Abstract

Pada tahun 2005, Kepolisian Republik Indonesia (POLRI) dan Polis Diraja Malaysia (PDRM) membentuk kerjasama untuk memberantas Transnational Organized Crime yaitu peredaran Narkotika yang terjadi di wilayah perbatasan kedua negara. Penyalahgunaan narkotika sangat meresahkan bagi semua umat manusia khususnya bagi Indonesia dan Malaysia karena merupakan kegiatan tindak pidana. Penelitian ini dibuat untuk mengetahui bahwa dalam implementasi perjanjian kerjasama masih kurang efektif dilaksanakan karena adanya beberapa penghambat. Pendekatan ini menggunakan pendekatan normatif.

Abstract

In June 2020, sixteen Indonesian migrant workers (IMW) who worked as fishing boat crew in a Surinamese company fled to the Indonesian Embassy in Paramaribo, Suriname to acquire protection and assistance. They revealed that the company had failed to uphold their rights, committed inhuman treatment, and resulted in numerous losses. The embassy then immediately exercised a consular function to protect their safety and tried to facilitate the demands of those sailors to relevant parties and local authorities. The article aims to analyze the role of Indonesian representatives to protect the rights of Indonesian migrant workers in Suriname based on the International Labour (ILO) conventions. It is juridical empirical research that was conducted through visiting and field research to the Indonesian Embassy in Suriname in November 2020. The research suggested that Indonesian representatives in Suriname have played a significant role in advocating the IMW rights through all possible means, including mediation, negotiation, and diplomatic channels. In addition, there is a need to create a Memorandum of Understanding between Indonesia and Suriname to ensuring proper protection for migrant workers.

Abstract

The idea of the implementation of fast-track legislation in Indonesia has been widely discussed lately. It is triggered by the absence of definitive provisions regarding the period for the formation of law. This study examined concept and mechanism of fast-track legislation in some states; and compared them to Indonesia. It projected the idea of implementing fast-track legislation in Indonesia. The study used conceptual and comparative methods related to the mechanism of fast-track legislation. The analysis was performed qualitatively to produce conclusions related to the implementation of fast-track legislation in Indonesia. There are various methods of fast-track legislation around the world based on regulatory features, indicators, bill proposers, subjects, legalizations, and supervisions over the law generated from the fast-track legislation. Sometimes, law is generated quickly, and, on other occasions, it takes a long time, regardless of the material content, the urgency, and the implications. Indonesia needs clear benchmarks for law process completion. Unfortunately, the idea cannot be implemented immediately because a fast-track legislation mechanism must go together with an in-depth study, which covers several substantial changes in the Indonesian legal system in terms of law, institutions, and supporting instruments.DOI: https://doi.org/10.22304/pjih.v10n1.a6

Abstract

Russia's invasion of Ukraine has resulted in serious humanitarian tragedies in recent decades. This has led to many violations of international humanitarian law. The 1949 Geneva Conventions, which have been ratified by many countries in the world, seem to have no significance for Russia in the conduct of state life. Thus, there is widespread anxiety among the international community. The UN as an international organization that aims to create world peace does not remain silent by taking preventive steps in responding to the conflict. Based on this explanation, questions arise regarding what violations Russia has committed in terms of International Humanitarian Law, how the 1949 Geneva Convention regulates this matter and how the role of the UN as a world peace organization responds to the conflict. This paper focuses on explaining and analyzing the data found collectively in explaining what violations have been committed in relation to the 1949 Geneva Convention and showing how important the role of the UN is in acting to create peace globally. This paper explains the facts of the Russia-Ukraine conflict and what steps the UN will take regarding this matter.Invasi Rusia ke Ukraina telah mengakibatkan tragedi kemanusiaan yang serius dalam beberapa dekade terakhir. Hal tersebut, tentu saja membuat banyaknya pelanggaran terjadi terhadap hukum humaniter internasional. Konvensi Jenewa 1949 sebagai landasan hukum berperang yang telah diratifikasi banyak negara di dunia seolah-olah tidak memiliki arti penting bagi Rusia dalam kehidupan bernegara. Dengan demikian, konflik tersebut juga menimbulkan kecemasan meluas bagi masyarakat internasional. PBB sebagai organisasi internasional yang bertujuan dalam menciptakan perdamaian dunia tidak tinggal diam dengan melakukan langkah preventif dalam menanggapi konflik tersebut. Dari pernyataan tersebut, maka timbullah pertanyaan mengenai apa saja pelanggaran yang telah dilakukan Rusia ditinjau dari Hukum Humaniter Internasional, bagaimana Konvensi Jenewa 1949 mengatur hal tersebut dan bagaimana peran PBB sebagai organisasi perdamaian dunia menyikapi konflik tersebut. Tulisan ini akan difokuskan pada penjelasan dan analisis dari data yang ditemukan secara kolektif dalam memaparkan pelanggaran apa saja yang telah dilanggar terkait Konvensi Jenewa 1949 serta menunjukkan seberapa penting peran PBB dalam bertindak menciptakan perdamaian secara global. Penulisan ini dapat menjelaskan bahwa fakta-fakta yang terjadi pada konflik hingga langkah apa yang akan diambil oleh PBB

Abstract

Preparing development plans for the National Capital City (IKN) of Nusantara is one of the authorities that must be carried out by the Government to ensure the continuity and progress of the State’s development in accordance with the mandate of Law Number 3 of 2022 concerning the National Capital City. However, in reality, the formulation of development plans for the new National Capital City still experiences problems related to the Nusantara Capital City Authority (OIKN). Problems with OIKN in preparing development plans for the new National Capital City can come from various factors, such as disharmony of laws and regulations. This study aimed to find out the power of the chairman of authority related to the planning and development of the Nusantara Capital City and the concept of the chairman of authority in preparing the Nusantara Capital City development plans in harmony with the Long-Term National Development Plan. The method used in this study was the Normative Method with interviews and Legislative, Conceptual, Philosophical, and Futuristic approaches which were analyzed in a descriptive-analytic manner and processed qualitatively. The results of the study show that in planning for the development of the national capital city, the chairman of authority has the power to determine the location of the new national capital city according to geographical, social, and economic conditions and to prepare a master plan. However, IKN development plans that are not guided by the Long-Term National Development Plan (RPJPN) as national development guidelines, but are instead guided by the Government’s Master Plan (RIP) will create their own problems. The recommendation from this research is to launch a Hybrid Government system followed by the process of integrating the RIP into the 2025-2045 RPJPN so that it becomes the country’s grand master plan for the next 20 years.

Abstract

Abstrak: Adanya stigma negatif dan sulitnya akses informasi bagi penyandang disabilitas menyulitkan mereka untuk memperoleh pekerjaan ataupun membuat usaha sendiri. Untuk mengatasi masalah ini, pengabdian kepada masyarakat ini bertujuan untuk memberikan solusi agi penyandang disabilitas yang kurang mendapatkan informasi terkait pendaftaran perseroan perorangan sehingga mereka cinderung kesulitan untuk memperoleh izin atas usaha yang mereka miliki adanya pengabdian ini tentu dapat meningkatkan taraf hidup mereka terutama dalam aspek ekonomi dengan adanya izin yang jelas terkait usaha mereka sehingga mereka dapat menjalankan usahanya dengan lancar. yang dapat meningkatkan taraf hidup mereka terutama dalam aspek ekonomi . Pada kegiatan ini, menggunakan metode survei yaitu suatu penelitian yang dilakukan untuk memperoleh data-data dari fenomena yang berlangsung dan mencari keterangan-keterangan secara factual dari suatu kelompok. Kemudian dilanjutkan dengan analisis pendampingan pendaftaran perseroan perorangan bagi penyandang disabilitas. Hasil pengabdian kepada masyarakat menunjukkan bahwa adanya pendampingan dan pelatihan terkait pendaftaran perseroan perorangan memberikan pengetahuan dan juga keterampilan yang diperlukan untuk memberikan perlindungan dan kepastian hukum dalam menjalankan usaha. Kegiatan pendaftaran perseroan perorangan ini menghasilkan 3 (tiga) buah Sertifikat Nomor Induk Berusaha dan 9 (Sembilan) Sertifikat Pendaftaran Pendirian Perseroan.Abstract: The existence of negative stigma and difficult access to information for people with disabilities makes it difficult for them to get a job or create their own business. To overcome this problem, this community service aims to provide solutions for people with disabilities who lack information related to individual company registration so that they have difficulty obtaining permits for their businesses the existence of this service can certainly improve their living standards, especially in the economic aspect with a clear permit related to their business so that they can run their business smoothly. In this activity, using the survey method is a study conducted to obtain data from ongoing phenomena and seek factual information from a group. Then followed by the analysis of assistance for individual company registration for persons with disabilities as many as 13 people. The results of community service show that assistance and training related to the registration of individual companies provide the knowledge and skills needed to provide protection and legal certainty in running a business. This individual company registration activity resulted in 3 (three) certificates of business Identification Number and 9 (nine) certificates of registration of Company establishment. Abstract

After the stipulation of Presidential Decree no. 62 of 2022 concerning the Nusantara Capital Authority, the Authority can have power over business entities which is characterized by share control and ownership of shares of a business entity so that it becomes the domain of the IKN Authority in its management. However, in reality, adequate regulations to accommodate the formation and planning of the Authority-Owned Business Entity itself are not not yet in place. This research aims to find out how business entities owned by the state capital are regulated and planned in a comparative perspective and what the ideal concept of regulation and planning of authority owned business entities is in realizing sustainable development of the Nusantara Capital City. The research used normative juridical with a statutory approach, comparative approach and conceptual approach. The research results show that the concepts of the three countries are different. The concept from Australia requires the formation of a state-owned enterprise through the law of its capital region, namely the Territorial State-owned Corporation Act 1990. Meanwhile, India uses a registration mechanism by injecting funds from the government to mark it as a government-owned company according to its level in accordance with the provisions of the Company Law of India, 2013. Then China acknowledged the existence of controlling and non-controlling shares in government control as regulated in the Law of State-owned Assets Enterprise 2018 Revision. In this case, Indonesia can adopt it by establishing an authority-owned business entity using regulations from the head of the authority that are regulatory and based on sustainable development. In this way, the next generation can experience the development results of the authority's business entities.

Abstract

In th Simultaneous elections are considered to have a bad tendency by a number of people, also considered not to see a big future impact on national development planning in 2025 – 2045. The purpose of this article is to present a new perspective on seeing simultaneous elections by linking national development planning as a future impact on people's welfare. This research is qualitative by using a statue approach in comparing the laws and regulations that change in each period of simultaneous elections and the synchronization of laws and regulations with national development planning. The conseptual approach is used as the basis for the author to conceptualize the synchronization of simultaneous elections to national development planning in the 2025 - 2045 RPJPN. The results of the research from this article show three outlines: First, the impact of holding simultaneous elections results in harmony in the implementation of national development planning. Second, the synchronization of simultaneous elections to national development planning eliminates the disparities between regions that occur in Indonesia. Third, the results of synchronization as discussed will result in a phased walfare state in 2025 - 2045.

Abstract

Every Indonesian citizen has the right to get a decent job, as mandated in Article 27 of the 1945 Constitution. The right to get a job belongs to every Indonesian citizen, including citizens with disabilities. However, discrimination and difficulties often occur in accessing the supporting facilities needed by workers with disabilities. This research aims to socialize the quality of implementation of law enforcement towards fulfilling the rights of workers with disabilities regarding access and supporting facilities in the workplace, and how the optimization of the law can improve the fulfillment of the rights of workers with disabilities regarding access and supporting facilities in the workplace, especially in Indramayu Regency area. This research uses a normative method complemented by interviews with a statutory and conceptual approach and uses descriptive and qualitative analysis techniques. The results of the research show that: First, the Indramayu Regency Government has not met the 2% requirement for employing people with disabilities in the government sector by Law Number 8 of 2016 concerning People with Disabilities. Second, based on literature studies and comparisons of regional regulations in the last 3 years, there have been many regulations that specifically regulate the empowerment and protection of people with disabilities to get decent work, so it would be best for the Indramayu Regency Government to immediately prepare and ratify related Regional Regulations regarding the empowerment and protection of people with disabilities.

Abstract

The problem of stunting remains a prevalent health issue in Indonesia. Stunting not only affects typically developing individuals but can also occur among persons with disabilities. The suboptimal prevention of stunting is largely due to insufficient knowledge regarding its control and prevention within the disability community. Based on this concern, the Community Service Team of UPNVJ conducted an outreach activity with the aim of educating persons with disabilities about stunting prevention. The implementation method of this activity consisted of three stages: firstly, the pre-activity phase involved preparing the necessary resources and conducting location surveys. Secondly, the execution phase included checking for stunting among participants followed by providing educational sessions on stunting prevention. Lastly, there were discussions on stunting prevention strategies and distribution of support packages to the participants. The result of this activity is that participants gain an understanding of the methods and steps for controlling and preventing stunting among individuals with disabilities, and they are able to create balanced meal patterns or portions to prevent stunting.
