The principle of legality is a principle which determines that no act which is prohibited and punishable by criminal if not determined in advance in legislation. This principle is usually known as nullum delictum nulla poena sine praevia lege (no offense, no crime without law first. There are four principles of legality that is, the lex scripta (written law), lex chert (which includes criminal law), nonretroaktif (rule not retroactive) and analogy.

This paper is a result of a research on women in Panyingkiran Village (Karawang) and Ciherang Village (Purwakarta) of West Java-Indonesia who migrate internationally. Paradigm used in this research is Post-Positivism which integrates quantitative and qualitative methods. Primary data is collected through in depth interview and Focus Group Discussion. The result of the research shows that most of female migrants spend remittent from working in Saudi to buy land (dry land and paddy rice fields) of relatively small in size. Land is an interesting choice because: (1) female migrants come from poor families which are the lowest class in rural areas; (2) the livelihood of female migrants’ families are farm labors and landless farmers; (3) occupations of migrants before going abroad are farm labors, jobless and as house wife; (4) farm land is a social status symbol for rural communities; (5) land is a saving and land ownership is also a capital when one dies, and becomes a standard in the ritual of death ngamumule or mulasara.

The objective of this research is to get adeguate explanation and understanding to Indonesia-Malaysia relation in related to solving problem of the illegal workers. The method was using descriptive and qualitative. This study shows, that illegal workers was a serious problem which give impact to the Indonesia-Malaysia relations. In Malaysia contexs, its can be impact to the economy, social, security and etc. Nevertheless, Indonesian government must be take integrative and comprehensive program through good recruitment, regulation, advocation and administrative services.

This research about cultural manipulation in local politic, Toraja, South Sulawesi. The purpose of this study was to determine the local cultural forms are manipulated by local political elites to achieve their political objectives. The methodology used in this study is descriptive qualitative, with the determination of key informants through snowball sampling. The research results showed there has been manipulation of culture by utilizing culture (traditional parties, burial ceremonies, traditional houses, houses of worship, and cultural symbols) as a political instrument to achieve political goals and is used as one reasons in regional expansion.

This research about agrarian social change in Bangka. The method in this study uses structural Gramscian perspective and critical theory approach. The results of research has showed the role of intellectuals in the social change process. Its related to political dynamic in this area. After the new Order Era, the position of the intellectual very importance, especially in moving of mass aspiration. In this context, these change are realted to the role of the intellectual as a social entity forming the state and civil society well that the New Orde era and before the for the political leadership through organic intellectual actor. In the pos New Orde era more emphasizes the intellectual and moral leadership.

The operational objectives of this research is to increase the motivation to learn through creative dialogue. This study uses a class action (PTK) by the number of three cycles. The results showed that average scores on the motivation to learn or cycle 1 at 139.08 (77%). Average scores on the motivation of 141.46 or cycle (7.9%) and the average score of 147.26, or (82%). Thus the creative dialogue can enhance motivation to learn as much as 8%.

The concept of civil society refers to the ideal model of community life in Medina the Prophet Muhammad, which is based on a constitution that called the Charter of Medina. Madani Society is islamization of civil society. Strategies to build madani society in Indonesia can be done with the national integration and political, democratic political system reform, education and political awareness. The role of Muslims in the realization of madani society are as agents of change against the emergence and growth of the intellectuals among the middle class to create the order of social life in a democratic political-economic system is fair.

This article aims to explain how market fundamentalism and religious fundamentalism have a position opposite to the ideology of Pancasila. Today, two types of fundamentalism in the dominant ideology has become a challenge for the values of Pancasila. In the context of the nation of Indonesia, Pancasila ideology which has been the glue fundamental diversity of race, religion, race, culture, or group, has been degraded implementation intrinsic value, instrumental and praxis that seemed to be a utopian ideology against both types of fundamentalism in above. In practice the ideology of Pancasila is limited to less normative philosophy formulated well in the practice of national life.

This paper aims to explain why most political parties, particularly the Prosperous Justice Party (PKS), the coalition tend to behave pragmatically, ie, do not form a stable coalition party/firm to win mass support. The findings of the study explained that the attitude and behavior of this coalition further highlight the principle of pragmatism transactional, ie the act of looking for a great opportunity to win a pair of candidates who are influenced by the politics of money and also for the purpose of raising funds for the party's survival and existence it self.

This study aimed to describe the genocide descriptively Chinese in Batavia that occurred in October 1740. Event known as Chinatown Chinese troubelen or commotion, is the first step of ethnic segregation in Indonesia are carried out systematically by the Trade Union of the East Indies Company (VOC).
