MTA). In providing the protection of the Indonesian nation's intellectual property on Genetic Resources (SDG) —especially those derived from genetic material in the form of biological material (DNA/RNA), clinical specimens, and non-biological material (related to human health), the Indonesia's Material Transfer Agreement (MTA) standard is still far from perfect. A Commercial Material Transfer Agreement (CMTA) is required which not only contains clauses on the exchange of genetic material but also contains more detailed provisions on Intellectual Property Rights such as Patents and Benefit Sharing. In this Journal, the author proposes a new framework for the Commercial Material Transfer Agreement (CMTA) which contains additional clauses from the current MTA, which is expected to further protect and encourage of new patentable invention in the future.

Abstract

Criminal offenses related to gambling are regulated in Article 303 of the Indonesian Penal Code (KUHP) and Article 303 bis of the KUHP. Additionally, the criminalization of gambling conducted through electronic media is addressed in Article 27 paragraph (2) of Law No. 19 of 2016 on Amendments to Law No. 11 of 2008 on Electronic Information and Transactions. However, the effective implementation of this law has not yet been enforced in the jurisdiction of the Padang Panjang City Police Resort. The research aims to address the following issues: (1) What efforts are being made by the police authorities in enforcing the law against online gambling in the jurisdiction of the Padang Panjang City Police Resort? (2) What are the inhibiting factors or obstacles faced by the police authorities in enforcing the law against online gambling in the jurisdiction of the Padang Panjang City Police Resort? This research adopts an empirical juridical approach and a descriptive method. Primary data collection involves interviews conducted at the Padang Panjang City Police Resort, while secondary data collection entails document analysis. The research findings reveal that law enforcement efforts against online gambling in the jurisdiction of the Padang Panjang City Police Resort can be carried out through preventive measures such as public awareness campaigns and collaborations with relevant parties. Repressive measures include gathering information from the community, investigation and prosecution, site blocking, and providing rehabilitation for offenders. The obstacles faced by the police authorities include weaknesses in the Electronic Information and Transactions Law No. 11 of 2008, lower penalties for online gambling offenses compared to those in Article 303 of the KUHP, difficulties in obtaining evidence through the internet, lengthy case processing, and inadequate understanding and skills of investigators in the field of information technology.

Abstract

In line with the Government's efforts to increase efficiency in the performance of State-Owned Enterprises (BUMN) in each sector, one of the strategies used is to create BUMN Holding, Further, Government Regulation was stipulated concerning Amendments to Government Regulation Number 44 of 2005 concerning Procedures for Participation and Administration of State Capital in State-Owned Enterprises and Limited Liability Companies Number 72 of 2016. One of the implementation of BUMN Holding was carried out in the Mineral and Coal Mining sector resulting in a change in the status of PT Timah Tbk which was originally a state-owned enterprise (BUMN) based on Government Regulation concerning the Transfer of Forms of a State-owned Tin Mining Company to a Limited Liability Company (Persero) Number 3 of 1976 Changed to become a BUMN Subsidiary with the stipulation of Government Regulation Concerning the Addition of the Republic of Indonesia State Equity Participation into the Share Capital of PT Indonesia Asahan Aluminium Company Number 47 of 2017 where PT Indonesia Asahan Aluminium Tbk (Persero) is BUMN Holding. With the change in status from previously a State-Owned Enterprise (BUMN) to a Subsidiary of a State-Owned Enterprise (AP BUMN), it has an impact on the change in the financial status of PT Timah Tbk, which no longer has state shares/capital in it. Abstract

The issue of industrial waste in the plantation industry has become an urgent concern in efforts to maintain environmental sustainability. This research aims to analyze the policy strategies for combating crimes related to industrial waste in plantation companies. The implementation of policies for managing and addressing crimes related to industrial waste in plantation companies is a crucial factor in mitigating the environmental problems caused by plantation activities. The research methodology employed is normative legal research, which involves analyzing various legal regulations through literature review and normative analysis. This study identifies the legal principles that should form the basis of policies for combating crimes related to industrial waste in the plantation industry. Additionally, the research identifies weaknesses in existing policies and provides recommendations for new strategies that can be implemented, such as strengthening surveillance and law enforcement, active participation of companies and communities, and the adoption of environmentally friendly technologies. This research is expected to contribute to the formulation of more effective policies for combating crimes related to industrial waste in the plantation industry. The research identifies factors influencing policy implementation, such as the awareness and active participation of companies, the role of the government in surveillance and law enforcement, and the involvement of the community in monitoring and reporting violations. The research findings provide an overview of the challenges and obstacles faced in policy implementation and offer recommendations to enhance the effectiveness of implementation in optimizing the management of combating crimes related to industrial waste in plantation companies.

Abstract

Hugo Grotius is recognized as one of the influential figures in the development of world law, especially in the context of international law so that with his rational and humanist rationale, the criminal justice system in particular has shifted its paradigm to a modern aspect. It is a logical consequence that the progress of juvenile criminal justice also accommodates customary law, especially in West Kalimantan and Indonesia recognizes the existence of customary justice as an effort to handle cases that occur in their environment, as well as cases related to children. In substance, customary law and its legal sanctions still apply to indigenous peoples. These legal values then become an action that is considered good by the community which is then used as a principle in carrying out social activities. These values will then form a norm that guides behavior. legal space to give power to jurors to explore, follow, and understand customary law and use it as a basis for consideration in deciding cases handled. Therefore, it is necessary that a customary court which currently applies strongly to the indigenous Dayak community has a mechanism of customary justice that is able to resolve community problems based on mutual agreement and various existing sanctions indicating that customary justice in society is able to provide a sense of justice.

Abstract

In the game industry itself, particularly in Indonesia, the majority of game developers and publishers are copyright holders who are not the creators themselves, often referred to as license holders. To analyze the legal protection for copyright holders of online game software in relation to the economic rights of the creator, Philipus M. Hadjon's Theory of Legal Protection can be used. The objectives of this research are to analyze the legal regulations for copyright holders of online game software, to analyze the legal protection for copyright holders of online game software in relation to the economic rights of the creator, and to analyze the role of the Government in providing legal protection for copyright holders of online game software. The research used a normative juridical approach, therefore the data used are secondary data obtained from existing literature. It employs qualitative juridical data analysis. The results of the research show that in the legal protection for copyright holders of online game software in relation to the economic rights of the creator, according to Philipus M. Hadjon, "there are two types of legal protection means, namely Preventive Legal Protection means that can be resolved through arbitration/non-litigation, such as Mediation, Negotiation, Conciliation, Arbitration.

Abstract

The TRIP’S Agreement confirms that Member States may exclude certain types of inventions from patentability and may refuse to grant patents on methodological inventions used on humans, including the granting of patents on inventions in the field of biotechnology applied to humans. Indonesia regulates patent protection for biotechnology in the Patent Law, which emphasizes that patents cannot be granted for inventions of biotechnological processes applied to humans. However, with the development of technology, the use of inventions in the field of biotechnology applied to human genes is considered to have great benefits for mankind. Therefore, this research that uses doctrinal-normative methodology through a statute approach will discuss how the TRIP’s Agreement and the Patent Law in Indonesia regulate patents on biotechnology products applied to human genes and the urgency of granting patent protection to biotechnology inventions applied to humans so that it can be known that granting patents to biotechnology inventions applied to humans is prohibited by Indonesian law but given freedom under international law and further research and comprehensive studies need to be done to deal with future trade liberalization flows.
