Abstract

Investasi adalah penanaman modal yang biasanya dilakukan dalam jangka panjang, untuk pengadaan pembelian saham-saham dan surat berharga lain untuk memperoleh keuntungan. Seiring dengan perkembangan zaman, terdapat berbagai jenis investasi yang dapat dilakukan, salah satunya yaitu investasi berbentuk digital. Dengan kemajuan teknologi, kita dapat melakukan investasi secara daring dan bahkan terdapat mata uang digital. Perlindungan Hukum bagi Investor yang ingin melakukan Investasi digital diperlukan karena uang digital sangat rentan untuk menjadi kejahatan virtual. Salah bentuk Investasi secara Digital adalah dengan membeli Non-Fungible Token. Transaksi yang dilakukan biasanya berbentuk dalam gambar digital dan disimpan datanya di dalam teknologi yang bernama Blockchain. Abstract

Pasal 267 Undang-undang Nomor 22 Tahun 2009 telah mengatur tentang Tata Cara Penindakan Pelanggaran Lalu Lintas dan Angkutan Jalan. Ketentuan ini bertujuan untuk meningkatkan kepatuhan pengendara kendaraan bermotor roda dua dalam mematuhi peraturan berlalulintas sehingga terciptanya ketertiban dan kenyamanan di jalan raya. Namun walaupun aturan hukumnya sudah ada, dalam prakteknya masih banyak masyarakat yang melakukan pelanggaran lalu lintas seperti yang terjadi di Kota Bukittinggi. Spesifikasi penelitian ini bersifat deskriptif analitis, yaitu menggambarkan tentang penerapan Jumlah denda kepada pengendara kendaraan bermotor roda dua diwilayah hukum polres Bukittinggi. Sedangkan metode pendekatan yang digunakan adalah yuridis Normatif sebagai pendekatan utama dan yuridis empiris sebagai pendukung pendekatan utama dengan menggunakan data sekunder dan data primer. Teknik pengumpulan data adalah studi lapangan melalui wawancara untuk data primer dan studi kepustakaan untuk memperoleh data sekunder. Data yang diperoleh kemudian dianalisis secara kualitatif dan disajikan secara deskriptif kualitatif

Abstract

Pentingnya investasi semakin berkembang di era globalisasi, terutama bagi negara berkembang seperti Indonesia. Indonesia adalah negara berkembang yang memiliki jumlah penduduk yang sangat banyak dan mempunyai sumber daya alam yang melimpah. Indonesia masih terus berusaha untuk meningkatkan pertumbuhan ekonomi dengan tujuan untuk memperluas lapangan pekerjaan sehingga bisa memberikan kesempatan yang luas dan terbuka bagi masyarakat untuk bekerja, mengurangi kemiskinan serta pengangguran, meningkatkan pembangunan ekonomi yang berkelanjutan sehingga bisa terwujud masyarakat Indonesia yang maju, adil, dan makmur sesuai tujuan negara untuk memajukan kesejahteraan umum seperti yang diamanatkan dalam Pembukaan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Kebutuhan modal pembangunan yang cukup besar seringkali menjadi masalah yang signifikan di setiap negara berkembang, termasuk Indonesia. Ketika modal ini tidak dapat dipenuhi maka dari itu dibutuhkan investasi atau penanaman modal dari dalam negeri maupun luar negeri. Para penanam modal ini mempunyai berbagai macam pertimbangan yang harus dipikirkan secara matang sebelum mereka menanamkan modalnya pada suatu perusahaan ataupun pada suatu negara, salah satu pertimbangan tersebut adalah mengenai kepastian dan perlindungan hukum.

Abstract

Legal certainty is one of the aspects that can attract investors to invest in Indonesia, one of which is investment in infrastructure development. This investment is one form of funding other than the state budget to develop Indonesia. One of the schemes as an alternative funding for infrastructure development is Limited Cooperation for Infrastructure Financing (KETUPI) which until now has not been able to be implemented, one of the obstacles is the covid pandemic, so to attract investors it is necessary to improve regulations and harmonize other regulations in the context of implementing this KETUPI. The role of regulation is very important, one aspect that provides legal certainty is the substance of the law itself, so that existing regulations need to contain the spirit contained in investment, namely equal treatment, openness and one-stop service for various investment pilots.

Abstract

The Indonesian state continues to pay attention to the welfare of its people, especially health, which is part of human rights. This is stated in article 28 H paragraph (1) of the 1945 Contitution which state ; Everyone has the right to live a good and healthy services. Specifically regarding legal protection for health insurance policy holders, it is regulated in the Law of the Republic of Indonesia Number 20 of 2014 concerning Indurance. Health insurance claims in the form of claims from the insured aas the insurance policy holder. Teha insurance company or the insurer must make patments to the policyholder or the insured when making an insurance claim, this is a benefit of the health insurance they have. Health insurance is a financing system that provides social insurance in lieu of facing risks caused bya health users (illness), both diseases that can be cured on an outpatient care. This of course requires very high costs for a class of middle and lower economic people. Having health insurance is part of the risk management system, because when there is a disaster or illness, the policyholder does not need to think about the cost of treatment. Abstract

Online saving club is a group of people who use social media as a tool to raise money regularly at any given period. Saving club is recognized as an agreement even though it is often done. This online gathering is only done by agreement between several parties who participate in the gathering and is not written. If in the future there are problems such as defaults, it is very difficult to prove the form of the agreement is not written so that to resolve the problem, including the recognition of the parties participating in the social gathering. For this reason, this study will discuss what exactly is the position of the verbal agreement electronically and how its legal force is and what legal remedies are taken in the event of a breach of contract. This research was conducted by reviewing and focusing on the application of "Normative Juridical" legal rules, so the method used in this research is the normative juridical method related to civil law laws, especially the Legality of the Unwritten Agreement on Online Saving Club. The unwritten agreement in the online social gathering is legal and binding for the maker based on the principle of freedom of contract. The unwritten agreement in this online social gathering still has legal force with the backwardness of legal evidence in accordance with the ITE Law. The legal consequences of default are compensation and other legal remedies that have been agreed at the beginning of the agreement.

Abstract

The problem with law enforcement for environmental crimes is that in prosecuting perpetrators of environmental crimes, the emphasis is still on the element of error. The implication of this problem is that it is difficult to prove environmental crimes, considering that the perpetrators of environmental crimes are not only people (natuurlijk person) but also include corporations (recht person). Legislation regarding the environment, especially Law Number 32 of 2009, has determined responsibility for perpetrators of environmental crimes using the strict liability theory. This article will discuss the implementation of strict liability theory to find the ideal concept for dealing with environmental crime. The method used in writing this article is normative legal research with a statutory approach. The results of this research are the ideal concept of corporate responsibility for the occurrence of environmental crimes in the form of payment of compensation (civil) and punishment of perpetrators (criminal sanction).

Abstract

Evidence in criminal procedure law plays a very important role in the criminal proceedings. Because, in criminal procedural law, evidence is considered extremely important because its main purpose is to discover material truths in discovering criminal cases. To reveal the truth of the case, evidence is the main method used by the judge to determine whether the defendant committed a crime or to obtain the necessary basis to make a decision to resolve the case. Relevant evidence has been further stipulated in Article 184 of the Criminal Procedure Code, specifically: testimonies of witnesses, expert statements, letters, instructions, and statements of the accused. The evidence provision mechanism in criminal justice today is increasingly enriched thanks to the presence of the concept of amicus curiae or friend of the court. Amicus curiae is defined as a party who feels interested in a case and gives his legal opinion to the court. However, stakeholder participation is limited to providing opinions and is not intended to interfere with the judge. In the development of existing evidence and evidence mechanisms, one of them is the Amicus Curiae (Friend of the Court). Amicus Curiae is a third party who feels interested in a case, provides legal advice to the court and does not intend to interfere with the judge. Amicus curiae has not been clearly regulated in Indonesia, but in principle it is accepted based on clause 5, paragraph 1 of the Judicial Power Law "Judges and constitutional magistrates are required to learn, comply with and understand legal values ​​and the sense of justice. exist in society. Furthermore, the admission of amicus curiae can be found in article 180, paragraph 1, of the Code of Criminal Procedure, which states that "In case it is necessary to clarify a question raised in the 'trial, the presiding judge of the court may be asked to provide expert information and may also request the parties involved to submit new documents.The premeditated murder committed by defendant Richard Eliezer in the Jakarta area is an example of a case involving amicus curiae.

Abstract

Penelitian ini bertujuan untuk menganalisis perubahan dalam pengaturan tindak pidana korupsi sebagai kejahatan luar biasa dalam Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana atau kerap disebut sebagai KUHP Nasional. Penelitian ini menggunakan pendekatan normatif untuk menganalisis teks hukum yang relevan dan perubahan yang terjadi seiring waktu. Metode analisis deduktif digunakan dengan menerapkan premis mayor berupa prinsip-prinsip hukum dan ajaran terkait kejahatan korupsi, serta premis minor berupa fakta atau peristiwa hukum yang ada. Temuan utama penelitian ini adalah bahwa pembaharuan pengaturan tindak pidana korupsi dalam KUHP Nasional berpotensi menghilangkan sifat kekhususan tindak pidana itu sendiri, yang dapat menimbulkan akibat terhadap upaya pemberantasan kasus korupsi di Indonesia. Kendati demikian, perubahan tersebut mencerminkan usaha untuk mengadaptasi hukum dengan dinamika sosial dan politik, serta memperkuat kerangka hukum dalam memberantas korupsi. Penelitian ini memberikan wawasan tentang perkembangan hukum korupsi dalam konteks nasional dan dampak dari perubahan hukum tersebut terhadap upaya pemberantasan korupsi. Implikasi penelitian ini diharapkan dapat memberikan pemahaman yang lebih mendalam tentang dinamika hukum dalam menghadapi tindak pidana korupsi serta memberi sumbangan dalam perbaikan lebih lanjut terhadap pengaturan hukum terkait.

Abstract

The aim of this study is to examine and comprehend the legal foundation and implementation of legal protection for victims of malpractice by hospitals in Indonesia. This research seeks to assess the degree to which victims of malpractice receive legal protection and hold hospitals and involved medical personnel accountable. The research methodology employed is a literature study, encompassing secondary data collection through books, law journals, research findings, and pertinent legislative documents. Various legal sources are scrutinized in this research, including Law Number 8 of 1999 on Consumer Protection and Law Number 17 of 2023 on Health. The findings reveal that there are legal frameworks providing protection for victims of malpractice, such as Law No. 44 of 2009 on Hospitals and Health Law No. 17 of 2023. Nonetheless, challenges persist in the implementation of legal protection for malpractice victims, particularly concerning the legal procedures that victims must navigate to secure compensation and accountability from hospitals or medical personnel.
