Abstract

 Notaris merupakan pejabat umum yang mempunyai tugas dan kewajiban memberikan pelayanan dan konsultasi hukum kepada masyarakat yang membutuhkan. Bantuan hukum yang dapat diberikan oleh seorang notaris adalah dalam bentuk pembuatan akta otentik ataupun berbagai kewenangan lainnya yang telah diatur dalam peraturan perundang-undangan sehingga fungsi notaris sangat penting. Dalam menjalankan tugasnya, notaris di kota Banjarmasin diawasi oleh Majelis Pengawas Daerah Kota Banjarmasin. Saat ini banyak sekali notaris yang melakukan pelanggaran di berbagai daerah, hal tersebut tidak menutup kemungkinan juga terjadi di Kota Banjarmasin ditambah akibat pertumbuhan perekonomian di Kota Banjarmasin memberikan dampak yang signifikan pada kebutuhan masyarakat terhadap jasa notaris dalam pembuatan akta jual beli ataupun perjanjian lainnya. Penelitian ini mertupakan penelitian yuridis empiris, Pendekatan penelitian yuridis sosiologis dengan menggunakan data primer dengan melakukan wawancara, sekunder dengan melakukan studi kepustakaan. Hasil dan pembahasan menemukan bahwa terdapat beberapa hambatan yang terjadi di lapangan, mulai dari jarak, waktu hingga biaya dimana hal tersebut diselesaikan dengan upaya penjadwalan ulang pengawasan dan diperlukan sekretariat MPD di Kota Banjarmasin.Kata-Kunci: Hambatan, Upaya, Pengawasan, Notaris, Majelis PengawasDaerahNotaries are public officials who have the duty and obligation to provide legal services and consultations to people in need. Legal assistance that can be provided by a notary is in the form of making an authentic deed or various other authorities that have been regulated in laws and regulations so that the function of a notary is very important. In carrying out their duties, notaries in the city of Banjarmasin are supervised by the Regional Supervisory Council of the City of Banjarmasin. Currently, there are many notaries who commit violations in various regions, it is also possible that it will also occur in the City of Banjarmasin, plus the economic growth in the City of Banjarmasin has a significant impact on the community's need for notary services in making sale and purchase deeds or other agreements. This research is an empirical juridical research, a sociological juridical research approach using primary data by conducting interviews, secondary by conducting library research. The results and discussion found that there were several obstacles that occurred in the field, ranging from distance, time to cost where this was resolved by rescheduling the supervision and requiring an MPD secretariat in Banjarmasin City.Keywords: Obstacles, Efforts, Supervision, Notary, Regional Supervisory Council

Abstract

This paper aims to analyze the urgency of the supervisory authority of the Financial Services Authority (OJK) on fundraising activities by non-financial institutions. For the purpose of discussion, this type of normative legal research uses a statutory approach, an analytical approach, and a case approach. Primary and secondary legal materials were analyzed using grammatical and systematic analysis techniques. Based on the results of the discussion, it was concluded that the Financial Services Authority's supervisory authority over the activities of collecting funds by non-financial institutions was that the Financial Services Authority had no authority. Based on the provisions of Articles 4, 5, 6, and Article 34 of the BI Law and their explanations regarding the regulation of OJK's supervisory functions, objectives, and authorities, it can be concluded that OJK's supervisory authority is limited to only covering financial service sector institutions, both banks, and non-banks. Meanwhile, First Travel is categorized as a non-financial institution in the form of a travel agency for Hajj and Umrah, although First Travel carries out fundraising activities. It is also strengthened that First Travel is not an official entity under the authority of the OJK in terms of licensing, regulation and supervision. First Travel status has received permission from the Ministry of Religion of the Republic of Indonesia but raises funds that are not in accordance with the license held. So, in the case of First Travel, it should have been sufficiently handled by the Ministry of Religion of the Republic of Indonesia, because that ministry was the one that issued permits and carried out supervision.How to cite item: Zuhriyah, S., Negara, T., Kawuryan, E. Abstract

The purpose of this article is to discuss the authority of the notary in making a certificate of inheritance and legal force for the certificate of inheritance for Indonesian citizens after the enactment of Law Number 24 of 2013 concerning Population Administration. The study uses a normative juridical method with a legislative approach and analytical approach. The legislative approach is used to analyze problems caused by inconsistencies in norms of the relevant laws and regulations in making a certificate of inheritance. The analytical approach is used to analyze the meaning contained in the terms used in legislation regarding the drafting of a certificate of inherit- ance conceptually. Notaries have strong authority in making certificate of inheritance for Indonesian citizens without discriminating between population groups. The certificate of inheritance made by a Notary has perfect legal force.

Abstract

Tulisan ini bertujuan untuk mengkaji bagaimana prosedur yang ideal dalam penyerahan protokol notaris yang telah berumur 25 tahun atau lebih kepada MPD serta bagaimana konsep sanksi yang ideal terhadap MPD atas tidak diserahkannya protokol notaris tersebut. Guna mendekati masalah ini dipergunakan pendekatan konseptual (conceptual approach) dan pendekatan perundang-undangan (statute-approach). Data-data dikumpulkan melalui pengkajian peraturan perundang-undangan yang berlaku atau yang diterapkan terhadap suatu permasalahan hukum tertentu dan dianalisis secara kualitatif. Kajian ini menyimpulkan bahwa perlu adanya sosialisasi mengenai protokol notaris yang berumur 25 tahun atau lebih oleh MPD kepada notaris, memberikan jangka waktu 30 hari dalam penyerahan protokol tersebut yang kemudian MPD mencatat dalam database dan menyimpannya di kantor yang representatif agar memudahkan jika suatu saat notaris perlu mengeluarkan salinan akta ataupun grosse.

Abstract

This study aims to determine the position of the minutes of auction minutes after 30 years and the authority of the Auction Officer after the minutes are kept for 30 years. The Minutes of the Minutes of Auction Deed are authentic deeds and have perfect evidentiary power for the parties. In Article 92 paragraphs (3) and (4) of the Regulation of the Minister of Finance (PerMenKeu) Number 27/PMK.06/2016 concerning Auction Implementation Guidelines, it is stated that the minimum period of storage for the Minutes of Auction Deed is 30 years. The position of the minutes of auction minutes that have been kept for 30 years or more, if it is related to the juridical age of the authentic deed, then the position of the minutes of the auction minutes that have been kept for 30 years remains valid as legal evidence. Minutes of Auction made by the Class II Auction Officer are kept at the Class II Auction Officer's Office for 30 years so that the Class II Auction Officer is authorized to make a copy/quote/Grosse after 30 years and is not liable for the minutes of the auction minutes. In terms of enforcing the rights of the parties concerned and requiring the Minutes of Auction that have been kept for 30 years, the parties concerned may take legal action by submitting a request for a court order.How to cite item: Manora, H., Budiono, A., Kawuryan, E. Abstract

The ambiguity of norms in Article 15 of Insurance Law Number 40 of 2014 has led to multiple interpretations in practice, especially concerning the scope of responsibility for insurance company controllers when there is a policyholder's default, experienced by insurance policyholders at PT Asuransi Jiwasraya in case 676/PDT/2021/PT DKI. This study aims to analyze and determine the scope of responsibility limits for insurance company controllers regarding policyholders' default. This research is a normative study with a legal approach, conceptual and case approaches, and analyzed using grammatical interpretation and systematic interpretation.

Abstract

Abstract: This study discusses the juridical study of the upper limits on fees for making land dees (PPAT) from the perspective of making land deeds (PPAT) as public officials. This study is a normative study with a conceptual approach and statutory approach. The data collection technique was carried out by means of a literature study. The results of the analysis result showed that the regulation regarding the upper limits for PPAT fees in f the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 33 of 2021 does not yet reflect the principle of justice for PPATs as public officials and the concept of regulation regarding PPAT fees which can create justice and legal certainty by equalizing fees like other public officials.
