Abstract

Service agreements have been known for a long time by the public because they allow easier access to running a business that generally needs to go through a complicated process and takes a long time. This is utilized by parties who have direct access to take care of certain business licenses, for example, the legality of becoming a distributor agent. The problem in this research focuses on the refund agreement letter between Nureni and Ika Jatnika which was made in the form of a deed under the hand. This letter arose because Ika Jatnika had made a default against Nureni. This research is normative legal research using qualitative method. The research legal materials are obtained from literature study and interviews which will be examined with the approach of laws and cases and analyzed qualitatively. The results of this study indicate that the parties are still protected by law because the deed under the hand has valid evidentiary power based on Article 1338 of the Civil Code and the protection of the parties depends on the strength of the type of deed made. The conclusion of this research is that the legal protection of the parties who make a deed under the hand is subject to Article 1338 of the Civil Code and the parties still have the right to claim compensation for material losses they receive.

Abstract

The growth of illegal shrimp ponds in Batang Anai, Padang Pariaman Regency has been very widespread recently. This is because the advantages of shrimp cultivation include fast growth, high survival rate, high shrimp appetite, greater resistance to disease attacks and relatively short rearing time, namely 90-100 days per cycle. As shrimp cultivation develops in this area, environmental pollution problems arise. Of course, this is contrary to Law number 36 of 2009 concerning Health, Article 4 and Article 6 states that everyone has the right to health and everyone has the right to a healthy environment for achieving a level of health. Based on preliminary interviews with the community around the shrimp ponds, it was stated that the existence of illegal shrimp ponds does not take into account the impact on the environment, and even disturbs the community. Meanwhile, there is no action by the district or local government to control or manage the impacts, so various efforts are needed to restore optimal health status for the surrounding community.

Abstract

The issuance of Government Regulation (PP) No. 39 of 2021 concerning the Implementation of the Halal Product Guarantee Field and Minister of Religion Regulation No. 20 of 2021 concerning Halal Certification for MSEs. Self Declare independent halal application service helps businesses to obtain halal certification effectively and efficiently. But in its implementation, there are several differences in the process of issuing halal certification and legal guarantees for registered products. In this study the authors used a legal methodology system Descriptive analysis method used for specifications. The data collection techniques used are direct observation and documentary research. Data conducted through empirical juridical data analysis strengthens the validity of the research to test the effectiveness and legal security of the self-declared halal certification process.

Abstract

This article explores the urgency of social rehabilitation for drug-addicted inmates within the confines of correctional facilities. Substance abuse has become a serious issue affecting various segments of society, including those ensnared within the criminal justice system. Social rehabilitation within correctional institutions is crucial in addressing this problem. Through a rehabilitative approach, drug-addicted inmates can receive guidance, support, and the necessary skills to reintegrate into society as productive individuals. This article underscores the importance of social rehabilitation as an integral part of efforts to rehabilitate drug-addicted inmates, with the hope that these measures will have a significant positive impact on behavioral change and their overall recovery.

Abstract

An agreement is a written or oral agreement made by two or more parties, each of whom agrees to obey what is contained in the agreement. This research uses a normative juridical approach and analysis. The research findings and discussion involve aspects such as the protection of good faith parties, the principle of good faith in the execution of agreements, and the legal implications of PPJB. The research conclusion emphasizes the importance of good faith in sale and purchase transactions, the need for legal protection for good faith parties, and the significant role of PPJB as a binding legal instrument. In the context of property sale and purchase, PPJB is perceived as an important means to protect the interests of the parties involved.

Abstract

Destructive actions can be categorized as vandalism. This destructive action is common in tourism areas. Tourism is an important sector of national economic development. The tourism sector faces challenges in the form of acts of vandalism on public facilities that result in losses for the tourism sector and indicate the existence of social diseases in Indonesia. This problem is important to be addressed through law enforcement and prevention efforts in accordance with the principles of good governance because the lack of government supervision in terms of order has caused problems in the form of a social disease called vandalism which is rampant in tourism sites. Therefore, it is necessary to conduct research to examine legal prevention and efforts to prevent this act of vandalism in terms of the principles of good governance. The method used for this research is the normative juridical method in which the research focuses on positive legal norms written in and the Criminal Code (KUHP) relating to sanctions. The purpose of this research is to find out whether law enforcement and prevention of acts of destruction in the tourism environment are in accordance with the principles of good governance. The form of sanctions against the perpetrator is regulated in the Criminal Code. One of the efforts that can be made to reduce this act of destruction in accordance with the principles of good governance is to facilitate these street artists to help the government beautify tourism in Indonesia.

Abstract

Information technology can be used to commit a wide variety of crimes, including online gambling, automated teller machine theft, corporate data theft, and fraud through electronic media. As victims of fraud crimes often lack access to legal assistance and receive little attention from the criminal justice system as a whole - especially in terms of human rights - laws are therefore needed to control them. The author concludes that Article 28 paragraph (1) of the Electronic Information and Transaction Law and Article 378 of the Electronic Information and Transaction Law regulate in terms of positive law regarding the legal protection of mobile banking users as victims of internet crimes. Article 378 of the Criminal Code, which provides legal protection to consumers of M-Banking users against potential losses, is evident in the Law on the protection of witnesses and victims, a special regulation relating to the protection of victims. Even so, witness and victim protection laws offer protection to victims from illegal activities that place witnesses and victims in dangerous situations that could endanger their lives. Electronic information and technology laws offer protection to suspects and defendants through case resolution and criminal sanctions; in contrast, the criminal procedure code protects victims through the right to report, the right to organize public prosecutors, and the right to combine criminal and civil prosecutions to obtain compensation.

Abstract

In transferring rights to land and buildings by way of sale and purchase, the requirements for the formation of an agreement are sufficient based on the agreement between the parties and an agreement. Article 1320 of the Civil Code explains the conditions for the validity of an agreement. In the process, the transfer of land rights is carried out by prioritizing the principles of light and cash, if an agreement has a defect in the subject, the agreement can be canceled, while there is a defect in the object, it is null and void. PPAT plays an important role as an authorized official in making a Sale and Purchase Deed, in this case PPAT is responsible for the product it has made and its making must be in accordance with applicable laws and regulations. If a PPAT commits an act that is not in accordance with the applicable regulations, there are legal consequences that will become a problem in the future. The type of research used is normative. To support this research, the author uses a literature study type of research, which examines several documents related to this research. The method in this research is a normative method with a statutory approach. The research data shows how the problem of the price discrepancy in the Sale and Purchase Deed with the actual price.

Abstract

The SKB ITE was established as a guideline for the implementation of specific articles within the Electronic Information and Transactions Law (UU ITE) that were deemed inherently confusing in their execution. However, the legality of the SKB ITE remains a current issue, particularly concerning its issuance procedures and status. This research employs a normative legal research approach. The findings indicate that SKB ITE serves as an implementation guideline for the UU ITE that lacks a legal basis and violates the Law on Legislation Formation, as its establishment does not conform to the prescribed mechanisms, thus SKB ITE must be declared null and void. Nonetheless, a subsequent issue arises regarding the divergent interests between legislators, regulatory observers, and all of whom are demanding amendments to the UU ITE. Considering the invalidity of the SKB ITE, the most appropriate course of action would be to revise the UU ITE by incorporating the substantive aspects outlined in the SKB ITE and aligning it with the provisions of cybercrime in the New Indonesian Criminal Code. Through these changes, the need for a implementation guideline for the UU ITE can be addressed, thereby enhancing the effectiveness of its implementation and reducing societal controversies surrounding it

Abstract

In making grants of land and buildings according to civil law, it is regulated in the Civil Code (KUHPerdata) article 1666 which states that a gift is an agreement where the donor gives a gift while still alive to the recipient of the gift free of charge and cannot be withdrawn. return, hand over an object for the purposes of the recipient of the gift who receives the delivery of the object, in general to make a gift of land and buildings by making a deed of gift to the PPAT, the making of this deed of gift is attended by the parties, in this case the giver and recipient of the gift and witnessed by at least 2 (two) witnesses who meet the requirements, then the grant deed is registered at the Land Office, pays taxes, namely Income Tax (PPh) and BPHTB on the grant, then transfers the name of the certificate to the Land Office based on the grant. The type of research used in this research is normative. To support this research, the author used a library research type of research, which examined several documents related to this research. The method in this research is a normative method with a statutory regulatory approach. Research data shows the strength of the Deed of Grants for Land and Buildings According to Civil Law (Case Study of Bekasi District Court Decision Number 236/PDT.G/2022/PN.BKS).
