Abstract

AbstractThe death penalty reform in Indonesia’s Criminal Code (KUHP) 2023 marks a transition from a repressive penal system to a more humanistic approach. Under the previous code, capital punishment was a principal and final sentence, whereas the 2023 KUHP redefines it as an alternative punishment with a ten-year probation period. This study aims to assess the effectiveness of this reform and the need for a new implementing law. Using a normative juridical method with statutory and comparative approaches, data were collected through literature research and analyzed qualitatively. The findings show that the implementation of the death penalty still relies on Law No. 2 of 1964, which no longer reflects the humanitarian spirit of the new KUHP. Therefore, a new implementing law is needed, as mandated by Article 102 of the KUHP, to regulate lethal injection, establish a Medical Execution Unit, and provide ethical guidelines for doctors to ensure executions are conducted professionally and in line with human rights principles. Keywords: Death Penalty, Criminal Law Reform, Lethal Injection, Human Rights.

Abstract

Kasepuhan Karang is one of the Sundanese indigenous communities located in the Lebak Regency, Banten Province, Indonesia. This community is part of a network of kasepuhan around the Gunung Halimun Salak National Park (TNGHS). Their lives are closely related to environmental sustainability, especially in the management of customary forests. The social and cultural systems of the Kasepuhan Karang community reflect harmony between humans and nature. These values are reflected in customary traditions such as ngaseuk (planting), customary spatial planning that divides the area into restricted forests, production forests, and agricultural land, as well as tatali paranti (customary rules) that serve as guidelines for maintaining ecosystem sustainability. This study focuses on the importance of the Kasepuhan Karang Customary Forest in the context of environmental conservation and climate change mitigation. In addition, this study will identify the main challenges faced in preserving customary forests, including policy aspects, cross-sectoral understanding, and external pressures that threaten their sustainability. By prioritizing the perspective of indigenous peoples as the primary managers of the forest, this study aims to provide an overview of how synergy between local traditions and modern policies can be realized to support sustainable development.

Abstract

Abstract Individual debtors, especially MSME owners, are often trapped in bankruptcy situations that cannot be resolved due to insufficient assets to pay outstanding debts to creditors. Substantially, this debt burden persistently shackles individual debtors. Damage to their financial reputation, coupled with the possibility of future lawsuits, significantly limits their ability to regain a decent economic life after the bankruptcy process is completed. The purpose of this study is to analyze the urgency of applying the principle of “debt forgiveness” that can provide justice for debtors and creditors in the bankruptcy process, especially for individual debtors who own MSMEs. The research method used is normative juridical with a case approach and a regulatory approach using secondary data sources. The results of the study indicate that in order to achieve a balance between debtors and creditors, needs to be a mechanism for applying the principle of “debt forgiveness” that provides relief for debtors to be able to write off all or part of their remaining debt, which can be proven by good faith and the limited financial capacity of debtors who have remaining debt from the failure of their MSME. This will provide debtors with the opportunity to rebuild their economic lives without constantly being overshadowed by the demands of past outstanding debts. Keywords: The Principle of “Debt Forgiveness”, Individual Debtors, MSME Owners, Bankruptcy.

Abstract

 AbstractProtection of industrial designs for food packaging is vital to preserve originality and legal certainty. In Indonesia, substantive examination remains reactive triggered only by third-party objections during the publication period creating potential uncertainty, as seen in the red ginger drink packaging dispute between PT Aneka Boga Citra and PT Total Asri Sumber Alam. In contrast, Japan applies a full examination from the outset to assess novelty and originality. Using a normative juridical method (comparative approach and case studies), this study finds that full examination effectively strengthens protection and prevents disputes. This research recommends that Indonesia must  adopt a Hybrid Substantive Examination Model combining rigorous expert review with AI technology. Keywords : Industrial Design, substantive examination, comparative law.
