Abstract

 Penelitian ini bertujuan menganalisis penegakan hukum terhadap korban penghinaan citra tubuh (body shaming) dan implementasi perlindungan hukum terhadap korban tindak pidana penghinaan citra tubuh (body shaming). Penelitian ini menggunakan metode penelitian hukum yuridis-empiris. Adapun hasil dari penelitian ini yaitu Ketidakpahaman aparat penegak hukum akan sistem peradilan pidana, akan menghambat dalam tercapainya pembangunan hukum yang sangat di inginkan oleh bangsa ini. Penegak hukum merupakan ujung tombak tercapainya keadilan, kepastian, dan kemanfaatan hukum. Bentuk perlindungan hukum bagi korban penghinaan citra tubuh body shaming belum berhasil diwujudkan. Baik dengan upaya preventif maupun upaya represif sehingga lebih jauh lagi korban yang sempat mengalami beban mental, menarik diri dari lingkungan, hingga depresi sekalipun hanya bisa menanggung penderitaan tersebut sendiri. Tidak adanya upaya represif yang dilakukan penegak hukum akan menimbulkan banyak korban dengan kasus yang serupa.Kata-Kunci: Penghinaan Citra Tubuh, Perlindungan Hukum, Penegakan Hukum This study aims to analyze law enforcement against victims of body image humiliation (body shaming) and the implementation of legal protection for victims of body shaming crimes. This research uses juridical-empirical legal research methods. The result of this research is that law enforcers' lack of understanding of the criminal justice system will hinder the achievement of legal development that is desired by this nation. Law enforcers are the spearhead of achieving justice, certainty and legal benefits. The form of legal protection for victims of body image humiliation has not yet been realized. Both with preventive and repressive measures so that even further victims who have experienced mental burdens, withdraw from their environment, and even become depressed can only endure the suffering themselves. The absence of repressive efforts by law enforcers will result in many victims with similar cases..Keywords: Body Shaming, Legal Protection, Law Enforcement

Abstract

 Adanya wacana untuk menghidupkan kembali Garis besar Haluan Negara (GBHN) yang digagas oleh para elit politik menarik untuk dikaji, mengingat sistem demokrasi di bawah Undang-Undang Dasar 1945 ( UUD 1945) sebelum amandemen menganut sistem demokrasi tidak langsung, sedangkan pada saat ini di bawah UUD 1945 amandemen menganut sistem demokrasi langsung, terbukti dalam UUD 1945 amandemen ini memberikan jaminan bahwa semua anggota perwakilan harus dipilih dan tidak ada yang diangkat lagi. Penelitian ini mengkaji dua hal yaitu status presiden terhadap MPR jika PPHN tetap dilaksanakan dihadapkan dengan status Presiden terhadap rakyat dalam rangka janji janji para calon presiden dan wakil presiden saat mereka menawarkan program kerja dalam rangka pemilihan umum demi menegakan demokrasi secara langsung, akan berjalan secara efisien dan efiektif dalam penyelenggaraan negara. PPHN yang dibuat oleh MPR akan lebih bersifat berkelanjutan seperti halnya GBHN pada masa lalu, dimana bisa bertahan sampai 30 tahun. GBHN bisa terjadi disebabkan pada masa Orde Baru tersebut penguasanya adalah partai dan rezim pimpinan Soeharto yang terus menerus berkuasa sehingga praktis GBHN bisa berkelanjutan, sedangkan saat ini dimana penguasa bisa berbeda-beda tergantung hasil pemilihan umum, sehingga anggota MPR, DPR yang juga merangkap anggota MPR dan presiden bisa berubah-ubah sehingga diprediksikan tidak akan bisa menjamin PPHN berkelanjutanKata-Kunci: PPHN, MPR, Presiden, DemokrasiThe existence of a discourse to revive the Outline of State Policy (GBHN) which was initiated by the political elite is interesting to study, considering that the democratic system under the 1945 Constitution (UUD 1945) prior to the amendments adopted an indirect democratic system, whereas at present it is under the 1945 Constitution. The 1945 amendment adopts a direct democracy system, as evidenced in the 1945 Constitution this amendment provides a guarantee that all members of the representative must be elected and no one is appointed again. This study examines two things, namely the status of the president against the MPR if the PPHN continues to be implemented in the face of the President's status against the people in the context of the promises of the presidential and vice presidential candidates when they offer work programs in the context of general elections to uphold democracy directly, will run efficiently and effective in the administration of the state. The PPHN made by the MPR will be more sustainable like the GBHN in the past, which could last up to 30 years. The GBHN could occur because during the New Order era the rulers were the party and regime led by Suharto, which continued to rule so that the GBHN could practically be sustainable, while at this time the rulers can vary depending on the results of the general election, so that members of the MPR, DPR are also members of the MPR. and the president can change so that it is predicted that he will not be able to guarantee a sustainable PPHN.Keywords: PPHN, MPR, President, Democracy

Abstract

 Penelitian tentang bimbingan pranikah atau yang sekarang disebut binwin diselenggarakan oleh Kantor Urusan Agama Kecamatan Dau untuk membekali pengetahuan, memberikan pengertian dan keahlian tentang kehidupan rumah tangga, dan menciptakan keluarga sakinah, mawaddah,  warahmah Sesuai Undang-Undang RI No 16 Tahun 2019. Binwin ini diberikan untuk calon pengantin sebelum melaksanakan akad. Penelitian ini bertujuan untuk mengetahui perencanaan, memaksimalkan, dan evaluasi bimbingan pranikah di KUA Dau. Penelitian ini merupakan penelitian lapangan (Field Research) dengan metode kualitatif. Sumber data penelitian ini ada 2 yaitu, primer dan sekunder. Teknik pengumpulan data yang digunakan didalam penelitian ini adalah  pengamatan, wawancara, dokumentasi. Teknik analisis data yang dilakukan adalah Data Reduksi Data, Penyajian Data, Dan langkah terakhir verification. Hasil penelitian ini menjelaskan bahwa calon pengantin yang melaksanakan binwin di Kantor Urusan Agama Kecamatan Dau adalah calon pengantin yang sudah terdaftar di KUA Kecamatan Dau dan belum melaksanakan pernikahan. Berdasarkan fakta setelah mengiktui bimbingan pranikah, calon pengantin mendapatkan rasa percaya diri setelah mendapat materi-materi pernikahan seperti keluarga sakinah, pemenuhan kebutuhan keluarga, mengelola dinamika pernikahan dan keluarga serta membangun ketahanan keluarga. Sehingga calon pengantin yang mengikuti binwin menimbulkan rasa percaya diri dalam mengarungi kehidupan berkeluarga. Peran binwin begitu signifikan dalam mewujudkan kehidupan harmonis suatu keluarga. Binwin begitu penting untuk memberikan bekal untuk pasangan yang akan melaksanakan pernikahan di KUA Kecamatan Dau.Kata-Kunci: Peran, Bimbingan Pranikah, Keharmonisan KeluargaResearch on premarital guidance organized by KUA Dau District aims to provide knowledge, increase understanding, and skills about household and family life to form a sakinah, mawaddah, warohmah families in Undang-Undang RI No 16 Tahun 2019. This pre-wedding guidance is given to the bride and groom before the marriage ceremony. This study aims to determine the planning, maximization, and evaluation of premarital guidance at KUA Dau. This research is field research with qualitative methods. There are 2 sources of data in this study, namely, primary data sources and secondary sources. Data collection techniques used in this research are Observation, Interview, Documentation. The data analysis technique used is Data Reduction, Data Display, and the last step is Conclusion Drawing/verification. The results of this study stated that the participants of pre-marital guidance at the KUA of Dau District were those who had been registered at the Dau District KUA but had not yet carried out the marriage. The fact is that after following premarital guidance, prospective brides gain confidence after receiving marriage materials such as a sakinah family, fulfilling family needs, managing marriage, and family dynamics, and building family resilience. So that prospective brides who follow premarital guidance feel more ready to live a family life. The role of premarital guidance is very decisive in realizing family harmony. Premarital guidance is very effective in providing capital for prospective brides who will carry out marriages at the KUA, Dau District.Keywords: Role, Premarital Guidance, Family Harmony

Abstract

 Pengaturan pendaftaran dan pendirian Perseroan Komanditer terdapat 2 (dua) aturan hukum yang berbeda dalam pengaturannya. Pertama menurut Pasal 23 KUHD menyebutkan bahwa Perseroan Komanditer diwajibkan untuk mendaftar di Pengadilan Negeri, Kedua, menurut Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 17 Tahun 2018 tentang Pendaftaran Perseroan Komanditer diajukan oleh Pemohon kepada Menteri melalui Sistem Adminitrasi Badan Usaha. Dari 2 (dua) dasar hukum tersebut terjadi pertentangan norma diantara keduanya yang menyebabkan tidak adanya kepastian hukum dalam pendaftaran Perseroan Komanditer. Penelitian ini ditujukan untuk mengetahui legalitas pencatatan pendaftaran persekutuan komanditer yang melebihi batas maksimal. Jenis Penelitian yang diterapkan adalah yuridis normatif dengan pendekatan perundang-undangan (statue approach) dan pendekatan konsep (conceptual approach). Bahan hukum yang digunakan yaitu perundang-undangan dan literatur serta hasil-hasil penelitian. Teknik pengumpulan bahan hukum yang digunakan adalah melalui penelitian kepustakaan (library research).Kata Kunci: Legalitas, Perseroan Komanditer (CV), SABU There are 2 (two) different legal regulations for the registration and establishment of Limited Partnership. First, according to Article 23 of the KUHD (Commercial Law Book) state that Limited Partnership are required in the District Court. Second, according to the Regulation of the Ministerial of Law and Human Rights Number 17 of 2018, concerning the Registration of Limited Partnership Company submitted by the Petitioner to the Minister through Business Entity Administration System. Both legal bases created conflict of norms between the two which causes the absence of legal certainty in the Limited Partnership Company. This study is aimed at knowing the legality regitration of Limited Partnership that exceeds the maximum limit. The research applied a normative juridical with statutory approach (statue approach) and conceptual approach. The legal materials are legislation and literatures of research results. Abstract

 Kasus penelantaran tanah yang dilakukan oleh PT. Sarana Subur Agrindotama sebagai Pemegang Hak Guna Usaha (HGU) di Kalimantan Selatan karena tidak memanfaatkan tanah negara yang diperuntukan untuk perkebunan kelapa sawit. Dinyatakan berdasarkan Surat Keputusan Menteri Agraria Dan Tata Ruang / Kepala Badan Pertanahan Nasional No.1/PTT-HGU/KEM-ATR/BPN/2017 tanggal 6 Juni 2017, tentang Penetapan Tanah Terlantar yang berasal dari Hak Guna Usaha Nomor 01/Tanah Laut atas nama PT. Sarana Subur Agrindotama Terletak di Desa Kandangan Lama, Kuringkit, Batu Tungku dan Bumi Asih, Kecamatan Panyipatan, Kabupaten Tanah Laut, Provinsi Kalimantan Selatan. Metode yang digunakan dalam penelitian ini adalah metode pendekatan kasus (case approach), dengan menggunakan metode tersebut peneliti mampu menjawab permasalahan yang terjadi dan peneliti juga mencoba untuk membangun argumentasi hukum mengenai kasus yang terjadi di Kalimantan Selatan. Mengenai penelantaran tanah ini dibantah oleh PT. Sarana Subur Agrindotama yang menyatakan bahwa tidak melakukan penelantaran tanah, tetapi karena tanah masih sulit untuk dijangkau dan alat berat masih terbatas selain itu masyarakat yang berbatasan dan berada di desa tempat tanah itu berada sudah membuka ladang-ladang untuk kebun. Penyelesaian kasus yang dilakukan adalah PT. Sarana Subur Agrindotama mengajukan gugatan ke Pengadilan Tata Usaha Negara Jakarta untuk membatalkan Surat Keputusan Menteri tersebut. Tetapi berdasarkan laporan hasil identifikasi dan penelitian tanah yang terindikasi terlantar oleh Kantor Pertanahan Tanah Laut menyatakan bahwa tanah di Kalimantan Selatan tersebut teridentifikasi sebagai tanah terlantar. Sehingga Putusan Nomor 182/G/2017/PTUN.JKT menolak gugatan PT. Sarana Subur Agrindotama,  yang menyatakan bahwa PT. Sarana Subur Agrindotama melakukan penelantaran tanah di Kalimantan Selatan.Kata-Kunci: Tanah Terlantar, Hak Guna Usaha (HGU), Penguasaan TanahThe case of abandonment of land carried out by PT. Sarana Subur Agrindotama as the Holder of Cultivation Rights (HGU) in South Kalimantan because it does not utilize state land designated for oil palm plantations. It is stated based on the Decree of the Minister of Agrarian Affairs and Spatial Planning / Head of the National Land Agency No.1/PTT-HGU/KEM-ATR/BPN/2017 dated June 6 2017, concerning the Stipulation of Abandoned Land originating from Cultivation Rights Number 01/Tanah Laut over name of PT. Means Subur Agrindotama is located in Kandangan Lama Village, Kuringkit, Batu Furnace and Bumi Asih, Panyipatan District, Tanah Laut Regency, South Kalimantan Province. The method used in this study is the case approach method, by using this method the researcher is able to answer the problems that occur and the researchers also try to build legal arguments regarding the cases that occurred in South Kalimantan. Regarding the abandonment of this land, PT. Sarana Subur Agrindotama which stated that they did not abandon the land, but because the land was still difficult to reach and heavy equipment was still limited. In addition, the people who bordered and were in the village where the land was located had already opened fields for gardens. The settlement of cases carried out is PT. Sarana Subur Agrindotama filed a lawsuit to the Jakarta State Administrative Court to cancel the Ministerial Decree. However, based on the report on the results of the identification and research of abandoned land indicated by the Tanah Laut Land Office, it was stated that the land in South Kalimantan was identified as abandoned land. So that Decision Number 182/G/2017/PTUN.JKT rejected PT. Sarana Subur Agrindotama, which stated that PT. Abstract

Financing Agreements with Fiduciary Transfer of Ownership on Vehicles generally use a Standard Agreement or commonly known as a Standard Contract.  Fiduciary collateral must be registered at the Fiduciary Transfer of Ownership Registration Office to obtain a Fiduciary Transfer of Ownership Certificate.  Article 15 of Act Number 42 of 1999 concerning Fiduciary Transfer of Ownership states that "a Fiduciary Transfer of Ownership Certificate which includes the words "FOR JUSTICE BASED ON THE ALMIGHTY GOD".  Furthermore, Article 15 section (2) states that the Fiduciary Transfer of Ownership Certificate has the same executorial power as a court decision that has permanent legal force.  Then Article 15 states, if the debtor breaks his promise, then the Fiduciary Recipient has the right to sell the object that is the object of the Fiduciary Transfer of Ownership on his own power.The Constitutional Court Decision’s Number 18/PUU-XVII/2019 conducted a judicial review of Article 15 section (2) and (3) of the Fiducia Law with several article in The 1945 Constitution of the Republic of Indonesia. The Constitutional Court's decision caused a polemic among the public.  The results of research and normative studies conducted by the author are, a. A Financing Agreement with a Fiduciary Transfer of Ownership cannot apply the principle of freedom of contract as a whole, and there are limitations in its application because a Financing Agreement with a Fiduciary Transfer of Ownership is a Standard Agreement b. The fiduciary Transfer of Ownership deed refers to a standard financing agreement, therefore the content of the financing agreement made by the financing company must adjust to the matters regulated by laws and regulations and the Constitutional Court's Decision.  c. The execution by the creditor can still be carried out provided that the implementation is not carried out against the law and must be voluntary and both the debtor and creditor can prove that the debtor is in breach of contract.Notary as the recipient of the authority from Fiducia Law, especially in the making of the Fiduciary Transfer of Ownership Deed.  In carrying out its duties and authorities, the Notary profession also takes responsibility for the actions he has done.  Keywords: security of law, fiduciary, execution, breach of contract.

Abstract

 Tipe penelitian yang digunakan dalam peniltian ini adalah penelitian normatif (doktrinal). Penelitian ini menggunakan tiga jenis pendekatan penelitian hukum yaitu Pendekatan histori (Historical approach), Pendekatan perundang-undangan (statute approach) dan Pendekatan konseptual (Conseptual approach). Adapun data penelitian akan dianalisis dengan metode analisis deskriptif, yakni usaha untuk mengumpulkan dan menyusun suatu data, kemudian dilakukan analisis terhadap data tersebut. Hasil penelitian ini menyimpulkan bahwa Dasar pemikiran (Ratio Legis) dari Pasal 6a ayat (3) UUD 1945 tentang syarat keterpilihan presiden dan wakil presiden adalah merupakan kompromi terhadap masalah yang akan timbul jika hanya memakai sistem popular vote. Penambahan tentang syarat persebaran suara bertujuan utama untuk mendapat legitimacy rakyat indonesia seluruhnya dalam kontestasi politik pemilihan presiden. Hal ini juga bertujuan untuk memastikan representasi rakyat berdasar kewilayahan dapat tercapai agar konflik horizontal bisa dihindari. Majelis hakim Mahkamah konstitusi pada putusan Nomor 39/PUU-XVII/2019 terbukti tidak memperhatikan dasar pemikiran (Ratio Legis) dari Pasal 6a ayat (3). Pemaknaan majelis hakim terhadap prinsip kedaulatan rakyat dan representasi kewilayahan mempunyai konteks yang berbeda dengan pembahasan pembentukan ketentuan ini. Rekomendasi dari penelitian ini adalah Perlunya Perlunya analisis yang menyeluruh dalam usaha memahami teks konstitusi termasuk dengan mencari tahu dasar pemikiran terbentuknya ketentuan konstitusional tersebut. Perlunya Hakim Mahkamah konstitusi menggali dasar pemikiran sebuah ketentuan dalam UUD 1945 pasca amandemen sebelum memutuskan sebuah perkara Judicial Review.Kata-Kunci: Putusan, Mahkamah Konstitusi, Ratio LegisThis study aims to analyze the decision of the Constitutional Court Number 39/PUU-XVII/2019 and its conformity with the ratio legis for the formation of the presidential and vice presidential election regulations in the amendments to the 1945 Constitution. The type of research used in this research is normative (doctrinal) research. This study uses three types of legal research approaches, namely the historical approach, the statutory approach and the conceptual approach. The research data will be analyzed by descriptive analysis method, namely an effort to collect and compile a data, then an analysis of the data is carried out. The results of this study conclude that the rationale (Ratio Legis) of Article 6a paragraph (3) of the 1945 Constitution regarding the requirements for the election of the president and vice president is a compromise on the problems that will arise if only using the popular vote system. The addition of the requirements for the distribution of votes has the main aim of gaining the legitimacy of the Indonesian people as a whole in the political contestation of the presidential election. It also aims to ensure that regional representation of the people can be achieved so that horizontal conflicts can be avoided. The judges of the Constitutional Court in their decision Number 39/PUU-XVII/2019 were proven not to pay attention to the rationale (Ratio Legis) of article 6a paragraph (3). The meaning of the panel of judges on the principle of people's sovereignty and territorial representation has a different context from the discussion on the formation of this provision. The recommendation from this research is the need for a thorough analysis in an effort to understand the text of the constitution, including by finding out the rationale for the formation of the constitutional provisions. It is necessary for judges of the Constitutional Court to explore the rationale for a provision in the 1945 Constitution after the amendment before deciding on a Judicial Review case.Keywords: Decision, Constitutional Court, Ratio Legis

Abstract

 Pelaksanaan tugas jabatan Notaris dalam membuat akta autentik, masih terdapat dokumen dan keterangan palsu dari para penghadap diera pandemic covid19, sehingga timbul persoalan dan sengketa bahkan menjadi celah hukum pidana bagi Notaris. Penulis tertarik untuk menganalisis dan mengkaji sejauh mana Pembelaan Notaris Dalam Menghadapi Persoalan Pidana Dalam Era Pandemic Covid19. Metode penelitian ini menggunakan penyusunan yang sistematis, dengan pendekatan yuridis normatif  yaitu mengacu pada norma-norma hukum tertulis, baik yang dituangkan dalam bentuk peraturan perundang-undangan maupun dalam bentuk literatur kepustakaan, atau literatur lainnya. Penelitian ini termasuk kedalam penelitian deskriptif analitis yaitu melakukan analitis terhadap permasalahan yang akan dikaji. Hasil penelitian ini yaitu: 1). Notaris/PPAT dalam membuat akta-akta autentik dalam memenuhi pelayanan kebutuhan masyarakat di era pandemic covid19 Melaksanakan protokol pencegahan penyebaran covid19 dengan menggunakan masker, cairan penyanitasi tangan, pemberlakuan jam kerja karyawan secara bergantian (PPKM) dan meningkatkan kebersihan kantor; 2). bahwa para penegak hukum dalam prosedur pemanggilan Notaris sebagai saksi/terdakwa harus memperhatikan Pasal 66 UUJN, MoU nomor: 01/Mou/PP-INI/V/2006 dan SK. Kapolri nomor 12 Tahun 2009.Kata-Kunci: Pelaksanaan, Jabatan, Notaris, Pandemic Covid19.  In carrying out the duties of the Notary's position in making authentic deeds, there are still false documents and information from the presenters in the era of the COVID-19 pandemic, so that problems and disputes arise and even become a criminal law loophole for Notaries. The author is interested in analyzing and assessing the extent to which the Notary's Defense in Facing Criminal Issues in the Covid19 Pandemic Era. This research method uses a systematic arrangement, with a normative juridical approach that refers to written legal norms, both as outlined in the form of legislation and in the form of literature, or other literature. This research is included in analytical descriptive research, which is doing analysis of the problems to be studied. The results of this study are: 1). Notary/PPAT in making authentic deeds in meeting the needs of the community in the era of the covid19 pandemic Implementing protocols to prevent the spread of COVID-19 by using masks, hand sanitizer, implementing alternate working hours (PPKM) and improving office cleanliness; 2). that law enforcers in the procedure for summoning a Notary as a witness/defendant must pay attention to Article 66 of the UUJN, MoU number: 01/Mou/PP-INI/V/2006 and SK. Abstract

 Notaris merupakan pejabat umum yang mempunyai tugas dan kewajiban memberikan pelayanan dan konsultasi hukum kepada masyarakat yang membutuhkan. Bantuan hukum yang dapat diberikan oleh seorang notaris adalah dalam bentuk pembuatan akta otentik ataupun berbagai kewenangan lainnya yang telah diatur dalam peraturan perundang-undangan sehingga fungsi notaris sangat penting. Dalam menjalankan tugasnya, notaris di kota Banjarmasin diawasi oleh Majelis Pengawas Daerah Kota Banjarmasin. Saat ini banyak sekali notaris yang melakukan pelanggaran di berbagai daerah, hal tersebut tidak menutup kemungkinan juga terjadi di Kota Banjarmasin ditambah akibat pertumbuhan perekonomian di Kota Banjarmasin memberikan dampak yang signifikan pada kebutuhan masyarakat terhadap jasa notaris dalam pembuatan akta jual beli ataupun perjanjian lainnya. Penelitian ini mertupakan penelitian yuridis empiris, Pendekatan penelitian yuridis sosiologis dengan menggunakan data primer dengan melakukan wawancara, sekunder dengan melakukan studi kepustakaan. Hasil dan pembahasan menemukan bahwa terdapat beberapa hambatan yang terjadi di lapangan, mulai dari jarak, waktu hingga biaya dimana hal tersebut diselesaikan dengan upaya penjadwalan ulang pengawasan dan diperlukan sekretariat MPD di Kota Banjarmasin.Kata-Kunci: Hambatan, Upaya, Pengawasan, Notaris, Majelis PengawasDaerahNotaries are public officials who have the duty and obligation to provide legal services and consultations to people in need. Legal assistance that can be provided by a notary is in the form of making an authentic deed or various other authorities that have been regulated in laws and regulations so that the function of a notary is very important. In carrying out their duties, notaries in the city of Banjarmasin are supervised by the Regional Supervisory Council of the City of Banjarmasin. Currently, there are many notaries who commit violations in various regions, it is also possible that it will also occur in the City of Banjarmasin, plus the economic growth in the City of Banjarmasin has a significant impact on the community's need for notary services in making sale and purchase deeds or other agreements. This research is an empirical juridical research, a sociological juridical research approach using primary data by conducting interviews, secondary by conducting library research. The results and discussion found that there were several obstacles that occurred in the field, ranging from distance, time to cost where this was resolved by rescheduling the supervision and requiring an MPD secretariat in Banjarmasin City.Keywords: Obstacles, Efforts, Supervision, Notary, Regional Supervisory Council

Abstract

 Konsepsi penataan ruang pada dasarnya harus memperhatikan kondisi, potensi,  permasalahan sosial dan budaya serta memperhatikan daerah kawasan rawan bencana sebagai basis dalam pengembangan dan pengelolaan suatu wilayah. Karena itu untuk mewujudkan pembangunan perumahan dan permukiman sebagai pembangunan yang berkelanjutan, diperlukan penyelenggaraan penataan ruang yang transparan, efektif dan partisipatif agar terwujud ruang yang nyaman, aman, produktif dan keberlanjutan.  Salah satu upaya yang bisa ditempuh dalam mewujudkan pembangunan yang berkelanjutan dan sesuai dengan rencana tata ruang adalah  dilakukan melalui pemberian izin sebagai syarat dalam kegiatan pengendalian pemanfatan ruang. Pmberian izin merupakan salah satu implementasi dari upaya dalam pengendalian pemanfaatan ruang. Karena itu izin pemanfaatan ruang yang tidak  sesuai dengan rencana tata ruang wilayah dapat dibatalkan oleh pemerintah dan pemerintah daerah menurut kewenangan masing masing sesuai dengan ketentuan peraturan perundang-undangan yang berlaku.Kata-Kunci: Penataan ruang, Penyelenggaraan penataan ruang, Pengendalian penataan ruang, dan Pemberian izin The concept of spatial planning basically must pay attention to conditions, potentials, social and cultural problems and pay attention to disaster-prone areas as a basis for developing and managing an area. Therefore, to realize housing and settlement development as a sustainable development, transparent, effective and participatory spatial planning is needed in order to create a comfortable, safe, productive and sustainable space. One of the efforts that can be taken in realizing sustainable development and in accordance with the spatial plan is through the issuance of permits as a condition for controlling the use of space. The granting of permits is one of the implementations of efforts to control space utilization. Therefore, space utilization permits that are not in accordance with the regional spatial plan can be canceled by the government and regional governments according to their respective authorities in accordance with the provisions of the applicable laws and regulations.Keywords: Spatial planning, Spatial planning implementation, Spatial planning control, and Permit granting
