Abstract

 Adanya wacana untuk menghidupkan kembali Garis besar Haluan Negara (GBHN) yang digagas oleh para elit politik menarik untuk dikaji, mengingat sistem demokrasi di bawah Undang-Undang Dasar 1945 ( UUD 1945) sebelum amandemen menganut sistem demokrasi tidak langsung, sedangkan pada saat ini di bawah UUD 1945 amandemen menganut sistem demokrasi langsung, terbukti dalam UUD 1945 amandemen ini memberikan jaminan bahwa semua anggota perwakilan harus dipilih dan tidak ada yang diangkat lagi. Penelitian ini mengkaji dua hal yaitu status presiden terhadap MPR jika PPHN tetap dilaksanakan dihadapkan dengan status Presiden terhadap rakyat dalam rangka janji janji para calon presiden dan wakil presiden saat mereka menawarkan program kerja dalam rangka pemilihan umum demi menegakan demokrasi secara langsung, akan berjalan secara efisien dan efiektif dalam penyelenggaraan negara. PPHN yang dibuat oleh MPR akan lebih bersifat berkelanjutan seperti halnya GBHN pada masa lalu, dimana bisa bertahan sampai 30 tahun. GBHN bisa terjadi disebabkan pada masa Orde Baru tersebut penguasanya adalah partai dan rezim pimpinan Soeharto yang terus menerus berkuasa sehingga praktis GBHN bisa berkelanjutan, sedangkan saat ini dimana penguasa bisa berbeda-beda tergantung hasil pemilihan umum, sehingga anggota MPR, DPR yang juga merangkap anggota MPR dan presiden bisa berubah-ubah sehingga diprediksikan tidak akan bisa menjamin PPHN berkelanjutanKata-Kunci: PPHN, MPR, Presiden, DemokrasiThe existence of a discourse to revive the Outline of State Policy (GBHN) which was initiated by the political elite is interesting to study, considering that the democratic system under the 1945 Constitution (UUD 1945) prior to the amendments adopted an indirect democratic system, whereas at present it is under the 1945 Constitution. The 1945 amendment adopts a direct democracy system, as evidenced in the 1945 Constitution this amendment provides a guarantee that all members of the representative must be elected and no one is appointed again. This study examines two things, namely the status of the president against the MPR if the PPHN continues to be implemented in the face of the President's status against the people in the context of the promises of the presidential and vice presidential candidates when they offer work programs in the context of general elections to uphold democracy directly, will run efficiently and effective in the administration of the state. The PPHN made by the MPR will be more sustainable like the GBHN in the past, which could last up to 30 years. The GBHN could occur because during the New Order era the rulers were the party and regime led by Suharto, which continued to rule so that the GBHN could practically be sustainable, while at this time the rulers can vary depending on the results of the general election, so that members of the MPR, DPR are also members of the MPR. and the president can change so that it is predicted that he will not be able to guarantee a sustainable PPHN.Keywords: PPHN, MPR, President, Democracy

Abstract

There are three kinds of inheritance law in Indonesia, namely Islamic inheritance, Customary inheritance and BW inheritance. The scope of this writing is limited to customary inheritance law. The parts of customary law have a big influence on customary inheritance law and vice versa. Customary inheritance law has its own characteristics and characteristics that are unique to Indonesia, which is different from Islamic law and western law (BW). Because the difference lies in the natural background of the Indonesian people who have the philosophy of Pancasila with a society that is Bhinneka Tunggal Ika. The inheritance law that exists and applies in Indonesia to date is still not in the form of legal unification. The purpose of this study is to analyze the inheritance system according to the customary inheritance law related to the kinship system in Indonesia.The type of research used in this research is normative juridical research, namely research on legal systematic is research conducted on primary and secondary legal materials, the terms of reference used are the basic definitions contained in the legal system. The approach used is a conceptual approach, a statute approach and a case approach. Types of Legal Materials are primary legal materials and secondary legal materialsThe results of this study indicate that the inheritance system according to the Adat Inheritance Law does not refer to the kinship system of the customary law community. Customary law communities whose system of collective inheritance can occur are parental kinship systems. Heritage assets related to inheritance must be distinguished from the origin of the assets, because they are related to the kinship system that exists in the local customary law community, whether parental, patrilineal or matrilineal, because not all inheritance can be divided individually.

Abstract

In meeting the personal and social needs of the community for land in everyday life and with limited purchasing power in the midst of an economic downturn due to the Covid-19 pandemic and limited availability of residential land, for land sellers it is carried out by providing land through plots of land in the form of plots -Plots are ready to build while for buyers it is done by installment or credit. This research is a normative research that examines various laws and regulations, norms, concepts and jurisprudence using a conceptual, statutory and philosophical approach. In making a sale and purchase agreement Land sale and purchase agreements are generally subject to articles 1457, 1458 and 1459 Burgelijk wet Boek (BW), which require a seller and a buyer and the legal terms of the agreement as stipulated in article 1320 BW, which are marked by an agreement and the surrender of the object (levering) but since the enactment of the Basic Agrarian Law the provisions for buying and selling land are subject to customary law, namely carried out with the cash and clear concept.

Abstract

Bank runs business with fiduciary principle, prudential, know your customer and bank secrecy. The money laundering criminal can use bank to save fund. Bank as a financial institute must implements prudential and must keep customer personal information has polemic and must open bank secrecy if money laundering occurred. That’s matter become problem is regulation and impelementation of regulation about bank secrecy and law protection for banking and customer because open customer personal information because of money laundering. This riset use normative law riset with statue approach use law material source. Statue approach use with study all regulation. The type of data used is in the form of data obtained from laws and regulations, books, journals, library materials and other written sources related to the problem to be studied. To analyze the data collected from literature search, this research uses qualitative analysis techniques.

Abstract

Background. The issue of supervision of foreigners plus illegal immigrants is a very sensitive issue in the Asia Pacific region because it involves many countries and is cross-border in nature. The use of Visa-Free Visit Permits is a modus operandi for foreigners to stay in Indonesian territory and then commit immigration violations which include misuse of stay permits, overstay, illegal immigrants, use of fake travel documents, cybercrime. The research purpose was to determine supervision and enforcement of immigration by immigration officer for foreigners who commit violations in the territory of Indonesia. Research Method. This research was a normative legal research. Sources of legal materials used are primary and secondary legal materials. The legal materials obtained will be analyzed using a qualitative analysis method, namely an analysis that departs from the norms, principles that exist as positive legal norms which are then analyzed qualitatively with the understanding that the results of the analysis will be realized in the form of descriptions not in the form of numbers. Findings. The supervision of foreigners is carried out in the form of administrative, coordinative and on-site supervision with one field operation. The actions taken are refusal to grant visa, refusal to allow entry into Indonesian territory, change, limit/ cancel immigration permit, prohibit foreigners to be in a certain place in Indonesian territory. Conclusion. In the event of a criminal offense, immigration may conduct process of criminal procedure law. In certain cases, immigration may take immigration action directly such as expulsion or deportation.

Abstract

Tourism is the activity of temporary travel of one or more people to a location other than their place of residence. In Batu Bengkung, residents depend on tourism for their livelihood. This study discusses legal protection for tourists by focusing on two aspects. First, Law no. 10 of 2009 concerning Tourism regulates legal protection for tourists and tourism industry players in the event of loss from both parties. Second, the manager's obligation to guarantee the security and safety of Batu Bengkung beach visitors if an incident occurs. The research method used is an empirical research technique with a sociological legal perspective. The results of the study show that Law Number 10 of 2009 concerning Tourism provides fair protection for travelers and tourism industry players. This protection covers the full rights and obligations of both parties. The responsibility of the manager for the safety and security of Batu Bengkung Beach tourists is to provide insurance claims and hospital medical expenses for victims.

Abstract

Every foreigner who holds a Visit Stay Permit, Limited Stay Permit, and Permanent Stay Permit is required to have a Guarantor who guarantees the existence and activities of guaranteed foreigners while in Indonesian Territory. The absence of detailed regulations and special legal protection for a guarantor has various impacts and consequences. One of them is the lack of responsibility of a guarantor. This research is legal research, which focuses on legal studies on positive law. The problem approach used is the philosophical approach, the statutory approach and the conceptual approach. primary legal materials in the form of laws and regulations relating to research problems and secondary legal materials, namely legal materials that provide explanations of primary legal materials, such as legal books, journals, published magazines relating to the problem. The results of the research show that the responsibility of a guarantor is to supervise and monitor the activities of the foreigners he guarantees in Indonesian territory, to be responsible for the presence and activities of foreigners while in Indonesian territory, Article 63 paragraph (2) of Law no. 6 of 2011, which confirms the guarantor's obligation to report if there is a change in civil status, immigration status and change of address or becomes the subject of immigration administrative action in the form of deportation, the guarantor's sanctions for violations are more administrative in nature. More severe criminal sanctions are often not carried out in law enforcement. Supposedly a foreigner who violates the provisions of Article 116, the guarantor can already be said to have violated the provisions of article 118 because he does not fulfill obligations related to the existence of the guaranteed foreigner.

Abstract

Undang-Undang Nomor 36 Tahun 2009 Tentang Kesehatan (Selanjutnya disebut Undang-Undang Kesehatan) menyebutkan bahwa, setiap orang mempunyai hak yang sama dalam memperoleh akses atas sumber daya di bidang kesehatan, mereka dapat menentukan sendiri pelayanan kesehatan yang diperlukan bagi dirinya, karena setiap orang berhak memperoleh pelayanan kesehatan yang aman,bermutu, dan terjangkau. Penelitian ini bertujuan untuk melakukan analisis terhadap tanggung jawab rumah sakit secara yuridis dalam melakukan penanganan pasien gawat darurat. Penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Dalam penelitian hukum normatif ini dipergunakan pendekatan peraturan perundang-undangan (Statute Approaach) dan pendekatan konseptual (Conceptual Approach). Hasil penelitian rumah sakit yang menolak memberikan tindakan medis terhadap pasien dalam keadaan darurat dapat dikenakan sanksi pidana penjara paling lama 2 (dua) tahun dan denda paling banyak Rp200.000.000,00 (dua ratus juta rupiah) sesuai Pasal 32 ayat (2) Undang-Undang Nomor 36 Tahun 2009 Tentang Kesehatan. Dalam hal perbuatan tersebut mengakibatkan terjadinya kecacatan atau kematian, pimpinan fasilitas pelayanan kesehatan dan/atau tenaga kesehatan tersebut dipidana dengan pidana penjara paling lama 10 tahun dan denda paling banyak Rp1.000.000.000,00. Putusan Mahkamah Agung Nomor: 68/G/TF/2019/PTUN-SRG dinyatakan telah tepat sesuai dengan perundangan terkait dikarenakan gugatan penggugat tidak memiliki legal standing dan tidak mampu menguraikan secara rinci masyarakat dan/atau pasien yang mana yang dimaksud, kapan terjadinya penolakan tersebut, dan akibat yang ditimbulkan dari penolakan tersebut kepada masyarakat/pasien sehingga tidak dapat dilakukan analisis yang sah akan dugaan penolakan pelayanan pasien dalam keadaan darurat.

Abstract

This research will explore the use of technology so that it can strengthen the legal system in Indonesia and examine best legal practices in various countries to improve consumer data protection in e-commerce. Consumer protection legal research is increasingly urgent given the risks that continue to evolve and have a significant impact on consumers. The formulation of this research problem is: 1) How is the protection of business civil law in providing protection for consumers related to the misuse of consumer personal data in e-commerce transactions? 2) What are the legal actions against the misuse of consumer data in e-commerce? This thesis research uses normative legal types on consumer protection and misuse of personal data while also researching legal aspects that regulate consumer rights and the protection of unauthorized users. The results of the study show that the protection of consumers' personal data in e-commerce transactions in Indonesia is regulated by various laws and regulations, which are relevant to the civil law aspects of business. Cases of misuse of consumer data in e-commerce have encouraged increased awareness of the importance of protecting consumer rights in civil relations between consumers and business actors.

Abstract

The results of this study show that the form of liability claimed by the entrepreneur is compensation according to the large loss suffered by consumers, as well as the legal relationship of the parties in the online sale, is a binding contractual relationship for the parties. E-Commerce Shopee, as the organizer of the electronic system and third parties in online sale transactions, is not entirely responsible for the losses arising from negligence by the parties (penjual dan pembeli). Shopee tends to act as a mediator in the mediation process between the seller and buyer in a dispute, with the responsibility to facilitate communication between the parties. The problem in this study also concerns the Perdata Claims on Consumer Loss Against Entrepreneurs in Online Transactions by Cash On Delivery (COD) in E-Commerce Shopee Indonesia. This kind of research is normative law. In many cases, Shopee does not fully fulfil the roles and responsibilities as laid down in government laws and regulations. Therefore, governments, especially the Ministry of Communications and Information Technology as the authority, should emphasize specifically to what extent the role and form of liability of the system operator in the system is responsible in the settlement of disputes between the seller and the buyer. This can be done through the refinement of legislation that regulates more detailed obligations and responsibilities of online market platforms such as Shopee in dealing with Customer Liability Claims for Consumer Loss Against Entrepreneurs in Online Cash On Delivery (COD) Transactions in E-Commerce Shopee Indonesia.
