Abstract

Enforcement of criminal law at the examination stage in court hearings plays a crucial role in SPP. The court decision is the end of this stage. The heart of a court decision is the judge's legal considerations and ruling. The judge's legal considerations explain why his decision was such. One thing that is often included in the judge's legal considerations is the reason for mitigation which is the cause of the judge's decision regarding the sentence being reduced. In practice, the judge's legal considerations and rulings are not always in line with the Supreme Court's cassation decision Number 3287 K/Pid.Sus/2019. The type of research in this writing uses normative legal research, a type of secondary data with a library research method which is then analyzed using qualitative methods and drawing conclusions deductively. The reasons for mitigation in the court's decision are manifested in the judge's legal considerations. For reasons of mitigation, the judge handed down a lighter sentence to the defendant. The verdict, which carries a lighter sentence, is given by the panel of judges by including the reasons for mitigation in the legal considerations so that the Ratio Decidendi is created, and the decision can be justified. Article 95 of the Juvenile Criminal Justice System Law states that judges who make mistakes in deciding cases can receive punishment in the form of administrative sanctions in accordance with statutory provisions. In practice, in the Supreme Court's cassation decision Number 3287 K/Pid.Sus/2019, the panel of judges gave a lighter sentence decision than the public prosecutor demanded but did not explain the reasons for mitigation in their legal considerations, on the contrary what was explained was the reasons for aggravation, even though this is required in Law on Judicial Power to judges. Thus, the decision is contrary to the law, materially flawed and cannot be held accountable by the panel of judges because it does not present the Ratio Decidendi which is the mandate of Article 8 paragraph (2) of the Judicial Power Law that in considering the severity and severity of the crime, the judge must be obliged to clearly see the nature of the crime. good and bad of a defendant.

Abstract

Kesejahteraan seluruh rakyat Indonesia merupakan cita-cita seluruh bangsa Indonesia. Salah satu cara untuk mewujudkan cita-cita luhur tersebut adalah dengan memaksimalkan seluruh sumber daya alam dan manusia yang ada, didukung oleh aspek permodalan yang kuat, pengetahuan yang maju, dan peralatan yang berteknologi tinggi. Untuk memaksimalkan potensi tersebut, diperlukan peran serta investor asing dalam pengolahan sumber daya alam, transfer ilmu pengetahuan, dan penyediaan fasilitas produksi berteknologi tinggi. Namun penanaman modal asing langsung di Indonesia harus dilakukan dalam bentuk pendirian perusahaan patungan antara penanam modal asing dan penanam modal nasional, sebagaimana diatur dalam Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal. Di sisi lain, untuk mengundang investor asing diperlukan kemudahan dan kenyamanan berinvestasi, seperti keringanan dan/atau pengurangan pajak, potensi keuntungan bagi kedua belah pihak, dan tentu saja aturan hukum yang jelas dan adil bagi investor asing. Sehingga investor asing tertarik untuk menanamkan modalnya di Indonesia. Dengan begitu, keuntungan besar bisa diraih pemerintah Indonesia untuk membawa kesejahteraan bagi seluruh bangsa Indonesia.

Abstract

Penelitian ini menyelidiki lanskap investasi digital, dengan fokus pada kerentanan investasi online terhadap aktivitas penipuan. Penelitian ini membahas tentang landasan hukum dalam berinvestasi, bertujuan untuk memahami perlindungan hukum yang diperlukan bagi investor di era digital. Dengan kemajuan teknologi, investasi online menjadi lazim, membawa tantangan dan risiko terkait praktik penipuan. Dalam konteks investasi online, kemudahan akses juga menarik skema penipuan. Kasus yang melibatkan seorang mahasiswa yang berhasil menipu 338 investor dengan skema investasi valuta asing menggambarkan seriusnya permasalahan ini. Untuk melindungi investor dari risiko yang terkait dengan investasi online, perlindungan hukum sangatlah penting. Kerangka hukum yang ada, seperti UU Pasar Modal dan Otoritas Jasa Keuangan (OJK), harus memberikan kejelasan mengenai kompensasi kerugian. Meskipun ada upaya yang dilakukan BKPM dan OJK, investasi online yang curang masih tetap ada, sehingga memerlukan eksplorasi strategi pencegahan secara menyeluruh. Studi ini berkontribusi pada pemahaman tentang aspek hukum investasi online dan upaya berkelanjutan untuk melindungi investor. Melalui kajian yang komprehensif, penelitian ini bertujuan untuk meningkatkan kesadaran akan perlindungan hukum yang dibutuhkan masyarakat dalam ranah investasi digital.

Abstract

This study discusses agreements regarding various issues that arise in connection with the Enhancement and Protection of Foreign Investment (P4M) as agreements that encourage protection against capital restrictions, but often cause lawsuits that can cause losses from the Indonesian side. Therefore, it is necessary to have a P4M moratorium so that Indonesia needs to review clauses that are detrimental to Indonesia and carry out renegotiations with foreign parties. In the event that a dispute arises between Indonesia and foreign investors, it can be resolved through The International Center for the Settlement of Investment Dispute (ICSID) by taking into account the interests of Indonesia. This research was conducted in a juridical-normative way with a literature study.

Abstract

This research aims to analyze the legal implications of APHT registered by PPAT for more than 7 (seven) working days at the Luwu Regency Land Office. This research was conducted using Normative research methods. The data obtained, both primary data and secondary data, are categorized according to the type of data. The results of this research show that late registration of the Deed of Granting Mortgage Rights (APHT) will affect the birth time of the Mortgage Rights thereby causing losses for the parties, based on Article 23 paragraph (1) Law Number 4 of 1996 concerning Mortgage Rights, Officials Land Deed Makers (PPAT) will be subject to administrative sanctions, in the form of: verbal warning; written warning; temporary dismissal from office; dismissal from office. The guarantee itself provides legal protection for creditors. 4) Late registration of the Deed of Granting Mortgage Rights (APHT) does not cause the deed to be null and void.

Abstract

At the Panyabungan Jae gold mine location there was a waste leak, this waste leak caused losses due to fish pond harvest failure in the area. This research aims to find out the gold mine's compensation obligations for failed harvests in farmers' fish ponds. This research uses a qualitative method with an empirical juridical type of research, where the phenomenon to be studied is the phenomenon of crop failure caused by leakage of gold mining waste. Data was collected from observations and interviews with related parties, namely interviews with the mine and interviews with the pool owner. From the results of this research, it was found that in Islamic law, one party's mistake causes harm to the other party, so they have to fight. This is in accordance with what is explained in MUI Fatwa No. 22 of 2011 that gold mining business actors are obliged to offer to improve the environment and compensate for losses from fish pond harvest failures caused by waste leaks which result in losses for local residents in utilizing river flows. for irrigating rice fields and for daily needs, especially for fish pond farmers.

Abstract

This article discusses the position of a Land History Certificate or "SKT", when used as proof of ownership of a plot of land in general or when litigating in court. The purpose of this writing is to provide education regarding the existence of SKT which is used as proof of land ownership and its position at the level of land law in Indonesia. The results of the research are that a certificate is the highest proof of control and ownership of land, so that normatively there is no single piece of evidence, including SKT, which can replace the position of a certificate in the context of proving land rights. However, the process of obtaining a certificate is not easy, which is an obstacle, so there is still a lot of land that has not been certified. The assumption that SKT is strong evidence is still often found in society. This perspective results in the land certification process becoming less important and having a certificate is not a necessity. SKT is considered capable of providing a sense of security for its holders. For SKT holders, by referring to the mixed publication system adopted in the land registration regulations, in terms of evidence, it is possible for the SKT to become proof of land ownership. The negative publication system with positive elements means that the Certificate is strong evidence, but not absolute, so that anyone who feels most entitled as the holder of land rights, should be able to prove themselves with the evidence they hold.

Abstract

The increasingly widespread problem of personal data leakage in Indonesia has become a concern for many parties, considering that protecting personal data is one of the human rights that must be protected. One sector that is vulnerable to being targeted by hackers is the financial technology sector or often called fintech. In 2020, a cyber attack occurred which caused a fintech platform called Cermati to experience a data leak which resulted in the leaking of 2.9 million users' data. This of course raises questions about how accountable the organizers are for this event. For this problem, the author will analyze in more depth using normative juridical methods regarding the form of accountability for the Cermati organizing body. The research results show that in fact Law Number 19 of 2016 concerning Electronic Information and Transactions, Law Number 27 of 2022 concerning Personal Data Protection, Law Number 4 of 2023 concerning Development and Strengthening of the Financial Sector, and Financial Services Authority Regulation Number 10/POJK.05/ 2022 of 2022 concerning Information Technology-Based Joint Funding Services has provided an accountability mechanism for personal data controllers, namely PT. Dwi Cermat Indonesia, where customers who experience losses can file civil lawsuits for material and non-material losses, as well as apply for administrative sanctions to PT. Dwi Cermat Indonesia due to the lack of complete and in-depth notification regarding the leak case that occurred. Apart from that, there needs to be direct education by other fintech organizing bodies to customers to prevent personal data leaks.

Abstract

The issue of foreign workers is increasingly receiving media and national attention. However, to date research into the nature and consequences of employing foreign workers in Indonesia is still limited. The introduction of significant changes in the recruitment phenomenon ended in a painful and traumatic atmosphere that was almost unacceptable for the local workforce in Indonesia. This research aims to look from an industrial relations perspective which plays an important role in employing foreign workers. The research results will show the employment status of local workers and the rights of local labor unions which are affected by the use of foreign workers. In addition, the research provides a number of recommendations, including the need for further development in reducing the employment of foreign workers and better targeting of vulnerable foreign workers in relation to labor laws.

Abstract

Criminal acts of theft that occur in Indonesia are not only committed by the general public, there are also thefts committed by several elements of the state apparatus, such as theft committed by members of the Indonesian National Army (TNI). If during the term of office a member of the TNI carries out activities against the law or this is related to a criminal act, the Military Police have the authority to carry out the inquiry and investigation process in accordance with the applicable rules and SOPs in the Criminal Procedure Code (KUHAP) and the Law. -Law Number 31 of 1997 concerning Military Justice. In Article 69 paragraph (1) of Law no. 31 of 1997. Normative research is used by the author because it applies legal theories and positive legal regulations in analyzing legal criminal sanctions. Meanwhile, the results obtained from this writing are that the main criminal sanction is imprisonment, and additional criminal sanctions are in the form of dismissal.
