Abstract

Hacking is used for other purposes that are detrimental. Legal protection for hacking is regulated in Law Number 19 of 2016. Problem Formulation What is the legal action taken by law enforcers regarding the eradication of criminal acts related to data theft? What is the legal protection for victims of hacking crimes related to data theft? What obstacles do law enforcers encounter in legal protection for victims of hacking crimes related to data theft? Type of research Normative legal research is supported by interviews. Data sources include primary data and secondary data. Data collection techniques are document studies and interviews. Data were analyzed descriptive-analytical. Conclusion of the research results: Law enforcement against hacking or hacking still does not reflect effective law enforcement due to a lack of understanding by investigators. Legal protection is divided into two kinds of preventive legal protection and repressive legal protection. Obstacles encountered by law enforcers in protection law against victims of criminal acts of hacking related to data theft, consists of several aspects, namely: investigator aspects, aspects of evidence in the investigation process, aspects of facilities, aspects of jurisdiction

Abstract

This study aims to find out and analyze how the power of underhanded deeds legalized by a notary as evidence in the trial process at court in civil cases, to find out and analyze the judge's consideration of civil case decisions, and to find out and analyze the notary's responsibility for the deed has been legalized in the Civil Code. The research method in this research is the normative research method. Normative legal research is legal research carried out by examining library materials or secondary data. The results of this study, want to show how the power of underhanded deeds legalized by a notary in civil cases, basically the strength of proof of underhanded deeds legalized by a notary the power of proof cannot be equated with an authentic deed, underhanded deed legalized by a notary if denied the power changes as proof of the beginning of writing.

Abstract

This research aims to find out and analyze the provisions for tax imposition in the transfer of inheritance in the Bukit Tinggi City Area as well as understand and understand the income tax imposed in the inheritance process in the Bukit Tinggi City Area. This type of internal research is empirical juridical research which is carried out by researching and collecting initial data that has been obtained through direct observation of related problems. Based on the results of the author's research, BPHLTB Tax Management uses a Self-Assessment System. The tax object in BPHLTB is specifically inheritance tax as stated in Article 85 paragraph (2) letter a Law No. 28 of 2009 n Law No. 1 of 2022 concerning Financial Relations Between Regional Government and Regional Government. The basis for imposition of PPLh tax is contained in Article 2 paragraph (1) ULU PPLh, the subject of which is one of the inherited assets that has not been divided into one unit to replace those entitled to it. Meanwhile, in Article 4 Paragraph (3) ULU PPLh is excluded and one of the tax objects is inheritance.

Abstract

Public Prosecutor is a prosecutor at the Attorney General's Office of the Republic of Indonesia who is authorized by law to conduct prosecutions, which process includes the authority to compose indictments. In exercising this authority, Article 15 and Article 137 of the Criminal Procedural Code (KUHAP) provide limitations for Public Prosecutors to conduct prosecutions within their jurisdictions, however, in practice it is found that Public Prosecutors indict criminal offenders who committed crimes outside their given jurisdiction (extra-jurisdictional). To study this phenomenon and its legal consequences, this research examines the consideration of the Public Prosecutor at Padang Panjang District Prosecutor's Office who indicted the perpetrator of criminal offense outside its given jurisdiction, as found in indictment No. PDM-15/PPJNG/Eoh.2/03/2021 on behalf of the defendant Aziarlis Bin Ameh Pgl Ziar, by employing empirical legal research methods based on primary data obtained by interviewing related Judges, lawyer and Public Prosecutors and also based on secondary data obtained through literature studies of various regulations and references that are analyzed qualitatively. This study finds that despite the restrictions imposed by KUHAP, extra-jurisdictional indictment is made possible through several provision in legislation, including Article 2 paragraph (3) of Law Number 16 Year 2004 concerning the Attorney General’s Office of the Republic of Indonesia. This study also recommends that the Supreme Court should consistently apply Article 4 paragraph (1) of Law No. 49 year 2009 concerning the Second Amendment to Law No. 2 Year 1986 concerning General Courts, which is included as a consideration in Chief Justice Decree No. 200/KMA/SK/X/2018.

Abstract

This research focuses on; 1) control and management of Government Land by the Regional Government, 2) control of Regional Government Land by the Padang City Government, and 3) control and security of Regional Government Land which can create legal certainty and provide maximum benefits. The research method in this study uses a normative juridical, empirical, and conceptual approach. The data sources used come from regulations, documents relating to the management of land assets as well and the results of interviews with parties involved in the management of Regional Property in the form of land of the Padang City Government. Based on research that has been carried out, the implementation of the management of Regional Government land assets has been carried out by the Padang City Government through regulations governing the management of Regional Property. However, several obstacles cause less than optimal management of land assets by the Padang City Government by OPD land users. Furthermore, 3 (three) efforts to secure land assets must be implemented as an inseparable unit, so that legal certainty of land assets of the Padang City Government can be achieved which can provide maximum benefits.

Abstract

Act Number (No) 16 of 2019 concerning Amendments to Act Number (No) 1 of 1974 concerning Marriage has been amended in Article 7 regarding the age limit for marriage, which was originally 19 years for men and 16 years for women to 19 years for men and women. The amendment to the law is a follow-up to the decision of the Constitutional Court Number 22/PUU-XV/2017 which was handed down on December 13, 2018. After the revision of the Marriage Law was enacted, the Solok Religious Court experienced a surge in requests for dispensation from marriage. This research is a legal research with descriptive analytical research specifications. The approach used is a normative juridical approach as the main approach, supported by an empirical juridical approach. The data used are primary data as the main data and secondary data as supporting data collected through field studies using interview techniques and literature studies. The data was then analyzed qualitatively and presented in a qualitative descriptive form.

Abstract

Article 310 paragraph (3) of Law Number 22 of 2009 concerning Road Traffic and Transportation regulates the types of serious traffic accidents. This research is an empiricaljuridical research. Settlement of heavy class traffic accidents with a restorative justice approach as an alternative model for solving traffic violations at the South Pesisir Resort Police is carried out by forgiving each other by both parties, then the crashing party undertakes to provide compensation to the victim, and helps with medical and repair costs. victim's vehicle. The victim is willing to do restorative justice because an accident is a disaster for road users. No one wants this problem so that the settlement is considered fair. The parties made peace in writing which was known to the Wali Nagari where the victim was domiciled, so the letter was handed over to the traffic accident investigator that both parties in the traffic accident case wanted to resolve it amicably. Obstacles in solving heavy traffic accidents using the Restorative Justice approach at the Pesisir Selatan Police are first, the settlement of traffic crimes through restorative justice for heavy class accidents does not yet have a legal umbrella; secondly, the amount of compensation demanded by victims is often too large to give the impression of being used as a means of seeking profit; third, the limited economic capacity of the perpetrators of traffic crimes (severe class accidents); fourth, the involvement of certain parties that are not directly related to the accident often becomes an obstacle to reaching an agreement between the perpetrator and the victim.

Abstract

Reports of cases of illegal logging that occurred in areas of West Sumatra province were based on data from the Ditreskrimsus and Satwil Sejajaran Polda West Sumatra that reports of criminal acts of illegal logging at the Pasaman Police were 5 (five) cases, Dharmasraya Police were 2 (two) cases, Pesisir Selatan Police with 9 (nine) cases, Tanah Datar Police with 3 (three) cases. This study uses an empirical juridical approach. The Application of Elements of Crime by Investigators at the Tanah Datar Police Criminal Investigation Unit Against the Action of Logging Trees in Protected Forest Areas. Subjectively the element applied is "everyone" which is aimed at the person who did it. The suspect was logging trees in a forest area that was not in accordance with the forest utilization permit located in the Bukit Mantobak Forest Area in the Guguak Bancah Jor area. Galanggang Nag. Edge Selo Kec. Lintau Buo Utara Kab. Flat Land. The objective element is the act committed, namely illegal logging of trees in the forest area. While Article 55 paragraph (1) to 1e of the Criminal Code is applied because it is done jointly because there are people who order to cut down trees in the forest area without having a permit and the others are people who participate in committing a crime. Obstacles in the Application of Elements of a Criminal Act by Investigators at the Satreskrim Polres Tanah Datar for the Action of Logging Trees in Protected Forest Areas is an internal factor, namely the human factor (law enforcement officials) where the lack of technical skills related to mastery in the field of licensing in the forestry sector. External factors include the relatively low level of public legal awareness, the reluctance of members of the public to become witnesses, because they are busy and because they are threatened by suspects.

Abstract

Penulisan ini bertujuan untuk mengkaji lebih dalam tentang bentuk perkara anak yang berkonflik dengan hukum dalam perkara putusan Nomor 5/Pid.Sus-Anak/2022/PN.Jkt.Pst dan Nomor 24/Pid.Sus-Anak/2021/PN.Jkt.Brt. Metode penelitian yang digunakan yuridis normatif dengan data sekunder dan penelitian pustaka, kemudian data dianalisis secara kualitatif serta mengacu pada konsep doktrinal hukum yang berlaku saat ini. Hasilnya tidak tepat di mana hakim tidak melakukan diversi yang harusnya wajib dilakukan bagi perkara pengadilan pidana anak yang berhadapan dengan hukum untuk mengambil langkah diversi. Untuk melaksanakan proses diversi agar anak dapat menyelesaikan perkara di luar pengadilan yang merupakan perwujudan dari Pasal 59 Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak, di mana pemerintah dan lembaga negara lainnya berkewajiban dan bertanggung jawab untuk memberikan perlindungan khusus kepada anak antara lain dengan memperbaiki hambatan penyidik unit perlindungan perempuan dan anak, diantaranya yaitu: tidak semua ABH memiliki status keluarga yang lengkap dan jelas atau bahkan tidak mengetahui keberadaan orang tua dan keluarganya dan belum banyak yang memahami semangat diundangkannya Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, berdampak pada pihak korban yang sering mengajukan ganti rugi melebihi batas kemampuan keluarga anak sebagai pelaku.

Abstract

Guidelines (GBHN) of Indonesia, including through the Decree of the People's Consultative Assembly (TAP MPR) No. II of 1988. Consumer protection is regulated by Law No. 8 of 1999 concerning Consumer Protection. Repressive protection is an effort to restore the losses suffered by consumers. In any consumer dispute resolution process, evidence is required. Under the Consumer Protection Law (UUPK), the burden of proof is shifted, as stipulated in Articles 19, 22, 23, and 28, where the burden of proof falls on the business entity obligated to prove its innocence. Evidence in civil procedure law is regulated in Article 163 of the HIR/283 RBg, following the ordinary burden of proof. This leads to a lack of harmony in the regulations, which can result in confusion and legal uncertainty in its implementation. This can hinder the achievement of the goals of consumer protection. Legal policy is the direction of future legal regulations, so when making laws, it is necessary to refer to Indonesia's legal policy. Based on the above reasons, the research problem in this study is how evidence is handled in the resolution of consumer disputes from the perspective of Indonesian legal policy. The research method used is normative. In conclusion, in the legal policy of consumer protection, especially in the dispute resolution process, there is a need for harmonization between the Consumer Protection Law (UUPK) and future civil procedural law to ensure legal certainty.
