Abstract

Sexual violence on campus is a crime against humanity that is difficult to uncover because of professors’ power relations and domination over students. Power relations also manifest at the structural level so that sexual violence is often dismissed and silenced by the administrators. The campus environment’s hierarchy of status and positions makes sexual crime cases go on for years without any accountability. On the other hand, there are efforts such as the collective action of lecturers across faculties to protect victims from the perpetrators and bring the perpetrators to justice. This study describes the author’s experience in dealing with sexual violence on campus and using a reflexive approach in addressing sexual violence in Indonesia.

Abstract

Despite growing of internet users and digitalizing economy as result of Industry Revolution 4.0, Indonesia experiences with digital divide in which young women are still left behind in the digital economy. To address the issue, affirmative action in accessing skills development and labour market are crucial. The aim of the study is observing whether affirmative action for women exist and it helps to address the issue. The paper uses mixed qualitative and quantitative methods in which primary and secondary data collected respectively through interview, and online survey as well as literature review. The study argues that the affirmative action will not be adequate to address gender inequality in the digital economy, unless integrated approaches through capacity building and women engagement are in place. The paper concludes that the affirmative action is only effective if the intervention integrated with skills development and women engagement at various level of process for policy formulation and its implementation.

Abstract

This article will describe the research’s result on the experiences of the members of ‘Forum Pengada Layanan’ or Service Provider Forum (FPL), a civil society initiative, in handling the victims of sexual violence. Through FPL's experience, this article will analyze the importance of legal protection and the availability of financial and human resources, in handling and protecting victims of sexual violence. This research was conducted using mixed methods, through surveys and in-depth interviews. This article concludes that the legal umbrella regarding the elimination of sexual violence with victims’ perspective would provide stronger foundation for protection, legal processes, and the availability of resources in handling cases of sexual violence in Indonesia.

Abstract

The Indonesian Witness and Victim Protection Agency (LPSK in Indonesian) was established based on Law No.13/2006 Protection of Witness and Victims, which was later amended by Law No 31/2014. It is an independent non-structural agency headed by seven commissioners for 5-year terms. One of the Agency’s priority crimes is sexual violence. The Agency protects witnesses, victims, whistleblowers, justice collaborators, and experts. For the years 2019-May 2021, the Agency has given protection to a total of 984 victims of sexual crimes, consisting of 67 percent children and 33 percent adults. Out of that, 78 percent are female victims compared to 22 percent male victims. Based on Law No. 31/2014, there are 16 types of witness and victims’ rights. The three most sought-after protection programs for victims of sexual violence are Procedural Rights, Psychological Rehabilitation, and Restitution Facilitation. For prevention programs, we need to learn who are sexual violence perpetrators.

Abstract

This article was formulated based on interviews with 5 (five) trade union confederations from a number of confederations in Indonesia, namely: Konfederasi Serikat Pekerja Nasional (KSPN), Konfederasi Sarikat Buruh Muslimin Indonesia (KSarbumusi), Konfederasi Serikat Buruh Seluruh Indonesia (KSBSI), Konfederasi Serikat Pekerja Indonesia (KSPI), and Konfederasi Kongres Aliansi Serikat Buruh Indonesia (KKASBI). This article seeks to explore the efforts made by the trade union confederation in promoting gender equality - specifically in advancing the agenda for the prevention and elimination of sexual violence in the world of work. This article was compiled based on research with a qualitative approach, with data collection methods through interviews and literature studies. The results of this study found that the confederations interviewed had already set up internal structures that have specific functions on issues related to gender equality, gender-based violence, and women’s empowerment; although still limited and on ad-hoc basis. This research also finds that the role of the trade union confederation is particularly prominent in advocating policies related to sexual violence and gender-based violence in the world of work, such as advocating the Bill on the Elimination of Sexual Violence, and the ratification of the ILO Convention No. 190 on Violence and Harassment.

Abstract

The paper explains how criminal code of zina (fornication) criminalized women victims of sexual violence. The data of Komnas Perempuan's Annual Records and the direct complaint from the victims can illustrate that women's personal relationships are particularly vulnerable to violence. The theories of feminism are used as an analytical tool of women's lives and their problems in the private sphere, including in terms of sexual relationships and love, whether married or not. This paper concludes with the challenge of the stigma of the feminist movement, as a movement considered to be opposed to morality and religion, and it is not just happen in Indonesia.

Abstract

The Draft of the Indonesian Criminal Code has provoked a debate, especially with regard to the articles under the scope of decency. The formulation of Article 488 has the potential to create new problems for women. Especially women who have obstacles in accessing legal identity. This Article 488 is a reflection of the failure of jurists to formulate laws, in understanding women's experience in relation to their access to the right to obtain legal identity, especially in the context of relationship. The criminal law is not the answer to all problems. This paper is compiled using data obtained from field study related to the handling of cases of violence against women under customary law, carried out by the authors and the team from Legal and Community Studies Fields in 2015, 2016 and 2017 in Eastern Indonesia; as well as data on legal and non-legal text analysis. The overall method and analysis of research findings using feminist legal studies and feminist legal theories.

Abstract

After the resolution about the petition of extending the meaning of adultery rampant discussed in the community, Article 284 KUHP is still an interesting article to be reviewed. Diversity in the Indonesian community causes a number of applied regulations must become as fair as possible to be a legal protection for all layers of society, including the regulations ruling the crimes of decency. Different understanding about violating decency in some community groups causes the article in Decency Crime section, especially in adultery case, often marginalizes some groups of community. There are indeed some group that might be potential to be victims of adultery cases if the meaning of adultery ever happens to be broadened. Further in its application, Article 284 KUHP makes the line between morality and crime becomes very thin. This research is done using the approach of feminist legal theory, by reviewing legal text to get an understanding on how sexuality and imagination about the woman victim is projected by law.
