Abstract

Islamic Jurisprudence is a knowledge on the practical Islamic law based on its detailed approve concerning with the deeds of human. This article discusses on the position of Jurisprudence in relation with two different functions, indeed as a positive law and moral standard. In order to derive the Islamic law from its primary sources, al-Qur’an and the Sunnah, Islamic Jurisprudence needs theoretical tool and methodology which commonly named as the Principle of Islamic Jurisprudence. So the Islamic Jurisprudence is considered as Islamic epistemology which stands as the basis of the development of Islamic Jurisprudence as a knowledge. As the basis of epistemology, the principle of Islamic Jurisprudence is closely related to theology. Furthermore, this knowledge develops a principle on adillah which its foundation has been constructed by Syafi’i, indeed al-Qur’an, the Sunnah, Ijma’ and Qiyas. Since constructed by Syafi’i, this Principle of Islamic Jurisprudence has some changes and innovations. This innovation has been in the long duration of time with complicated problems and helped the ummah to solve the problems.

Abstract

A theory on naskh which develops grantedly in the Islamic sciences, naturally raises a controversy, which indicates that this concept is arguable and discussable. On the other hand, contemporary muslim scholars have solved significantly on this controversy. This article tries to present some problems of naskh in relation with the Holy Al-Qur’an. Among the problems discussed in this regard is a controversy on the meaning of naskh, particularly in the development of Interpretation of Quranic verses in relation to the development of Islamic jurisprudence. The view of muslim scholars and their argumentation to approve the nasikh-mansukh in the Al-Qur’an is also another point to be presented which argued by the view of contemporary Muslim scholars who criticize this concept. Finally, it is concluded that a theory on naskh is contemporary issue which is exaggerated and developed not on the basis of an adequate scientific criticism, therefore, muslim ummah should consider this problem as a logical consequence of the topic (al-tah} ayyuz al-mawdhû‘iy).

The role sahabiyyat companions of the Holy Prophet Muhammad PBUH has given many examples in political participation. These political dimensions may be seen from their activities. All political roles of female companions of the Messenger of Allah is considered as the implementation of Muslimah politics at the time being. Yusuf Qardhawi is among vew Muslim scholars who concerns upon the role and participation of Muslimah in politics. In the view of Qardhawi, Islam has practiced democracy to lay on the principle and norms of democracy itself. A Muslimah supports democracy with consideration that democracy is a mechanical authority to actualize the political principles of Islam, such as in the leadership election, organizational consultation, a media of commanding the truth and avoiding the false, against tyrannies and avoiding the vise , particularly at the unbelieving in Allah. Even though, the political participation of a Muslimah has faced many obstacles external as well as internally.

Abstract

Scholarly interest in the thought and teachings of Shâh Waliyyullâh adDihlawî has increased in recent years –not surprisingly, given the richness and profundity of his writings. This article explores the mystical dimension of prophecy emerging from Shâh Waliyyullâh’s insights and remarks, focusing on the key concepts such as the World of Images (‘Âlam al-Mithâl), the Highest Council of Angels (al-Mala’ al-A‘lâ) and the Holy Enclave (Haz} îrat al-Quds), which help explain how, from the sûfî point of view, prophecy is possible. The main task of a prophet is to set up order in social, political and economic life of people. The prophet receives revelation which enables him to communicate the Divine Message to mankind containing all that is necessary for their welfare both in this life and the next according to the Divine Plan.

Abstract

The depiction of Mulla Sadra’s philosophy could be best out by referring to his magnum opus, al-Hikmah al-Muta’aliyah, usually referred to as al-Asfar alArba’ah. The book contains almost all aspect of philosophy such as theory of essence and existence, subtance, movement, time, world order, knowledge, intellect and the likes. In addition, being Muslim peripatetic, he also gives special interest on the demonstrating the concept of God and eschatology. The summary below could hopefully be instrumental for paying particular interest in further studying Mulla Sadra thought for academic pusposes. The point interest, however, is to be found in his repudiation againts Ibn Sina’s concept of Essence and Existence. Whereas Ibn Sina vindicates the essence rather than existence, Sadra gives priority to existence rather than essence. Not only has Mulla Sadra differed from Ibn Sina and other Muslim peripatetic on the issue of essence and existance, but also on the problem of substance, movement, time.

Abstract

The tajdid (renewal) which involves the meaning of the non-existence invention should have the guidelines based on Islamic Law. By these guidelines, there will be no space for destructing religion in the name of tajdid. Consequently, the discussion on tajdid guidelines is an Islamic matter, so that the confusion between the right and the wrong will be eliminated. Tajdid is neither a complete chaos nor a strong desire to remove all religion’s original form. Also, it does not mean to do a judgment to the efforts done by the early Muslim scholars and who came after them, but tajdid in Islam should be based on the guidance given by Allah in order to achieve the aim of being deputies and empowerment in this world. Thus, it should not exceed the area of rules which are semi definitive (al-ahkam al-zanniah) which is the area of conducting ijtihad. Finally, the guidelines of tajdid in Islam comprise the rational knowledgeable, moral and Islamic guidelines, by which, the tajdid will be prevented from the misuse.

Abstract

The renewal in worship has specific characteristics, guidelines and areas. The worship does not accept a development, does not change with time and are not the subject of ijtihad, analogy (qiyas) and consensus of the ummah (ijma’). Islam has specified and made the unchangeable pillars and foundation to form it. Also, Islam has established a certain time, quantity and condition which do not accept changing or interpretation as it contain a commitment of fully worship. In the areas of tajdid in Islamic jurisprudence, there are rules derived from the text (nas) zanny al-tsubut (semi definitive in its affirmation and linkages) or zany al-dilalah (ambiguous/equivocal in the way they relay their meanings) or zanny in one of both (tsubut al-dilalah), here (in these rules) ijtihad can be done. Moreover, as the circumstance and the needs are developed and various, ijtihad is also done in the area in which the text (nas) and consensus are absent. Finally, this ijtihad leads to different opinions among muslim scholars, thus, the comparison area in worship requires three different guidelines i.e. Islamic guidelines, rational knowledgeable guidelines and moral guidelines.

Abstract

This research tries to compare between the position of Abu Hamid alGhazali and the position of Abu al-Walid ibn Rushd in the question of the size of the universe and the possibility of it to be greater or smaller. Al-Ghazali says the possibility of the universe to be greater or smaller than it is, while Ibnu Rushd denies such possibility. According to the latter, if the universe is greater or smaller than it is, it will lead to the possibility of the existence of a magnitude which has no end. In this discussion, Ghazali relies on the Mutakallimin position of the universe concept, while Ibnu Rushd prefers to base his idea of universe on the philosophers such as Aristotle.
